Ordinance No. 405 - Building CodeORDINANCE NO. 405 AN ORDINANCE OF THE CITY OF ROSEMEAD ADOPTING BY REFERENCE THE LOS ANGELES COUNTY BUILDING CODE, THE LOS ANGELES COUNTY ELECTRICAL CODE, THE LOS ANGELES COUNTY PLUMBING CODE AND THE LOS ANGELES COUNTY MECHANICAL CODE, CONTAINED IN THE 1975 EDITION OF LOS ANGELES COUNTY UNIFORM BUILDING LAWS PUBLISHED BY THE BUILDING NEWS, INC., MAKING AMENDMENTS TO SAID CODES, AND AMENDING THE ROSEMEAD MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN AS FOLLOWS: • Section 1. Chapter 1 of Article VIII of the Rosemead Municipal Code is amended by renumbering Sections 8104 to 8106, by amending Sections 8100, 8102 and 8103 and by adding Sections 8104 and 8105 to read: "8100. Adoption of Building Code. The Los Angeles County Building Code, being Ordinance No. 2225 of the County of Los Angeles as amended to and in effect on July 31, 1975, as contained in the 1975 Edition of the Los Angeles County Building Laws published by Building News, Inc., except as hereinafter provided, is hereby adopted by reference as the Building Code of the City of Rosemead as amended by Sections 8101, et seq., of this Chapter. Said code may be referred to as the 'Building Code.' • "The provisions of said Building Code applying to dwellings, lodgings, houses, hotels, apartment houses, convents, monasteries or other uses classified by said Building Code as a Group H or I Occupancy and including Chapters 1, 2, 3, 4, and 98 and 99 shall constitute and may be cited as the Housing Code. "Three copies of said Los Angeles County Building Laws have been deposited in the office of the City Clerk of the City of Rosemead, and shall be at all times maintained by said Clerk for use and examination by the public. "8102. Violations and Penalties. "(a) Compliance with Chapter. A person shall not erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, occupy or maintain any building or structure or perform any grading in the City, or cause the same to be done, contrary to, or in violation of, any of the provisions of this Chapter. Ll 0 "(b) Penalty. Any person, firm or corpora- tion violating any of the provisions of this Chapter shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Chapter is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than $500, or by imprisonment for not more than six months, or by both such fine and imprison- ment. "8103. Amendment to Building Code. Notwith- standing the provisions of Section 8100 of the Rosemead Municipal Code, Section 303 of said Building Code is amended as follows: "(a) The second paragraph'of Section 303(f) is amended to read: "For inspection of any use, occupancy or • change in use or occupancy not otherwise covered herein by a fee and which is regulated by any City of Rosemead Ordinance. This fee shall cover all cor- rective work, which has a total valuation of less than $1,000, resulting from an occupancy inspection: ...$30.00. "(b) Each and every other fee set forth in Section 303(f) is increased by fifty percent. "(c) Each and every fee set forth in Table 3-A is increased by fifty percent. "8104. Amendment to Building Code. Notwith- standing the provisions of Section 8100, Section 306 of said Building Code is amended by amending Sections 306(a), 306(c), and 416 to read: "Sec. 306(a). Use or Occupancy. No building or structure in Groups A to J, inclusive, shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made until the Building Official has approved the building or structure for such use or occu- pancy. A building of Group H or I Occupancies, if erected on a site where grading has been performed pursuant to a grading permit issued under provisions of this code, shall not be occupied, nor shall gas or electric utilities be connected thereto, unless the grading has been completed in accordance with all applicable requirements of Chapter 70, or the Building Official has found, should the grading not be so completed, that the site conditions will pose no hazard to the health, safety, or welfare of occupants and/or occupants of adjacent properties. "Sec. 306(c). Certificate Issued. After final inspection when it is found that the building or structure complies with the provisions of this Code, the Building Official shall issue a certificate of occu ancy which shall contain the following: TO y~1. 6`z-g. (1) The building permit number. (2) The address of the building. (3) The name and address of the owner. (4) A description of that portion of the building for which the certificate is issued. (5) A statement that the described portion of the building complies with the require- ments of this Code for group of occupancy in which the proposed occupancy is classified. (6) The name of the Building Official. "Sec. 416. Occupancy is the purpose for which a building is used or intended to be used. The term shall also include the building or room housing such use. Change of occupancy includes a change of tenant or user in any commercial or industrial use. • "Occupant Load. See Section 3301 (c). "Oriel Window is a window which projects from the main line of an enclosing wall of a building and is carried on brackets or corbels. "Owner is any person, agent, firm,_or corporation having a legal or equitable interest in the property. "8105. Amendment to Building Code. Notwithstand- ing the provisions of Section 8100, the Building Code is amended by deleting Sections 307 and 9907 therefrom." Section 2. Pursuant to Section 17958.5 of the Health and Safety Code of the State of California, the City Council hereby finds that the changes and modifications of the Uniform Building Code, 1973 Edition, prepared by the Interna- tional Conference of Building Officials, made in the County of Los Angeles Building Code and made by this ordinance are needed, being reasonably necessary because of local conditions. Section 3. Chapter 2 of Article VIII of the Rose- mead Municipal Code is amended to read: "CHAPTER 2 - ELECTRICAL CODE 8200. Adoption of Electrical Code. The Los Angeles County Electrical Code, being Ordinance No. 11906 of the County of Los Angeles, as amended to and in effect on April 13, 1975, as contained in the 1975 edition of the Los Angeles County Building Laws, published by Building News, Inc., except as hereinafter provided, is hereby adopted by reference as the Electrical Code of the City of Rosemead, as amended by Sections 8201, et seq., of this Chapter. Said Code may be referred to as the 'Electrical Code.' "Three copies of said Los Angeles Building Laws have been deposited in the office of the City Clerk of the City of Rosemead and shall be at all times maintained by said clerk for use and examination by the public. Oltd, W-5- "8201. Definitions. Whenever any of the following names or terms are used in the Electrical Code adopted by Section 8200 of this Code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this section as follows: "'Chief Electrical Inspector' shall mean the County Engineer of the County of Los Angeles except in Section 80-4 of said Electrical Code. "'County,' 'County of Los Angeles' or 'unincorporated area of the County of Los Angeles' shall mean the City of Rosemead. "'Maintenance Electrician' shall mean a person holding a valid Certificate of Registration as Maintenance Electrician issued by the County of Los Angeles as set forth in Sections 80-10 and 82-8(c) of said Los Angeles County Electrical Code. • 8202. Fees. Notwithstanding the provisions of Section 8200, the Electrical Code is hereby amended by increasing by fifty percent (50%) the amount of each and every fee set forth in Section 82-8 of said Electrical Code." However, occupancy inspection corrective work, as defined in Section 306(a) of the Building Code, is exempted from further fees when the total valuation for all the corrective work is under $1,000. "8203. Violations and Penalties. Every person who violates any of the provisions of this Chapter is guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of • any of the provisions of this Chapter is committed, con- tinued, or permitted, and upon conviction is punishable by a fine not exceeding $500 or by imprisonment in the County Jail for a period not exceeding six months or by both such fine and imprisonment." Section 4. Pursuant to Section 17958.5 of the Health and Safety Code of the State of California, the City Council hereby finds that the changes and modifica- tions of the National Electrical Code, 1975 Edition, sponsored by the National Fire Protection Association, made in the County of Los Angeles Electrical Code and made by this ordinance, are needed, being reasonably necessary because of local conditions. Section 5. Chapter 3 of Article VIII of the Rosemead Municipal Code is amended to read: Dup c/os' "CHAPTER 3 - PLUMBING CODE "8300. Adoption of Plumbing Code. The Los Angeles County Plumbing Code, being Ordinance No. 2269 of the County of Los Angeles, as amended to and in effect on April 13, 1975, as contained in the 1975 Edition of the Los Angeles County Building Laws published by Building News, Inc., including Appendices A, B, C, F and G of said Los Angeles County Plumbing Code, except as hereinafter provided, is hereby adopted by reference as the Plumbing Code of the City of Rosemead as amended by Sections 8301, et seq., of this Chapter. 'Said Code may be referred to as the 'Plumbing Code.' "Three copies of said Los Angeles County Building Laws have been deposited in the office of the City Clerk of the City of Rosemead and shall be at all times maintained by said Clerk for use and examination by the public. "8301. Definitions. Whenever any of the following • names or terms are used in said Los Angeles County Plumbing Code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this section as follows: "'Administrative Authority,'.'Chief Plumbing Inspector' or 'Plumbing Inspector' shall mean the County Engineer of the County of Los Angeles acting as the City Engineer except in Section 4 thereof. "'Board of Examiners of Plumbers, Gas Fitters and Sewerage Contractors' or 'Board of Examiners' shall mean the Board of Examiners of Plumbers, Gas Fitters and Sewerage Contractors, of the County of Los Angeles established by Section 73 • of the said Los Angeles County Plumbing Code. "'City' shall mean the City of Rosemead except in Section 3 of said Los Angeles County Plumbing Code. '"County,' 'County of Los Angeles' or 'unincorpo- rated territory of the County of Los Angeles' shall mean the City of Rosemead ''Gas Fitting Contractor,' 'Journeyman Gas Fitter,' 'Journeyman Plumber,' or 'Plumbing Contractor,' shall mean a person holding a valid Certificate of Registration issued by the County of Los Angeles as set forth in Section 72 of said Los Angeles County Plumbing Code. "8302. Fees. Notwithstanding the provisions of Section 8300, the Plumbing Code is hereby amended by increasing by fifty percent (50%) the amount of each and every fee set forth in Sections 59 and 60 and in el d. 90_t~ Tables No. I and II of said Plumbing Code, except plumbing work resulting from occupancy inspection corrective work, as defined in Section 306(a) of the Building Code, is exempted from further fees when the total valuation for all the corrective work is under $1,000. "8303. Violations and Penalties. Every person who violates any of the provisions of this Chapter is guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Chapter is committed, con- tinue or permitted, and upon conviction is punishable by a fine not exceeding $500 or by imprisonment in the County Jail for a period not exceeding six months or by both such fine and imprisonment." Pursuant to Section 17958.5 of the Health and Safety Code of the State of California, the City Council hereby finds that the changes and modifications • of the Uniform Plumbing Code, 1973 Edition, prepared by the International Association of Plumbing and Mechanical Officials, made in the County of Los Angles Plumbing Code and made by this ordinance, are needed, being reasonably necessary because of local conditions. Section 7. Chapter 4 of Article VIII of the Rosemead Municipal Code is amended to read: "8400. Adoption of Mechanical Code. The Los Angeles County Mechanical Code, being Ordinance No. 9544 of the County of Los Angeles as amended to and in effect on April 13, 1975, as contained in the 1975 edition of the Los Angeles County Building Laws published by the Building News, Inc., and including the appendix to said Los Angeles County Mechanical Code, except as herein provided, is hereby adopted by reference as the Mechanical • Code of the City of Rosemead, as amended by Sections 8401, et seq., of this Chapter. Said Code may be referred to as the 'Mechanical Code.' "Three copies of said Los Angeles County Building Laws have been deposited in the office of the City Clerk of the City of Carson and shall be at all times maintained by said Clerk for use and examination by the public. "8401. Definitions. Whenever any of the following names or terms are used in said Los Angeles County Mechanical Code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this section as follows: "'Board of Appeals' or 'Board of Examiners of Plumbers' shall mean the Board of Examiners of Plumbers, Gas Fitters and Sewerage Contractors, of the County of Los Angeles established by Section 73 of the Los Angeles County Plumbing Code as published in said Los Angeles County Building Laws, 1975 Edition. "'Building Department' shall mean the 'Build- ing and Safety Division' of the Department of the County Engineer. "'Building Code,' 'Uniform Building Code' or 'Los Angeles County Building Code' shall mean the Building Code of the City of Rosemead as amended. "'Building Official' shall mean County Engineer of the County of Los Angeles acting as the City Engineer. "'City' shall mean the City of Rosemead. "'Electrical Code' shall mean the Electrical Code as adopted by Section 8200 of the Rosemead Municipal Code as amended. "'Fire Code' or 'Los Angeles County Fire Code' shall mean the Fire Code as adopted by Section 3100 of the Rosemead Municipal Code as amended. • "'General Fund' shall mean the City Treasury of the City of Rosemead. "'Health Code' or 'Los Angeles County Health Code' shall mean the Health Code as adopted by Section 5100 of the Rosemead Municial Code as amended. "'Mechanical Code' shall mean the Mechanical Code of the City of Rosemead. "'Plumbing Code' shall mean the Plumbing Code as adopted by Section 8300 of the Rosemead Munici- pal Code as amended." • "8402. Fees. Notwithstanding the provisions of Section 8400, the Mechanical Code is hereby amended by increasing by fifty percent (50%) the amount of each and every fee set forth in Section 304 of said Mechanical Code. However, occupancy inspection corrective work, as defined in Section 306(a) of the Building Code, is exempted from further fees when the total valuation for all the corrective work is under $1,000.00. "8403. violations and Penalties. It shall be unlawful for any person, firm or corporation to erect, install, alter, repair, relocate, add to, replace, use or maintain heating, ventilating, comfort cooling, or refrigerating equipment in the jurisdiction or cause the same to be done, contrary to or in violation of any of the provisions of this Code. Maintenance of equipment which was unlawful at the time it was installed and which would be unlawful under this Code if installed after the effective date of this Code, shall constitute a continu- ing violation of this Code.
