CC - Minutes - 09-13-16MINUTES OF THE CITY COUNCIL AND THE SUCCESSOR AGENCY TO THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION REGULAR JOINT MEETING SEPTEMBER 13, 2016 Workshop The meeting of the Rosemead City Council was called to order by Mayor Armenta at 6:01 p.m. in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PRESENT: Mayor Armenta, Council Members Alarcon, Clark, and Ly ABSENT: Mayor Pro Tem Low STAFF PRESENT: City Manager Manis, City Attorney Richman, Assistant City Manager McKinney, Director of Finance Chu, Director of Parks and Recreation Chacon, Acting Director of Public Works Fajardo, Director of Community Development Ramirez, Special Projects Manager Cannon, and City Clerk Donohue WORKSHOP A. Public Safety (Community Service Officers & Public Safety Officers) Assistant City Manager McKinney stated Public Safety staff would be presenting an overview of the Public Safety Division procedures and practices to address any questions and concerns. The workshop provided up -to date information on the Public Safety's vision and roles of CEO, CSO, and Parking Control Officers. The recent change in supervision of the Public Safety Center has been relocated to the City Manager's Office to assure supervision by City employees who follow the same administrative policies and evaluation procedures. Mr. McKinney added this would allow. the City Manager's office to facilitate community issues and operation procedures with the division. Public Safety Supervisor Reyes presented a power point presentation reviewing the primary function of the CEO, CSO, and PCO. Mayor Armenta asked if Public Safety Supervisor Reyes is a Code Enforcement Officer in addition to Public Safety Supervisor. Public Safety Supervisor Reyes answered in the affirmative. Mayor Armenta asked who enforces the law when a CSO or CEO violates the law, such as running a stop sign or red light. She noted she has received complaints about CSOs running a stop sign. She suggested the City Council have a no tolerance policy of employees Joint Meeting of the Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Minutes of September 13, 2016 Page 1 of 17 running a stop sign and they should also be held to a higher standard and address the issue immediately if a CSO runs a stop sign. Public Safety Supervisor Reyes stated any city employee would be subject to the same laws as everyone else. If an employee is running a stop sign or red light, it would be enforceable by a police officer. If the violation is a misdemeanor, it would have to be observed by a police officer. Mayor Armenta stated she has received calls from residents on animal control issues. She asked if a CSO could handle animal control calls and why they are taking two to four hours to respond to pick up a carcass or a loose dog. Public Safety Supervisor Reyes explained all calls received are prioritized based on urgency. He stated animal calls are important because alive or loose animal is considered a threat to the community because they can injure or kill and dead animals are considered less urgent calls. Mayor Armenta asked if Public Safety Supervisor Reyes was aware of a resident who captured a loose dog after waiting a long time for officers to respond to his call. Public Safety Supervisor Reyes stated he was not aware of the situation. He noted people do take in dogs to the Public Safety Center. He stated residents are welcome to call him personally to address any response issues or complaints. Council Member Ly asked if there was a dedicated or on -call CEO who handles certain issues at night. Public Safety Supervisor Reyes stated there is currently no on -call CEO for after hours. He explained there are special night patrol assignments conducted regularly every six to eight weeks. He noted most cases handled by staff are done during the day and a night shift would be scheduled to conduct an investigation on recurring issues, but not on a regular basis. Council Member Ly asked who would handle noise complaints and if noise disturbances fall under the city code or State law. Public Safety Supervisor Reyes stated they would need to call the police. City Attorney Richman stated the City contracts with the Sheriff's Department to enforce the code. Council Member Ly asked since the City employs the Code Enforcement Team, they could also do enforcement. He noted deputies have bigger crimes to handle, it would make sense to have a CEO handle neighborly issues existing in the code. Mayor Armenta shared another concern about a teacher who was issued a citation after the enforcement hours stated on the parking sign. She noted she has received letters from residents complaining CSOs are rude. She questioned how staff is working with residents to mitigate issues without issuing a citation. She explained in other occasions, she has had to bring the issue to staff at the public safety center and she is now bringing these issues to the City Manager's Office. Public Safety Supervisor Reyes stated staff is often considered rude because they are issuing something unpopular. Mr. Reyes noted the parking citation given to the teacher, was issued by an officer who was new and the officer stated to them she could not void the citation herself but it was going to be voided. Mayor Armenta disagreed and stated if staff is issuing a citation regardless, then they are not working with residents to mitigate the issue before issuing a citation. Assistant City Manager McKinney stated there may be occurrences where Public Safety Officers come off as rude when issuing citations and it is unfortunate. He stated staff will strive to improve communication with residents and staff will be held accountable. Mayor Armenta stated her concerns are things which have happened in the past and are recurring issues because they have not been properly addressed. Mayor Armenta inquired on the Public Safety Center hours of 7:00 am to 6:00 p.m. She noted there was an incident where a resident had to contact her to report a CSO never arrived to assist them after waiting for over two hours. She stated she called several times and could not get a hold of anybody and therefore, called the Sergeant. She noted on Fridays and Saturdays, calls should not be going to voicemail and suggested calls be forwarded to staff on their city issued smart phones. Assistant City Manager McKinney stated staff would look into those shifts where resources are limited. Mayor Armenta stated Public Safety Supervisor Reyes is a Code Enforcement Officer in addition to a Public Safety Supervisor. Mayor Armenta stated animal control is not being treated as a top priority if it takes hours for an animal carcass to be removed from the street. She asked if Public Safety Supervisor Reyes was aware the animal bled out in a box and carcasses being left out for a day or two. Public Safety Supervisor Reyes stated he was aware the animal bled out in a box but was unaware of carcasses being left out for a day or two. She asked why the animal wasn't taken immediately to the San Gabriel Valley Humane Society. Public Safety Supervisor Reyes stated if an animal is injured, it is taken to the San Gabriel Valley Humane Society. He noted if the Veterinarian is not available at the Humane Society, the animal is taken to the City's contracted hospital in Pasadena which is open 24 hours a day. Mayor Armenta asked if the animal was taken immediately to the hospital. She asked how long it takes to get the animal to the hospital. Public Safety Supervisor Reyes noted it takes about an hour to transport animals to the hospital. He stated when residents bring in a dog, they need to notify staff of the condition of the animal in order to assess and help them. Mayor Armenta questioned why she keeps getting animal control related calls about staff not being responsive to calls at the Public Safety Center. Public Safety Supervisor Reyes stated he is available to talk to the residents about animal concerns. He noted he has not received calls or complaints about response time and in his presentation there was a slide which shows animal calls are handled quicker. Mayor Armenta noted she has received complaints about Public Safety Supervisor Reyes being inaccessible and not answering his phone. Public Safety Supervisor Reyes stated there is a slide in the PowerPoint presentation which states animal related calls are handled quicker than other calls. Mayor P.rmenta stated she is glad it will be put on record. Mayor Armenta asked if staff has received data from the San Gabriel Humane Society on what they collected after hours. Public Safety Supervisor Reyes noted staff has not reached out to the San Gabriel Humane Society for the data. Mayor Armenta inquired as to why the data has not been requested for the year to year analysis. Assistant City Manager McKinney explained the information on the slide was taken from the City's online request system which shows how many cases are open and closed. If the San Gabriel Humane Society data was to be included, it would outweigh the numbers shown on the current slide. The Humane Society has only one person dedicated to the whole City along with other cities, therefore our response time is shown as much quicker than theirs. Mayor Armenta stated she has obtained data by the San Gabriel Humane Society which says otherwise. The data includes calls on dogs, cats, total lives, date of adoptions, adopted animals, returns etc. Council Member Clark asked if the data from the San Gabriel Humane Society also included response times. Mayor Armenta stated response times were not on the data. She stated she will discuss response times when it comes up in the presentation. Mayor Armenta inquired on the PCO's starting shift during street sweeping. Assistant City Manager McKinney stated the PCO's are the officers who start before 7:00 a.m. and they report to address the street sweeping hours which start on major arterials anywhere from 3:30 a.m, to 4:00 a.m. Council Member Ly asked why only nine out of fourteen CSO positions are filled. Public Safety Supervisor Reyes stated four CSOs have resigned in the last eight weeks. Council Member Ly asked if the positions are in the process of being filled. Assistant City Manager McKinney stated staff is reviewing a list of eligibility and potential candidates. Public Safety Supervisor Reyes noted two individuals have already been offered and accepted the job. He noted they are currently going through the background phase. Council Member Ly inquired about the remaining three CSO positions. Assistant City Manager McKinney stated once a new eligibility list is established, the remaining vacancies will be filled. Mayor Armenta inquired as to how long it takes to replace a CSO position once someone leaves. Public Safety Supervisor Reyes stated staff attempts to hire someone as soon as possible. Council Member Ly inquired if officers spoke other languages and if it is a skill considered Joint Meeting of the Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Minutes of September 13, 2016 Page 5 of 17 when hiring. Public Safety Supervisor Reyes stated all officers speak English and there are a few who speak Spanish. He noted it is a desirable quality to have a second language when recruiting candidates. Council Member Ly asked if the City gets any potential candidates who speak languages other than English and Spanish. Public Safety Supervisor Reyes noted staff recently interviewed an individual who spoke Chinese but the candidate was rejected because he had no desire to pursue law enforcement as a career. Council Member Ly requested copies of the PowerPoint be made available to the City Council before the meeting in the future. He inquired as to why the entire City Council did not receive a copy of the PowerPoint. Assistant City Manager McKinney stated he was unware of the rule and noted copies will be provided in the future. Mayor Armenta asked how shifts are covered if an officer is unable to come to work. Public Safety Supervisor Reyes stated if a shift needs to be covered, usually another officer such as a CEO may stay longer on a shift and handle the calls to assist the public. He also added CSO's supplement deputies as needed to take reports when callers need assistance on no- emergency issues. Mayor Armenta stated it was not the case for the car burglary on Fern Ave. and Del Mar Ave., where an individual waited for hours because there was no one available to assist him. Public Safety Supervisor Reyes noted any Deputy can write a police report a CSO would normally do. He stated there might have been a high call volume at the time. Mayor Armenta asked at what point staff contacts the individual who is waiting for a long period of time. Public Safety Supervisor Reyes stated the CSOs are dispatched from the Temple Station. He noted calls are prioritized in order of urgency. Mayor Armenta inquired as to who pays for the CSOs. Public Safety Supervisor Reyes stated it comes out of the general fund. Joint Meeting of the Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Minutes of September 13, 2016 Page 6 of 17 Mayor Armenta asked why CSOs are not dispatched by the City of Rosemead since the City is their employer. Public Safety Supervisor Reyes stated the City does not have a dispatch center. He noted those types of calls are typically police calls. Mayor Armenia asked what the protocol is when a crime call is made to the Public Safety Center and expressed concerns. She requested staff look into the current practices. Public Safety Supervisor Reyes stated crime calls are reported to the Sheriffs Temple Station and they dispatch the CSO if needed. He noted a log is utilized to show what crime calls the Public Safety Center is responding to which involve non - emergency issues. Council Member Ly asked if the current CSO positions will be affected with the new money being shifted to hire a full time CEO. In addition, how many hours are budgeted for Community Service Officer under the new budget. Public Safety Supervisor Reyes stated at least five shifts would need to be cut in order to hire a full time CEO depending on the budgeted hours available. Mayor Armenta clarified depending on the hours allocated for each CSO to work, some may get more hours; therefore, additional CSO hires may not be needed. Public Safety Supervisor Reyes answered in the affirmative. Mayor Armenia reiterated her concerns about animal control calls not being a top priority. She stated there are residents who are frustrated and therefore call her to report the animal issue. Public Safety Supervisor Reyes stated he has not received any complaints pertaining to animal services. Assistant City Manager McKinney stated there are resources going to other calls and Public Safety will make an effort to make animal calls a top priority. Council Member Alarcon stated he has called the Public Safety Center to report animal issues and they have responded well. Mayor Armenia asked why Public Safety staff is telling residents it's too expensive to trap coyotes. She indicated on social media, residents are posting what is being said by the Public Safety staff on trapping coyotes and people are posting negative comments about the city. She stated residents have spoken to her stating the City cannot do anything and Rosemead was a no kill city. She clarified the city does not have a no kill policy in place and the City Council would need to discuss such a policy. She reiterated on social media, Joint Meeting of the Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Minutes of September 13, 2016 Page 7 of 17 residents post different kinds coyote encounters and their interactions with the Public Safety Center. Public Safety Supervisor Reyes stated capturing a coyote is expensive which is why hazing is recommended. Public Safety staff have conducted coyote workshops and are looking into new ideas to deter coyotes. City Attorney Richman stated other cities will kill the coyotes because they are considered very dangerous. City Manager Manis explained if coyotes are relocated and transferred, since they are a pack animal, they will likely be killed by the new pack of coyotes. Assistance City Manager McKinney confirmed Public Safety staff is working on a plan and for alternative deterrents to address the coyote issue. Mayor Armenta stated the City Council are not just figure heads, they develop policy. Council Member Clark asked staff to look into the legalities on trapping and killing coyotes and what is allowed. Mayor Armenta reiterated her concerns for the lack of presence of Public Safety Officers at the first two concerts in the park and the Easter egg hunt. She addressed communication issues within the Public Safety department. Assistant City Manager McKinney stated the City Manager's Office is now overseeing the department and communications between the Public Safety Department and Sheriff Officers. Brian Lewin, resident, expressed concerns with the city's CRM practice when staff responds and emails updates, to not close the CRM request until the issue is completely resolved. He also requested, all CRM request include the officer's name to know who is the contact person for a specific issue. Mr. Lewin suggested in light of the animal control issues, the City consider making the dedicated part-time animal control officer to a full- time position. LaDou Lewin, resident, stated dog owners at Rosemead Park let their dogs loose and only one citation was issued in the park and requested staff patrol the parks frequently. Council Member Ly stated based on Mrs. Lewin's comments on pets, a pet park was needed in the City. Ms. Lewin was also concerned with after hour animal control calls. She noted she called the Public Safety Center and the San Gabriel Humane Society to report a dog on the loose Joint Meeting of the Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Minutes of September 13, 2016 Page 8 of 17 but was not able to reach anyone. Mayor Armenta stated residents call, mail her letters, and email her concerns about issues in the City, which is why she brings these issues to staff. She wanted to make it clear, if she did not receive these complaints, she would not have any issues. Mayor Armenta concluded the workshop meeting at 7:09 p.m. Regular Meeting The regular joint meeting of the Rosemead City Council and Successor Agency to the Community Development Commission was called to order by Mayor Armenta at 7:14 p.m. in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PUBLIC COMMENTS FROM THE AUDIENCE Ron Esquivel commended staff for being proactive in removing graffiti at a Rosemead school in a timely manner. 3. PRESENTATIONS Mayor Armenta requested to the City Council for a motion to add an agenda item in proclaiming September 23 rd as Vin Scully Day. She stated she was contacted by the Dodgers Organization for the request and wanted to address it to the Council. Council Member Ly asked if Mayor's Armenta's request met the Brown Act standards as an urgency item. City Attorney Richman stated the item could not be added, but Council could make a general statement to support the idea, but cannot take action. A. Recognition of Muscatel Middle School Science Olympiad Team Joint Meeting of the Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Minutes of September 13, 2016 Page 9 of 17 Mayor Armenta announced the City Council was recognizing Muscatel Middle School Science Olympiad Team, which placed 9th at the 2016 Science Olympiad National Tournament held at the University of Wisconsin -Stout on May 20 -21, 2016. The Muscatel Science Olympiad Team was awarded medals in the following four official events: 3�d place — Crime Busters; 3b place — Bottle Rocket; 4� place — Bridge Building; and 6" place —Picture This. The City Council commended and presented each student with a certificate of recognition. B. Proclamation — National Preparedness Month, September 2016 Mayor Armenta read and presented a proclamation for National Preparedness Month to Public Safety Center staff. Public Safety Coordinator Wong noted September is Nation Preparedness month and encourages the public to continue to prepare for unforeseen emergency such as fire, flood, and earthquakes. Ms. Wong also introduced the City of Rosemead Communication Team and the Community Emergency Response Team Training Program. C. Southern California Edison Streetlight Acquisition Program ( Tankko Lighting Presentation) Alex Wurzel, representative of Tanko Lighting, presented a power point presentation on the streetlight acquisition program with Southern California Edison. Mr. Wurzel spoke on the specifications of the new LED lights and the savings and cost the City would incur over time with the program. 4. PUBLIC HEARING - None 5. CONSENT CALENDAR A. Approval of Minutes Recommendation: Approve the regular meeting minutes of the June 28, 2016 regular meeting, the July 12, 2016 regular meeting, the July 26, 2016 regular meeting, the August 22, 2016 special meeting, and the August 23, 2016 regular meeting. Brian Lewin, resident, stated there were comments he made at the July 12" City Council meeting which requested action by Council regarding revising the smoking ordinance in relation to proposition 64. In addition, Mr. Lewin stated at the August 23 meeting, he also made a suggestion for a memorial for all Rosemead residents who died in service in our country. Mr. Lewin requested to the City Council to have his comments reviewed. City Clerk Donohue stated staff will review the minutes and make any necessary changes. Council Member Ly stated he requested on the minutes of July 12 for the record to show he was present at the June 27 meeting, but did not participate in the meeting and the objections he made. Minutes of August 23` were deferred to the next meeting pending review of Mr. Lewin's comments. Robert Alcaraz, resident, thanked the City Council for consideration of his request for a blue curb parking space in front of his home. Mayor Armenta commended Mr. Alcaraz for being proactive and getting the necessary documents to obtain a blue curb. MATTERS FROM CITY MANAGER & STAFF A. Consideration to Reschedule the November 8, 2016 City Council Meeting and Cancelling the November 22, 2016 and the December 27, 2016 City Council Meetings Recommendation: That the City Council reschedule the November 8th City Council meeting to Tuesday, November 15 and cancel the November 22 and December 27 City Council meetings. City Clerk Donohue stated due to the presidential election on November 8 staff is requesting the City Council meeting of November 8 be rescheduled for November 15 th . Council Member Clark stated due to a commitment to attend a National League of Cities committee meeting in Pittsburg, Pennsylvania on November 15 through 16 she would not be able to attend the City Council meeting as proposed. Mrs. Clark requested keeping the regular schedule City Council meeting of November 8 th . Mayor Armenta agreed with Council Member Clark to keep the regular scheduled City Council meeting of November 8 h . ACTION: Moved by Council Member Ly and seconded Council Member Clark to keep the regular scheduled City Council meeting of November 8 and cancel the November 22 and December 27 City Council meetings. Possible Support for California Public Utilities Commission Staff Recommendations Following SB 1371 (Requested by Councilmember Clark) Joint Meeting of the Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Minutes of September 13, 2016 - Page 14 of 17 Recommendation: Discuss and provide direction to staff. Jorge Rodriguez, representing Blue Green Alliance, requested to the City Council to consider sending a letter of support to the California Public Utilities Commission regarding concerns with the mandatory minim requirements and best practices for natural gas leak abatement. ACTION: Moved by Council Member Clark and seconded by Council Member Ly to direct staff to send a letter of support to the California Public Utilities Commission. The motion carried as follows: AYES: Alarcon, Armenta, Clark, Ly and Absent: Low B. Garvey Avenue Specific Plan (GASP) Update Recommendation: That the City Council receive and file this report. Community Development Director Ramirez reviewed the staff report and announced a joint Garvey Avenue Specific Plan Workshop is scheduled for the City Council, Planning Commission, Traffic Commission, and Sub - committee on September 27 2016 to update all parties on the status of the plan and the Environmental Impact Report. Council Member Ly expressed concerns with the proposed workshop on the Garvey Avenue specific Plan on September 27 at 6:00 p.m. He stated the City Council created a committee to deal with a specific issue; therefore, the committee needs to be empowered to make recommendations to the Council. He stated in the City Manager's update, there was no indication of the Ad -Hoc Committee or the Planning Commission regarding this update and asked staff to address his concerns. City Manager Manis explained it was staff's intent to invite all groups to the workshop. The weekly update is a very general snapshot with what is taking place with the proposed updated workshop. He noted staff did intend to and would invite each group Council Member Ly referenced. Council Member Ly reiterated it's important to update the remaining members of the City Council with what is going on with the specific plan. Each member of the Council has had a chance to be updated by staff, the Mayor was updated on March 8'`, Council Member Alarcon on March 10 and Council Member Clark on March 14 He reiterated it's important for the committee to get empowered to do its job. Council Member Clark asked what the date of the city manager's newsletter was and if Council Member Ly spoke to the City Manager about his concerns. Council Member Ly stated he is bringing it up now and the City Manager's newsletter was sent on September I", and he had emailed the City Manager on the Joint Meeting of the Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Minutes of September 13, 2016 Page 15 of 17 item during the weekend on September 5 and received a response on September 6` He noted he asked for this item to be on the agenda for discussion. Community Development Director Ramirez stated the section of weekly update was written by one of the consultants and in previewing it, she did not notice none of the Commissions or the Ad -Hoc Committee were mentioned, she apologized on her oversight in reviewing it. Council Member Ly requested the City Council, Commissions, and Ad -Hoc committee have copies of the presentation before the meeting to review those items incase members have questions for staff. 8. CITY MANAGER COMMENTS - None 9. CITY COUNCIL COMMENTS Council Member Clark stated there was a request for abatement of graffiti at the auto auction property. She stated she also requested staff contact the owner to discuss on the maintenance of the property. Mayor Armenta noted a gate at the auto auction is open and children are going in with their skateboards. Council Member Ly stated Mayor Armenta, City staff, and he meet with Sheriff McDonald, Captain Jacob, Lieutenant Somoano, and members of the Sheriff Team. He explained during their meeting they discussed the Asian Task Force issue and were told the reason why resources were reallocated is due to crime being viewed differently. As gangs and organizations become more sophisticated with their operations going into other types of industries, it requires Sheriffs to view things in a different perspective. Mr. Ly encouraged the City to continue monitoring the different gang issues to address and mitigate them. Mayor Armenta commended Parks and Recreation Director Chacon and all staff involved on the 9/11 Ceremony tribute. She announced Rosemead had been rated 5 place for the 9/11 Memorial amongst twenty two other 9/11 monuments around the world. Furthermore, Ms. Armenta stated she received a letter from the Asian Pacific Family Center requesting to renew its membership and asked staff to research the request. Lastly, she reiterated her request on the Vin Scully Day proclamation and requested direction from the Council. City Attorney Richman explained if an item comes after the agenda has been posted and it requires urgent action, those are the requirements to add something to the agenda. Council Member Ly stated the Council has never voted on a proclamation and suggested a certificate of recognition instead. Mayor Armenta recessed the meeting at 8:51 p.m. and reconvened the meeting at 9:09 p.m. City Attorney Richman reported there was not reportable action taken during the closed session. 11.
