AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ROSEME AD AMENDING PART XIX
SECTION. 9119 - 9119.4 OF THE D - DESIGN
ZONE BY DELETING THE PRESENT PART XIX
OF THE ROSEME AD MUNICIPAL CODE AND
ENACTING A NEW PART XIX THEREIN.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN AS FOLLOWS:

deleted in its entirety.

9119. D-DESIGN, Land classified in a D Zone shall also be classified
in another zone. The following regulations shall apply in the
D-Design Zone unless otherwise provided in this Chapter.
9119.1 PURPOSE. In order to assure an orderly development and that
buildings, structures, signs and landscaping will be harmonious
within a specified area; to prevent the development of structures
or ,uses which are not of acceptable exterior design or appearance
or are of inferior quality or likely to have a depreciating or
negative effect on the local environment or surrounding area by
reason of use, design, appearance or other criteria affecting
value.
9119.2. JURISDICTION. No building permit shall be issued for any
building structure or other development of property 'or
appurtenance thereto, on any property for which a precise plan
of design is required, until the precise plan of design
covering the parcel or parcels to be so used shall be approved
and adopted as herein provided.'
1. Commercial Uses--Design review prccsdures-shall be followed
for all improvements requiring a building permit or visible
changes in form, texture, color, exterior facade or
landscaping.
• 2. Residential and Institutional Uses--Design review shall not
be imposed on residential or institutional uses except
for improvements requiring a building permit for structural
alteration of a building. Painting, landscaping and normal
maintenance are expressly exempted from such review. For
all improvements requiring a building permit, the juris-
diction shall be as set forth in the preceding subsection.
9119.3 APPLICATION. Prior to the issuance of a building permit for the
erection, alteration, addition to or enlargement of, or the
moving or relocation of, any building or structure, in the D
Zone, an application shall be submitted with six sets of plans
to the Planning Department. Such application shall be on a .form
prescribed by the Planning Commission. A fee of $50.00 for
commercial construction, and $25.00 for residential con-
struction shall be paid upon the filing of such application.
• 1. Contents.
Such precise plan of design shall specify and include but not
limited to the following information and appropriate site plans
and accompanying text: -

a. The street address of the work and the name and address
of owner and the person who prepared the plans.
b. The location, size, bulk, height, and number of stories
_ of all buildings and structures including walls and
fences and the materials of their construction.
c. Architectural elevations of all buildings and structures,
(including signs; walls and fences.)
d. A site or plot plan showing the location, size, and dimen-
sions of yards, courts, setbacks and all other open spaces
between buildings and structures together with the im-
provements of all driveways, parking areas, walkways, and
means of access, ingress and egress, and drainange; and
the dimesions and orientation of. the parcel or parcels.
e. A landscape plan showing the location, size, species,
.and quantity of all landscaping and method of irrigation.
f,. Location and size of exterior signs and outdoor ad-
vertising.
g. The location, dimensions and method of improvements on
all property to be dedicated to the public or to public-
utilities. •
h. Indication of the proposed use of the building shown on
the site.
i. Such other architectural and engineering. data as may be
required to permit necessary findings that the provisions
of this article are being complied with, which may in-
clude the following:
1. Photographs from thesite~~of adjoining structures.:
2, Detailed drawings of decorative elements.
3. Samples of exterior materials and colors.
4. Sectional studies to explain the character of the
design.
5. All mechanical equipment and method of screening from
view. •

9119.4 ACTION ON APPLICATIONS AND-REVIEW CRITERIA
The Planning Commission or the Director where authorized,
may approve, approve with conditions, or disapprove any
application based on the following criteria:
1. The plans indicate proper consideration for the
' relationship between the proposed building and site de-
velopments'that exist or have been approved for the
general neighborhood;
2. The plan for the proposed building and site development
indicates the manner in which the proposed development and
surrounding properties are protected against noise,
.vibrations and other factors which may have an adverse
effect on the environment, and the manner of screening
mechanical equipment, trash, storage and loading areas;
3. The proposed building or site development is not, in
its exterior design and appearance, so at variance with
the appearance of other existing buildings or site develop=
merits"in the neighborhood as to cause the nature_of the
local environment to materially depreciate in appearance
and value;
• 4. The proposed building or structure is in harmony with
the proposed developments on land in the general area,
especially in those instances where buildings are within
or adjacent to land shown on the'General Plan as ,being
part of the. Civic Center or in public or educational use,
or are within or immediately adjacent to land included
within any precise plan which indicates building shape,
size or style;
5. The proposed development is in conformity with the
standards of this code and other applicable ordinances
in so far as the location and appearance of the buildings
and structures are involved; and
6. The site plan..and the design of the buildings, parking
areas, signs, landscaping, luminaires, and other site.
features indicates that proper consideration has been given
~to both the functional aspects of the site development,
such as automobile and pedestrian circulation, and the
visual effect of the development from the view of public.

9119.5 AP
AL PROCEDURE:
Application for approval of a precise plan of design shall
- be made with the Planning Director. If the Planning
Director. If the Planning Director determines that the plans .
conform to the provisions of this Section, and the policies
adopted by the Planning Commission hereunder, the Director
shall endorse his approval thereon in writing to the
Planning Commission for their concurrence. When the plans
for an approval do not arbitrarily alter the appearance
of the property, the only approval required shall be that, .
of the Planning Director.
9119.6 APPEALS:
The applicant or any person aggrieved by the decision of
the Planning Commission may file an appeal to the City
Council on any ruling by the Planning Commission by
filing a written request on forms provided by the Planning
Department. The .appeal shall be filed within fifteen
(15) days after such hearing, setting forth alleged
inconsistency or non-conformity with procedures or
criteria set forth in or pursuant to this Code. •
Said filing shall suspend any building permit until final
action.
The City Council shall hold a hearing on said appeal and shall
render its decision thereon within forty (40) days after the
filing thereof. The City Council may approve, disapprove or
modify the decision of the Planning Commission, and its decision
shall be final.
If significant new evidence is presented with the appeal which
may include substantial changes to the original proposal, the
Council may refer the matter back to the Planning Commission,
in which case the Planning Commission's decision shall be final.
