Ordinance No. 388 - Combustible and Non-Cumbustible Rubbishq ORDINANCE NO. 388 AN ORDINANCE OF THE CITY OF ROSEMEAD PROVIDING DEFINITIONS OF COMBUSTIBLE AND NON-COMBUSTIBLE RUBBISH, COMMERCIAL CUSTOMERS, AND THE DUTIES OF HOUSEHOLDERS AND COMMERCIAL CUSTOMERS, AND AMENDING THE ROSEMEAD MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 5402(b) of the Rosemead Municipal Code shall Be amended in its entirety to read as follows: "(b) Combustible and Non-Combustible Rubbish. Com usti e an non-com usti e rubbish + j shall mean all waste and refuse capable of burning readily, including trimmings, lawn trimmings; plants or flowergarden waste, .wood, paper, straw, packing materials, leather, rubber, clothing, bedding, books, magazines,'newspapers, rags and all other similar articles which will burn by contact with flames of ordinary temperature; and -ashes, tin cans and bottles,.glass, crockery, china, pottery, metal wire, discarded house- hold furniture, furnishings or appliances, dead small animals and animal excreta and .other similar materials which are rejected by the owner or producer thereof as worth- less or useless, excluding therefrom, (1) Trunks, stumps or limbs of trees, or bundles of such'materials, exceeding one hundred (100) pounds in weight or four (4) feet in length; (2) Automobile parts, bodies or junk automobiles: (3) Waste material resulting from con- struction, alteration'or repair, rock, brick, stone, cement, plaster or sod generated or discarded by a contractor or other person in the -scope of his business. : Section 2. Section 5402(h) shall be added to the Rosemead Municipa Code to read as follows: a •o ~ } f. 0 0 T "5403 Containers and-Location Duties of Householders and COmmerC& Customers. (a) It shall be the duty of householders and commercial customers to provide and maintain containers as herein specified for the accumulation and disposal of garbage, combustible and non-combustible rubbish, mis- cellaneous debris or combined rubbish. Garbage containers shall be of tight seamed leakproof metal construction, with a tight lid, and not to exceed twenty (20) gallon capacity in size. Containers for combustible and non- combustible rubbish,•miscellaneous debris and combined rubbish shall have a capacity of not to exceed thirty-five (35) gallons, and when filled shall not exceed sixty (60) pounds in weight. All containers for combined rubbish shall be of leakproof metal construction with a tight lid. "Commercial Customer. 'Commercial Customer', as use in t is C apter, shall mean an owner ,or 'op'erator of a business, commercial or ,industrial establishment or anyone electing, to utilize commercial services pursuant to any contract or franchise.agreement between the City and Contractor." Section 3. Section 5403 of the Rosemead Municipal Code.shall be amended in its entirety to read as follows: Except when placed for collection as otherwise provided herein, no container or garbage, combustible.and non- combustible rubbish, miscellaneous debris or combined rubbish shall be placed in any area," street, parkway or other public place or upon any private lot or parcel of land other than in the rear or side yard of improved lots. -Such containers or articles shall be so set out or placed by the"house- holder or commercial customer not earlier than 6:00 P.M. of the day preceding collection and-such con- tainers shall be removed by the householder from the collection place not later than 8:00 P.M. on the day of collection. p _2- All loose materials shall be securely tied in bundles which shall not weigh in excess of one hundred (100) pounds each, and shall not,exceed the size of four (4) feet in length. (b) It shall be the duty of householders to set out or place.containers for the collection of garbage, combustible and non-combustible rubbish, mis- cellaneous debris.and combined rubbish as follows: When the householder's property is contiguous_•to a public alley; all containers and articles for collection _ shall be placed at the alley property line in one and the same location. When the householder's property is not contiguous- to a public alley; all containers and articles for collection shall be placed in the public parkway or at the curb line in one and the • same location. (c) It shall be the duty of commercial customers to set out or place containers for the collection of garbage, com- bustible and non-combustible rubbish, miscellaneous debris.and combined rubbish as follows: When the rear or side of the establish- ment is accessible to contractor's equipment and when'personal injury or property damage is unlikely to result from the operation of contractor's C• equipment; all containers and articles for collection shall be placed at the rear," or when appropriate, at the side of the establishment in one and the id!! same location. When the rear or side of the establish- ment is inaccessible to contractor's equipment or when personal injury or property damage is likely to result from the operation of contractor's equipment; all containers and articles for collection shall be placed in the public parkway or curbside at one and the same location. (d). In lieu of performing the duties as heretofore prescribed in this Section, a householder or commercial customer may request special service from the Contractor pursuant to the terms and provisions of any contract or franchise agreement between the City and a contractor." -3- Section 4. Section 5409 of the Rosemead Municipal c. code'shall.be amended to read as follows (added portion underlined): 115409. Duty of Property Owners re Collection. aY Except as otherwise provided, in this Chapter, it shall be unlawful for any person other than the'c:ontractor, as defined in this Chapter, or the City, to gather, collect or remove, any garbage or rubbish from any commercial, business,. industrial or residential, premises within the City, or to tamper with, injure destroy or remove an in, container or an other e ui ment used or re use storage.
