OB - 2015-0005 - Authorizing the Sucessor Agency to the Rosemead Community Development Commission to Transfer Certain Real Property to the City of Rosemead
RESOLUTION NO. 2015-0005 RESOLUTION OF THE OVERSIGHT BOARD FOR THE SUCCESSOR AGENCY TO THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION DIRECTING AND AUTHORIZING THE SUCCESSOR AGENCY TO THE ROSEMEAD COMMUNITY DEVELOMENT COMMISSION TO TRANSFER CERTAIN REAL PROPERTY TO THE CITY OF ROSEMEAD WHEREAS, pursuant to Health and Safety Code Section 3418l(a) the Oversight Board for the Successor Agency to the Rosemead Community Development Commission ( "Oversight Board "), shall direct the successor agency to the former Rosemead Community Development Commission ( "Successor Agency ") to dispose or transfer all assets and properties of the former Rosemead Community Development Commission; and WHEREAS, on or about January 7, 2015, the Successor Agency was notified by Seymour Morgan of the Department of Finance that the Department of Finance (DOF) had identified parcels owned by the former Rosemead Community Development Commission, and directed the Successor Agency transfer two of the properties to the City of Rosemead. The DOF indicated that the two properties as more specifically described in the attached grant deeds as Exhibits A and B ( "Properties ") qualified as "public uses" one is a sidewalk Assessor Parcel No. 5284- 001 -919 and the piece of property used as a park Assessor Parcel No. 5288- 005 -901, therefore the properties could be transferred to the City without having to be placed on the Long -Range Property Management Plan ( "LRPMP "). 4. Based on the direction of the DOF the Oversight Board is approving this resolution to transfer the Properties to the City of Rosemead. NOW, THEREFORE, BE IT RESOLVED that the Oversight Board of the Successor Agency to the Rosemead Community Development Commission hereby: 1. Authorizes and directs the Successor Agency to transfer the Properties to the City of Rosemead. 2. Authorizes and directs the Successor Agency or its designated staff to take any action and execute any documents necessary to implement this Resolution including transmitting this Resolution to the DOF for its approval. The Property was acquired by the Successor Agency pursuant to a Grant Deed recorded in the Official Records of the County of Los Angeles on May 11, 1983 as Instrument No. 523655. 2. In accordance with Health and Safety Code Section 34191.5, the Oversight Board of the Successor Agency adopted Resolution No. 2014 -009 affirming that the former Rosemead Community Development Commission did not hold title to any real property, and submitted said resolution to the Department of Finance. 3. . On or about January 7, 2015, the Successor Agency was notified by the Department of Finance (DOF) that it had identified parcels owned by the former Rosemead Community Development Commission, including the Property, and directed the Successor Agency transfer the properties to the City of Rosemead. The DOF indicated that the Property qualified as "public use" as a public park and therefore it could be transferred to the City without having to be placed on the Long -Range Property Management Plan ( "LRPMP "). 4. Based on the direction of the DOF the Successor Agency approved by Resolution No. 2015 -0005 approving this grant deed to have the Successor Agency transfer the Property to the City of Rosemead.
