City Council Meeting Minutes Recommendation: That the City Council approve the minutes from the regular meeting on May 9, 2017, the regular meeting on June 27, 2017, the special meeting on July 10, 2017, and the regular meeting on July 11, 2017. C. Home Investment Partnerships (HOME) Funds Commitment Agreement between the City of Rosemead and the Rosemead Housing Development Corporation (RHDC) for the Implementation of Certain HOME Funded Programs The City is required to commit its HOME Investment Partnerships (HOME) funds for particular affordable housing activities within 24 months after the U.S. Department of Housing and Urban Development's (HUD's) appropriation of the entitlement allocation. To comply with this requirement, staff recommends that the City commit $173,503 of FY 2017-18 HOME funds, plus unspent carried over funds of approximately $540,000 from prior FY's, by contracting with the Rosemead Housing Development Corporation (RHDC) to administer certain HOME funded programs. Recommendation: It is recommended that the RHDC and the City Council take the following actions: 1. Approve a HOME Funds Commitment Agreement between the RHDC and the City Council for the implementation of the City's Owner -Occupied Rehabilitation Loan Program in the amount of $523,503 (approximately) and Mortgage Assistance Program in the amount of $190,000; 2. Authorize the Mayor to execute the contract on behalf of the City; and 3. Authorize the President to execute the contract on behalf of the RHDC D. Los Angeles County Regional Park and Open Space District Competitive Tree Planting Grant — Resolution No. 2017-34, Approving the Adoption of a Youth Employment Plan 3 City Council and the Housing Development Corporation Special & Joint Meeting Agenda July 25, 2017 The County of Los Angeles, 1st Supervisorial District, made grant funds available in 2012, to local communities for tree planting and other "greening" projects. A total of $1.8 million was available to 1st District cities, with a cap of $100,000 per grant application. The City prepared two applications under the Competitive Tree Planting Grant Program (one to help recuperate losses related to tree damages incurred during the 2011 windstorm and another to plant new trees in public areas). The City was awarded $100,000 for each application. One of the requirements from the Los Angeles County Regional Park and Open Space District is to adopt a Youth Employment Plan for development projects by the governing body of the agency. The District stated that there is no requirement to utilize youth for the tree planting grants, therefore, the City may adopt a plan stating that they will not be utilizing any youth for the work performed under the awarded grants. Recommendation: It is recommended that the City Council approve Resolution No. 2017-34, approving the adoption of a Youth Employment Plan for all grant funds received through the Competitive Tree Planting Grant Program offered by the Los Angeles County Regional Park and Open Space. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, APPROVING THE ADOPTION OF A YOUTH EMPLOYMENT PLAN FOR ALL GRANT FUNDS RECEIVED THROUGH THE COMPETIVTIVE TREE PLANTING GRANT PROGRAM OFFERED BY THE LOS ANGELES COUNTY REGIONAL PARK AND OPEN SPACE E. Request to Install Parking Restrictions — 7715 Garvey Avenue The Traffic Commission received a request from the business owner at 7715 Garvey Avenue to review conditions in this area since vehicles parking along the curb in front of his business block the view of oncoming traffic for vehicles attempting to exit the premises and prohibits large vehicles from maneuvering in or out of the premises. On April 06, 2017, the Traffic Commission reviewed conditions at the business at 7715 Garvey Avenue and recommended the installation of red curbing, approximately 3 -feet on the west side of the driveway apron and 5 -feet on the east side. Recommendation: It is recommended that the City Council approve the Traffic Commission's recommendation to paint 3 -feet of red curb on the west side of the driveway apron and 5 -feet of red curb on the east side of the driveway apron of the business at 7715 Garvey Avenue. F. Review of Traffic Conditions at Hart Avenue and Steele Street The Traffic Commission received a request from a resident to install traffic calming measures such as STOP signs in the north and south leg of the intersection at Hart Avenue and Steele Street or speed humps to slow down the speed of the vehicles traveling along Hart Avenue. On April 06, 2017, the Traffic Commission reviewed conditions at the intersection of Hart Avenue and Steele Street and recommended City Council and the Housing Development Corporation Special & Joint Meeting Agenda July 25, 2017 that 25 miles per hour (mph) speed limit signs be installed on Steele Street for eastbound and westbound traffic and on Hart Avenue north of Guess Street for northbound traffic and that DIP (W8-2) signs be installed on Hart Avenue north and south of Steele Street. Recommendation: It is recommended that City Council approve the Traffic Commission's recommendation to install 25 mph speed limit signs on Steele Street for eastbound and westbound traffic and on Hart Avenue north of Guess Street for northbound traffic and to install DIP (W8-2) signs on Hart Avenue north and south of Steele Street. G. Keep Clear Markings — Rio Hondo Avenue Between Valley Boulevard and Steele Street The Traffic Commission received a request to review traffic conditions and access to the alley on the east side of Rio Hondo Avenue between Valley Boulevard and Steele Street due to a new 5,645 square foot shopping center development being considered at the southeast corner of Rio Hondo Avenue and Valley Boulevard. On June 01, 2017, the Traffic Commission reviewed conditions at Rio Hondo Avenue between Valley Boulevard and Steele Street and recommended that a "KEEP CLEAR" pavement legend with limit lines in the northbound travel lane of Rio Hondo Avenue fronting the alley be installed with one "DO NOT BLOCK INTERSECTION" (R10-7) sign, for the NB direction, opposite the "KEEP CLEAR" pavement legend. Recommendation: It is recommended that the City Council approve the Traffic Commission's recommendation to install "KEEP CLEAR" pavement markings with limit lines in the northbound travel lane of Rio Hondo Avenue south of Valley Boulevard in front of the alley with one "DO NOT BLOCK INTERSECTION" (R10-7) sign opposite the "KEEP CLEAR" pavement legend for the NB direction. H. Right Turn Only Sign at Driveway Exit of Frances Willard Elementary School Parking Lot The Traffic Commission received a request from the Principal of Frances Willard Elementary School, Ms. Michelle Collaso, regarding traffic concerns within the parking lot at the school. On June 01, 2017, the Traffic Commission reviewed conditions at the Willard Elementary School parent/visitor parking lot which is utilized as a drop-off/pick-up zone and recommended the installation of a "RIGHT TURN ONLY" sign at the exit of the northern driveway on the west side of Willard Avenue and suggested for the School District to install pavement arrows designating an entrance driveway and exit driveway as well as Entrance Only and Exit Only signage at the driveway gates along with a white travel stripe delineating the drop off lane to be striped in the parking lot. Recommendation: It is recommended that the City Council approve the Traffic Commission's recommendation to install a "RIGHT TURN ONLY" sign at the exit of the northern driveway on the west side of Willard Avenue. It is suggested that 5 City Council and the Housing Development Corporation Special & Joint Meeting Agenda July 25, 2017 the School District paint pavement arrows designating an entrance driveway and exit driveway as well as post Entrance Only and Exit Only signage at the driveway gates and a white travel stripe delineating the drop off lane to be striped in the parking lot. 6. MATTERS FROM CITY MANAGER & STAFF A. Tobacco Retailer Licensing Requirement The City of Rosemead recognizes the dangers of smoking and secondary smoke. To encourage responsible tobacco retailing and to discourage violations of tobacco - related laws, especially those that prohibit the sale or distribution of tobacco products to minors, staff is requesting that the City Council select one of three possible options. The incorporation of one of these options will assist in promoting the health, safety, and general welfare of Rosemead residents and encourage compliance with Federal, State, and local laws regulating tobacco sales and use. These options include: 1. Since the City Rosemead has adopted Title 11 of the County of Los Angeles Ordinance into the Rosemead Municipal Code, the City may enforce Chapter 11.35 (Tobacco Retailing) of the County of Los Angeles Code of Ordinances and require any business who sells, offers for sale or distribution, exchanges, or offers to exchange for any form of consideration, tobacco, tobacco products, or tobacco paraphernalia without regard to the quantity sold, distributed, exchanged, or offered for exchange to obtain a Tobacco Retail License. A copy of Chapter 11.35 is attached as Attachment "A". If the City Council selects this option, it may become effective immediately. 2. Require any business who sells, offers for sale or distribution, exchanges, or offers to exchange for any form of consideration, tobacco, tobacco products, or tobacco paraphernalia without regard to the quantity sold, distributed, exchanged, or offered for exchange obtain a Conditional Use Permit and comply with Rosemead Municipal Code Chapter 17.132. A copy of Chapter 17.132 is attached as Attachment "B". The cost would be $1,985 and would require a public hearing before the Planning Commission. Under this process, conditions can be incorporated to set specific restrictions and require the applicant to submit a written plan on staff training. If the City Council selects this option, staff will incorporate this option during the Zoning Code Update this year. 3. Develop a new ordinance which would require that owners of all retail businesses offering tobacco products, tobacco paraphernalia, and/or electronic smoking devices for sale to the public be subject to a Tobacco Retailer License with annual renewal. The ordinance will include regulations crafted in a manner to reduce underage access to tobacco products and establishes performance standards for these business that are consistent with those for retail establishments engaging in the sale of alcoholic beverages for off-site consumption. If the City Council selects this option, staff will need to draft a 6 City Council and the Housing Development Corporation Special & Joint Meeting Agenda July 25, 2017 new ordinance, incorporate the ordinance into Title 5 (Business Licenses and Regulations), and establish a new fee. Recommendation: It is recommended that the City Council select Option 1 and direct staff to immediately enforce the Tobacco Retail License to all new tobacco retail stores. All existing tobacco retail stores shall be permitted to continue. However, any transfer of ownership or business expansion of an existing tobacco retail store shall require the compliance with the Tobacco Retail License. 7. MATTERS FROM MAYOR & CITY COUNCIL A.
