A. Interim Urgency Ordinance Declaring and Imposing a Citywide Moratorium on
Non - Medical Marijuana Facilities and Private Marijuana Cultivation in Light of
the Passage of Proposition 64
Proposition 64, which legalized various recreational marijuana activities, was
passed by the voters on November 8, 2016. Though the Rosemead Municipal
Code currently prohibits medical marijuana dispensaries and marijuana
cultivation facilities, it is silent on private marijuana cultivation and non - medical
marijuana facilities. Given uncertainties associated with implementation of
Proposition 64 and the impact of recreational marijuana uses on the community,
the City Council will consider adopting an Urgency Ordinance imposing a
moratorium on non - medical marijuana facilities and private marijuana cultivation
activities in the City.

Recommendation: That the City Council adopt Urgency Ordinance No. 969 under
Government Code section 65858(a), establishing a 45 -day moratorium on non-
medical marijuana facilities and private marijuana cultivation, except for private
indoor cultivation of six marijuana plants or less, which shall be subject to
reasonable regulations. This interim urgency ordinance requires a four- fifths vote
for adoption.

Angeles County
Every three (3) years the City of Rosemead adopts the California Building Laws
as amended by Los Angeles County. Both the State of California and County of
Los Angeles have completed their adoption process and the City will now adopt
the County Codes — Titles 26 through 31 and 33.
Recommendation: That the City Council take the following actions:
1. Move to INTRODUCE and ADOPT, by title only, Urgency Ordinance No.
967 (Attachment "A ") an Ordinance of the City Council of the City of
Rosemead adopting by reference, pursuant to Government Code Section

C. Ordinance 966 — Second Reading and Adoption: Skate Plaza Regulations
On November 8, 2016, the City Council introduced Ordinance No. 966, adding
sections 10.20.030, 10.20.040, and 10.20.050 to title 10, chapter 10.20 of the
Rosemead Municipal Code setting regulations for the use of designated skate
parks consistent with California Health & Safety Code Section 115800.
Recommendation: That the City Council approve the second reading and adoption
of Ordinance No. 966.

D. Annual Report on Development Impact Fees — Government Code Section 66006
The City has four development impact fees in place, Traffic, Public Safety,
General Government and Parks. Per Government Code Section 66006, the City is
required to prepare an annual Development Impact Fee report 180 days after the
end of the fiscal year.
Recommendation: That the City Council receive the Annual Report on
Development Impact Fees for FY 2015/16 and adopt Resolution No. 2016 -60.

ROSEMEAD, CALIFORNIA, REGARDING THE ANNUAL
REPORT ON DEVELOPMENT IMPACT FEES AS OF JUNE
30, 2016
E. Temporary Appointment to the Los Angeles County Sanitation District
Currently, Mayor Armenta serves as the designated representative and Mayor Pro
Tern Low serves as the alternate for the City of Rosemead on the Los Angeles
County Sanitation District. On November 9, 2016, the City Clerk sent a letter
(attached) to the Secretary to the Board of Directors stating that the City Council
intends to appoint Councilmember Margaret Clark as the temporary alternate for
only the November 14, 2016 meeting.
Recommendation: That the City Council appoint Councilmember Margaret Clark
as the temporary alternate on the Los Angeles County Sanitation District for only
the November 14, 2016 meeting.
F. Information Technology Professional Services
The City of Rosemead has historically contracted for Information Technology
(IT) Professional Services. Currently, the City is utilizing an IT service model
that was developed over a decade ago. To support employees in providing service
to the public, the City's IT Division maintains and supports an aging IT system
consisting of over 100 computers, 14 servers, numerous enterprise and department
specific software programs and systems, and several output devices (printers,
faxes, etc.).
The City currently contracts for one IT person, onsite two days a week, with no
offsite hours to support and maintain the infrastructure and systems described
above. Due to the increased dependability on technology and the efficiency it
brings to the management of the services and programs provided to the
community, the City is in need of additional support and development of a long
term strategic management and implementation plan for IT. The current two days
a week model with no off -site desk help or support has not allowed for critical
plans to be developed, systems to be maintained and upgraded, and aging
equipment to be refreshed.
In an effort to bring the City's IT in compliance with best practices, staff
recommends continuing to contract for IT management services, while utilizing
both on -site and off -site support. By contracting for both on -site and off -site
services, the City will be able to utilize specialized resources from a variety of IT
professionals. This model will allow the City to implement, upgrade and support
enterprise and other systems that will provide better and more efficient service to
residents as well as staff, which depend on the IT infrastructure on a daily basis.
Additionally, contracting with a firm that has a robust support system will allow
for an IT Strategic Plan to be developed. A plan will identify areas where systems,
software and hardware can be more efficient and provide a schedule for

implementing necessary upgrades to maintain and enhance technology -based
services to the public.
Recommendation: That the City Council authorize the City Manager to enter into
a three year Professional Services Agreement with Interwest Consulting Group
for Information Technology (IT) Project Management Services and appropriate
$19,704 from unassigned fund balance to offset the current IT Services budget for
FY 2016 -17.

FUNDS FROM THE GENERAL FUND RESERVES FOR THE
INFORMATION TECHNOLOGY PROFESSIONAL SERVICES
CONTRACT
G. Approval of Undertaking Agreement for Tract Map No. 72871 - 9048 Garvey
Ave
Tract Map No. 72871 is being submitted for consideration and approval along
with an Undertaking Agreement to guarantee construction of public
improvements subsequent to the recordation of the tract map.
Recommendation: That the City Council approve Tract Map No. 72871 and the
Undertaking Agreement and direct the City Clerk to arrange for the recordation of
the map.
H. Traffic Signal Maintenance Services — Contract Award
The City requires professional contracting services to provide routine traffic
signal maintenance services, emergency repair services, non- emergency
maintenance, new equipment upgrade and installation. The City owns 43 traffic
signalized intersections, 13 in- roadway lighting systems and 8 speed feedback
sign locations. All other traffic signalized intersections are owned by Los Angeles
County or Caltrans. The City currently uses Siemens for traffic signal
maintenance and on -call emergency services for these intersections. The contract
with Siemens has expired and the City is currently utilizing Siemens' services on
a monthly basis.
Recommendation: That the City Council authorize the City Manager to enter into
a two (2) year contract with St. Francis Electric for an estimated annual cost of
$106,950 for the first two (2) years, with an annual option to renew for the
following two (2) years.
I. Adoption of Complete Streets Policy to Maintain Eligibility for Grant
Applications
The Los Angeles County Metropolitan Transportation Authority (Metro) has
developed a Complete Streets Policy (Policy) to establish a standard of excellence

for multimodal design. The term "Complete Streets" describes a comprehensive,
integrated transportation network with infrastructure and design that allows safe
and convenient travel along and across streets for all users, including pedestrians,
users and operators of public transit, bicyclists, persons with disabilities, seniors,
children, motorists, users of green modes, and movers of commercial goods.
Complete Streets is a high level policy direction that helps redefine how
transportation agencies approach streets and highways so that the outcome is a
transportation system that balances the needs of all users, regardless of age,
ability, or mode of transportation.
Recommendation: That the City Council approves to adopt Resolution No. 2016-
66 (Attachment "A ") adopting the Rosemead Complete Streets Policy.

STREETS POLICY
6. MATTERS FROM CITY MANAGER & STAFF
A. Amendments to Rosemead Municipal Code Title 6 - Animals
The City of Rosemead Municipal Code, Title 6 pertaining to animals was last
amended in 2009. At the time of the last amendment, the Municipal Code
included a limit on Household pets permitted per dwelling unit by making
reference to those limits found in the Zoning Code. The Zoning Code was updated
in 2013, and the household pet limit language was unintentionally omitted. As a
result, the current code does not include a limit on animals per dwelling unit. Not
having the animal limit in the Municipal Code has created code enforcement
challenges, therefore staff is recommending that the animal limit be returned to
the Municipal Code. The current Code also includes an optional identification
license for cats, which was not included in the fee resolution approved by City
Council in May 2016 and is a process that has not been utilized or practiced in
recent years. In order to bring the Code into compliance with current practices,
three amendments are recommended.
The proposed ordinance changes (Attachment A) will return to the Municipal
Code a limit to the number of pets in a dwelling unit to three and remove outdated
Code language. The proposed ordinance, adds a Household Pets definition to
Section 6.02.010, new Section 6.04.240 regarding Animal Keeping, and removes
Chapter 6.12 regarding cats and the optional indemnification license for cats.

Section 6.04.040) may not exceed three animals total per dwelling unit.

Section: 6.12.010 Optional identification license for cats
In order to provide a method for identifying cats, a license may be
obtained. The fee for such license shall be established by resolution of the
city council. These licenses shall be valid for the life of the cat. This
section shall not require the licensing of cats, but merely provides for their
optional licensing.
Recommendation: That the City Council approve the first reading of Ordinance
No. 970, amending Title 6 of the Rosemead Municipal Code.

MUNICIPAL CODE TITLE 6 CONCERNING ANIMALS
7. MATTERS FROM MAYOR & CITY COUNCIL
A. Casting Votes for the San Gabriel Basin Water Quality Authority Vacancy
On September 22, 1992, Senate Bill 1679 was signed into law by Governor Pete
Wilson authorizing the creation of the San Gabriel Basin Water Quality
Authority.
The Board of the San Gabriel Basin Water Quality Authority is composed of
seven members. These members consist of three appointed members from each of
the three municipal water districts, one elected city council person from a city in
the San Gabriel Basin with prescriptive water pumping rights, one elected city
council person from a city in the San Gabriel Basin without prescriptive water
pumping rights, and two members representing water producers in the San
Gabriel Basin.
At their September 27, 2016, meeting, the City Council unanimously approved
Resolution No. 2016 -52, nominating Councilmember Margaret Clark to represent
cities without prescriptive water pumping rights on the Governing Board of the
San Gabriel Basin Water Quality Authority.
On December 2, 2016, the Authority sent a letter (Attachment A) to the City
requesting that the City Council adopt a Resolution (Attachment B) of the City
casting its votes for the Board Member to represent cities without prescriptive
water pumping rights on the Governing Board of the San Gabriel Basin Water
Quality Authority.
