CC - Minutes - 01-24-17MINUTES OF THE CITY COUNCIL, HOUSING DEVELOPMENT CORPORATION AND THE SUCCESSOR AGENCY TO THE ROSEMEAD COMMUNITY DEVELOPMENT COMMISSION REGULAR JOINT MEETING JANUARY 24, 2017 The regular joint meeting of the Rosemead City Council, Housing Development Corporation and Successor Agency to the Community Development Commission was called to order by Mayor Pro Tem Low at 7:01 p.m. in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead, California. PRESENT: Mayor/Chau/President Armenta, Mayor Pro Tem/Vice-Chair/ Vice -President Low, Council Members/Board Members/Directors Alarcon, Clark, and Ly PLEDGE OF ALLEGIANCE was led by Council Member Ly INVOCATION was led by Council Member Clark STAFF PRESENT: City Manager Manis, City Attorney Richman, Assistant City Manager McKinney, Director of Finance Chu, Director of Parks and Recreation Chacon, Director of Public Works Garcia, Director of Community Development Ramirez, and City Clerk Donohue 2. PUBLIC COMMENT Lilian DeLoza with Los Angeles County Metro invited the community to Metro's upcoming meetings on the extension of the Metro Gold Line Eastside project. Captain Coronne Jacob commended Public Safety Coordinator Wong and the CERT volunteers for assisting the City of Duarte during their mudslide emergency during this past weekend. 3.. PRESENTATIONS A. Employee Recognition — Carolyn Chu, Finance Director City Council commended Carolyn Chu for her nine years of service to the City and presented her with a certificate of recognition. Carolyn Chu thanked the City Council for their recognition and the opportunity to have served the Rosemead community. B. Employee Recognition — Ignacio Somoano, Chief of Police City Council commended Lieutenant Ignacio Somoano for his 3 '/2 years of service as Rosemead's Chief of Police and keeping the community safe. He was presented with a certificate of recognition for his service. Mayor Armenta acknowledged and thanked the CERT volunteers for assisting the City of Duarte during their emergency disaster. Kenney Tran store manager of Walmart in Rosemead thanked Lieutenant Somoano for his service to the community and presented him with a cake. C. Employee Introduction — Robert G. Hahnlein, Chief of Police Mayor Armenta introduced and welcomed Lieutenant Robert G. Hahnlein as Rosemead's new Chief of Police. Chief of Police Lieutenant Robert Hahnlein thanked the City Council, staff and the community for welcoming him to the City of Rosemead. D. Employee Introduction - Pearl Lieu, Finance Director Mayor Armenta introduced and welcomed Pearl Lieu as the new Rosemead Finance Director. Finance Director Pearl Lieu thanked the City Council for welcoming her to the City of Rosemead. E. Recognition of Rosemead High School Girls Basketball Team Mayor Armenta commended and recognized Coach Chuck Lyons, Assistant Coach Elizabeth Lyons, and Rosemead High School Girls Basketball Team on receiving the Champion of Character Award. The City Council presented certificates of recognition to the Rosemead High School Girls Basketball Team. Coach Chuck Lyons thanked the City Council for recognizing the Rosemead High School Girls Basketball Team. He added the girls are all dedicated to their families, school, work, and the community. 4. PUBLIC HEARINGS A. Extension of Proposition 64 Citywide Moratorium on Non-medical Marijuana Facilities and Private Marijuana Cultivation for 10 months and 15 days. Recommendation: That the City Council adopt Interim Urgency Ordinance No. 971 under Government Code section 65858(a), which implements a 10 month and 15 day extension to the moratorium on non-medical marijuana facilities and private marijuana cultivation adopted under Ordinance No. 969. This interim urgency ordinance requires a four-fifths vote for adoption. Rosemead City Council, Housing Development Corporation and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of January 24, 2017 Page 2 of 7 Mayor Armenta opened public hearing at 7:37 p.m. There being no comments the public hearing closed at 7:38 p.m. Community Development Director Ramirez stated the 45 -day moratorium on non-medical marijuana facilities and private marijuana cultivation activities was not enough time to address all concerns. Staff recommended extending the moratorium for 10 months and 15 days to further assess the City's options on regulating private marijuana cultivation, non-medical marijuana facilities, and businesses. ACTION: Moved by Council Member Clark and seconded by Mayor Pro Tem Low to approve the recommended action: The motion unanimously carried by the following vote: AYES: Alarcon, Armenta, Clark, Low, Ly AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, EXTENDING A TEMPORARY MORATORIUM PERTAINING TO PRIVATE MARIJUANA CULTIVATION AND NON-MEDICAL MARIJUANA FACILITIES 5. CONSENT CALENDAR A. City Council Meeting Minutes Recommendation: That the City Council approve the minutes from the regular meeting on January 10, 2017. C. Housing Element 2016 Annual Progress Report Recommendation: That the City Council receive and file the City's 2016 Housing Element Annual Progress Report. D. Transmittal of Fiscal Year 2015-16 City of Rosemead and Rosemead Housing Corporation Annual Financial Reports Recommendation: That the City Council receive and file the City of Rosemead Comprehensive Annual Financial Report and the Rosemead Housing Development Corporation Annual Financial and Compliance Report for the 2015- 16 FY. ACTION: Moved by Mayor Pro Tem Low and seconded by Council Member Ly to approve the Consent Calendar items 5A, 513, 5C and 5D. The motion unanimously carried by the following vote: AYES: Alarcon, Armenta, Clark, Low, Ly 6. MATTERS FROM CITY MANAGER & STAFF A. Southern California Edison Street Light Acquisition and Conversion Program Recommendation: That the City Council select Option 2 of the four potential options listed below. 1. Status Quo 2. SCE Conversion Program —LED Bulbs 3. City Acquisition and LED Conversion 4. Tanko Lighting Acquisition and LED Conversion City Engineer Fajardo reported in the previous City Council meeting, staff was asked to bring before the City Council more information on Option 2 and address the Council's liability concerns. In addition, there was no confirmed schedule on Rosemead City Council, Housing Development Corporation and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of January 24, 2017. Page 4 of 7 when Southern California Edison was planning on converting the streetlight bulbs to LED bulbs. John King, Southern California Edison Manager explained with Option 2, the City would not be required to use funds for the conversion of streetlights and there would be no liability incurred. Southern California Edison would replace the streetlights with LED lights and maintain the street lights at no cost to the City. He continued to explain there is a built in component in the tariff which pays back the initial cost of the first light over 20 years. Mayor Pro Tem Low made a motion for Option 2. Brian Lewin expressed concerns with Option 2 and urged the Council to reconsider Option 3 or Option 4. Mr. Lewin stated Southern California Edison did not have a good service record for maintaining the streetlights or responding to calls. Furthermore, he expressed safety concerns associated with the delayed response in fixing streetlights in some neighborhoods. Mr. Lewin suggested the City should look into converting to solar streetlights in the future. Mayor Armenta asked Mr. King if blackouts would still occur if the City owned the streetlights. Mr. King replied customers are in a LS2 tariff, which includes the City. Even if you owned the streetlight, the electricity, wires, and infrastructure are owned by Southern California Edison. If there are outages, Southern California Edison would still respond. He added, service calls for streetlights have improved since last year. Council Member Ly agreed with Mr. Lewin's concerns on Southern California Edison's response times to streetlight service calls. In addition, he reiterated the City is still waiting on the approval from the Public Utility Commission on Jay Imperial Park, which is on Edison's right -a -way and Edison's service has not improved. Council Member Clark asked Mr. King if Southern California Edison would allow for the City to fix a streetlight and bill Edison after for the work. Mr. King stated Southern California Edison would not allow that due to the liability. Mayor Armenta asked if there were any deadlines for the other options presented to the City Council. City Engineer Fajardo stated the deadline for any of the options was January 31, 2017. She expressed concerns with Southern California Edison's time response to service calls. Mr. King answered affirmatively. He noted Southern California Edison will work to service the City on a timely manner. Mayor Armenta reiterated Mayor Pro Tem Low's concerns on the delay of services calls and hopes to keep a good working relationship with Southern California Edison. Council Member Clark added the San Gabriel Council of Governments had a special meeting with Southern California Edison to address a lot of the same concerns. Sal Ramirez, Southern California Edison representative stated he had been working with staff and urged the City to contact him on any Southern California Edison related issue. He stated he would inform the City Council on the status of the Jay Imperial Park project with the Public Utility Commission. Council Member Ly stated the City submitted plans to Southern California Edison over six years ago and it's gone back and forth due to staff changes. The project has gone to the Public Utility Commission less than a year ago and the City has to meet a grant deadline. Mr. Ramirez replied Southern California Edison was aware of the grant deadline. Council Member Ly inquired about Rule 20A money to underground wires on Walnut Grove Avenue which is not under operation yet. Mr. Ramirez invited Mr. Ly to get together to discuss the status of the project. Mayor Armenta asked if Southern California Edison will consider converting to solar streetlights suggested by Mr. Lewin. City Engineer Fajardo stated he has seen solar lights on parking lots but not on streets. Mr. King explained solar lights are usually installed at private settings such as a shopping center or sport arena. Southern California Edison's system was not designed to take in power. ACTION: Moved by Mayor Pro Tem Low and seconded by Council Member Alarcon to select Option 2, the Southern California Conversion Program. The motion carried by the following vote: AYES: Alarcon, Armenta, Clark, Low, and NOES: Ly Rosemead City Council, Housing Development Corporation and the Successor Agency to the Rosemead Community Development Commission Joint Meeting Minutes of January 24, 2017 Page 6 of 7 Council Member Ly stated he voted no on Option 2 because Southern California Edison should prove they have improved on their service calls. 7. MATTERS FROM MAYOR & CITY COUNCIL A. City Council Comments Council Member Alarcon cautioned the public on recent coyote sightings near his neighborhood. He asked if it was illegal to carry a can of mace. Chief of Police Lieutenant Somoano replied it is legal to carry a can of mace. Council Member Clark reported she attended a Contract Cities Legislative Tour in Sacramento and met with legislators. Mayor Pro Tem Low thanked Public Works staff for maintaining public right -a - ways from harm during the heavy rains. Mayor Armenta stated residences experience street flooding and staff had been responsive during the rain and encouraged staff to continue working with County to prevent future issues. In addition, when considering city events requiring the Council's attendance, she asked staff to provide additional options on dates. 8. CLOSED SESSION - None 9. ADJOURNMENT The meeting adjourned in memory of Elena Somoano at 8:10 p.m. The next regular City Council meeting is scheduled to take place on February 14, 2017, at 7:00 p.m. in the Rosemead City Hall Council Chamber.
