CC - Item 3A - Minutes of June 10, 2014 Joint Meeting AgendaMinutes of the City Council and the successor Agency of the Rosemead Community Development Commission JOINT MEETING AGENDA June 10, 2014 The regular meeting of the Rosemead City Council was called to order by Mayor Alarcon at 7:00 p.m. in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PLEDGE OF ALLEGIANCE: Mayor Pro Tern Clark INVOCATION: Council Member Armenta PRESENT: Mayor Pro Tem Clark, Council Members Armenta, Hall ABSENT: Mayor Alarcon and Council Member Low STAFF PRESENT: City Manager Allred, City Attorney Richman, Assistant City Manager /Finance Director Hawkesworth, Community Development Director Ramirez, Director of Parks and Recreation Montgomery- Scott, Public Works Director Marcarello, and City Clerk/Director of Public Information and Communications Molleda. 1. PUBLIC COMMENTS FROM THE AUDIENCE Brian Lewin - Welcomed back Council Member Steven Ly from his military leave. Mr. Lewin stated that the City's Vietnam Memorial salutes six men from Rosemead that were killed in the Vietnam War. He stated that Corporal Arellano a Rosemead resident and Mark Keppel graduate was killed in Afghanistan just two month prior to his scheduled return home. Mr. Lewin believes that the City should honor him along with the gentlemen that are on the Vietnam Memorial somewhere in the new plaza along with any future Rosemead residents that are serving in the military that do not make it home. Barbra Diaz — Stated she was walking her daughter's dog at Rosemead Park when she noticed two large German Sheppard's jump out of a vehicle along with their owner. She stated that she asked the owner if the dog were going to be okay not realizing that he did not speak English. She stated that no sooner than asking him one of the German Sheppard's grabbed her dog by the neck and the other one broke free from the owner and grabbed her dog as well and began to play tug-o -war with her small dog. She stated that she was screaming hysterically and no one was coming to her aid. She stated that the dogs could have easily turned on her as she was kicking them with all her might. She stated a runner came to her assistance and grabbed one German Sheppard and pulled him off her dog. It was a horrific experience. She stated that she called the Temple City Sheriffs and about fifteen minutes later and they did not respond. She called a second time while in the meantime her dog was bleeding and later required surgery and 125 stitches. She stated she was present to request the City to enforce the City Leash policy. Mayor pro Tom Margaret Clark —Asked to confirm that neither dog was on a leash Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of June 10, 2014 Item No. -A Page 1 of 9 Barbra Diaz — Stated one dog was on a leash and the other broke free from the leash. She also stated that through an interpreter the owner of the German Sheppard's said he would pay for the hospital bill. She stated the dog may need a second surgery and as of now the bill is $1,600. She is not sure how she will react the next time she sees such a big dog on the park. Her daughter asked that signs be posted about the City's policy. She also stated that when speaking to the park security they stated that they do not like to cite people because it is a neighborhood park. Mayor Pro Tem Clark— Stated she was very sorry for the incident and trauma. She stated that staff will look into the Ordinances and see what can be done about that. LaDon Lewin - stated that she understood that Rosemead does have a leash law and that it is posted in English all around the park. She also stated that there is a group of ,people who use Rosemead Park and let their dogs run without a leash and in the past have told her to tether dog go as well. Code enforcement has been called out and has talked to the individuals with their dogs yet code enforcement has not done anything about it. She staled that the day of the attack she hadwalked over to see what had happened and saw the German Sheppard's in the vehicle and explained that they were hitting the window trying to get out and getting to her dog. She stated when Code Enforcemeatfinally arrived they informed her that they did not like to give tickets. Council Member Sandra Armenta — Requested clarification on how long it took the Sheriffs to arrive. Barbra Diaz — Stated that it was about 45 Mayor Pro Tem Margaret Clark — Requested clarification as to who stated that they did not like to give out tickets. Barbra Diaz— Stated that it had shown up about the same time after Ms . take her Mayor Pro Tam Margaret Clark —Asked staff to look into this situation and why tickets are not being used. 2. City Council Member Jean Hall Recognition Mayor Pro Tem Margaret Clark— Presented Jean Hall with a plaque and thanked her for her civic service . Council Member Sandra Armenia - thanked Jean Hall for all her efforts and dedication. Council Member Jean Hall- Thanked everyone and said it was an honor to step in for Steven Ly. Mayor Pro Tem Margaret Clark— Commended Council Member Ly for his service. Council Member Steven Ly— Spoke of his experience in the Military . Council Member Sandra Armenta — Congratulated Council Member Ly and welcomed him back. 3. PUBLIC HEARING A. Consideration of the Imposition of Rubbish Liens Pursuant to the contract between the City of Rosemead and Consolidated Disposal Services, a Public Hearing has been scheduled to consider protests regarding the imposition of liens on real property for customers who are delinquent in paying their trash collection bills. Recommendation: That the City Council direct staff to place liens on those properties whose owners have not paid their trash collection bills in full by 6:00 pm. on June 27, 2014. City Manager Allred reviewed the staff report. Council Member Sandra Armenta — Stated that this in relation to the last contract not the new contract. Mayor Pro Tem Margaret ,Clark opened the Public Hearing at 7:14 p:m ; there being no one to speak on this item she closed the Public Hearing at 1:34 p.m. Council Member /Board Member Steven Ly made a motion, seconded by Council MemberlBoard Member SandraAmienta to approvethe imposition of rubbish liens. ResolutionNo.2014 -11 Recommendation: to approve Resolution No. 2014 -11, entitled: A RESOLUTION OF THE SUCCESSOR AGENCY TO THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $183,061.62 NUMBERED 10065 THROUGH 10086 B. Ordinance No. 941- Second Reading: Regulations for the Operation and Parking of Private Buses - Rosemead Municipal Code Section 10.24 On May 27, 2014, the City Council introduced Ordinance No 941, adopting the regulations for the operation and parking of private buses - Municipal Code section 10.24. The Ordinance No. 941 is now before Council at the required second reading for adoption. Recommendation: That the City Council adopt Ordinance No. 941, at its second reading, entitled: AN ORDINANCE: OF, THE CITY COUNCIL OF THE CITY OF ROSEMEAD AMENDING: CHAPTER 10 OF THE ROSEMEAD MUNICIPAL CODE RELATING TO REGULATIONS FOR THE OPERATION AND PARKING OF PRIVATE BUSES C. National League of Cities Summer Policy Forum - July 20 - 26th - Saint Paul, MN The City Council will consider, authorizing': the attendance of Mayor Pro Tern Margaret Clark f, fke;u�1 �nai t namrr: of Ciffes:Summer Policv Forum in Saint Paul, MN, on July 24th -July Recommendation: That the City Council authorize the attendance, at City expense, of Mayor Pro Tem Margaret Clark to the National League of Cities Summer Policy Forum in Saint Paul, MN. D. Probation officer Contract Renewal The City currently contracts with the Los Angeles County Probation Department for one Deputy Probation Officer (DPO) forjuvenile prevention and intervention programs. The DPO works full -time with Rosemead youth who have been identified as at -risk or arrested for minor criminal offenses. These juveniles may have problems ranging from school attendance and performance to vandalism, theft and drug arrests. The DPO's authority allows him to work closely with the juveniles and their families to implement a variety of programs and services to help correct their behavior. E. Used Oil Payment Program Application The California Oil Recycling Enhancement Act of 1991 authorizes the Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste Management Board, to award grants to enhance the collection and recycling of used lubricating oil. Rosemead is eligible; to apply under the Used Oil Payment Program for the July 1, 2014 — June 30 2015 fiscal Year. It is anticipated that these grant funds will be utilized for the promotion of the City's Slate - certified collection centers, development of education awareness materials, and assistance in the recruitment of additional collection facilities. An application for these grant funds must be accompanied by a resolution authorizing the City's grant submittal. Recommendation: That the City Council approve Resolution Nos 2014 -23, respectively entitled: A RESOLUT ROSEMEAD F. Adoption of the City of Rosemead's Fiscal Year 2014.15 Appropriation Limit Article XIIIB of the Constitution of the State. of California was enacted by a vote of the people as Proposed 4 (the Gann Initiative) in November 1979. This law limits the level of most appropriations from tax sources that the state and most local government entities are permitted to make in any given year. It also requires that annually each governmental unit calculate its Appropriations Limit and adopt It by Resolution prior to the beginning of the fiscal year under consideration Recommendation: That the City Council approve Resolution No. 2014 -15, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAO AflOPTING AN APPROPRIATION LIMIT FOR THE 2014.15 FISCAL YEAR City Manager Allred reviewed the staff report. Council MemberlBoard Member Sandra Armenta made a motion, seconded by Council Member /Board Member Steven Ly to approve the Adoption of the City of Rosemead's Fiscal Year 2014.15 Appropriation Limit. Adoption of the 2014.15 Fiscal Year Budget The City Council will consider the adoption of the City's Budget for the 2014 -15 Fiscal Year, which provides for a total appropriations of $35,350,900. The ongoing operations of the General Fund budget of $18,533,300 are balanced with essentially no surplus for the Rosemead City Council and the successor Agency to the Rosemead Community Development commission Joint Meeting Minutes of June 10, 2014 Page 6 of 9 upcoming fiscal year. Consequently, a full scope of services to residents will be continued without service reductions. A five -year financial outlook workshop with the City Council was held on February 11, 2014 and a 2014 -15 budget workshop was held on May 13, 2014. Since the budget workshop on May 13th was conducted, adjustments to both General Fund revenues and expenditures have been made to help cover increased insurance costs. The General Fund revenue budget was increased by approximately $60,000 based on increased projections in parking citations and animal license fees, and expenditures were increased by $150,000 related to a retrospective adjustment cost for General Liability insurance. After adjustments the General Fund operation budget has a surplus of $1,400. No additional major financial changes have been made to the draft budget as presented at the May 130 workshop. Recommendation: City Council take the following actions 1. Consideration of Replacement of Annual Lunar New Year Family Festival with Moon Festival In 2009, City Council approved creation of the City of Rosemead's Lunar New Year Family Festival, The Festival was operated in par hership with EDI Media through, 2013. In 2014, the City assumed sole evOrd operation. Due to ,a prdiferation of similar area events and date - related conflicts, attend ance,has been lo wer than anticipated and vendors are increasingly unwillingly to participate Following a discussion with Council Member Pally Low, it is relieved that the community might be baliterserved by shifting resources towards the celebration of the Chinese Moon Festival. The Moon (or Mid- Autumn) Fo lival is the 'second most celebrated of Chinese cultural events. The City has received a MOW from Sing jatr Newspapers of Lac Angeles to serve as organizer of an event for the affeittioonleveniroof August 23, 2014 along Valley Boulevard between Ivar and Walnut Grove Avenues, Recommendations City Council authorize the execution of an agreement with Sing Tao Newspapers of Los Angeles to organize and operate a Moon Festival event along Valley Boulevard on Aucusf23, 2014. Director of Parks and Recreation Mdritgomery-Scott reviewed the staff report. Council Member Sandra Armenta stated that she believes this will be a great event and with the diverse culture in Rosemead it is great opportunity to serve all of them members of the different Asian cultures. She also stated that with the many Lunar New Year festivals it will be great to switch to something others are not offering. COMMENTS FROM CITY COUNCIL Council Member Steven Ly asked on the status of Jay Impe dial Park and the progress made to the plaza parking lot. He also inquired about the issue regarding public comment and the dog attack. He asked that in the future there be an item on the agenda for discussion regarding a .Pat Park and a skate park. Council Member Sandra Armenta stated she would like st: regards to their skate park, as it does not look too costly and also asked for a status update from Director of Public Works location.
