CALL TO ORDER The Pledge of Allegiance was led by Mayor Pro Tem Hunter. The Invocation was delivered by Reverend Kenneth Harry of the First Baptist Church. 2. ROLL CALL: Present: Councilmen: Andersen, Hunter, Maude, Pike, Taylor Absent: Councilmen: None Ex officio: Andersen, Anderson, Chambers, Foutz, Gunn, Miller 3. APPROVAL OF MINUTES: MARCH 28 AND APRIL 11, 1972 - REGULAR MEETINGS. It was moved by Councilman Hunter, second by Councilman Taylor, and unanimously carried, that the minutes of March 28 and April 11, 1972, be approved as printed. 4. REPORT OF CANVASS OF ELECTION. City Clerk Andersen advised that on Wednesday, April 12th, the returns of the election were canvassed as authorized and found to be correct as originally reported. 5. RESOLUTION NO. 72-27.DECLARING RESULTS OF ELECTION. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY OF ROSEMEAD ON THE 11TH DAY OF APRIL, 1972, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. Attorney Anderson presented this resolution by title only. It was moved by Councilman Hunter, second by Mayor Maude, and unanimously carried, that further reading be waived and Resolution No. 72-27 be adopted. Page Ten C/C 4/18/72 Mayor Maude recessed the meeting to a personnel session at 8:06 p.m. The meeting reconvened at 8:15 p.m. 8. ELECTION OF MAYOR. Mayor Maude relinquished the gavel to City Manager Gunn. Mr. Gunn declared nominations open for office of Mayor. Dr. Maude nominated Herbert Hunter. It was moved by Councilman Andersen, second by Mayor Maude, and unanimously carried, that nominations be closed and the Clerk instructed to cast a unanimous ballot for Herbert Hunter. 9. ELECTION OF MAYOR PRO TEM. Mr. Gunn declared nominations open for the office of Mayor Pro Tem. Councilman Maude nominated Kenneth Pike. It was moved by Councilman Taylor, second by Councilman Maude, and unanimously carried, that nominations be closed and the Clerk instructed to cast a unanimous ballot for Kenneth Pike. PUBLIC HEARINGS 10. AMENDMENT TO ZONING ORDINANCE - REMOVAL OF C-M ZONING CLASSIFICA- TION. City Manager Gunn presented the factual data report, stating on February 8, 1972, the Council approved recommendations of the Planning Commission for Zone Changes Nos. 54 and 55, changing the zones of certain properties from C-M to M-1. With the approval of these zone changes, the last C-M Zones in the City were removed from the Zoning Map and the zoning classifica- tion no longer applies to any parcels of land in the community. In light of the above facts the Commission is recommending the Council repeal Part X.III of the Municipal Code. Mayor Hunter requested anyone wishing to be heard to please stand and be sworn in. No one responded. The hearing was declared open at 8:17 p.m. No one responded and it closed immediately. ORDINANCE NO. 335• AMENDING MUNICIPAL CODE TO ELIMINATE THE C-M ZONE. AN ORDINANCE OF THE CITY OF ROSEMEAD AMENDING THE ROSEMEAD MUNICIPAL CODE TO ELIMINATE THE C-M ZONE. Attorney Anderson presented this ordinance by title only. It was moved by Councilman Maude, second by Councilman Andersen; and unanimously carried, that further reading be waived and Ordinance No. 335 be introduced. ADOPTION OF GENERAL PLAN. it Mr. Dale Beland of Wilsey & Ham, Planning Consultants, explained the purpose and nature of the proposed General Plan. Mr. Boland and Mr. Larry Morrison presented a summary of the General Plan, outlining the elements as follows: 1. Lane Use 2. Population 3. Industry 4. Commerce 5. Housing 6. Public Facilities 7• Circulation 8. Environmental Factors 9. Annexation Study 10. Implementation Mayor Hunter requested anyone wishing to be heard to please stand and be sworn in. The oath was administered by City Clerk Andersen. The hearing was declared open at 9:12 p.m. Mr. Burk Kellogg of First City Bank and also Chairman of the Citizens Advisory Committee, and Mr. Raoul Zwick of Toytown, addressed the Council in favor of the proposed General Plan and urged its adoption. Mr. Murray Cohen, 4143 Walnut Grove Avenue, discussed the proposed Planned Development Districts recommended by Wilsey & Ham, partic- ularly the area on Walnut Grove between Valley Boulevard and Mission Drive. Mr. Robert Ritchie, 9355 Glendon Way, dis- cussed the proposed additional on and off- ramp on the north side of the San Bernardino Freeway between Temple City Boulevard and Rosemead Boulevard. Mr. Carl Kriminger, 9112 Bentel Street, stated he is opposed to the General Plan as it relates to the Central Business District. Mr. Kriminger presented a petition signed by 33 property owners requesting Bentel Street be excluded from the Central Business District. Mr. Gunn explained that on March 6th the Council adopted an urgency ordinance which states that all properties facing on Bentel Street between Ivar and Mission which are presently zoned exclusively for residential purposes be excluded from the CBD Zone. Mr. Bart Newell, Rosemead Resident, and Mr. Mark Prim, 3404 Burton Avenue, addressed the Council and discussed various aspects of the General Plan. Mr. Carlos Estrada, representing Rosemead Little League, addressed the Council and requested the Mayor autograph the baseball to be used opening day, April 22nd at Garvey Park. 12 13 DISCUSSION OF GENERAL PLAN CONTINUED: Councilman Maude made reference to the Circulation Plan, and the recommendation that Hart Street be extended for a local pedestrian and mini-bus connection between Rosemead Square and the Valley Boulevard CBD, and following discussion, it was moved by Councilman Maude, second by Councilman Taylor, and carried. that Hart Street extension be deleted from the General Plan. Councilmen Andersen and Pike voted noe. Following further discussion, it was moved by Councilman Maude, second by Councilman Andersen, and carried, that Bentel Street proposed to be included in the Central Business District be deleted from the General Plan. Councilman Pike voted noe. Mayor Hunter recessed the meeting at 10:52 p.m.; and it reconvened at 10:54 p.m. UNFINISHED BUSINESS ORDINANCE NO. 334. GRANTING CATV FRANCHISE TO TELE-COMMUNICATIONS, INC. SECOND READING. AN ORDINANCE OF THE CITY OF ROSEMEAD GRANTING A COMMUNITY ANTENNA TELEVISION FRANCHISE TO TELE-COMMUNICATIONS, INC. Attorney Anderson presented this ordinance by title only. It was moved by Councilman Andersen, second by Councilman Taylor, and unanimously carried, that further reading be waived and Ordinance No. 334 be adopted. AMENDING DEFINITION OF PART-TIME EMPLOYEE FOR SOCIAL SECURITY PURPOSES. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AMENDING ITS DEFINITION OF PART-TIME POSITION FOR SOCIAL SECURITY PURPOSES. Attorney Anderson presented this resolution by title only. It was moved by Councilman Andersen, second by Councilman Taylor, and unanimously carried, that further reading be waived and Resolution No. 72-29 be adopted. 15• ACCEPTANCE OF ROAD EASEMENT. MISSION DRIVE AND WALNUT GROVE AVENUE. Mr. Gunn explained that this easement is over the Eagle Bell transmission line right-of-way. It was moved by Councilman Pike, second by Councilman Maude, and unanimously carried, that we accept the foregoing easement and authorize the Mayor to execute. 16. CHANGE OF DATE IN ANNIVERSARY CELEBRATION. Mr. Gunn stated several years ago the Chamber and the City combined the Heritage Parade, Carnival and City Picnic into one large celebration, which was held in late October. Last year the City Anniversary Committee met on several occasions to prepare the program and activities for the picnic. They suggested moving the date from October to the first Saturday in August for 1972• There are several advantages to this date, such as warmer weather, schools not in session, etc. The recommended date change was approved by the Park Board at their last meeting. It was moved by Councilman Taylor, second by Councilman Andersen, and unanimously carried, that the foregoing recommendation be approved. 17• APPOINTMENTS TO PLANNING AND TRAFFIC COMMISSIONS. Mayor Hunter stated he wished to reappoint Don Detora to the Planning Commission and Samuel Morales to the Traffic Commission, said terms to expire in May, 1974. It was moved by Councilman Taylor, second by Councilman Andersen, and unanimously carried, that the foregoing appointments be ratified. COMMUNICATIONS 18. A. BOARD OF SUPERVISORS. Mr. Gunn presented a cony of a resolution adopted by the Board of Supervisors, urging t e President, members of Congress representing Los Angeles County, and the Environmental Pro- tection Agency, be called upon to take all appropriate action to assure that the supply of natural gas to Los Angeles County is not reduced. Following discussion, it was moved by Councilman Pike, second by Councilman Taylor, and unanimously carried, that we adopt a similar resolution and forward to appropriate agencies. Page Fourteen C/C 4/18/72 B. GOVERNOR REAGAN. Mr, Gunn presented a copy of a resolution adopted by the State Allocation Board recommending support of Proposition #2 on the Primary Ballot June 6 relative to general obligations bonds for building schools. The foregoing communication was received and filed, 19, ORAL COMMUNICATIONS FROM THE AUDIENCE, A. Mr. Goldstein, 9040 E. Bentel Street, addressed the Council regarding a tree on his property. Mr. Gunn stated he would check into the matter,. 20, MATTERS FROM CITY OFFICIALS, A. Mr. Hugh Foutz, Chairman of the Sister City Committee, stated he has been notified by members of the Committee in Zapopan that they would rather plan their visit to us in August instead of October. It was moved by Councilman Taylor, second by Councilman Maude, and unanimously carried, that a letter of invitation be sent to Zapopan inviting their delegation, commencing' approximately the first week in August. B. Mr. Gunn stated that the Council by prior action ordered sidewalks installed on Fern Street, south side, between La Presa and Paljay. The owners on this street are anxious to have the work begin and have submitted a petition re- questing the City install the sidewalks prior to the 60-day waiting period, and further, that the 10-day notice to construct period be waived. It was moved by Councilman Andersen, second by Councilman Maude, and unanimously carried, that the foregoing request be approved. C. Mr. Gunn presented a letter from County Supervisor Schabarum`' advising that the County is again willing to exchange the 1971-72 and 1972-73 TOPICS funds apportioned to contract cities for equivalent amounts in HTC assistance on mutually agreeable City-County cooperative projects. This is the same arrangement made for the 1969-70 and 1970-71 apportion- ments. . If the Council wishes to exchange the TOPICS funds, it will be necessary to claim the 1971-72 and 1972-73 apportionments and at the same time assign these funds to the County for its use in financing eligible TOPICS projects. It was moved by Councilman Maude, second by Councilman Andersen, and unanimously carried, that this Council claim the City of Rosemead's Federal TOPICS funds apportioned by the Federal-aid Highway Acts and by the Streets and Highways Code for the fiscal years 1971-72 and 1972-73 and declare the City's intent to obligate its' 1971-72 appor- tionment by assigning these funds to the County of Los Angeles, and requesting that the County Board of Supervisors accept this assignment and to obligate its' 1972-73 apportionment by exchanging these funds for an equivalent amount of State funds. Further that the City Manager is instructed to submit certified copies of this action to the State Department of Public Works and the Los Angeles County Road Commissioner. D. Mr. Gunn presented notification of the U.S. Conference of Mayors convention to be held in June in New Orleans. It was moved by Councilman Taylor, second by Councilman Andersen, and unanimously carried, that the Mayor and Council be authorized to attend the foregoing conference. Page Fifteen C/C 4/18/72 E. Councilman Pike requested that staff investigate as to whether the City could regulate the number of peddlers that come into the City only on holidays to sell such items as flowers and stuffed toys. There were no objections. F. It was moved by Councilman Maude, second by Councilman Andersen, and unanimously carried, that Mayor Hunter be appointed as the City's representative to the County Sanitation District and Mayor Pro Tem Pike as the Alternate, and that a resolution be adopted approving the same. G. Councilman Maude suggested labels for the pictures of the Chambers. He also req, former City Clerk and City H. Mayor Hunter and Mayor Pro to the Council in electing that staff prepare appropriate former Councilmen displayed in tested that pictures of the Treasurer be added.
