Ordinance No. 083 - New Zone C-M (Restricted Commercial Manufacturing)ORDINANCE NO. 83 u AN ORDINANCE OF THE CITY OF ROSEMEAD CREAT"'";u A NEW ZONE C-M (RESTRICTED) (RESTRICTED COMMERCIAL-MANUFACTURING); PROVIDING FOR THE USE OF PREMISES IN SUCH ZONE AND AMENDING THE TEMPORARY INTERIM ZONING ORDINANCE. THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN AS FOLLOWS: Section 1. Chapter I of Article IX of the Rosemead Municipal Code, Section 9100 thereof, is hereby amended by adding a new subsection (a-6) thereto, to read: (a-6) Notwithstanding the foregoing provisions of subsection (a) of this section 9100, Article 4 of Chapter 2, of the Zoning Ordinance cf the County of Los Angeles, hereinabove adopted by reference as the temporary interim zoning ordinance of the City of Rosemead, is hereby amended by adding a new section 259.1 to read as follows: 1. BONE C-M (RESTRICTED) (RESTRICTED SECTION 259_ . - - COMMERCIAL-MANUFACTURING). Premises in Zone C-M (RESTRICTED) may be used for A. Assembly of, including manufacturing of small parts such as coils, condensors, transformers, or crystal holders; a.. Electrical appliances; b. Electronic instruments; • c. Radios, phonographs or television sets; 2: Candy manufacturing. 3. Cosmetic., manufacturing of. 4. Jewelry manufacturing. 5. Assembly of articles or merchandise from the following i'r--viously prepared materials; a. Cloth b. Leather (except machine belting) c. Glass d. Paper e. Plar;tics f" Shell o: Yarn 6. Metals, Manufacturing products of rare and precious. 7. Optical goods manufacturing. 8. Perfume manufacturing, blending and bottling. 9. Restaurant or Cafe. 10. Stones, Manufacturing products of precious or semiprecious: 11. Toiletries manufacturing, not including soap. 12. Scientific instrument and equipment manufacturing, or precision machine shops. 13. Other similar uses which will not be more obnoxious or materially detrimental to the public welfare and which the Commission finds to be of a comparable nature to the uses enumerated in this section. B. Accessory Uses: Premises in Zone C-M (Restricted) may be used for assessory uses, provided such uses are established on the same lot or parcel of land, are incidental to and do not substantially alter the character of amy permitted principal use including but not limited to: 1. Storage of materials used in the construction of a • buildin or building project, during the construction and thirty ~30) days thereafter, including the contractor's temporary office, provided that any lot or parcel of land so used shall be a part of the building project, or on property adjoining the construction site. 2. Accessory buildings or structures. 3. Open storage on the rear half of the lot when such storage is strictly incidental to the permitted use of a building on the front portion of the same lot, provided area is walled so as to comply with all provision of this Zoning Ordinance. No storage shall be higher than the solid wall or walls of the enclosure. 4. Single family residence and garage of a caretaker. • C. Uses Subject to Planning Commission Review and Approval: Premises in Zone-C-M estricted) may be used for the following purposes subject to review and approval by the Planning Com- mission: 1. Access'to property lawfully used for the purposes not permitted in Zone C-M (Restricted), provided no other practical access to such property is available, and such access, when developed to the improvements required by the Planning Commission, will not alter the character of the premises in respect to permitted uses in Zone C-M (Restricted) 2. Temporary Carnivals, not to exceed three days within any six month period. The sponsorship of such carnival shall be confined to a public agency or a religious, fraternal or service organization directly engaged in civic or charitable endevors. 3.. Tent revival meetings not to exceed thirty (30) days in any six month period. -2- A D. Uses by Zone Exce tp ion: Premises in Zone C-M (Restricted) may a use or t e wing purposes, provided a zone exception has first:been obtained in compliance with Section 522 of this Zoning Ordinance: 1. Electric substations and transformer stations. 2. Heliport. 3. Hospitals. 4. Oil wells. 5. Radio, telephone, television, microwave, transmitter and receiver stations, and towers. 6. Telephone company storage yards. 7. Water wells, reservoirs, tanks and pumping stations. E. Standards of Development- Premises in Zone C-M (Restrict- ed) shall be su sect to t R3 development standards prescribed in this subsection and any other development required by this Zoning Ordinance. 1. Lot Area: Each lot or parcel of land in Zone C-M (Restricte s a 1 have a minimum lot area of not less than: • a. The number following the zoning symbol. if such number is less than 100, it shall mean acres and if such number is more than 100, it shall mean square feet, or, b. Six thousand (6,000) square feet when no number follows the zoning symbol, or, c. As otherwise provided in Section 721 of this Zoning Ordinance. 2. Lot Width: a. Each interior lot or parcel of land in Zone C-M (Restricted) shall have a minimum lot width of not less than sixty (60) feet; • b. Except as otherwise provided in Article 2 of this Zoning Ordinance. 3. Front Yard: Each lot or parcel of land in Zone C-M (Restricted) shall have a front yard not less than 10 feet in depth. Such front yard shall be landscaped in accordance with a landscape plan to be submitted to and approved by the City Administrator. 4. Height Limit: No lot or parcel of land in Zone C-M (Restricted) shall have a building or structure in excess of two stories or 30 feet in height, whichever is less. 5. Off-Street Parking and Loading; a. Each lot or parcel of land in Zone C-M (Restricted) shall have off-stre6t.parking facilities as precribed in Section 744 of this Zoning Ordinance, and developed in occordance with sections 743.5 and 750 thereof. b. Provision shall be made for the loading and unloading of supplies and products. Such loading area -3- 0 shall not extend into the front yard setback area. 6. Signs: Each lot or parcel of land in Zone C-M (Restricted) may have an unlighted, indirectly lighted, or internally lighted, non-flashing sign not exceeding 84 square feet in size indicating the name of the company and the products produced on the premises. 7. Fences: Fences or Masonry walls not exceeding 8 feet in height may be erected along the side or rear property line unless the erection of a wall or fence of different specifications is prescribed in another section of this zoning Ordinance. Metal fences shall be of new material, of'uniform height and structurally safe. Wooden fences shallbe kept painted in a pastel color and maintained in good condition. 0 • Section 2. This ordinance is an ordinance for the immediate preservation of the public peace, health and safety and pursuant to the provisions of subsection (b) of section 36937 of the Government Code of the State of California shall take effect immediately. The facts constituting such urgency are as follows: There is presently pending before the planning com- mission of the City of Rosemead a proceeding for change of zoning of certain areas within said city now zoned for residential uses to industrial uses. Difficult problems have arisen in connection with these proceedings as a result of possible detriment to the owners of adjacent residential properties by the influx of certain industrial uses presently permitted by the temporary interim zoning ordinance in the M-1 industrial zone and an urgent need exists for the creation of a more restricted commercial and manufacturing zone which would provide a transition between adjacent residential uses and commercial and manufacturing uses of the type now permitted by said ordinance. Unless such a zone is created immediately, it would not be possible to consider its establishment in connection with public hearings now scheduled before the plannings commission with reference to the aforementioned zone change proceeding and thus the public interest in effective planning for the most beneficial and equitable use of property within the City would be hampered to the permanent damage of the properties involved and to the detriment of the public peace, health and safety.
