ORDINANCE NO.
AN ORDINANCE OF THE CITY OF ROSEMEAD
REGULATING THE EXPIRATION OF CONDITIONAL
USE PERMITS AND AMENDING THE MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF•ROSEMEAD DOES ORDAIN AS FOLLOWS:
Section 1. Section 9183.1 of the Rosemead Municipal
Code is amen e to read as follows:
9183.1 Expiration,oModification and Revocation of
Con itiona use ermit
A. If the use authorized by any conditional use
permit is, or has been, unused, abandoned or
discontinued for a period of six (6) months
or none of the conditions have been complied
with, said conditional use permit shall become
null and void and of no effect.
• B. If any condition attached to a conditional use
permit is violated or if any law, statute or
City Ordinance is violated, the conditional
use permit shall be suspended and the privileges
granted thereunder shall lapse; provided that
the applicant has been given written notice
to cease such violation and has failed to do so
for a period of 30 days. Repeated violations of
any of the conditions attached to a conditional
use permit may be grounds for revocation of the
conditional use permit.
C. In the event that the operation of any part of
a facility granted by conditional use permit
should result in substantial.complaints to the
Department of Planning, and when Staff investigation
• determines that the conditions as originally drafted
are not sufficient to properly regulate the use,
the conditions may be modified.
D. For any expiration, revocation or modification of
a conditional use permit, as set forth in sub-
sections A. B or'C-hereof, the Director of. Planning
shall send notice,'in writing, to the original
grantee of the.Dermit that the Commission intends
to revoke or modify the conditional use permit, and
stating the grounds therefor, and informing the
grantee of the time and place of the public hearing
on such revocation.
