CC - Minutes - 10-11-16 Workshop MINUTES OF THE CITY COUNCIL AND THE SUCCESSOR AGENCY TO THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION REGULAR JOINT MEETING OCTOBER 11, 2016 Workshop The meeting of the Rosemead City Council was called to order by Mayor Armenta at 6:04 p.m. in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PRESENT: Mayor Armenta, Mayor Pro Tenn Low, Council Members Alarcon, Clark, and Ly STAFF PRESENT: City Manager Manis, City Attorney Richman, Assistant City Manager McKinney, Director of Finance Chu, Director of Parks and Recreation Chacon, Director of Public Works Garcia, Director of Community Development Ramirez, and City Clerk Donohue 1. WORKSHOP A. Los Angeles Sheriff's Department Crime Task Force Chief of Police Lieutenant Somoano presented a power point presentation and spoke on crime statistics, gang activity, policing plan and Rosemead's Special Assignment Team. In addition, Mr. Somoano discussed year to date statistics in crime to crime comparisons, gang territory, and continue efforts on community outreach, neighborhood, and business watch programs. Mayor Armenta asked if arson crimes were recorded per incident. Chief of Police Lieutenant Somoano replied arson is recorded per incident whether it involves multiple cars or buildings. Mayor Armenta asked what the anticipation on the rise of burglary was if Proposition 47 passes. Chief of Police Lieutenant Somoano explained Proposition 47 reduces narcotic offenses and other property crimes which may release people sooner. Mayor Armenta inquired about the gang presence in the City. She stated on Graves Avenue and Del Mar Avenue there was gang members present at one end of the street and another gang member present at the opposite end. She asked if they predominately have a presence at the northern area of the City and at Rosemead Park. Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of October 11, 2016 Page 1 of 15 Chief of Police Lieutenant Somoano explained there is graffiti from one gang south of the I-10 freeway and different gang graffiti at the north end of the freeway. He continued to explain the presence of gang members in Rosemead Park could be because they congregate and recruit, but there is not noticeable increase of their •' presence. Mayor Armenta asked how many tagging crews transition to the gang life. Chief of Police Lieutenant Somoano replied most tagging crews do not transition to gang members, unless there is a leader. Most often the established gangs like to recruit young kids. He continued with the presentation. Mayor Pro T cm Low asked what the average age membership was. Chief of Police Lieutenant Somoano replied the age range is from grandfathers to little kids being raised in gang environment. The common group age average is 25 to 40 years old. Mayor Annenta asked if all Hispanic gang members are of Mexican decent. She added there are gang members who arc from Central America and they must travel through Mexico to come to the United States. Chief of Police Lieutenant Somoano stated statistics show there are numerus ^^ factors; however the majority of gang members are from the adjacent country which is Mexico. He continued with the presentation in describing crime strategy and strengthening the ties between law enforcement and the community. Mayor Armenia asked if Deputy Farley was working with both Garvey and Rosemead School Districts. She stated Garvey School District Intermediate School sent notices to parents notifying them of raids conducted with trained dogs on school property. In addition, suggested the Sheriffs Department partner with the School District on this program. Chief of Police Lieutenant Somoano explained Deputy Farley's focus is with junior high schools and below. Deputy Julian Ayon is strictly in Rosemead High School and Deputy Farley assist Deputy Ayon as needed. Council Member Ly stated a resident at an apartment complex on Jackson and Hellman expressed concerns with the presence of gang members in the area. He also indicated the previous city manager had spoken about a monitoring process to look into blighted type properties, absentee or vacant landlords where you have a lot of gang members living at. He asked if the Sheriffs Department or Public Safety Team was addressing those types of residences in Rosemead and working with landlords to make sure they are not a hub for gang residences. Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of October 11, 2016 Page 2 of 15 Chief of Police Lieutenant Somoano replied the former City Manager and former Chief of Police coordinated a unified command in the City between the Sheriff's Department and the Code Enforcement staff to work closely to abate some locations. Council Member Ly asked if gang members are living in clusters within the city. Chief of Police Lieutenant Somoano stated there were no clusters established within the city. Gang members typically use motel rooms to conduct narcotic activities and get together occasionally. The Sheriffs Department works closely with hotel owners to conduct patrol checks. Mayor Pro Tem Low asked if there are any new programs or operations the City could support to improve things. Chief of Police Lieutenant Somoano replied the probation watch program has been recently added to the Area Watch meetings. The goal is to educate the public on crime trends and problems in the future. For example, guiding kids before they get into the gang realm by having the school districts, religious organizations, and families more involved. He added Deputy Farley meets with the school districts every school year to have a presentation, which has been positive. Mayor Armenta stated there was the SANE and DARE program where deputies would conduct presentations for schools. Council Member Ly agreed the outreach anti-drug programs worked for kids when they were active. He recalled past Chief of Police working on a program to meet with school districts regularly to help with community outreach. Council Member Clark stated she spoke to the Chief of Police from the City of Oakland at a conference and discussed the academies available for elected officials to experience real life situations and suggested a similar program for residents to understand and respect law enforcement. Mayor Armenta asked how the Sheriffs Department assures residents the City is doing everything possible to deter dangerous activities. Chief of Police Lieutenant Somoano replied law enforcement tries to work with residents closely and following on cases to resolve the issues. 2. PUBLIC COMMENTS FROM THE AUDIENCE Lillian De Loza Gutierrez, representative for the Los Angeles County Metro provided information on Proposition Mon the half cent sales tax increase towards improvements to public transportation infrastructure. Sammy Nguyen expressed concerns on a citation he received regarding illegal dumping near his property. Council Member Ly suggested to Mr. Nguyen to speak to the Assistant City Manager overseeing the Public Safety Department to address his concerns. 3. PRESENTATIONS A. Employee Introduction—Kathy Garcia, Public Works Director Mayor Armenta introduced Kathy Garcia as the new Rosemead Public Works Director. She also thanked and acknowledged Rafael Fajardo, City Engineer for serving as the Interim Public Works Director. Kathy Garcia, Public Works Director thanked the City Council for welcoming her to the City of Rosemead. B. Public Safety Presentation Assistant City Manager McKinney provided the City Council with an update on the assault involving a Parking Control Officer and a transient. Mr. McKinney reported Parking Control Officer Alcala was recovering. In addition, he acknowledged Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of October 11,2016 Page 4 of 15 Senior Code Enforcement Officer Wayne Co for responding to the accident, his dedication and diligence to Officer Alcala during the incident. 4. PUBLIC HEARING A. Public Hearing on the Consolidated Annual Performance and Evaluation Report (CAPER) for FY 2015-16 Recommendation: That that the City Council conduct a public hearing and take public testimony on the City's FY 2015-16 Consolidated Annual Performance and Evaluation Report. No further City Council action is necessary. Community Development Director Ramirez spoke on the Consolidated Annual Performance and Evaluation Report for Fiscal year 2015-2016. The City's overall objective in the CDBG and HOME programs is the development of viable communities by providing decent housing, a suitable living environment, and expansion of economic opportunities primarily for low-to-moderate income persons. Mayor Armenia opened the public hearing, there being no public comments the public hearing closed at 7:20 p.m. 5. CONSENT CALENDAR A. ACTION: Moved by Mayor Pro 'rem Low and seconded by Council Member Alarcon to approve the Consent Calendar items SA, 5B, SC, 5D, SF, with the exception of items SE and 5G. City Tree Maintenance Services—Award Contract Recommendation: That the City Council authorize the City Manager to enter into a two (2) year contract with WCA Inc. for an estimated annual cost of$159,000 for the first two (2) years, with an annual option to renew for the following two (2) years. City Engineer Fajardo reviewed the staff report and stated staff is recommending the City Council to direct the City Manager to enter into a contract with West Coast Arborist in the amount of$159,000 for two years. Council Member Ly stated the City Tree Maintenance Contract was brought before the City Council in September with staff's recommendation to award the contract to Great Scott. At the last City Council meeting, staff reviewed the staff report and is recommending the contract to be awarded to West Coast Arborist. He asked staff to explain what led to the change. City Manager Manis explained after the staff report was approved and posted, staff subsequently noticed some comparisons of the per unit versus the per inch charges proposed by Great Scott. The per inch cost was not appropriate or consistent with the request for proposal. Staff reviewed the proposal again and decided to move forward with West Coast Arborist. In addition, Great Scott's proposal was $30,000 over the proposed budget and West Coast Arborist was about $20,000 to $25,000 under the proposed budget. Ernesto Pantoja representing Labor Union 300 stated they have just partnered with West Coast Arborist. He reiterated West Coast Arborist provides their employees a good paying job and benefits. Their internship program and local hire program benefits local residents in the community to obtaining jobs or internships within the industry. Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of October 11, 2016 Pagel of 15 Scott Griffith of Great Scott Tree Trimming submitted a letter for the record. Mr. Griffith stated five years ago they had submitted a bid for the same contract per tree cost and it was awarded to West Coast Arborist who bid per inch cost. Ile asked a why it was okay five years ago and not now. Mr. Griffith explained after inspecting some trees, they felt it was in the city's best interest to charge per inch. lie asked if it was legal and permissible to throw out the proposal because the same thing happened five years ago. Mayor Annenta asked staff if it was better to pay per inch or by tree and how it is determined. Mr. Griffith explained if a request is for the removal of trees at an area and the existing specs states 0 to 4 inches for removals and there are 36 inch trees, they make money. If the removal is for 12 or 13 inch tree the city would save money because their price for a 12 to 13 inch trees is 30 percent cheaper than any of the other three competitors. Mr. Griffith stated they had inventoried all city trees five years ago and most were 13 to 14 inch trees. He suggested to conduct another inventory in six inch increments and by GPS system and would donate an IPad and train staff to use the system. Mayor Annenta stated the calculations she had based on Great Scott's proposal were much higher. She asked how the city would save money when a tree is between five to six inches. How the right cost would be calculated. --- Mr. Griffith explained they go out and measure the trees with the City's urban forester to confirm the right measurements to submit to the City. Mayor Annenta asked about the quote submitted for the UPS system for $30,000 and a base price of$30,000. Mr. Griffith explained if a new inventory has to be conducted to account for every tree and location it would cost about $30,000, unless the City chooses to use their current system. In addition the UPS system would be done over a five year span and it was a supplementary proposal. City Attorney Richman referred to Mr. Griffith's letter he submitted from their attorney, because Great Scott listed the price by inches instead of per tree, an analysis was done to what their bid price was and why it was disqualified. She reiterated the request for proposal indicated certain inches would be equivalent to a small tree, other inches would he a medium tree, therefore staff asked for a per each tree price. Great Scott submitted a per inch tree price and staff could not determine what the price would be based on a range or evaluate properly. Mayor Pro Tem Low asked if the other proposals submitted met the Request for Proposal requirements and if Great Scott's met the proposal requirements. .-.. Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of October 11, 20/6 Page 8 of 15 City Engineer Fajardo replied yes, Great Scott's proposal met the proposal requirements but they submitted their cost in inches when staff requested by each tree unit. Mayor Armenta stated after reviewing the proposals, all the descriptions were all special request for tree trimming, pruning, removal, stump removal and everything else the vendors were describing by inch or per tree. She reiterated the grid tree services is what should be looked at because the services would not matter how tall the tree is, or how many inches but rather the quantity of trees. Great Scott has each tree at $68, West Coast Arborist at $53, Trimming Land at$43 for trimming trees. Between Great Scott and West Coast Arborist there is a difference of$30,000 extra annually in cost and reviewing line by line you could see what the cost savings is for the City. Council Member Ly asked for clarifications on the request for proposal specifications five years ago versus the current request for proposal. Were the specifications per inch or per tree when it was awarded to West Coast Arborist. Public Works Superintendent Scott replied the city piggy backed off a desert community contract for the tree contract. City Attorney Richman explained under the contract code if an agency adopts an ordinance where the City has identified a locality who follows the same public contract process which is similar to the city's process and it's in the best interested of the city to piggy back off their contact to get the same terms you can do so. Council Member Ly asked if Great Scott is arguing they have the cheaper price based on per inch, what is the overall value you would compare by inch. Public Works Superintendent Scott explained if you break the inventory into four categories as opposed to six categories, Great Scott would not be advantageous to have charge per inch but rather by categorizing in a range. Council Member Ly asked if staff has considered owning the GPS system data and software of the tree inventory and how often was the inventory updated. Public Works Superintendent Scott stated the current inventory provided by West Coast Arborist was the city's property and the city could continue to operate and build from it. City Engineer Fajardo replied the inventory software was received in 2012 and was outdated. IIe explained staff is planning to allocate Capital Improvement funds for a GPS system for a tree master plan. The project would be considered as a separate contract of approximately $25,000 to incorporate a new city tree inventory and GPS system to the current GIS system of the City. Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of October 11, 2016 Page 9 of 15 Council Member Clark asked if Great Scott was over the proposed budget, why did staff recommend them originally and what changed other than the inch issue. Public Works Superintendent Scott explained the request for proposal listed a lot of different criteria and the City has worked with both firms. West Coast Arborist has had some performance issues, which have been addressed and have improved on. Council Member Ly asked why staff is recommending a two year plus two year options for the contract. Public Works Superintendent Scott replied the performance issue was one of the reasons staff was recommending a two year contract versus a five year contract. City Manager Manis indicated staff has met with the tree trimming vendor every two weeks to ensure the city is happy with their services or the need to address any issues. Mayor Artnenta asked how many trees are planted in the City. Public Works Superintendent Scott replied approximately 6,500 to 6,600 which include parks,park ways, and medians. Mayor Armenta asked Public Works Superintendent Scott if he has worked with "a* Mariposa Landscaping or Trimming Land. Public Works Superintendent Scott answered yes, Mariposa Landscaping were the ^-* city's ground maintenance contractor and they trimmed all small trees. He replied he did not work with Trimming Land, but had good references from other agencies. Mayor Armenta expressed concerns with the dead trees in the city. She stated she has received calls from residents whom have been waiting for service to remove dead trees. She indicated West Coast Arborist had no fee for their tree inventory management. However, if awarded to Great Scott, they were proposing to charge $29,000 for their GPS system inventory, plus the $45,000 difference on grid tree trimming. Public Works Superintendent Scott stated staff can utilize West Coast Arborist GPS system if staff had an IPad sync up with their system. Pat Mahoney of West Coast Arborist explained as they bid a contract they bid as it's requested for the proposal. He stated they have done the city's tree inventory in a GPS system which staff has the access to use on their desk top. In addition, when tree maintenance is done, West Coast Arborist staff updates the inventory to keep it updated. He reiterated West Coast Arborist proposed to conduct a city wide inventory at no cost to the city. Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of October H, 2016 Page l of 15 Council Member Ly asked for clarification on the inventory system which West Coast Arborist would do at no cost, if staff requested a new inventory of all the city trees. Mr. Mahoney replied it was part of the bid item and requested in the bid document to conduct an inventory and its good practice every five years to evaluate health conditions of all trees. Mayor Armenta inquired on the response time from the current contractor and why the evaluation stated otherwise. Public Works Superintendent Scott explained West Coast Arborist emergency response was great. The issues were some cases involving tree removals, taking more than 30 to 60 days; however it's been addressed in the regular meetings with the contractor. Council Member Ly commended staff for being responsive towards the issues with the vendor; however, he expressed concerns with the time it takes away from other projects. He asked for the record to show West Coast Arborist is making a commitment to prioritize the city. Mayor Pro Tem Low stated she was comfortable with staffs recommendation to award the contract to West Coast Arborist with an annual cost of$159,000 and the option to renew. Council Member Ly made an amendment to the motion to have staff get control of the GPS system and inventory list moving forward and making sure it's in the contract. City Attorney Richman stated if West Coast Arborist was agreeable to that. Mr. Mahoney replied the data is property of the city and the language is fine to be included on the contract. City Attorney Richman confirmed Mr. Mahoney agreed to add a friendly amendment to the original motion which the City will have ownership of the GPS Data. ACTION: Mayor Pro Tern Low made a motion, seconded by Mayor Armenta to approve the recommended action; in addition, the City would have ownership of the GPS Data. Agreement for the Lease with Southern California Edison (SCE) for Jay Imperial Park Rosemead City Council and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of October 11, 2016 Page11 of15 Recommendation: That the City Council approve the Lease Agreement between the City and SCE for Jay Imperial Park and authorize the City Manager to execute the attached Lease Agreement. Council Member Ly gave an update on the project stating there had been some delays with working with Edison in the past and now with the Public Utility Commission; however the park will be completed as soon as possible. ACTION: Moved by Council Member Ly and seconded by Council Member Clark to approve the recommended action. The motion carried by the following roll call vote: AYES: Alarcon,Armenta, Clark,Low,Ly 6. MATTERS FROM CITY MANAGER & STAFF -None 7. MATTERS FROM MAYOR & CITY COUNCIL A. Coyote Issue Discussion (Requested by Mayor Armenta) Recommendation: Discuss and provide direction to staff. Brian Lewin expressed some concerns with the coyote issues in the city. He agreed with some of the deterring ideas staff has come up with, however he suggested if coyotes start to attack people in anyway, the City should consider the trap and -- destroy method. Mayor Armenta expressed concerns and stated she did not want the City to act on . ,d the coyotes issue after someone is attacked by a coyote, but rather be proactive and address the issues now. She suggested a task force and asked staff to contact surrounding cities on what they are doing to address the coyote issue as well as experts. She shared concerns from residents brought on social media and how coyotes are becoming accustomed to being around humans which puts children and pets in jeopardy. In addition, asked staff to research if coyotes are a protected species. Beverly Morton stated she never had concerns about camping out in her own lawn until the coyotes go in her lawn at least once a week. She reiterated the coyotes issues is a growing problem and suggested trapping and sterilizing the coyotes to address the growing problem. Mayor Armenta agreed with catching the coyotes and sterilizing them to make sure residents are taken care. Mayor Pro Tem Low requested to give staff some time to bring back some suggestions on managing the coyote problem. Council Member Ly asked staff to provide what the legal options are for the City. Mayor Pro 'rem Low suggested staff also reach out to the County for assistance and direct the City Manager to reach out to a regional board to seek advice. City Manager Manis reiterated staff would contact the County, surrounding communities and bring back a plan of action to include a best practice; staff would survey other communities and bring back a draft management plan in the next 30 days. Mayor Armenta reiterated for staff to survey other cities on what they are doing about the coyote problem. B. Cell Phone Numbers to be Placed on Business Cards For Employees Who Receive A Phone Allowance or a New Smart Phone Discussion (Requested by Mayor Armenta) Recommendation: Discuss and provide direction to staff. Mayor Armenta stated she requested employees who receive cell phone allowance, also included their cell phone number on their business card. Council Member Ly stated his concerns were based on labor laws indicating if an employee is a non-exempt employee they are eligible for overtime. For example, if they respond to an email or take a call during their off time period, theoretically they could sue the agency later or argue their calls were made during off times which qualified for overtime pay. City Attorney Richman clarified employees are not supposed to work unless they are non-exempt after hours. Council could give direction to non-exempt staff to not take calls after hours. She clarified department heads are the only staff their cell phone numbers could appear on business cards. City Manager Manis stated there are forty city issued phones to staff and public works staff who do not have City issued business cards; therefore they would not be required to provide their cell phone number. Mayor Armenta's request would only be required for Code Enforcement Officers and any other staff member who has a city issued phone, or receives cell phone reimbursement and city issued business cards. He asked staff to look for any related administrative policies of non-exempt employees and working after hours. City Attorney Richman suggested consulting with a labor law attorney to provide the City Council more thorough information. Mayor Armenia stated most middle management staff received a phone allowance or city issued phones have business cards. City Manager Manis clarified the city issued phones or phone allowance program to the middle management staff was phased out. Forty city issues phone have been distributed to mid-management staff; in addition staff will seek the city attorney's counsel on any labor laws. Mayor Armenta directed staff to take inventory of all city issued phones for the mid-management staff. 8. CITY MANAGER COMMENTS -None 9. CITY COUNCIL COMMENTS Council Member Ly reported he attended the League of California Cities conference in — Long Beach in which he attended a discussion on promoting diversity and having staff reflect the community they represent which the City of Rosemead has stride. Mr. Ly ,. announced he would be out of town on November 8`11 and stated he would teleconference to the November 8,2016 City Council meeting. Mayor Armenta suggested to staff to look into grants for cameras to monitor intersections due to burglaries in the city. She congratulated Mayor Pro Tern Low for her service as past president to the Asian Pacific Islander Caucus. 10.
