If awarded a Contract, the undersigned agrees to execute the formal Contract, which will be
prepared by the City for execution, within five (5) Calendar Days following the Letter of Award
for the Contract, and will deliver to the City within that same period the necessary original
Certificates of Insurance, Endorsements of Insurance, Performance Bond, Payment Bond and
all other documentation and certification required by the Contract.
The undersigned offers and agrees that if this bid is accepted, it will assign to the purchasing
body all rights, title, and interest in and to all causes of action it may have under Section 4 of the
Clayton Act (15 U.S.C. Section 15) or under the Cartwright Act (Chapter 2 of Part 2 of Division 7
of the Business and Professional Code), arising from purchases of goods, materials or services
by the Bidder for sale to the purchasing body pursuant to the bid. Such assignment shall be
made and become effective at the time the purchasing body tenders final payment to he
Contractor.
Bidder understands and agrees that, when requested by City, he shall provide: (1) evidence
satisfactory to the City of Bidder's California contractor's license(s) in good standing; (2)
evidence that the person signing this Bid is authorized to bind Bidder to this Bid and to a
contract resulting there from; and (3) any other information and documentation, financial or
otherwise, needed by City to award a Contract to the lowest responsible and responsive bidder.
Bidder acknowledges that data submitted with its Contract Bid Forms which it requires to be
incorporated into a Contract arising out of this Submittal has been so identified by Bidder.
Bidder further acknowledges that the City may, at its discretion, incorporate any of the
remaining data submitted herewith into a contract arising out of this Bid.

2.13 LIST OF PROPOSED SUBCONTRACTORS
In compliance with the "Subletting and Subcontracting Fair Practices Act," Sections 4100
through 4114 of the California Public Contract Code, and any amendments thereto, each
Bidder shall provide the information requested below for each subcontractor who will
perform work, labor or render service to Bidder in or about the construction of the Work
in an amount in excess of one -half of one percent (greater than 0.5 %) of the Bidder's
Total Bid Price, or, in the case of bids or offers for the construction of streets or
highways, including bridges, in excess of one -half of 1 percent of the Contractor's total
bid or ten thousand dollars ($10,000), whichever is greater, and shall further set forth the
portion of the Work which will be done by each subcontractor. Bidder shall list only one

If the Bidder fails to specify a subcontractor for any portion of the Work to be performed
under the Contract, it shall be deemed to have agreed to perform such portion itself, and
shall not be permitted to subcontract that portion of the Work except under the

Notice of Clarification
1. is this project a Re -bid? If yes, what caused this project to be re -bid?
No, this is the first bid of this project,
2. Is water and electrical available for use during construction?
Yes.
3. In regard to liquidated damages;
A. General Provisions, Page 24, 6.9 states Liquidated Damages to be
$1,500 per calendar day.
B. Contract Bid Forms — CBF -7, states Liquidated Damages to be
$500 per calendar day.
Which Liquidated Damages amount is correct for this project?
Liquidated Damages will be $500 per calendar day, per Contract Bid
Forms and Notice Inviting Bids.
4. In regard to Subcontractor Performance and Payment Bond
Requirements, General Provisions Page 5, indicates for
Subcontracts whose values exceed the amounts specified in the
Notice Inviting Bids, Performance Bonds are required for Subs
pursuant to Public Contract Code Section 4108. There is no amount
specified in the NIB.
Are Sub Bonds Required? If yes, what is the value basis?
Subcontractor bonds are required in amount equal to that of the total
amount of the subcontract.
5. Instruction to Bidders, Page ITB -10, indicates all bidders are to
complete Section 4 in regard to Responsibility. The bid forms
provided end at Section 3. If bid form Section 4 is to be completed,

please provide same or indicate that this data is not required as part of the
bid.
This information will not be required as a part of the bid. Please complete all sections of
the bid forms as presented in the contract documents.
6. The project completion schedule indicates a 120 calendar day schedule.
The duration requirement indicated is approximately half of the time
required for completing a project of this type and size. Will the City be
revisiting the schedule requirement and revising to a realistic duration?
The Engineers Estimate of 120 Calendar Days will stand.
The Contract Agreement, Insurance Requirements, Page D -2, states that
Professional Liability or Errors and Omissions insurance be provided. This
requirement is more often for engineer type consultants. Are the General
Contractors required to provide this type of insurance?
The insurance requirement document reads "errors and omissions insurance, as
appropriate ". This insurance is not appropriate for a General Contractor on a
construction project. All other specified terms regarding liability insurance are
appropriate.
8. Sheet G -0007, Key Note 10.06 & 10.06 Indicate lockable bulletin boards. We are
unable to locate any of these bulletin boards on the plans. How many of each type
of bulletin boards are required for the project?
There are no bulletin boards required for this project. Delete Keynotes 10.05 & 10.06.
9. Sheet A101, Site Plan, Key Note 2.02 indicates (E) asphalt driveway and parking
area near building as "repair cracks, overlay with 1" AC and slurry seal.
• Sheet C1.02, Demolition Plan, indicated this same area to have all existing
asphalt demolished.
• Sheet C1.03, Grading Plan, Key Note 10, indicated this same area to be
removed and replaced with PCC (Concrete) Paving?
• PLEASE CLARIFY
Civil plans (C1.02 & C1.03) show the correct scope of work in this area. The area in
question is to have all existing asphalt removed and replaced with PCC paving.
Disregard Keynote 2.02 on Sheet A101 She Plan for this area.
10. Spec book called-out for aluminum framing system which is to be manufactured
by Kawneer, or equal products by EFCO, Vista Wall, or YKK but specification on
plan called-out for Arcadia. Which of these is to be used?
The Plans call out the correct standard for the storefront system by Arcadia. Equal
products by EFCO, Kawnesr, Vista Wall or YKK are also acceptable.
11. Division 12 section 12.05 on plan, it is calling -out for aluminum Front Loading
"Snap" Frame for Banner/ Poster. There is nothing shown on plan. Is this to be
included in the bid?

12.Pleass clarify contractor to provide blank bricks for installation of
monument
City will fumish all necessary blank bricks.
13. What would be the container size for PLA and ACE as shown on the plans but not
on the keynotes.
Container size for PLA and ACE is 48"
14. Keynote shows PL and ZEL for trees, but none of it shown on the plans.
PL on the schedule should be PLA. ACE is Acer palmatum 'Bloodgood' (48" Box) and
there are no Zelkovas on the plan.
15.Bid schedule has many items to fill out for bidding purposes would you
allow to fill out the division cost total on bid form with itemized cost 24
hours later? -
No. All bid documents must be complete when submitted in order for the bid to be
considered responsive.
16.Are permits required by the contractor? If yes, is there an estimated permit
cost?
The City will require the contractor to obtain a permit from the building department with
no fee. The contractor who is awarded the project must obtain a City business license
with a cost of $101.00.
17. What is the estimated cost for the three (3) bid alternates?
Per the Notice Inviting Bids, the estimated cost for the three alternates combined is
$80,000.00.
18. is the RCRC facility occupied during construction?
Yes.
19. Is weekend work permitted?
Saturday work is acceptable. Sunday work will be considered on an as needed basis.
20. What are the construction work hours?
7:00 a.m. to 5:00 p.m.
21. Is there any hazardous material abatement work?
No. All hazardous material abatement has been completed for the existing structure.

An environmental report was prepared for the existing facility.
23. Section 02251 — Is soil treatment for subterranean termite control required?
Yes.
24. Section 16721 — Fire Alarm Dfb system is standalone or is it required to
communicate with other devices on campus?
The Fire Alarm and D/B System is a stand -alone system.
25.C1.03 & A101 differ a bit Please confirm staff parking, driveway, east
parking is a part of scope?
Staff parking, driveway, east parking are part of the scope as indicated in C1.03. The
notes in those areas on A101 (e.g. '(E) Staff Parking ", (E) East Parking to remain, etc)
are plan check notes that indicate that the quantity of parking spaces and use of the
areas will not change. However, these areas will be redone according to the civil plans.
