4. PUBLIC HEARINGS
A. Public Hearing on the Adoption of Ordinance No. 956 Amending Chapter 5.24 of the
Rosemead Municipal Code Pertaining to the Regulation of Massage Establishments and
Massage Providers
During the 2014 legislative session the Legislature passed, and the Governor signed AB 1147
( "Massage Therapy Act of 2014 ") relating to massage establishments which restored the ability of
cities and counties to regulate massage establishments and establish land use controls as of January
1, 2015. As a result, the proposed ordinance would amend Chapter 5.24 of the Rosemead Municipal
Code to update the City's massage regulations to ensure that massage establishments and massage
practitioners are appropriately regulated to best ensure the public safety, health, and welfare.
Recommendation: That the City Council take the following actions:
1. Conduct the noticed public hearing and receive public comment, and
2. Introduce for First Reading, by title only, Ordinance No. 956 "An Ordinance of the City
Council of the City of Rosemead, California Amending Chapter 5.24 of the Rosemead
Municipal Code Regarding the Licensing and Regulation of Massage Practitioners and
Massage Establishments ".
B. Public Hearing —Municipal Code Amendment 15.06 —An Ordinance Amending the Zoning
Code as Related to massage Establishments in the City of Rosemead
During the 2014 legislative session the Legislature passed, and the Governor signed AB 1147
relating to massage establishments which restored the ability of cities and counties to regulate
massage establishments and establish land use controls as of January 1, 2015. As a result,
Municipal Code Amendment 15 -06 is a City initiated amendment that proposes to amend the zoning
provisions of the Rosemead Municipal Code, Title 17 ( "Zoning "), to require that massage businesses
obtain a Conditional Use Permit for operation in a C -3 (Medium Commercial) zone.
On October 19, 2015, the Planning Commission held a public hearing related to Municipal Code
Amendment 15 -06. Upon hearing written and oral testimony, the Planning Commission adopted
Resolution No. 15 -15, recommending that the City Council ADOPT Ordinance No. 957 approving the
municipal code amendment without any deletions, additions, or modifications.
Recommendation: recommended that the City Council take the following actions:
1, Conduct the noticed public hearing and receive public comment, and
2. Introduce for First Reading, by title only, Ordinance No. 957 "An Ordinance of the City
Council of the City of Rosemead, County Los Angeles, State of California, Approving
Municipal Code Amendment 15.06 Amending Services Uses — Restricted in Table
17.16.020.1 of Section 17.16.020 for the Purpose of Revising Land Use Controls for
Massage Services."

The Rosemead Housing Development Corporation (RHDC) prepares a quarterly Treasurer's
Report of Cash and Investments. This report is reviewed by the Finance Committee each
quarter. The Treasurer's report is as of September 30, 2015.
Recommendation: that the RHDC Board Receive and File the Treasurer's Report of Cash
and Investments.
D. Consideration of Cancelling the December 22, 2015 City Council Meeting
The City Council has traditionally cancelled the second meeting in December due to the
Christmas Holiday. Accordingly, the Council will consider action to cancel the December 22,
2015 City Council Meeting.
Recommendation: That the City Council cancel the December 22, 2015 City Council
Meeting due to a Lack of Quorum.

E. Ordinance No. 955— Second Reading: Municipal Code Amendment 15.05— Adoption
of Amended Fireworks Ordinance
On September 22, 2015, the City Council introduced Ordinance No. 955, amending (in its
entirety) Chapter 8.28 of the City's Health and Safety Code (Title 8 of the Rosemead
Municipal Code) entitled Fireworks. On October 27, 2015, the City Council reintroduced
Ordinance No. 955 due to substantial changes made to the ordinance during the Council
meeting. Ordinance No. 955 is now before Council at the required second reading for
adoption.
Recommendation: That the City Council adopt Ordinance No. 955 at its second reading:

6. MATTERS FROM CITY MANAGER & STAFF
A. One Year Extension of Contract with Auditors
The City of Rosemead currently contracts with a certified public accounting firm, Rogers,
Anderson, Malody and Scott, LLP (RAMS) for audit services. This contract will expire upon
completion of the 2014/15 fiscal year audit. The City Council will consider whether to extend
this contract for one additional year or direct staff to initiate a competitive Request for
Proposal (RFP) process. There will be no cost increase to the City as RAMS has proposed
to maintain their existing fees for the 2015/16 audit. In addition, the one year extension will
provide needed stability during the current era of turnover in the City's management team.
Recommendation: that the City Council authorize the one year extension of the RAMS
contract for $44,882. This is the same as the fiscal year 2014/15 fee.
B. Los Angeles Regional Inter - Operable Communication System (LA -RIGS)
The City Council will receive an update on the proposed county -wide Los Angeles Regional
Inter - operable Communications System (LA- RICS). The proposed system will provide
improved radio and broadband communications (voice and data) for public safety providers
of the greater Los Angeles region. The proposed LA -RIGS will provide coverage within a
4,000 square mile area with integrated communications for over 50 law enforcement
agencies and 31 fire departments, as well as other emergency medical services (EMS),
transportation and education agencies, The City's interests and obligations in this proposed
system are represented by the California Contract Cities Association (CCCA). The City
Council will receive an update and discuss recent communications received from the CCCA
representative on the LA -RICS Board of Directors.

MATTERS FROM CITY COUNCIL
A. Appointment to the San Gabriel Valley Mosquito & Vector Control District
As Council is aware, Council Member William Alarcon was appointed as the City's
representative to the San Gabriel Valley Mosquito & Vector Control Board. Council Member
Alarcon's term expires on December 31, 2015. The City has received a letter from the
District Manager of the San Gabriel Valley Mosquito & Vector Control District requesting the
City Council appoint a representative to its Board prior to January 8, 2016. The qualifications
for the appointment is any individual who is a registered voter in the City and a resident
within the District.
Council Member Alarcon has expressed a desire to be reappointed to the Mosquito and
Vector Control District Board and is requesting Council consideration in that regard.
Recommendation: That the City Council appoint a representative to the San Gabriel Valley
Mosquito & Vector Control District Board of Directors to serve a two year term beginning
January 1, 2016.
B. City Hall Exterior Improvement Project — Options for Modifications to the Existing
Copper Roofline Fascia for Compatibility with other City Facilities
On October 13, 2015, the City Council authorized funding for improvements to the City Hall
exterior to match the exterior of the Rosemead Community Recreation Center (RCRC). At
its last meeting on October 27, 2015, the Council directed staff to review options relative to
modifications to the existing copper roofline fascia on the City Hall building. The optional
treatments include: 1) replacement of the existing copper roofline fascia material with a
decorative metal material similar to the RCRC; or 2) paint the existing copper fascia in a
color to match the RCRC.
Recommendation: That the City Council provide direction regarding the preferred options
for compatibility with other City facilities.

regular City Council meeting is scheduled to take place on November 24, 2015 at 7:00 p.m. in the
