SUBJECT: APPROVAL OF PROFESSIONAL SERVICES AGREEMENT FOR
KIMLEY-HORN AND ASSOCIATES FOR A SEWER SYSTEM
COMPREHENSIVE STUDY
SUMMARY
The Budget for the current 2015-16 Fiscal Year includes an appropriation of $100,000
for completion of a Sewer System Comprehensive Study. On March 10, 2016, the City
received proposals from qualified engineering firms to conduct a Sewer System
Comprehensive Study, consisting of the following components:
• Update 2009 Sewer System Management Plan in accordance with State Water
Resources Control Board (SWRCB) Order No. 2006-0003.
• Update the existing City-wide Info-Sewer Model.
• Analyze sewer system network along Garvey Avenue in coordination with the
Garvey Corridor Specific Plan (GASP).
• Provide documentation and justification for the establishment of a Sewer
Development Impact Fee (SDIF) in accordance with Assembly Bill 1600
requirements.
Staff Recommendation
Staff recommends that the City Council authorize the City Manager to enter into an
agreement with Kimley-Horn and Associates, Inc. for engineering services related to the
completion of the Sewer System Comprehensive Study in the amount not to exceed
$99,800.00.
DISCUSSION
The City of Rosemead local sewer system provides wastewater collection service to a
population of approximately 60,000, as well as numerous commercial and industrial
customers. The sanitary sewer system consists of approximately 81 miles of gravity
sewer mains ranging in sizes from 6-inches to 12-inches in diameter and assisted by
one pump station. The City's collection system discharges to the Los Angeles County
Sanitation District trunk sewers at various locations within the City.

The City of Rosemead's sewer system is entirely within the Consolidated Sewer
Maintenance District (CSMD) and Los Angeles County Sanitation District No. 15. The
local sewage system is under the jurisdiction of the City of Rosemead and is operated
and maintained by the Los Angeles County Department of Public Works.
On May 2006, the State Water Resources Control Board (SWRCB) adopted Order No.
2006-0003, establishing General Waste Discharge Requirements (WDR) for sanitary
sewer systems. This order is required for all public agencies that own or operate a
sanitary sewer system comprised of more than one mile of sewer lines which convey
untreated wastewater to a publicly owned treatment facility. The mandate further
requires public agencies to electronically report all sanitary sewer overflows (SSOs)
such as spills, releases, discharges, or diversions of untreated or partially treated
wastewater from a sanitary sewer system to the State Board's database.
Noncompliance with the mandate could subject the City to penalties and potential fines.
The goal for SSO reduction is to decrease the risk to human health and the
environment. The WDR requires the City Council to approve the SSMP at a public
meeting. Thereafter, the SSMP must be updated every five (5) years, and certified by
the City's authorized representative upon completion. The last time that the SSMP was
updated was 2009; therefore, the City must update its SSMP.
Since the City of Rosemead is in the process of adopting the Garvey Avenue Specific
Plan (GASP) and Environmental Impact Report (EIR), it is recommended that an
analysis of the sewer system within the area regarding existing capacity and structural
deficiencies be conducted. A sewer capacity analyses based on an assumed General
Plan build-out and projection for the GASP will provide more appropriate guidelines for
future development along this corridor.
The City Council recently adopted a Development Impact Fee (DIF) Program. A Sewer
fee was not proposed for adoption at that time. With the process of the GASP and EIR
moving forward at this time, a more detailed review of the sewer needs for future
development within the corridor, and throughout the remainder of the City has been
assessed. Prior to the process of a proposed DIF for sewer, and in conjunction with the
work that will accompany the attached agreement, a "nexus" analysis and study must
be completed in order to propose official action by the City Council.
The following are requirements related to the applicability of a sewer DIF: Preparation
of a sewer nexus study identifying the determination of facility standards and the
allocation of cost burden amongst applicable land uses. The analysis will allocate the
cost of sewer facilities to future development based upon the defined benefit nexus.
Comprehensive documentation of the development assumptions, methodologies, and
results, including findings required by AB 1600 and/or the Mitigation Fee Act.

City staff distributed a request for proposal (RFP) to seven engineering firms. Proposals
were received from two of the seven firms and were ranked on a qualification basis.

Staff has reviewed the proposal documents as well as the consultants' background and
recent projects for competency. Staff determined that Kimley-Horn and Associates has
the qualifications to complete this project, and has provided sewer-related professional
services to the City in the past.
FINANCIAL REVIEW
Funding for this project was approved during in the mid-year budget adjustments for a
total of $100,000 from the General Fund.

SEWER SYSTEM COMPREHENSIVE STUDY
(KIMLEY — HORN, AND ASSOCIATES)
1. PARTIES AND DATE.
This Agreement is made and entered into this day of , 20
(Effective Date) by and between the City of Rosemead, a municipal organization organized
under the laws of the State of California with its principal place of business at 8838 E. Valley
Blvd., Rosemead, California 91770 ("City") and (Kimley-Horn) with its principal place of
business at (21820 Burbank Blvd., Suite 230, Woodland Hills, CA) ("Consultant"). City and
consultant are sometimes individually referred to herein as "Party" and collectively as
"Parties."
2. RECITALS.
2.1 Consultant.
Consultant desires to perform and assume responsibility for the provision of certain
professional services required by the City on the terms and conditions set forth in this
Agreement. Consultant represents that it is experienced in providing (Sewer System
Comprehensive Study) to public clients, is licensed in the State of California and is familiar
with the plans of City.
2.2 Project.
City desires to engage Consultant to render such services for the (Sewer System
Comprehensive Study) ("Project"), also referred to as "Services" as set forth in this
Agreement.
3. TERMS.
3.1 Scope of Services and Term.
3.1.1 General Scope of Services: Consultant promises and agrees to furnish
to the City all labor, materials, tools, equipment, services, and incidental and customary work
necessary to fully and adequately supply the professional Sewer Analysis services
necessary for the Project, herein referred to as "Services". The Services are more

particularly described in Exhibit "A" attached hereto and incorporated herein by reference.
All Services shall be subject to, and performed in accordance with, this Agreement, the
exhibits attached hereto and incorporated herein by reference, and all applicable local, state
and federal laws, rules and regulations.
3.1.2 Term: The term of this Agreement shall be from the Effective Date
shown above to (End Date) unless earlier terminated as provided herein. Consultant shall
complete the Services within the term of this Agreement, and shall meet any other
established schedules and deadlines. The Parties may, by mutual, written consent, extend
the term of this agreement is necessary to complete the Services
3.2 Responsibilities of Consultant.
3.2.1 Control and Payment of Subordinates; Independent Contractor: The
Services shall be performed by Consultant or under its supervision. Consultant will
determine the means, methods and details of performing the Services subject to the
requirements of this Agreement. City retains Consultant on an independent contractor basis
and not as an employee. Consultant retains the right to perform similar or different services
for others during the term of this Agreement. Any additional personnel performing the
Services under this Agreement on behalf of Consultant shall also not be employees of City
and shall at all times be under Consultant's exclusive direction and control. Consultant shall
pay all wages, salaries, and other amounts due such personnel in connection with their
performance of Services under this Agreement and as required by law. Consultant shall be
responsible for all reports and obligations respecting such additional personnel, including,
but not limited to: social security taxes, income tax withholding, unemployment insurance,
disability insurance, and workers' compensation insurance.
3.2.2 Schedule of Services: Consultant shall perform the Services
expeditiously, within the term of this Agreement. Consultant represents that it has the
professional and technical personnel required to perform the Services in conformance with
such conditions. In order to facilitate Consultant's conformance with the Schedule, City shall
respond to Consultant's submittals in a timely manner. Upon request of City, Consultant
shall provide a more detailed schedule of anticipated performance to meet the Schedule of
Services.
3.2.3 Conformance to Applicable Requirements: All work prepared by
Consultant shall be subject to the approval of City.
3.2.4 Substitution of Key Personnel: Consultant has represented to City that
certain key personnel will perform and coordinate the Services under this Agreement.
Should one or more of such personnel become unavailable, Consultant may substitute other
personnel of at least equal competence upon written approval of City. In the event that City
and Consultant cannot agree as to the substitution of key personnel, City shall be entitled to
terminate this Agreement for cause. As discussed below, any personnel who fail or refuse to
perform the Services in a manner acceptable to the City, or who are determined by the City
to be uncooperative, incompetent, a threat to the adequate or timely completion of the
Project or a threat to the safety of persons or property, shall be promptly removed from the

Project by the Consultant at the request of the City.
3.2.5 City's Representative: The City hereby designates the City Engineer, or
his or her designee, to act as its representative for the performance of this Agreement
("City's Representative"). City's Representative shall have the power to act on behalf of the
City for all purposes under this Agreement. Consultant shall not accept direction or orders
from any person other than the City's Representative or his or her designee.
3.2.6 Consultant's Representative: Consultant will designate a designee to
act as its representative for the performance of this Agreement ("Consultant's
Representative"). Consultant's Representative shall have full authority to represent and act
on behalf of the Consultant for all purposes under this Agreement. The Consultant's
Representative shall supervise and direct the Services, using his/her best skill and attention,
and shall be responsible for all means, methods, techniques, sequences and procedures and
for the satisfactory coordination of all portions of the Services under this Agreement.
3.2.7 Coordination of Services: Consultant agrees to work closely with City
staff in the performance of Services and shall be available to City's staff, consultants and
other staff at all reasonable times.
3.2.8 Standard of Care; Performance of Employees: Consultant shall perform
all Services under this Agreement in a skillful and competent manner, consistent with the
standards generally recognized as being employed by professionals in the same discipline in
the State of California. Consultant represents and maintains that it is skilled in the
professional calling necessary to perform the Services. Consultant warrants that all
employees and subcontractors shall have sufficient skill and experience to perform the
Services assigned to them. Finally, Consultant represents that it, its employees and
subcontractors have all licenses, permits, qualifications and approvals of whatever nature
that are legally required to perform the Services, including a City Business License, and that
such licenses and approvals shall be maintained throughout the term of this Agreement. As
provided for in the indemnification provisions of this Agreement, Consultant shall perform, at
its own cost and expense and without reimbursement from the City, any services necessary
to correct errors or omissions which are caused by the Consultant's failure to comply with the
standard of care provided for herein.
3.2.9 Laws and Regulations: Consultant shall keep itself fully informed of and
in compliance with all local, state and federal laws, rules and regulations in any manner
affecting the performance of the Project or the Services, including all Cal/OSHA
requirements, and shall give all notices required by law. Consultant shall be liable for all
violations of such laws and regulations in connection with Services. If the Consultant
performs any work knowing it to be contrary to such laws, rules and regulations and without
giving written notice to the City, Consultant shall be solely responsible for all costs arising
therefrom. Consultant shall defend, indemnify and hold City, its officials, directors, officers,
employees and agents free and harmless, pursuant to the indemnification provisions of this
Agreement, from any claim or liability arising out of any failure or alleged failure to comply
with such laws, rules or regulations.
3.2.10 Insurance: Consultant shall maintain prior to the beginning of and for the

duration of this Agreement insurance coverage as specified in Exhibit B attached to and part
of this agreement.
3.2.11 Safety: Consultant shall execute and maintain its work so as to avoid
injury or damage to any person or property. In carrying out its Services, the Consultant shall
at all times be in compliance with all applicable local, state and federal laws, rules and
regulations, and shall exercise all necessary precautions for the safety of employees
appropriate to the nature of the work and the conditions under which the work is to be
performed. Safety precautions as applicable shall include, but shall not be limited to: (A)
adequate life protection and life saving equipment and procedures; (B) instructions in
accident prevention for all employees and subcontractors, such as safe walkways, scaffolds,
fall protection ladders, bridges, gang planks, confined space procedures, trenching and
shoring, equipment and other safety devices, equipment and wearing apparel as are
necessary or lawfully required to prevent accidents or injuries; and (C) adequate facilities for
the proper inspection and maintenance of all safety measures.
3.3 Fees and Payments.
3.3.1 Compensation. Consultant shall receive compensation, including
authorized reimbursements, for all Services rendered under this Agreement and shall not
exceed (Ninety Nine Thousand Eight Hundred) ($99,800.00). Extra Work may be authorized
in writing, as described below, and will be compensated at the rates and manner set forth in
this Agreement.
3.3.2 Payment and Compensation: Consultant shall submit to City a monthly
itemized statement which indicates work completed and hours of Services rendered by
Consultant. The statement shall describe the amount of Services and supplies provided
since the initial commencement date, or since the start of the subsequent billing periods, as
appropriate, through the date of the statement. City shall, within 45 days of receiving such
statement, review the statement and pay all approved charges thereon.
3.3.3 Reimbursement for Expenses: Consultant shall not be reimbursed for
any expenses unless authorized in writing by City.
3.3.4 Extra Work: At any time during the term of this Agreement, City may
request that Consultant perform Extra Work. As used herein, "Extra Work" means any work
which is determined by City to be necessary for the proper completion of the Project, but
which the parties did not reasonably anticipate would be necessary at the execution of this
Agreement. Consultant shall not perform, nor be compensated for, Extra Work without
written authorization from City's Representative.
3.3.5 Prevailing Wages: Consultant is aware of the requirements of California
Labor Code Section 1720, et seq., and 1770, et seq., as well as California Code of
Regulations, Title 8, Section 1600, et seq., ("Prevailing Wage Laws"), which require the
payment of prevailing wage rates and the performance of other requirements on "public
works" and "maintenance" projects. If the Services are being performed as part of an
applicable "public works"or"maintenance" project, as defined by the Prevailing Wage Laws,

and if the total compensation is $1 ,000 or more, Consultant agrees to fully comply with such
Prevailing Wage Laws. City shall provide Consultant with a copy of the prevailing rates of
per diem wages in effect at the commencement of this Agreement. Consultant shall make
copies of the prevailing rates of per diem wages for each craft; classification or type of
worker needed to execute the Services available to interested parties upon request, and
shall post copies at the Consultant's principal place of business and at the project site.
Consultant shall defend, indemnify and hold the City, its elected officials, officers, employees
and agents free and harmless from any claim or liability arising out of any failure or alleged
failure to comply with the Prevailing Wage Laws.
3.4 Accounting Records.
3.4.1 Maintenance and Inspection: Consultant shall maintain complete and
accurate records with respect to all costs and expenses incurred under this Agreement. All
such records shall be clearly identifiable. Consultant shall allow a representative of City
during normal business hours to examine, audit, and make transcripts or copies of such
records and any other documents created pursuant to this Agreement. Consultant shall
allow inspection of all work, data, documents, proceedings, and activities related to the
Agreement for a period of three (3) years from the date of final payment under this
Agreement.
3.5 General Provisions.
3.5.1 Termination of Agreement.
3.5.1 .1 Grounds for Termination: City may, by written notice to
Consultant, terminate the whole or any part of this Agreement at any time and without cause
by giving written notice to Consultant of such termination, and specifying the effective date
thereof, at least seven (7) days before the effective date of such termination. Upon
termination, Consultant shall be compensated only for those services which have been
adequately rendered to City, and Consultant shall be entitled to no further compensation.
Consultant may not terminate this Agreement except for cause.
3.5.1.2 Effect of Termination: If this Agreement is terminated as
provided herein, City may require Consultant to provide all finished or unfinished Documents/
Data and other information of any kind prepared by Consultant in connection with the
performance of Services under this Agreement. Consultant shall be required to provide such
document and other information within fifteen (15) days of the request.
3.5.1.3 Additional Services: In the event this Agreement is
terminated in whole or in part as provided herein, City may procure, upon such terms and in
such manner as it may determine appropriate, services similar to those terminated.
3.5.2 Delivery of Notices. All notices permitted or required under this
Agreement shall be given to the respective parties at the following address, or at such other
address as the respective parties may provide in writing for this purpose:

Such notice shall be deemed made when personally delivered or when mailed,
forty-eight (48) hours after deposit in the U.S. Mail, first class postage prepaid and
addressed to the party at its applicable address. Actual notice shall be deemed adequate
notice on the date actual notice occurred, regardless of the method of service.
3.5.3 Ownership of Materials and Confidentiality.
3.5.3.1 Documents& Data; Licensing of Intellectual Property: This
Agreement creates a non-exclusive and perpetual license for City to copy, use, modify,
reuse, or sublicense any and all copyrights, designs, and other intellectual property
embodied in plans, specifications, studies, drawings, estimates, and other documents or
works of authorship fixed in any tangible medium of expression, including but not limited to,
physical drawings or data magnetically or otherwise recorded on computer diskettes, which
are prepared or caused to be prepared by Consultant under this Agreement ("Documents &
Data"). Consultant shall require all subcontractors to agree in writing that City is granted a
non-exclusive and perpetual license for any Documents & Data the subcontractor prepares
under this Agreement. Consultant represents and warrants that Consultant has the legal
right to license any and all Documents & Data. Consultant makes no such representation
and warranty in regard to Documents & Data which were prepared by design professionals
other than Consultant or provided to Consultant by the City. City shall not be limited in any
way in its use of the Documents and Data at any time, provided that any such use not within
the purposes intended by this Agreement shall be at City's sole risk.
3.5.3.2 Confidentiality: All ideas, memoranda, specifications,
plans, procedures, drawings, descriptions, computer program data, input record data, written
information, and other Documents and Data either created by or provided to Consultant in
connection with the performance of this Agreement shall be held confidential by Consultant.
Such materials shall not, without the prior written consent of City, be used by Consultant for
any purposes other than the performance of the Services. Nor shall such materials be
disclosed to any person or entity not connected with the performance of the Services or the
Project. Nothing furnished to Consultant which is otherwise known to Consultant or is
generally known, or has become known, to the related industry shall be deemed confidential.

Consultant shall not use City's name or insignia, photographs of the Project, or any publicity
pertaining to the Services or the Project in any magazine, trade paper, newspaper, television
or radio production or other similar medium without the prior written consent of City.
3.5.4 Cooperation; Further Acts: The Parties shall fully cooperate with one
another, and shall take any additional acts or sign any additional documents as may be
necessary, appropriate or convenient to attain the purposes of this Agreement.
3.5.5 Attorney's Fees: If either party commences an action against the other
party, either legal, administrative or otherwise, arising out of or in connection with this
Agreement, the prevailing party in such litigation shall be entitled to have and recover from
the losing party reasonable attorney's fees and all other costs of such action.
3.5.6 Indemnification: To the fullest extent permitted by law, Consultant shall
defend, indemnify and hold the City, its officials, officers, employees, volunteers, and agents
free and harmless from any and all claims, demands, causes of action, costs, expenses,
liability, loss, damage or injury, in law or equity, to property or persons, including wrongful
death, in any manner arising out of, pertaining to, or relating to any negligence, errors or
omissions, recklessness, or willful misconduct of Consultant, its officials, officers, employees,
agents, and Consultants arising out of or in connection with the performance of the
Consultant's Services, including without limitation the payment of all consequential damages,
expert witness fees, and attorneys fees and other related costs and expenses. Consultant
shall defend, at Consultant's own cost, expense and risk, any and all such aforesaid suits,
actions or other legal proceedings of every kind that may be brought or instituted against
City, its directors, officials, officers, employees, agents, or volunteers. Consultant shall pay
and satisfy any judgment, award or decree that may be rendered against City or its directors,
officials, officers, employees, agents, or volunteers, in any such suit, action or other legal
proceeding. Consultant shall reimburse City and its directors, officials, officers, employees,
agents, and/or volunteers, for any and all legal expenses and costs incurred by each of them
in connection therewith or in enforcing the indemnity herein provided. Consultant's obligation
to indemnify shall not be restricted to insurance proceeds, if any, received by the City, its
directors, official's officers, employees, agents, or volunteers.
3.5.7 Entire Agreement: This Agreement contains the entire Agreement of the
parties with respect to the subject matter hereof, and supersedes all prior negotiations,
understandings or agreements. This Agreement may only be modified by a writing signed by
both parties.
3.5.8 Governing Law: This Agreement shall be governed by the laws of the
State of California. Venue shall be in Los Angeles County.
3.5.9 Time of Essence: Time is of the essence for each and every provision
of this Agreement.
3.5.10 City's Right to Employ Other Consultants: City reserves right to employ
other consultants in connection with this Project.

3.5.11 Successors and Assigns: This Agreement shall be binding on the
successors and assigns of the parties.
3.5.12 Assignment or Transfer: Consultant shall not assign, hypothecate, or
transfer, either directly or by operation of law, this Agreement or any interest herein without
the prior written consent of the City. Any attempt to do so shall be null and void, and any
assignees, hypothecates or transferees shall acquire no right or interest by reason of such
attempted assignment, hypothecation or transfer.
3.5.13 Construction; References; Captions: Since the Parties or their agents
have participated fully in the preparation of this Agreement, the language of this Agreement
shall be construed simply, according to its fair meaning, and not strictly for or against any
Party. Any term referencing time, days or period for performance shall be deemed calendar
days and not work days. All references to Consultant include all personnel, employees,
agents, and subcontractors of Consultant, except as otherwise specified in this Agreement.
All references to City include its elected officials, officers, employees, agents, and volunteers
except as otherwise specified in this Agreement. The captions of the various articles and
paragraphs are for convenience and ease of reference only, and do not define, limit,
augment, or describe the scope, content, or intent of this Agreement.
3.5.14 Amendment; Modification: No supplement, modification, or amendment
of this Agreement shall be binding unless executed in writing and signed by both Parties.
3.5.15 Waiver: No waiver of any default shall constitute a waiver of any other
default or breach, whether of the same or other covenant or condition. No waiver, benefit,
privilege, or service voluntarily given or performed by a Party shall give the other Party any
contractual rights by custom, estoppel, or otherwise.
3.5.16 No Third Party Beneficiaries: There are no intended third party
beneficiaries of any right or obligation assumed by the Parties.
3.5.17 Invalidity; Severability: If any portion of this Agreement is declared
invalid, illegal, or otherwise unenforceable by a court of competent jurisdiction, the remaining
provisions shall continue in full force and effect.
3.5.18 Prohibited Interests: Consultant maintains and warrants that it has not
employed nor retained any company or person, other than a bona fide employee working
solely for Consultant, to solicit or secure this Agreement. Further, Consultant warrants that it
has not paid nor has it agreed to pay any company or person, other than a bona fide
employee working solely for Consultant, any fee, commission, percentage, brokerage fee,
gift or other consideration contingent upon or resulting from the award or making of this
Agreement. Consultant further agrees to file, or shall cause its employees or subconsultants
to file, a Statement of Economic Interest with the City's Filing Officer as required under state
law in the performance of the Services. For breach or violation of this warranty, City shall
have the right to rescind this Agreement without liability. For the term of this Agreement, no
member, officer or employee of City, during the term of his or her service with City, shall

benefit arising therefrom.
3.5.19 Equal Opportunity Employment: Consultant represents that it is an
equal opportunity employer and it shall not discriminate against any subcontractor, employee
or applicant for employment because of race, religion, color, national origin, handicap,
ancestry, sex or age. Such non-discrimination shall include, but not be limited to, all
activities related to initial employment, upgrading, demotion, transfer, recruitment or
recruitment advertising, layoff or termination. Consultant shall also comply with all relevant
provisions of City's Minority Business Enterprise program, Affirmative Action Plan or other
related programs or guidelines currently in effect or hereinafter enacted.
3.5.20 Labor Certification: By its signature hereunder, Consultant certifies that
it is aware of the provisions of Section 3700 of the California Labor Code which require every
employer to be insured against liability for Worker's Compensation or to undertake self-
insurance in accordance with the provisions of that Code, and agrees to comply with such
provisions before commencing the performance of the Services.
3.5.21 Authority to Enter Agreement: Consultant has all requisite power and
authority to conduct its business and to execute, deliver, and perform the Agreement. Each
Party warrants that the individuals who have signed this Agreement have the legal power,
right, and authority to make this Agreement and bind each respective Party.
3.5.22 Counterparts: This Agreement may be signed in counterparts, each of
which shall constitute an original.
3.6 Subcontracting.
3.6.1 Prior Approval Required: Consultant shall not subcontract any portion of
the work required by this Agreement, except as expressly stated herein, without prior written
approval of City. Subcontracts, if any, shall contain a provision making them subject to all
provisions stipulated in this Agreement.

INSURANCE REQUIREMENTS
Prior to the beginning of and throughout the duration of the Work, Consultant will maintain
insurance in conformance with the requirements set forth below. Consultant will use
existing coverage to comply with these requirements. If that existing coverage does not
meet the requirements set forth here, Consultant agrees to amend, supplement or endorse
the existing coverage to do so. Consultant acknowledges that the insurance coverage and
policy limits set forth in this section constitute the minimum amount of coverage required.
Any insurance proceeds available to City in excess of the limits and coverage required in
this agreement and which is applicable to a given loss, will be available to City.
Consultant shall provide the following types and amounts of insurance:
Commercial General Liability Insurance using Insurance Services Office "Commercial
General Liability" policy form CG 00 01 or the exact equivalent. Defense costs must be paid
in addition to limits. There shall be no cross liability exclusion for claims or suits by one
insured against another. Limits are subject to review but in no event less than $1,000,000
per occurrence.
Business Auto Coverage on ISO Business Auto Coverage form CA 00 01 including symbol
1 (Any Auto) or the exact equivalent. Limits are subject to review, but in no event to be less
that $1,000,000 per accident. If Consultant owns no vehicles, this requirement may be
satisfied by a non-owned auto endorsement to the general liability policy described above.
If Consultant or Consultant's employees will use personal autos in any way on this project,
Consultant shall provide evidence of personal auto liability coverage for each such person.
Workers Compensation on a state-approved policy form providing statutory benefits as
required by law with employer's liability limits no less than $1 ,000,000 per accident or
disease.
Excess or Umbrella Liability Insurance (Over Primary) if used to meet limit requirements,
shall provide coverage at least as broad as specified for the underlying coverages. Any
such coverage provided under an umbrella liability policy shall include a drop down
provision providing primary coverage above a maximum $25,000 self-insured retention for
liability not covered by primary but covered by the umbrella. Coverage shall be provided on
a "pay on behalf" basis, with defense costs payable in addition to policy limits. Policy shall
contain a provision obligating insurer at the time insured's liability is determined, not
requiring actual payment by the insured first. There shall be no cross liability exclusion
precluding coverage for claims or suits by one insured against another. Coverage shall be
applicable to City for injury to employees of Consultant, subconsultants or others involved
in the Work. The scope of coverage provided is subject to approval of City following receipt
of proof of insurance as required herein. Limits are subject to review but in no event less
than $1,000,000.00 per occurrence.

Professional Liability or Errors and Omissions Insurance as appropriate shall be written on
a policy form coverage specifically designed to protect against acts, errors or omissions of
the consultant and "Covered Professional Services" as designated in the policy must
specifically include work performed under this agreement. The policy limit shall be no less
than $1,000,000 per claim and in the aggregate. The policy must "pay on behalf of" the
insured and must include a provision establishing the insurer's duty to defend. The policy
retroactive date shall be on or before the effective date of this agreement.
Insurance procured pursuant to these requirements shall be written by insurers that are
licensed carriers in the state of California and with an A.M. Bests rating of A- or better and
a minimum financial size VII.
General conditions pertaining to provision of insurance coverage by Consultant.
Consultant and City agree to the following with respect to insurance provided by
Consultant:
1. Consultant agrees to have its insurer endorse the third party general liability
coverage required herein to include as additional insureds City, its officials,
employees and agents, using standard ISO endorsement No. CG 2010 with an
edition prior to 1992. Consultant also agrees to require all contractors, and
subcontractors to do likewise.
2. No liability insurance coverage provided to comply with this Agreement shall
prohibit Consultant, or Consultant's employees, or agents, from waiving the right
of subrogation prior to a loss. Consultant agrees to waive subrogation rights
against City regardless of the applicability of any insurance proceeds, and to
require all contractors and subcontractors to do likewise.
3. All insurance coverage and limits provided by Consultant and available or
applicable to this agreement are intended to apply to the full extent of the
policies. Nothing contained in this Agreement or any other agreement relating to
the City or its operations limits the application of such insurance coverage.
4. None of the coverages required herein will be in compliance with these
requirements if they include any limiting endorsement of any kind that has not
been first submitted to City and approved of in writing.
5. No liability policy shall contain any provision or definition that would serve to
eliminate so-called "third party action over" claims, including any exclusion for
bodily injury to an employee of the insured or of any contractor or subcontractor.
6. All coverage types and limits required are subject to approval, modification and
additional requirements by the City, as the need arises. Consultant shall not
make any reductions in scope of coverage (e.g. elimination of contractual liability
or reduction of discovery period) that may affect City's protection without City's
prior written consent.

7. Proof of compliance with these insurance requirements, consisting of certificates
of insurance evidencing all of the coverages required and an additional insured
endorsement to Consultant's general liability policy, shall be delivered to City at
or prior to the execution of this Agreement. In the event such proof of any
insurance is not delivered as required, or in the event such insurance is canceled
at any time and no replacement coverage is provided, City has the right, but not
the duty, to obtain any insurance it deems necessary to protect its interests under
this or any other agreement and to pay the premium. Any premium so paid by
City shall be charged to and promptly paid by Consultant or deducted from sums
due Consultant, at City option.
8. Certificate(s) are to reflect that the insurer will provide 30 days notice to City of
any cancellation of coverage. Consultant agrees to require its insurer to modify
such certificates to delete any exculpatory wording stating that failure of the
insurer to mail written notice of cancellation imposes no obligation, or that any
party will "endeavor" (as opposed to being required) to comply with the
requirements of the certificate.
9. It is acknowledged by the parties of this agreement that all insurance coverage
required to be provided by Consultant or any subcontractor, is intended to apply
first and on a primary, noncontributing basis in relation to any other insurance or
self insurance available to City.
10.Consultant agrees to ensure that subcontractors, and any other party involved
with the project who is brought onto or involved in the project by Consultant,
provide the same minimum insurance coverage required of Consultant.
Consultant agrees to monitor and review all such coverage and assumes all
responsibility for ensuring that such coverage is provided in conformity with the
requirements of this section. Consultant agrees that upon request, all
agreements with subcontractors and others engaged in the project will be
submitted to City for review.
11 .Consultant agrees not to self-insure or to use any self-insured retentions or
deductibles on any portion of the insurance required herein and further agrees
that it will not allow any contractor, subcontractor, Architect, Engineer or other
entity or person in any way involved in the performance of work on the project
contemplated by this agreement to self-insure its obligations to City. If
Consultant's existing coverage includes a deductible or self-insured retention, the
deductible or self-insured retention must be declared to the City. At that time the
City shall review options with the Consultant, which may include reduction or
elimination of the deductible or self-insured retention, substitution of other
coverage, or other solutions.
12.The City reserves the right at any time during the term of the contract to change
the amounts and types of insurance required by giving the Consultant ninety (90)
days advance written notice of such change. If such change results in substantial
additional cost to the Consultant, the City will negotiate additional compensation
proportional to the increased benefit to City.

13.For purposes of applying insurance coverage only, this Agreement will be
deemed to have been executed immediately upon any party hereto taking any
steps that can be deemed to be in furtherance of or towards performance of this
Agreement.
14.Consultant acknowledges and agrees that any actual or alleged failure on the
part of City to inform Consultant of non-compliance with any insurance
requirement in no way imposes any additional obligations on City nor does it
waive any rights hereunder in this or any other regard.
15.Consultant will renew the required coverage annually as long as City, or its
employees or agents face an exposure from operations of any type pursuant to
this agreement. This obligation applies whether or not the agreement is canceled
or terminated for any reason. Termination of this obligation is not effective until
City executes a written statement to that effect.
16.Consultant shall provide proof that policies of insurance required herein expiring
during the term of this Agreement have been renewed or replaced with other
policies providing at least the same coverage. Proof that such coverage has
been ordered shall be submitted prior to expiration. A coverage binder or letter
from Consultant's insurance agent to this effect is acceptable. A certificate of
insurance and/or additional insured endorsement as required in these
specifications applicable to the renewing or new coverage must be provided to
City within five days of the expiration of the coverages.
17.The provisions of any workers' compensation or similar act will not limit the
obligations of Consultant under this agreement. Consultant expressly agrees not
to use any statutory immunity defenses under such laws with respect to City, its
employees, officials and agents.
18. Requirements of specific coverage features or limits contained in this section are
not intended as limitations on coverage, limits or other requirements nor as a
waiver of any coverage normally provided by any given policy. Specific reference
to a given coverage feature is for purposes of clarification only as it pertains to a
given issue, and is not intended by any party or insured to be limiting or all-
inclusive.
19.These insurance requirements are intended to be separate and distinct from any
other provision in this agreement and are intended by the parties here to be
interpreted as such.
20.The requirements in this Section supersede all other sections and provisions of
this Agreement to the extent that any other section or provision conflicts with or
impairs the provisions of this Section.
21.Consultant agrees to be responsible for ensuring that no contract used by any
party involved in any way with the project reserves the right to charge City or

Consultant for the cost of additional insurance coverage required by this
agreement. Any such provisions are to be deleted with reference to City. It is not
the intent of City to reimburse any third party for the cost of complying with these
requirements. There shall be no recourse against City for payment of premiums
or other amounts with respect thereto.
Consultant agrees to provide immediate notice to City of any claim or loss against
Consultant arising out of the work performed under this agreement. City assumes no
obligation or liability by such notice, but has the right (but not the duty) to monitor the
handling of any such claim or claims if they are likely to involve City.

Section 2 — Scope and Approach
Scope of Services
The following Scope of Service has been prepared pursuant to the information obtained in the City's RFP,our project understanding,
expertise on similar projects and previous work performed within the City.
Task 1.0 Review and Update the Sewer System Management Plan (SSMP)
Task 1.1 — Review Existing Documents
Kimley-Hom will review available data and documents from the City and County of Los Angeles,including but not limited to,the City
of Rosemead Draft SSMP,the Los Angeles County Sanitary Sewer District standards,and existing City of Rosemead and County of
Los Angeles sanitary sewer modeling information.
Task 1.2 — Update SSMP
Kimley-Hom will update and finalize the draft SSMP based upon the findings from Task 1.1.Kimley-Horn will provide the City with
the revised SSMP for the City's approval.This task assumes one round of City review comments.
Task 1.3 — Submittal to the California State Water Resources Control Board(SWRCB)
After the City has reviewed and approved the updated SSMP,from Task 1.2,Kimley-Horn will coordinate with the SWRCB and
submit a finalized SSMP for approval.
Task 2.0 Update Info Sewer Model
Task 2.1 — Existing Sanitary Sewer Flow Monitoring
Kimley-Hom will coordinate with the City to determine locations where sanitary sewer monitoring will be conducted.It is anticipated
that a total of ten(10)locations will be required.These locations include critical locations along the City's backbone system as well
as locations near recently completed development.Kimley-Horn will then work with Utility Systems,Science and Software,Inc.to
perform flow monitoring at the agreed upon locations.It is assumed that the City will assist in any encroachment permitting and no
fees will be required by the Kimley-Horn project team.
Task 2.2 — Sanitary Sewer Discharge Analysis
Kimley-Hom will review the data collected within Task 2.1,calibrate it and develop new sanitary sewer demands.The results of the
data and developed demands will be provided to the City for review.
Task 2.3 — Update Existing Model with New Discharge Rates
Kimley-Hom will compare the results of the sanitary sewer discharge rates,from Task 2.2,with the predicated flows generated
from the existing City sewer model,which utilized the Los Angeles County design standard criteria.Kimley-Horn anticipates that the
sanitary sewer model will need to be updated with the new demand factors from Task 2.2 due to water conservation measures that
have occurred over the years.
Task 3.0 Develop Optimized Sewer System Network
Task 3.1 —Model Future Growth Scenario
Kimley-Hom will use the City's provided buildout information,within the City's 2010 General Plan and the Garvey Avenue Specific
Plan(GASP)to model the City's future growth scenarios.Kimley-Horn anticipates that there may be a need to account for phased
development of the City's projected buildout and therefore has accounted for up to four(4)buildout scenarios as a part of this task.

Task 3.2 - Identify and Evaluate Sewer Constraints
Kimley-Horn will analyze the modeled growth scenarios from Task 3.1 to identify potential sewer constraints that may adversely
affect the City's sewer system.These constraints will then be evaluated to determine appropriate and feasible solutions that meet
the City's future growth needs.
Task 3.3 — Develop Optimized Sewer System Network
Kimley-Horn will develop an optimized sewer system model which incorporates the buildout scenarios modeled in Task 3.1 and
outcome of the Task 3.2 analysis.
Task 3.4 —Technical Report/Memorandum
Kimley-Horn will provide the City with a technical report/memorandum that includes project background,methodology,analysis,
findings and recommendations,modeling outputs and system maps.
Task 4.0 Establish Sewer Development Impact Fee (DIF)
Task 4.1 - Opinion of Probable Cost
Kimley-Horn will prepare an opinion of probable cost based on the optimized sewer system network and report from Tasks 3.3 and
3.4.This estimate will be reviewed with the City and approved prior to the start of Task 4.2.
Task 4.2 — Nexus Analysis and Establish Recommended Sewer DIF
Willdan Financial will prepare a sewer nexus study identifying the determination of facility standards and the allocation of cost
burden amongst applicable land uses.The analysis will allocate the cost of sewer facilities to the future development based upon
the defined benefit nexus.Willdan will provide comprehensive documentation of the development assumptions,methodologies,and
results,including findings required by AB 1600 and/or the Mitigation Fee Act.
Task 5.0 Project Management, Coordination and Meetings
Task 5.1 - Project Management, Coordination and Meetings
Jon Wakenhut will serve as the Project Manager responsible for supervision of the Kimley-horn Team.He will undertake consultation
and coordination of the project.As appropriate,Kimley-Horn will coordinate with the City,County and State regarding the SSMP,
modeling efforts and the sewer development impact fee.
Kimley-horn also anticipates several meeting with City staff and agencies.These meetings include a"kick-off meeting"and
deliverable submittal/review meetings.This task assumes that a total of four(4)meeting will be needed.Should the City determine
that additional meetings beyond the anticipated four(4)meetings are required,such services can be provided under a separate
authorization on a time and materials basis.

Rosemead Supplemental Sewer System Management Plan
Kimley-Horn developed a comprehensive SSMP and Master Plan Update for the City of Rosemead.The City owns its wastewater
collection system; however,operation and maintenance of the system is provided by Los Angeles County Sanitation District(LACSD)
as part of the Consolidated Sewer Maintenance District(CSMD).This intertwined relationship between owner(City)and operator
(CSMD)required a collaborative effort to GWDR compliance,in which certain elements of the SSMP are the responsibility of the City
and others fall to CSMD.
To address this unique relationship,Kimley-Horn developed the City's SSMP in the form of a"supplemental"SSMP to CSMD's.This
approach ensured the most cost effective approach by maximizing the use of CSMD's SSMP development efforts,while developing
for the City from scratch only those portions that were specifically the City's responsibility.A unique approach utilized during this
project is the development of a Memorandum of Understanding(MOU)between the City and CSMD for mutual signature,which
serves as a vehicle for the two parties to define their relationship with respect to GWDRs compliance and set expectations for both
parties now and into the future.Kimley-Horn worked closely with state board representatives that manage the GWDR-SSO program
to present and receive positive feedback of our approach prior to commencement of work.
To meet the SECAP provision of the SSMP,Kimley-Horn reviewed and analyzed existing master plans,mapping,rainfall and flow
data to verify regulatory compliance.Kimley-Horn updated to the City's SECAP plan and schedule with trigger points for completing
additional capacity related projects.This approach ensured development of the initial SECAP section of the SSMP met the GWDR
compliance deadline,while also providing the timeline for subsequent analysis within the City's available budget.Kimley-Horn is
developing a comprehensive dynamic flow model(InfoWorks-Sewer,1500 pipes)that will be used to update the City's Wastewater
Mater Plan to meet their current and General Plan build-out conditions.Kimley-Horn is setting up the model so that it can be used
by City staff as a tool for ongoing SSMP-SECAP compliance.

The Sacramento Railyards development is a 238-acre infill project situated on the old Union Pacific Railyards in downtown
Sacramento.This project will double the size of downtown Sacramento and turn the area into an urban mecca of mixed-use,
residential,commercial,retail,and other uses.Kimley-Horn is responsible for the project management and coordination of all
planning and design elements related to this complex project.
As part of the redevelopment of the site,Kimley-Horn was responsible for the planning and design of the sanitary sewer mains
that range from 6 to 36 inches,water mains that range from 6 to 12 inches,storm drain mains that range from 18 to 72 inches,
roadways,and associated grading and stormwater quality improvements.

Sanitary Sewer and Water Distribution System Assessment Group Jobs, San Diego
Kimley-Horn provided preliminary engineering and design services for the analysis and replacement of sewer and water lines
located throughout the City of San Diego due to maintenance issues,accessibility,and the age of the facilities.The total length of
sewer designated for replacement was 14.9 miles and the total length of water designated for replacement was 3 miles.The initial
planning studies involved analysis of the existing system by CCTV and included a hydraulic analysis of the sewers.
Kimley-Horn prepared final design plans,specifications and cost estimates for the sewer and water line replacements after approval
of the planning studies.Kimley-Horn also prepared designs and legal documents for retrofitting existing homes with new on-site
sewer lines to eliminate non-standard conditions.

Monte, La Puente, Baldwin Park, Maywood, Beverly Hills, and Pico Rivera. We will use our considerable
experience and knowledge to review and update the City's Sanitary Sewer Master Plan (SSMP) and provide a
Sewer Management Plan (SMP) that will be a well-honed tool for the City of Rosemead to use for years to
come. As our name implies, infrastructure engineering for cities is all we do, so we understand your needs and
concerns when it comes to maintaining a working system and preparing and scheduling a capital improvement
program.
A major component of comprehensive study activities that we will conduct will involve updating the City's
existing InfoSewer model. Our subconsultant, Charles Marr Consulting, will provide the model updates and
conduct modeling runs to optimize the sewer system network to meet buildout plans in agreement with the
General Plan (GP) and Garvey Avenue Specific Plan (GASP).
Finally, Infrastructure Engineers will analyze the buildout scenarios of the GP and GASP to provide our findings
on the cost-to-benefit ratio to determine the need for sewer development impact fees in accordance with
AB 1600 requirements.
Our Project Manager, Ken Putnam, PE, has managed, overseen, and authored all the master plans and related
studies that we have produced (well over a dozen at last count). His expertise comes from working with water

' The City of Rosemead serves a population of approximately 54,000 people. The City's Public Works
Department manages the City's sanitary sewer collection system, which consists of about 78.99 miles of
gravity sewer lines, 1,725 manholes, and two pump stations. The City prepares a CIP budget every year,
which forecasts the necessary expenditures required for rehabilitation or replacement of the sewer system
facilities. Infrastructure Engineers performed the tasks to provide recertification of the SSMP to meet Waste
Discharge Requirements (SWRCB Order 2006-003, WQ-2013-0058 EXEC). We found there were no sewer
' capacity issues and no major structural or maintenance deficiencies detected during the audit period. The
City/SMD SSMP had been very effective in keeping the number and total volume of SSOs in the City
consistently low during the previous two years. The existing SSMP, with associated programs, based on all
' categories of performance indicators seemed to have significantly enhanced the City's sewer collection
system management and operations.

The City of Montebello serves a population of approximately 63,400 people in 2013, per US Census Bureau.
The City's Public Works Department manages the City's sanitary sewer collection system, which consists of
89.4 miles of gravity sewer lines and a total of 1,898 manholes. No pump station is equipped with these
conveyance lines. The sewer mains range in size from 6 to 18 inches in diameter, with most of the pipes
being vitrified clay sewer pipes. Most of the City was developed during 1950 to 1975 and, as a result, most of

The City of Baldwin Park serves a population of approximately 81,000 people. The City's Public Works
Department manages the sanitary sewer collection system.The collection system consists of about 104 miles
of gravity sewer lines and three pump stations. Of these, only 17%were built in the early to late 1960s. The
remaining 83%were built much later. The existing sewer pipes, range from 8 to 12 inches in diameter and
are predominantly vitrified clay pipe material. The City's sewer collection systems are within the
Consolidated Sewer Maintenance District (CSMD) of the Los Angeles County Sewer Maintenance Districts
(SMD), and the City participates in the District's Accumulative Capital Outlay Program. As a result, the City
also benefits from the District's Sewer Condition Assessment Program. The City's first SSMP was prepared in
July 2009, and Infrastructure Engineers completed the recertification in 2014.

The City of South El Monte's sewer collection system serves its population of approximately 20,000, as of
2011 US census. The sewers discharge to a network of trunk sewers owned and operated by the Los Angeles
County Sanitation Districts (LACSD). The City was developed during the 1950s and, as a result, most of the
City's sewer system is more than 50 years old, with the majority of pipe diameters ranging from 6 inches to
12 inches. There are approximately 38 miles of mostly vitrified clay sewer pipes.The City is within the CSMD,
and therefore depends totally on the CSMD for the operation and maintenance of its collection sewer
system. The CSMD is responsible for conducting structural deficiencies under the ACO program, but the City

The City of Bell Garden's SSMP was developed and approved by City Council in July 2009, and Infrastructure
Engineers performed an update in 2014.The City owns 44.4 miles (234,226 feet) of generally 8-inch diameter
vitrified clay pipe sanitary sewers in its public streets, alleys, and rights-of-way. The sewers carry the sewage
(wastewater),via a lateral to each parcel of property, to larger trunk sewers owned and operated by the
County Sanitation Districts(CSD) of Los Angeles County.
The City of Bell Gardens is a part of the CSMD and currently contracts with Los Angeles County Department
of Public Works for their sanitary sewer cleaning and industrial waste enforcement. Additionally, as a part of
the CSMD, the City is included in the County's Accumulative Capital Outlay Program (ACO Program).The ACO
program identifies, rehabilitates, and reconstructs sewer pipes within the CSMD that have structural
deficiencies. However, the City is still responsible for implementing recommendations identified with the
SSMP that are not covered by CSMD.

main spot repairs and two phases of sewer main replacement. Current CCTV report for the City's sewer lines
was reviewed to identify sewer lines deficiencies and repairs needed. The project was constructed in
accordance with the City of Manhattan Beach requirements.
` Project Manager, City of Montebello—Sewer Main Reconstruction and Upgrade. Ken was the project
manager responsible for the preparation of plans, specifications and cost estimates for the City's Sewer Main
Reconstruction and Upgrade project. Project was for sewer main upgrade and connection to the existing
City's sewer system. The project located in the intersection of Whittier Boulevard and Montebello Boulevard
in the City of Montebello. The design was completed on time and within budget.
Quality Control and Constructability Review, City of La Puente—5 Year Sewer Improvement Plan. Ken
provided quality control and constructability review for a 5-year sewer improvement plan. The project
reviewed the City's aging sewer system, made recommendations for replacement and expansion and
provided plans, specifications, and cost estimates to replace and/or repair 30%of the system over a 5-year
period.
Design Engineer, City of Bell Gardens—Water Main Improvement/Replacement. Ken served as the design
engineer for the replacement and/or improvements to water mains throughout the City of Bell Gardens.
Between 2006 and 20010 Ken provided plans, specifications, and construction estimates for over 12,790 feet
of water main improvements totaling over$2,880,000.

Charles Marr Consulting - Sanitary Sewer Models
I Charles Marr Consulting will be providing the sanitary sewer modeling using the InfoSewer software package
by Innovyze. Charlie Marr has decades of hands-on experience in modeling of sewer systems. He has
specifically used InfoSewer on numerous recent projects. Some of his recent experience includes sewer
master planning for large development projects and municipal sewer master planning for all or portions of
the cities of Lancaster, La Palma, and Victorville. His experience includes sewer system management planning
and sewer systems analysis for college and university campuses of the California State University and Los
Angeles Community Colleges District. Charles Marr Consulting has been in business since 2014 and has used
the experience of 25 years with a reputable western region consulting firm to excel in the water resources
and wastewater collection fields. Charlie will be the lead engineer on the modeling task and he will be
working closely with Infrastructure Engineers' Project Manager, Ken Putnam, to ensure the project stays on
schedule and is of the highest quality.
Project Deliverables
In addition to all modeling results, Infrastructure Engineers will provide the City with an audited and certified

We will also update the Sewer Master Plan (SMP) based on the new General Plan and Garvey Avenue Specific
Plan land uses; this will be used to develop the sanitary sewer CIP. We will provide our recommendations on
the path forward for Development Impact Fees, if they are deemed necessary.
Project Approach
f Project Understanding
■ The City of Rosemead is a highly urbanized community. Yet the City has kept its eye on continued
revitalization and redevelopment of property and infrastructure for the health and well-being of its residents,
employers, and visitors alike.
The City is continuing its focus on maintaining its infrastructure by updating the Sanitary Sewer Master Plan
(SSMP) based on the new General Plan and the Garvey Avenue Specific Plan. Infrastructure Engineers will
help the City meet this goal by using our expertise in sewer master plans and our 20-plus years of
infrastructure engineering to provide a comprehensive plan and CIP recommendations for any necessary
maintenance and repair. We will further use the findings to prepare a Development Impact Fee Report to be
used by the City Council for processing and establishing the Sewer Impact Fee.
L The main objective of this updated sewer master plan will be to provide current and projected wastewater
flows to accurately reflect current wastewater system capacity, both total and utilized, available capacity for
future development or redevelopment, document the physical condition of the sewers based on available
information in the 2014 SSMP, provide the City with wastewater system improvement criteria, and identify
future improvements, including a comprehensive and prioritized CIP. Infrastructure Engineers understands
these objectives and, if requested, will present an annual assessment that will be adequate for carrying out
all needed programs of rehabilitation, lining, or replacement of overloaded or undersized sewer lines. In
addition, we will help the City explore funding for these projects by conducting a sewer rate study.

The SSMP update for the City of Rosemead will follow the California State Water Resources Control Board's A
Guide for Developing and Updating of Sewer System Management Plans(SSMPs), September 2015.
In addition,we are thoroughly versed in the waste discharge requirement(WDR) permit of May 2, 2006, and
Attachment A to the Order that became effective on September 9, 2013.This permit, among other things,
requires local public sewer collection system agencies to develop a SSMP, but it also prompts cities to
consider maintenance and repair of this significant infrastructure when developing their CIP programs.
Work Plan
Infrastructure Engineers' approach to updating the SSMP has been proven through the execution of the
many plans noted in our cover letter and previous sections. However,we also understand that the City of
Rosemead is unique,with different concerns, systems, and demands.This is our focus, and we will be mindful
of your distinct interests every step of the way.
Task A - Review & Update the Sewer System Management Plan (SSMP)
Project Planning
Project planning will be our first step. Comprehensive project planning, ongoing project management,and
communicating with you every step of the way are as important to us they are to you.These steps will
provide the backbone to the master plan preparation.
' Kick-off Meeting
Our Project Manager will meet with the City's staff within 1 week after the City's notice to proceed to initiate
the sewer comprehensive study. We will prepare an agenda for the meeting,the purpose of which will be to
establish clear lines of communication, introduce the team, review and refine the proposed project scope
and schedule, if needed,establish general study guidelines, discuss project parameters and constraints, and
available background data. Our goals for the kick-off meeting will be to:
• Update our understanding of the City's sewer system and its operations
• Discuss existing GIS data,the existing sewer master plan, the existing database structure, and any
pending acquisition of a GIS system for the sewer system
• Identify sewer maps, including any new sewer construction since the preparation of the existing master
plan

• Review the existing General Plan and identify the latest zoning maps,general plan, redevelopment plans,
land use maps, and their updates
• Discuss the sewer maintenance program and list of problem areas
• Identify all pertinent studies and reports prepared for the City sewer system
• Obtain and review all documents noted in the City's request for proposals, and identified in the
preceding bulleted items,well as other documents that may be pertinent for the master planning
process
• Obtain a copy of the existing InfoSewer model and all backup documents used
tFollowing the meeting,we will provide meeting minutes,which will include action items and next steps.
Review of System Records, In formation, and Data
tAfter collection of the available records,our engineers will review them to gain a comprehensive
understanding of the City's sewer system, its history, problems and issues, and deficiencies. As part of this
process, the maintenance logs will be reviewed to acknowledge the location of problem areas.All
recommendations made with studies and reports related to the system will be investigated to determine if

they have been implemented.Water consumption and sewer flow monitoring records will be reviewed for
relevant data that can be used to validate the sewer model.
Field Visit and Meet with Operations and Maintenance Staff
f
With prior approval from the City Project Manager, Infrastructure Engineers staff will meet with operations
and maintenance (O&M) staff and visit sewer facility sites such as lift stations,flow monitors, large sewer
generators, and odor locations. It is vitally important that City sewer system maintenance crews accompany
us on all site visits.The untold and unrecorded history of the system has sometimes been carried by the
maintenance people for years.We find that having them share their knowledge and experiences through the
years of working on the system, along with their vision and ideas, is a valuable asset during the development
of the master plan.
As part of the State Water Board's A Guide for Developing and Updating of Sewer System Management Plans
(SSMPs), the City is recommended to initiate an internal audit of the 2014 SSMP. Since Infrastructure
Engineers provided the 2014 plan, we will review it to determine which sections, if any, of the SSMP need to
be updated and we will include any additional information, as necessary.
• We will guide the process of recertification of the City's SSMP by the City Council.
j • We will enter the updated data to the State Board's Online Database and mail the forms to the State
Board.
' Task B - Update the Existing InfoSewer Model
A hydraulic model will be developed for the City's wastewater collection and conveyance system using
InfoSewer software by Innovyz.The hydraulic model can assess the capacity of the wastewater collection
system by simulating and identifying hydraulic restrictions within the system (surcharging pipes and
overflowing manholes) under specified flow conditions. In addition to the existing physical pipe network,the
model network can also include planned capital projects currently under construction or expected to be
constructed as part of future redevelopment.
This task will include refining the City's existing model to accurately represent the main sewer collection
system pipelines in each sewershed of the City's system.We will develop the calibrated model of the existing
collection system and evaluate its performance under existing conditions.The computer model loadings will
be based on the generation factors determined from the flow monitoring data for existing conditions, and
based on reviews of current planning criteria, planned loadings, and predicted system configuration for
future conditions.
The City's 2014 SSMP may have excellent information that can be used to determine a flow monitoring
approach. We will discuss the best locations for sewer flow monitoring with O&M and management staff in
order to(1)develop unit flow factors associated with the different classifications of water customers, i.e.,
single-family residential, multi-family residential, commercial, office, industrial, etc.; (2) develop diurnal flow
patterns associated with the different customer classes; and (3) confirm outlet capacities of downstream
sewers that will provide valuable information with regard to rainfall inflow and infiltration. Existing sanitary
sewer drainage data from previous studies will be used to the extent possible. Further refinement will be
performed, based on any added wastewater systems that have been constructed,or development that may
have changed flow patterns.
Once the boundary conditions are established, we will test the computer model for accuracy and determine
best methods for improving its accuracy.This validation process is paramount for understanding existing
system capacity as well as simulating future estimated flows.

' The City's General Plan will be used for updating the SSMP. We will review the various land-use categories,

including residential, commercial, industrial, and other land uses. Future sewer flows will be estimated and
loaded into the model using forecasted development or redevelopment projects.The General Plan's planned
land use zoning and conceptual building densities and uses will be analyzed to determine ultimate sewer
flows and flow patterns that could impact system capacity. We will examine past development trends to help
1 understand future sewer loadings, which could help forecast the sewer flows throughout the City's system.
The average daily and peak flows will be determined for each type of user based upon historical water
consumption data records for similar uses in the area. Flow patterns, i.e., diurnal variations, must be
determined using the flow monitoring data, or adopting standard diurnal patterns considered applicable to
any municipality within southern California.
` Dry Weather Model Calibration
Dry weather monitoring data will be used to develop base flow quantities and diurnal curves representing
the average daily flow for each sub-basin or monitoring point.Once the computer model is updated to
represent the City's current wastewater collection system and the quantity of theoretical base flow is
determined, it will be possible to assign the diurnal curve shapes to the theoretical base flow quantities at
each flow input location.The computer model routes the wastewater flow downstream,combining
hydrographs at sub-basin intersection points. At the intersection points that have monitoring data, it will be
possible to make any adjustments necessary to further calibrate the model.The main purpose for developing
a calibrated dry weather model is to establish a calibrated base flow hydrograph that can be used as a
component of the wet weather and design storm models.
Design Storm Development
' We will consider the impact of a 5-year, 60-minute rainfall event on the sanitary sewer system, should the
City not have any specific standard preference.The 5-year, 60-minute event will be based on Technical Paper
No.40, Rainfall Frequency Atlas of the United States.The event will be applied to the model based on
parameters determined during the observed wet weather calibration.The resulting hydrographs in the
sanitary sewer system will be comprised of the calibrated base flow component and a design storm
generated wet weather component.
Task C — Develop Optimized Sewer System Network
Modeling will provide a snapshot of the ability of the collection system to convey existing and future flows.
The design storm will be applied to the calibrated basin model for existing and future conditions.The model
results will be summarized in tables for pipes(peak flow,velocity and depth ratio),while nodes(manholes),
as loading points for the model,will be summarized in tables for invert elevation and surcharge depth.
Should the City desire, as an optional item,we can link the model results tables to the City's GIS data to
produce characterization maps.
1 The additional sewage collected from neighborhood areas will be accounted for during the hydraulic
modeling of the system.The standard used by many public sewer systems owners and operators is that for
average flow,the level of wastewater should not exceed 0.5D, and for maximum flows 0.75D should not be
exceeded.This standard will be used, if approved by the City. In our experience,this is a good rule for
proposed systems. Existing and larger sewers could be safely allowed to flow higher, as long as the sewer is
not problematic.
Design Storm Hydraulic Analysis
The behavior of a wastewater collection system during storm events and the impact of extraneous water
known as infiltration and inflow(I/I) during storm events on the wastewater collection system must be well
understood to be able to predict wet-weather overflows. Wastewater collection systems subject to I/I

behave similarly to a modified storm sewer system. Collection system defects allow inflow(surface runoff)
and infiltration (groundwater) to enter the collection system.The behavior of a collection system can be
illustrated by a hydrograph, which has historically been an excellent means to graphically display flow data
from a wastewater collection system.
Design Storm Modeling—Existing Conditions.The existing conditions of the system will be modeled and
evaluated using the design storm approximation(s) determined previously. Surcharged, overflowing and
overloaded segments will be identified as potentially vulnerable during storm events.
Design Storm Modeling—Proposed Conditions.This task involves modeling the system based on various
types of improvements such as (1) percent reduction due to rehabilitation, (2) paralleling or replacing lines,
and (3) providing overflow facilities.We will identify system improvements that are cost effective and that
bring the City maximum efficiency.
Design Storm Modeling—Future Conditions. The model showing recommended improvements will be
modified to reflect the anticipated development and flows will be identified for the year 2035, based on
census projections.Any additional improvements to accommodate future flows will be identified.
System Alternative Analysis
A system capacity/deficiency analysis will be conducted, using the calibrated hydraulic model.This will be
done to simulate the system's response to dry and wet-weather flow conditions. Once completed and the
results analyzed,the surcharging pipes and overflowing manholes will be identified. We will also identify and
categorize all locations of major hydraulic restrictions.
Once the existing deficiencies have been identified,the team will develop recommended relief/replacement
facilities to alleviate the identified deficiencies for both short-term and long-term, specifically determining
the effect of potential solutions.The hydraulic model will be extensively used to optimize the rehabilitation
plan. Should it apply, various dry-and wet-weather scenarios will be simulated to establish the current and
future levels of protection necessary to achieve long-term regulatory compliance with respect to sanitary
sewer overflows. Since televising or analyzing the sanitary sewer system in not a part of this project,we
assume the City will identify all sections of the sanitary sewer system that are structurally deficient and,
therefore, need repair or replacement. Since the hydraulic models can be linked to a defect database,various
repair strategies and costs can be easily evaluated as an optional task.The least-cost alternative and
implementation plan will be developed.
Task D — Establish Sewer Development Impact Fee
One goal of a SSMP is to review findings with the intent of developing a CIP by outlining the most feasible
sanitary sewer system improvements and repairs that will allow the City to achieve its goals for growth and
economic development through the next 20 years. Meeting this objective depends heavily on the effective
1 use of hydraulic modeling in conjunction with sound engineering judgment to evaluate necessary system
improvements.
A multi-year CIP will be developed based upon the results of the hydraulic analyses, staff interviews, and field
reviews.We will prioritize the projects based on the rating parameters established,and then formulate an
initial phasing of the improvements. Many factors affect this decision, including the funds available,the
capacity to undertake concurrent construction projects, impact on the community, and the severity of need.
We will review our findings with the City to further refine the prioritization and phasing strategies.
The CIP will be submitted to the City for review and comments. It will be refined and form the basis of the
final SSMP.

Infrastructure Engineers' many years of experience in the design of sewer rehabilitation and new
construction will allow us to recommend the most cost-effective solutions to solve sewer system deficiencies.
We will develop cost estimates for implementing the CIP, as well as critical ranking of recommendations.
The cost of upgrades, improvements, repairs, and maintenance of the sanitary sewer system can be
subsidized by establishing a sewer development impact fee for all future development in the City.The
foundation of the sewer development impact fee is a sewer study that examines the sewer system and,
based on the projected needs for replacement, upsizing, repairs and maintenance,comes up with the cost
estimate that can be funded over a span of years. Infrastructure Engineers,will prepare the needed sewer
development impact fee study for the City.
Task E — Sewer Master Plan Report
The final SMP report will consist of an executive summary, as well as a summary of all activities undertaken
1 during the course of the project.
The SMP report will be based on desktop assessments of the hydraulics, physical condition, and maintenance
of the collection system through data provided by the City.The plan will outline recommendations and
I improvements to provide adequate hydraulic capacity and improve the reliability of the collection system.
The financial impacts of the recommendations will also be evaluated. If the City should desire, Infrastructure
Engineers can arrange for a CCTV investigation for a physical condition assessment.
The results, conclusions, and recommendations will be presented in a narrative and graphical format.
Additionally,our team will adhere to the following special provision in performing the tasks specified herein.
The maintenance log of any problem areas(hot points) provided by the City will be used to identify areas
where sewer backups often occur as well as where extraordinary maintenance is needed.The report will
identify the improvement of such locations, including cost of implementation.
' A major function of the report will be the determination of a recommended repair plan and estimated costs.
Each system defect will be prioritized and sorted by repair method.
