The joint meeting of the Rosemead City Council, Housing Development Corporation and the Successor
Agency to the Rosemead Community Development Commission was called to order by Mayor Low at 7:12
p.m. in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California.

1. PUBLIC COMMENTS FROM THE AUDIENCE
Juan Nunez — stated that the property owners should do something on the maintenance of the auto auction
property.
2. PUBLIC HEARING
A. Municipal Code Amendment 13.01 —An Ordinance Reinforcing the City's Current Ban
on Medical Marijuana Dispensaries in All Zoning Districts
The City's Zoning Code (Title 17) is a "permissive" use ordinance. In a "permissive" use
ordinance only the land uses specifically listed in the zoning code are allowed within the
specific zoning district. Land uses that are not listed are not allowed. Although the City's
Zoning Code was drafted sufficiently to permanently ban medical marijuana dispensaries
citywide, choosing to incorporate the proposed ordinance will reinforce the current prohibition
on medical marijuana dispensaries consistent with California Supreme Court approved law.
On January 6, 2014, the Planning Commission held a duly noticed and advertised public
hearing relative to Municipal Code Amendment 13 -01. Upon hearing written and oral
testimony, the Planning Commission adopted Resolution No. 13 -20, recommending that the

City Council ADOPT Ordinance No. 935 approving the municipal code amendment without
any deletions, additions, or modifications.
Recommendation: That the City Council:
1. Conduct the noticed public hearing and receive public comment.
2. Introduce for First Reading, by title only, Ordinance No. 935, entitled:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD, CALIFORNIA, AMENDING TITLE 17 "ZONING"
OF THE CITY'S MUNICIPAL CODE BY ADDING CHAPTER
17.40 FOR THE PURPOSE OF REINFORCING AND
CONFIRMING THE CITY'S CURRENT BAN ON MEDICAL
MARIJUANA DISPENSARIES IN ALL ZONING DISTRICTS
Director of Community Development Ramirez reviewed the staff report.
Mr. Nunez — expressed support for the continued ban on medical marijuana dispensaries and stated he
hoped future Council Member will not change the ordinance.
City Attorney Richman clarified that the current City Council cannot bind future Council Members. If a future
Council sought to amend the code to allow medical marijuana dispensaries use, residents could expressed
their concerns at that time.
Mayor /PresidentlChair Low opened the public hearing at 7:18 p.m. there being no further comments the
public hearing closed at 7:19 p.m.
City Attorney Richman read ordinance by title only.
Council Member /Board Member Sandra Armenta made a motion, seconded by Council Member /Board
Member Margaret Clark to introduce Ordinance No. 935. Vote resulted in:

B. Housing Element 2013 Annual Progress Report
This report summarizes the low to moderate - income residential building activity, Regional
Housing Needs Allocation (RHNA) progress, and progress of housing program
implementation for the 2013 calendar year. The annual report was prepared on forms
provided by HCD, using definitions adopted by HCD.
Recommendation: That the City Council receive and file the City's 2013 Housing Element
Annual Progress Report.
C. Vehicle Replacement — Award of Purchase Agreement
As part of the City's vehicle replacement budget, funding was included this year for the
purchase of two plug -in electric hybrid vehicles for use in general business activities. The
purchase of these vehicles will replace two (2) outdated sedans that are each over twelve
(12) years old. Such replacement will help reduce vehicle maintenance costs and improve
fuel efficiency in the City's fleet. Using an existing contract through the National Joint
Powers Alliance program, the City was able to secure competitive pricing for these vehicles.
Funding for this purchase is included in the Fiscal Year 2013 -2014 budgeting utilizing Air

Quality Management District (AQMD) funds.
Recommendation: That the City Council:
Authorize the City Manager to execute a purchase agreement with the National Auto
Fleet Group for the purchase of two (2) 2014 Ford Fusion Energi SE Hybrid vehicles in
an amount of $74,512.56 using a competitively bid contract through National Joint
Powers Alliance; and
- 2. Designate Unit #2 (2001 Ford Crown Victoria) and Unit #20 (2001 Ford Taurus) as
surplus property and authorize the City Manager to dispose of both vehicles pursuant to
the City's Purchasing Ordinance /Policy.

PresidentlVice -Chair William Alarcon to approve the Consent Calendar. Vote resulted in:

4. MATTERS FROM CITY MANAGER & STAFF— None
5. MATTERS FROM MAYOR & CITY COUNCIL
Mayor Pro Tom Alarcon stated his neighbors expressed concerns with the quality of the curb number
painted in front of their homes. He commended Public Works Director and his staff for responding and
correcting the issues in a timely manner.
Council MemberArmenta stated there are many streets on the southern part of Rosemead where
addresses were not visible.
Mayor Low reported on the conference she attended in Washington, D.C. "U.S. Conference of Mayors". She
stated the speakers included Secretary of Labor, Secretary of Congress, Secretary of Transportation and
many others. Mrs. Low added President Barack Obama and Vice - President Joe Biden spoke on Economic
development and they emphasized the need for cities to grow economically. Mrs. Low asked Director of
Parks and Recreation to address the upcoming Lunar New Year event.
Director of Parks and Recreation Montgomery-Scott stated that there are 4 sponsoring agencies, 30 booths,
13 food vendors, 10 crafts booths 6 attractions. There are 63 different vendors participating in the event and
a stage for entertainment from 11:00 a.m. to 5:00 p.m. on February 15th.

6. CLOSED SESSION
A. Anticipated Litigation — Government Code 54956.9 (d)(4)
City Attorney Richman stated that council would go into closed session and she would announce any
reportable actions after they reconvene back to the meeting.
Mayor Low recessed the meeting to closed session at 7:29 p.m, and reconvened at 7:48 p.m.
City Attorney Richman announced there were no reportable actions taken by Council during closed session.
7. ADJOURNMENT
The next regular City Council meeting is scheduled to take place on February 11, 2014 at
7:00 p.m. in the Rosemead City Hall Council Chamber.
