SUBJECT: ADOPTION OF RESOLUTION 2015-42 SETTING THE FEE FOR
SHOPPING CART CONTAINMENT PLAN
SUMMARY
On February 24, 2015 the City Council adopted Ordinance No. 937 adding section 9.32
to the City's Municipal Code relating to shopping cart retrieval and containment by
owners. Section 9.32.060 states that "each proposed plan shall be accompanied by a
processing fee in an amount as set by resolution of the City Council. No proposed plan
shall be accepted for filing and processing by the Planning Division unless accompanied
by the processing fee established by the City Council." Since this entire process was new
and City staff was unsure of the time involved to review the plans, a fee was not
immediately established. Now that the Planning Division has been working with
businesses to receive and review shopping cart retrieval and containment plans, it's been
determined that these plans require a significant amount of staff time and cost recovery
in full is likely not feasible. Full cost recovery for the review and approval of these plans
would be in excess of $500. In order to be business friendly while enforcing these
regulations, staff is proposing a fee of$100.
Staff Recommendation
It is recommended that the City Council adopt Resolution 2015-42 authorizing the
Shopping Cart Retrieval and Containment Plan fee.
DISCUSSION
Abandoned shopping carts has been an ongoing problem in the community for more than
two decades. Within the last few years staff has taken a number of steps to reduce the
number of abandoned shopping carts including City funded cart retrieval services,
meeting directly with businesses to reduce offsite use by patrons, and implementing
Administrative Citations for individuals removing carts from business properties. Despite
all these efforts the problem of abandoned shopping carts was only minimally improved.
The problem of abandoned shopping carts was discussed with the City Council at several
meetings during 2014 and 2015, and it was ultimately decided that the City would declare
abandoned shopping carts a public nuisance and require the businesses providing the
carts to take responsibility for containment and retrieval.

A RESOLUTION OF THE CITY OF ROSEMEAD, COUNTY OF LOS ANGELES,
STATE OF CALIFORNIA, AMENDING RESOLUTION NO. 2015-19
COMPREHENSIVE SCHEDULE OF FEES BY ADDING A FEE FOR SHOPPING
CART CONTAINMENT AND RETRIEVAL PLANS
WHEREAS, the City Council adopted Ordinance No. 937 adding Part 9.32 to the
Rosemead Municipal Code relating to shopping cart retrieval and containment by owners;
and
WHEREAS, Part 9.32.060 states that "each proposed plan shall be accompanied
by a processing fee in an amount as set by resolution of the City Council. No proposed
plan shall be accepted for filing and processing by the Planning Division unless
accompanied by the processing fee established by the City Council."; and
WHEREAS, the City has determined that based on the personnel costs of City
staff and the time expected to be needed to review application, along with the costs
associated with the enforcement of the regulations, that the costs or processing the
shopping cart containment and retrieval plans are partially covered and are not exceeded
by the fee proposed below.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Rosemead City Council imposes the following fee:
• Shopping Cart Containment and Retrieval Plan $100.00
SECTION 2. The City Clerk shall certify to the adoption of this resolution and
hereafter the same shall be in full force and effect.
