CC - Item 3C - Installation of Connector Pipe Screens in the City and County Catch Basins Project - Award of ContractROSEMEAD CITY COUNCIL STAFF REPORT TO: THE HONORABLE MAYOR AND CITY COUNCIL FROM JEFF ALLRED, CITY MANAGER DATE: APRIL 22, 2014 SUBJECT: INSTALLATION OF CONNECTOR PIPE SCREENS IN THE CITY AND COUNTY CATCH BASINS PROJECT — AWARD OF CONTRACT SUMMARY The City of Rosemead, under the National Pollutant Discharge Elimination System ( NPDES), is required to take certain steps to prevent and treat the pollution of stormwater within its jurisdiction. As part of NPDES guidelines, the City is subject to the Los Angeles River Trash Total Maximum Daily Load (TMDL), meaning the City must take certain measures to prevent trash from entering the LA River through its stormwater discharge outfalls. In order to achieve compliance with this Trash TMDL, the city is required to place connector pipe screens (CPS) in all stormwater catch basins within its jurisdiction. CPS units catch all trash that enters stormwater catch basins and prevent it from entering the waterways. As a part of the City's Fiscal Year 2013 -14 Capital Improvement Program, the City Council approved the " Stormwater Capture Device Project." This project will allow for the retrofit of 200 of the catch basins within the City. On March 25, 2014, the City Council rejected bids received for this project and authorized the project's second advertisement in order to receive more competitive pricing. A subsequent public bid process was completed and two competitive bids were received with the lowest responsive bidder being United Storm Water, Inc. Staff Recommendation It is recommended that the City Council: 1. Approve the plans and specifications for the Installation of Connector Pipe Screens in the City and County Catch Basins Project; and, 2. Authorize the City Manager to enter into a contract with United Storm Water, Inc. in the amount of $87,200.00 and authorize a contingency in the amount of $21,800.00 (25 %) to cover any unforeseen construction expenses. To date, the City has completed the retrofit of approximately 50 of the 661 stormwater catch basins within the City's drainage system. The City will complete the retrofit of approximately 200 catch basins per year to meet the compliance deadline of all basins retrofitted by October 31, 2016. Failure to meet this deadline would put the City in violation of the Trash TMDL and NPDES Permit and could expose the City to lawsuits and fines. On March 25, 2014, the City Council rejected bids received for this project and authorized the project's second advertisement in order to receive more competitive pricing. A Notice Inviting Bids for this project was published in local newspapers and trade publications on April 3rtl and 10th, 2014. Sealed bids were received in the Office of the City Clerk until 10:30 a.m. on Wednesday, April 16, 2014 At 11:00 a.m. on April 16, 2014, the City Clerk publicly opened and read two (2) sealed bids with the following result: Rank Bidder Location Bid Amount 1 United Storm Water, Inc. Industry, CA $ 87,200.00 2 W.A. Rasic Construction Co., Inc. Long Beach, CA $ 118,400.00 Staff has reviewed the bid documents for completeness and investigated the contractor's background and recent projects for competency. Staff believes United Strom Water, Inc. is the lowest responsive bidder and is qualified to complete the work as specified for this project. United Storm Water, Inc. has been in this line of work for approximately 15 years and has recently completed similar projects for the cities of Agoura Hills, Inglewood, and La Canada Flintridge. This project includes the retrofit of basins owned both by the City of Rosemead and the County of Los Angeles. Per the standards set forth in the NPDES, liability for pollutants is attached to the jurisdiction where the pollutant is generated rather than the owner of the conveyance. Of the 661 catch basins located within the City of Rosemead, approximately 600 (91 %) are owned by the County of Los Angeles. Additionally, due to a highly competitive unit price that was received for this project, it is recommended that a higher contingency (25 %) be authorized for this project. As Council Meeting 22,2014 planned, these additional funds will allow the City to retrofit additional catch basins at a highly competitive price. In completing the retrofit of basins owned by the County of Los Angeles, the City and its contractor are subject to plan check and inspection provisions as well as all applicable fees as set forth by the county. Initial estimates from the County indicate that the plan check and inspection fees will range from $300 - $600 per basin dependent upon the quality of the City's submittals and the competency of the contractor. The selected contractor and device have both been previously approved by and utilized in basins owned by the County; therefore, staff is anticipating a simplified plan check and inspection process. FINANCIAL REVIEW This project was included in the Fiscal Year 2013 -14 Capital Improvement Program with a budget of $100,000.00. Additionally, the Engineering Division has an operations account for NPDES related activities with a budget of $165,000.00 for Fiscal Year 2013- 14. A portion of these budgeted funds will be used to pay for required County plan check and inspection services associated with this project. The unit price for each device ($436.00) is below the engineer's estimate of $500.00 for this project. ENVIRONMENTAL REVIEW This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (C) of the CEQA Implementing Guidelines.
