CC - 10-29-70 - Adjourned MeetingCITY OF ROSEMEAD ROSEMEAD, CALIFORNIA CITY COUNCIL MINUTES OF OCTOBER 29,1970 An adjourned regular meeting of the City Council of the City of Rosemead was held in the Council Chambers, 8838 East Valley Boulevard, and called to order by Mayor Taylor at 8:00 p.m. 1, CALL TO ORDER The Pledge of Allegiance was led by Mayor Pro Tem Maude. The Invocation was delivered by Reverend Robert Hanson of the Church of Christ, 2. ROLL CALL Present: Councilmen: Andersen, Hunter, Maude, Pike, Taylor Absent: Councilmen: None Ex officio: Andersen, Contreras, Gunn, Howell, Street 3, APPROVAL OF MINUTES: OOCTOBER 13, 1970 - REGULAR MEETING CTOBER 27, 1970 - REGULAR MEETING It was moved by Councilman Maude, second by Councilman Hunter, and unanimously carried, that the minutes of October 13 and 27, 1970, be approved as printed. PUBLIC HEARINGS 4, None UNFINISHED BUSINESS 5. None NEW BUSINESS 6. RESOLUTION NO. 70-100, CLAIMS AND DEMANDS. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD ALLOWING CERTAIN CLAIMS AND DEMANDS IN THE SUM OF $239,655.97 AND DEMANDS NUMBERS 9624-9712. Assistant City Manager Street presented this resolution by title only. It was moved by Councilman Maude, second by Councilman Pike, and unanimously carried, that further reading be waived and Resolution No, 70-100 be adopted. Roll Call Vote as follows: AYES: Councilmen: Andersen, Hunter, Maude, Pike, Taylor NOES: Councilmen: None ABSENT: Councilmen: None 7. APPROVAL OF COUNTY STORM DRAIN SPECIFICATIONS - NORTH MONTEBELLO AREA - PROJECT NO. 1225. Mr, Gunn stated these specifications relate to the 1964 Storm Drain Bond Issue in the cities of Montebello, Monterey Park and Rosemead, and in uncorporated territory of the County, for which bids will be received November 13, 1970. Request is made that the Council approve said specifications, authorize the District to proceed with construction, and grant permission to occupy and use the public streets to construct, operate, and maintain the installations. • Page Two C/C 10/29/70 0 Reference was made to the last paragraph of the District's letter which states the City is required to.furnish a cost estimate for certain work to be performed by the City in connection with this project. Mr. Gunn stated he had contacted the District with regard to this requirement, and was informed it was a matter of no concern. Mr. Gunn therefore recommended that the Council approve the specifications and go on record as taking exception to said paragraph. Following discussion, it was moved by Councilman Maude, second by Councilman Andersen, and unanimously carried, that we approve the foregoing specifications and go on record as opposing Section 1, Paragraph 12, of the Engineering Agreement as recommended by the City Manager. COMMISSION RECOMMENDATIONS 8, None COMMUNICATIONS 9. A. OPEN DOOR DRUG CLINIC (NOT ON AGENDA). Mayor Taylor presented this communication, requesting the Council meet with the Open Door Advisory Committee so that points of concern may be clarified. The foregoing communication was received. B. ROSEMEAD LEISURE AGE CLUB AND GARVEY PARK BINGO CLUB.. Mayor Taylor presented a letter from Louise Klinger, on behalf of the Leisure Age and Bingo Clubs, expressing appreciation for the use of Garvey Park gym, and also assistance in this year's` anniversary celebration. Also enclosed with this letter was a check for $10 which the Bingo Club collected at the picnic and would like donated to the Park & Recreation Department. The Council indicated their appreciation and requested a letter be prepared to this effect. 10. ORAL COMMUNICATIONS FROM THE AUDIENCE. -----A, Mr. Jim Driggan, 9450 Ralph Street, addressed the Council regarding the zone variance granted by the Planning Commission on property at 9456 Ralph Street. Mr. Driggan stated he submitted a petition at the hearing opposing this variance, and would like to appeal it to the Council but cannot afford the $50 fee required. Planning Director Contreras gave a brief background, stating the request was to allow a triplex to remain in the R-1 zone with less than the required parking. This was approved by the Commission at their meeting of October 19. During course of discussion the City Attorney was questioned whether the Commission could reconsider this case or if the Council could waive the required appeal fee. Page Three C/C 10/29/70 U Attorney Howell stated the Commission can reconsider a case within 10 days from the date of its approval, but it would be an impossibility in this instance, as the time expires at 12 midnight tonight. He would research the ordinance as to the waiver of fee and report his findings later in the meeting. 11, MATTERS FROM CITY OFFICIALS. A. Councilman Pike made reference to the zoning violation at 3234 Rosemead Place, concerning chickens in a residential zone, and inquired into the status of this matter. There being no objections, the staff was requested to prepare a report. B. Councilman Maude stated he would like the staff to develop specifications for tree trimming, signal installation and maintenance, by private contract, and these matters placed on the next agenda for discussion. C. Councilman Maude also stated he would like the Council to consider adopting an ordinance which would regulate the placement of guy wires along major boulevards. D. City Manager Gunn stated the Park Board would like a joint meeting with the Council to discuss the proposed restroom and/or snack bar and concession area at Rosemead Park, and if the Council agrees he will schedule it for Friday, November 20th at 12 Noon. The Council concurred. E. City Attorney Howell advised the Council that he has reviewed the Zoning Ordinance, Sections 9126.6 in con- junction with 9127.2, and the Council cannot waive appeal fees. If Mr. Driggan wishes to appeal the zone variance described earlier, he will have to submit his appeal tonight accompanied with the $50 fee. There being no further business to come before the Council, it was moved by Councilman Maude, second by Councilman Hunter, and unanimously carried, that we adjourn.
