SUBJECT: ROSEMEAD SKATE PLAZA (PROJECT NO. 41009) — AWARD OF
CONTRACT
SUMMARY
As a part of the adopted Fiscal Year 2015-16 Capital Improvement Project (FY15-16 CI P)
Budget, the City Council approved Project No. 41009, which consists of constructing a
skate plaza adjacent to the Aquatic Center, inside Rosemead Park.
The City has completed the construction documents, and subsequently solicited
competitive bids for the Rosemead Skate Plaza Project. On February 24, 2016, the City
received and publicly opened 6 bids; and the apparent lowest bidder was PK
Construction. The City is now ready to consider awarding a construction contract to the
lowest responsive bidder.
Staff Recommendation
It is recommended that the City Council:
1. Approve the plans and specifications for Project 41009, Rosemead Skate Plaza.
2. Waive the minor irregularities in PK Construction's bid.
3. Award the construction contract to PK Construction in the amount of $381,999,
and authorize a construction contingency of$57,301 (15%), for a total of$439,000.
4. Approve Resolution No. 2016-12 allocating an additional $187,000 in
Redevelopment Bond Fund for the Project
DISCUSSION
On November 10, 2014, the City Council directed staff to proceed with developing a skate
plaza adjacent to the Aquatic Center, inside the Rosemead Park. On April 28, 2015, the
City Council approved a contract with Spohn Ranch Skateparks, for conducting public
workshops and preparing design plans. On June 17, 2015 and July 22, 2015, the City
conducted public workshops, and subsequently incorporated community inputs into the
skate plaza design concept.

The Rosemead Skate Plaza is approximately 10,000 square feet in size, located
immediately to the east of the Aquatic Center in Rosemead Park. The design capitalizes
on the existing natural topography at the site to minimize major earthwork, and includes
a variety of street features: steps, handrails, benches, ramps, etc. Exhibits "A" and "B"
illustrates the location and the design concept of the Skate Plaza Project.
On August 11, 2015, the City Council approved the Skate Plaza design concept, and
authorized the City Manager to execute a contract with "Helping Governments Across the
County Buy" (HGACBuy) Program in an amount not to exceed $475,000, for construction
of the Project. Thereafter, the City Attorney opined that through the cooperative
purchasing program, the City is only permitted to purchase the precast (prefabricated)
skate plaza elements (e.g. hub ledge, stairs, grind rails, ramps, etc.). The construction
portion (e.g. site work, grading, concrete, drainage, etc.) must be competitively bid in
accordance with the Public Contract Code. Therefore, the City proceeded with HGACBuy
only for purchasing the precast skate plaza elements, in the amount of $166,207. Under
the HGACBuy Program, Spohn Ranch is the certified vendor, who is responsible for
fabricating and delivering the precast elements to the site for installation.
In December 2015, the City completed the bid documents, and subsequently advertised
the Project for construction bids. On February 24, 2016, the City publicly received and
opened six (6) bids, as summarized below.

Notes: (1' Bid price of $514,942 was adjusted to S513,942, to correct arithmetic error.
The apparent low bidder was PK Construction ("PK") of Altadena California, with a bid of
$318,999; that is approximately $126,610 lower than the next lowest bid. The bid price
also includes an alternate bid item for wrought iron fencing in the amount of $2,475.
If awarded by the City Council, construction is anticipated to begin in April 2016, with
sufficient progress in August 2016 ready for the delivery of the precast skate plaza
elements. Ordering the precast elements in advance is expected to result in significant
time and cost savings (e.g. no mark up from general contractor).

BID SUBMITAL ANALYSIS
On March 1, 2016, the City received a letter from Spohn Ranch (2nd Lowest Bidder)
protesting that the lowest bid submitted by PK Construction is either non-responsive or
non-responsible. The specifics of the protest, along with the City's responses on March
8, 2016, are summarized below.
1. Not Responsive.
A. Protest: PK did not adequately respond to Section 3.1 ("List categories of
work that your organization normally performs with its own forces.").
City Response: PK provided information as requested by Section 3.1, namely
"Concrete, forming, placing, grading". This is a minor irregularity which may be
waived by the City Council because it does not impact the amount of the PK bid
and does not give PK a competitive advantage over other bidders.
B. Protest: PK did not respond to Section 3.6 which asks for a separate sheet
listing the construction experience and present commitments of the key
individuals of your organization.
City Response: While this information was requested by Section 3.6, the lack of
this information is a minor irregularity which may be waived because this
omission does not impact the amount of the bid or give the bidder a competitive
advantage over other bidders.
2. Lack of Experience.
Protest: PK did not provide references for similar work as sought by Section 5.
City Response: PK provided 4 references sufficient to satisfy Section 5.
3. Lack of Responsibility.
Protest: PK is not a responsible contractor pursuant to Paragraph 30
"Responsibility Criteria" of the Bid Document.
City Response: PK is a "Responsible Bidder" as defined by Public Contract Code
Section 1103.
4. Sham Bid.
Protest: The bid by PK is a sham bid because it is 75% of the next lowest bid.
City Response: There is often a wide range of bids and a low bid being 75% of
the next lowest bid does not make the low bid a sham bid.

The City has reviewed PK Construction's bid submittal, and confirmed that it has the
necessary construction license(s) (A-General Engineering Construction, B-General
Building Construction, and C8-Concrete), which are in good standing and relevant to the
required work. Based on reference checks, PK has satisfactorily completed projects for
the Cities of Pasadena, Alhambra, and Manhattan Beach. PK's bid is also $166,207
below the 2nd lowest bid.
For the foregoing reasons, City staff recommends that the City Council waive these minor
irregularities in the bid of PK Construction and award the contract to PK Construction.
FINANCIAL REVIEW
The FY 15-16 CIP Budget contains $500,000 in Redevelopment Bond Funds for Project
No. 41009. Of this amount, a total of $188,207 has been expended ($22,000 for design,
and $166,207 for precast skate plaza elements), with a balance of $311,793 available for
the construction phase.
The total estimated cost for the construction phase (including contingencies, contract
administration, design support, and inspection) is $498,793, as tabulated below.
Therefore, an additional allocation of $187,000 from the Redevelopment Bond Fund is
required to complete the Project.
The City has previously set aside a total of $1,878,500 in Redevelopment Bond Fund for
the Rosemead Community Recreation Center (RCRC) Project. This Project is
substantially complete, and a net savings of S678,500 in Redevelopment Bond Fund can
be expected from not constructing a new building next to the RCRC. A portion of this
savings can be reallocated to the Rosemead Park Project (for the Skate Plaza).

A RESOLUTION OF THE ROSEMEAD, CALIFORNIA CITY COUNCIL
APPROPRIATING ADDITIONAL FUNDS FROM THE
REDEVELOPMENT BOND FUNDS FOR THE
ROSEMEAD SKATE PLAZA PROJECT
WHEREAS, appropriations are the legal authority for a City to spend its funds; and
WHEREAS, from time to time it is necessary to amend the budget with additional
appropriations; and
WHEREAS, the City desires the construction of Rosemead Skate Plaza at
Rosemead Park; and
WHEREAS, the Rosemead Skate Plaza Project is funded through proceeds from
Redevelopment Bond funds and currently has a budget amount of $311,793; and
WHEREAS, the total cost for the construction of this project, as proposed, will not
exceed $498,793, which is $187,000 more than currently budgeted; and
NOW THEREFORE, $187,000 is appropriated in the Capital Improvement Programs
for Expenditures related to the Rosemead Skate Plaza Project as defined below:
