CC - Minutes - 10-22-13Minutes of the City Council and The Successor Agency of the Rosemead Community Development Commission Joint Meeting October 22, 2013 The joint meeting of the Rosemead City Council and the Successor Agency of the Rosemead Community Development Commission was called to order by Chair /Mayor Low at 6:00 p.m. in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PRESENT: Chair /Mayor Low, Vice - Chair /Mayor Pro Tern Alarcon, Members /Council Members Armenta, Clark, and Ly Mayor Polly Low recessed to Closed Session at 6:01 p.m. 1. CLOSED SESSION A. Conference with Legal Counsel — Existing Litigation Government Code Section 54956.9 (d -1): 2 matters 1. Cal Poultry v City of Rosemead Case No USDC CV1202409 2. Tammy Gong, and L &G Rosemead Garden, LLC v. City of Rosemead and John Tran - Case No. BC487865 PRESENT: Chair /Mayor Low, Vice - Chair /Mayor Pro Tern Alarcon, Members /Council Members Armenta, Clark, and Ly PLEDGE OF ALLEGIANCE: Member /Council Member Clark INVOCATION: Member /Council Member Ly STAFF PRESENT: City Manager Allred, City Attorney Richman, Assistant City Manager Hawkesworth, Community Development Director Ramirez, Director of Parks and Recreation Montgomery-Scott, Public Works Director Marcarello, City Clerk/Director of Public Information and Communications Molleda, and Management Analyst Pat Piatt ChairlMayor Polly Low reconvened the City Council meeting at 7:00 p.m. City Attorney Rachel Richman announced that there was no reportable action taken during Closed Session Rosemead City Council and the Successor Agency of the Rosemead Community Development Commission Joint Meeting Minutes of October 22, 2013 Page 1 of 6 2. PUBLIC COMMENTS FROM THE AUDIENCE Brian Lewin — congratulated Director of Parks and Recreation David Montgomery-Scott on Sunday's successful Young Americans event, and thanked him for bringing the event to the City. He stated it was great to see kids getting involved and that it set a good precedent to get more children involved in the arts. Charles Trevino — introduced himself and stated he represented the Upper San Gabriel Valley Municipal Water District Division 2, which covers Rosemead. He inquired if it would be possible for him to address the Council on the Bay Delta Conservation Plan and the water bond for 2014. He explained that they are going to be rolling out conservation programs that will be of interest to the City, and inquired if it could be included in an upcoming agenda so he can discuss them in detail. City Manager Jeff Allred — stated the earliest opportunity for inclusion in the agenda would be either November 12, 2013 or December 10, 2013. Mr. Trevino — stated his Executive Secretary will contact the City Clerk to set the date. 3. PUBLIC HEARING A. The Consolidated Annual Performance and Evaluation Report (CAPER) for FY 2012.13 The City of Rosemead's Community Development Department has completed its Consolidated Annual Performance Report (CAPER) for the July 1, 2012 through June 30, 2013 fiscal year. The CAPER describes the overall use of federal Community Development Block Grant (CDBG) and HOME Investment Partnerships (HOME) funds received from the Department of Housing and Urban Development (HUD) in relationship to the needs of the community as outlined in its FY 2012 -13 Annual Action Plan. The City's overall objective in the CDBG and HOME programs is the development of viable communities by providing decent housing, a suitable living environment and expansion of economic opportunities primarily for low -to- moderate income persons. Recommendation: That the City Council conduct a public hearing and take public testimony on the City's FY 2012 -13 Consolidated Annual Performance and Evaluation Report. No further City Council action is necessary. Management Analyst Pat Piatt reviewed the staff report. No further action was required by the City Council. Council Member Margaret Clark requested that Item B be pulled for separate vote. 4. CONSENT CALENDAR A. Claims and Demands • Resolution No. 2013 — 55 Rosemead City Council and Planning Commission Special Joint Meeting Minutes of October 22, 2013 Page 2 of 6 Recommendation: to approve Resolution No. 2013 — 55 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $1,005,738.79 NUMBERED 82702 THROUGH 82834 INCLUSIVELY • Resolution No.2013 -02 Recommendation: to approve Resolution No. 2013 — 02 entitled: A RESOLUTION OF THE SUCCESSOR AGENCY TO THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $93,236.00 NUMBERED 10058 THROUGH 10064 INCLUSIVELY Member /Council Member Margaret Clark made a motion, seconded by Member /Council Member Sandra Armenta to approve Consent Item A. Vote resulted in: Yes: Alarcon, Armenta, Clark, Low, Ly No: None Abstain: None Absent: None B Ordinance 931, 932, and 933 — Second Reading: Municipal Code Amendment 10 -07, Zone Change 13 -01, and Amendment to the City's Single - Family Residential Design Guidelines On October 8, 2013, the City Council introduced Ordinance Nos. 931, 932, and 933, code amendment 10 -07, zone change 13 -01, and amendment to the City's Single - Family residential design guidelines. Ordinance Nos. 931, 932, and 933 are now before Council at the required second reading for adoption. Recommendation: That the City Council: Adopt at its Second Reading, by title only, Ordinance No. 931, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, APPROVING MUNICIPAL CODE AMENDMENT 10.07 AMENDING THE CITY'S ZONING CODE (TITLE 17 OF THE ROSEMEAD MUNICIPAL CODE) AND CHAPTER 5.41 — HOME OCCUPATIONS (TITLE 5 OF THE ROSEMEAD MUNICIPAL CODE) TO IMPLEMENT GENERAL PLAN POLICY AND TO ADD PROVISIONS MANDATED BY Rosemead City Council and Planning Commission Special Joint Meeting Minutes of October 22, 2013 Page 3 of 6 STATE AND FEDERAL LAW AS PART OF THE COMPREHENSIVE ZONING CODE UPDATE 2. Adopt at its Second Reading, by title only, Ordinance No. 933, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, APPROVING AN AMENDMENT TO THE CITY'S EXISTING SINGLE - FAMILY DESIGN GUIDELINES AS PART OF THE COMPREHENSIVE ZONING CODE UPDATE Member/Council Member Steven Ly made a motion, seconded by Member/Council Member Sandra Armenta to approve Ordinance Nos. 931, 932, and 933. Vote resulted in: Yes: Alarcon, Armenta, Low, Ly No: Clark Abstain: None Absent: None Member /Council Member Clark — explained that she voted no because she believes mixed use projects should come to Council automatically. 5. MATTERS FROM CITY MANAGER & STAFF— None 6. MATTERS FROM MAYOR & CITY COUNCIL A. San Gabriel Valley Mosquito & Vector Control District Term Appointment The City recently received a letter stating that the term of office for the representative from the City of Rosemead to the Board of Trustees for the San Gabriel Valley Mosquito and Vector Control District ends on December 31, 2013. The Board of Trustees is respectively requesting that the City Council appoint a representative to the Board prior to its January 10, 2013 meeting. Per the California Health and Safety Code Section 2024 (a) the term of office for a member of the board of trustees shall be for a term of two or four years, at the discretion of the appointing authority. Rosemead City Council and Planning Commission Special Joint Meeting Minutes of October 22, 2013 Page 4 of 6 Recommendation: That the City Council appoint a representative from the City of Rosemead to the Board of Trustees for the San Gabriel Valley Mosquito and Vector Control District AND appoint him/her for a two year or four year term. Mayor Pro Tern William Alarcon — expressed interest in serving on the Board. Council Member Sandra Armenta — inquired as to what time they met. Mayor Pro Tem Alarcon — stated they meet the 2nd Friday of each month at 7 a.m., and that meetings were usually over by 7:30 a.m. or 8:00 a.m. Council MemberArmenta — asked where the meetings were held. Mayor Pro Tern Alarcon — stated they are held in West Covina, across from the Tribune offices. Council Member Armenta — considered the appointment; however, withdrew her consideration due to Mayor Pro Tern Alarcon's interest. Council Member Margaret Clark made a motion, seconded by Council Member Steven Ly to appoint Mayor Pro Tern William Alarcon to the San Gabriel Valley Mosquito and Vector Control District for two year term. Vote resulted in: Yes: Alarcon, Armenta, Clark, Low, Ly No: None Abstain: None Absent: None 7. COMMENTS FROM CITY COUNCIL Council Member Armenta —expressed her disappointment over not being able to attend Sunday's Young Americans event. She stated hearing positive comments from the community in regards to the event, and commended Director of Parks and Recreation Montgomery-Scott for a great job. She also commended Staff and stated that it set a great precedent since it had a great turn out. Council Member Clark— echoed the sentiments of Council Member Armenta. She explained that she attended, and they did a great job keeping the audience involved. She then stressed the importance of music in the lives of children. Mayor Polly Low— stated she also was very pleased, and thanked Director of Parks and Recreation Montgomery -Scott for putting Rosemead on the map. She explained that a lot more people know where Rosemead is as a result of the event, and residents are proud of their City.
