ORDINANCE N0. 463
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ROSEMEAD ESTABLISHING AN INTERIh1 MORATORIUh1
RELATING TO ALL LAND USES INVOLVING TIIE SALE
OF ALCOHOLIC BEVERAGES IN THE CITY OF ROSEMEAD
AND DECLARING THE URGENCY THEREOF
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1. The City Council does hereby direct a study of
methods for regulating land uses involving the sale of alcoholic
beverages in the City of Rosemead, and further directs such study
to be performed by the Planning Commission, and pending such
study applications for all occupancy permits, zone changes, con-
ditional use permits and other land us e::entitlements shall not
be accepted. This section shall not effect the reissuance or ex-
tension of such entitlement where business is to be conducted on
the same site and by the same business operator.
SECTION 2. The City Council hereby finds, determines, and
declares that the immediate preservation of the public peace,
health, safety and welfare necessitates the enactment of this
• Ordinance. and its immediate implementation and effect as an urgency
measure.
A declaration of facts constituting the urgency for this
enactment is as follows:
1) Lack of standards for supervision of uses involving the
sale of alcoholic beverages, including regulations of proximity
to residences, schools, churches, etc.
2) The=growing:number of locations distributing alcoholic
beverages at retail outlets with the attendent problems of park-
ing, noise, incompatibility, with adjacent uses and rising crime
rates on such premises.
3) Potential jeopardy to the public from distribution of
alcoholic ,,beverages in locations which encourage abuse of pro-
• hibitions agsinst sale to juveniles.
SECTION 3. Pursuant to Section 65858 of the Government
Code, this Ordinance shall be effective for a.;period of 120 days
from the date of the adoption thereof; provided that after notice
pursuant to Section 65858 of the Government Code and public hear-
.. ing, such interim Ordinance may be extended.
SECTION 4. Effective immediately, by reason of the foregoing,
this Ordinance shall take effect upon its adoption. The Ci'ty,Clerk
sha115,certify to the adoption of this Ordinance and shall cause
the same to be published as requiredc;.by law.
