AN ORDINANCE OF THE CITY OF ROSEMEAD PROVIDING
FOR TEMPORARY RESTRICTIONS ON BUILDING IN
INDUSTRIAL ZONES ADJACENT TO RESIDENTIAL ZONES
PENDING ADOPTION OF BUFFER REGULATIONS AND
AMENDING THE TEMPORARY INTERIM ZONING ORDINANCE.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN AS
FOLLOWS:
Section 1. Chapter I of Article IX of the Rosemead Municipal
Code, -Section 9100 thereof, is hereby amended by adding a new
subsection (a-5) thereto, to read:

SECTION 277.5. TEMPORARY RESTRICTION ON BUILDING IN
INDUSTRIAL ZONES ADJACENT TO RESIDENTIAL
OR AGRICULTURAL ZONES. For a period of
sixty (60) days from and after the date of adoption hereof,
and subject to prior rights accrued pursuant to existing
building permits or valid, pending applications therefor,
a person shall not use any premises in Zones C-M, M-I,
M-I2- M-2, M-212- M-3, M-4, B-I, or B-2 for the erection
of any building, , any portion of which is or would be
located within thirty (30) feet from any property line
which is contiguous with any residential or agricultural
zone and no building shall be erected on such premises
contiguous to a residential or agricultural zone unless a
ten (10) foot planting strip is installed and continuously
maintained ad;atent to such property line and unless a six
(6) foot masonry wall is erected and maintained along or ad-
jacent to such line.
Section 2. This ordinance is an ordinance for the immediate
preservation of the public peace, health and safety and pursuant
to the provisions of subsection (b) of Section 36937 of the
• Government Code of the State of California shall take effect
immediately.
The facts constituting such urgency are as follows:
The City Council and the City Planning Commission are pres-
ently preparing regulations to govern the erection of buildings
on property zoned for industrial uses where the premises adjoin
property zoned for residential or agricultural uses. The pur-
pose of these regulations will be to protect the owners and
residents on property zoned for residential and agricultural
purposes against undue encroachment by industrial buildings
on adjacent property, together with attendant noises, odors and
dust and other inconveniences and interference with the quiet
enjoyment of such residential and agricultural property, by
requiring the owners of such encroaching industrial uses to
take adequate precautions and make proper provision for the
screening and protection-of such adjacent residential and
agricultural properties. At the same time it is contemplated
to eliminate existing buffer zones, in order to provide for a
'higher and more economical utilization of scarce land in the
face of constantly increasing population:
Until such regulations are finally drafted and adopted,
residential and agricultural, property which presently adjoins
property zoned for industrial uses:without the intervention of
existing buffer zones would be without protection against the
encroachments mentioned above. This, problem is particularly
acute in the newly annexed areas and unless existing conditions
are immediately preserved until the adoption of the regulations
aforesaid, encroachments of the kind referred to above would
occur, to the permanent damage of residential and agricultural
property and to the detriment of the public peace, health and
safety.
