Ordinance No. 058 - Personnel and Salary System! 1 ORDINANCE NO. 58 AN ORDINANCE OF THE CITY OF ROSEMEAD ESTAB- LISHING A PERSONNEL AND SALARY SYSTEM FOR THE CITY OF ROSEMEAD AND AMENDING THE MUNICIPAL CODE TO ADD CHAPTER 9 TO ARTICLE 11. THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN AS FOLLOWS: Section 1. Short Title. This ordinance shall be known as the "Personnel Ordinance". It shall hereby repeal all ordinances and parts of ordinances inconsistent herewith. Section 2. The Rosemead Municipal Code is hereby amend- ed by adding Chapter 9 to Article II thereof to read as follows: "Section 2900. Adoption of Personnel System. In order to establish an equitable, efficient, and uniform procedure for dealing with personnel matters, and to place municipal employment on a merit basis, so that the best qualified persons availabb shall be employed by the City of Rosemead, a personnel system is established as provided in this chapter. Section 2901. Position Classification and Salary Plan an -Personnel Rules. The City Administrator shall: (a) Prepare a Position Classification and Salary Plan, including class specifications, and prepare revisions of the plan as required. The Plan shall be adopted by resolution of the City Council. (b) Prepare such personnel Rules and revisions to the Rules as may be required. The Personnel Rules shall be adopted by 10 resolution of the City Council. Section 2902. Exempt Service. All elective city officers, the City Attorney and any employees so designated by the Council shall be within the group exempt from the classification and/or compensation plan. Section 2903. Personnel System. A. All municipal employment shall be based on merit and fitness to be ascertained by competitive examination as far as practicable. B. The City Administrator shall have the power to appoint, promote, discipline, demote and remove officers and employees of the City in accordance with Section 2107 (2) of the Rosemead Municipal Code, except that the City Council shall sit as a Personnel Committee to consider all salary and/ or personnel -'propbsal5_.or tictions.cbncernino, an emp1oyee'or concerning,an open position where the monthly salary rate of the employee or the position is $400.00 or over. . C. The City Administrator shall be responsible for the following procedures within the framework of this chapter: (1) The formulation of standards and qualifications for each class of position. (2) The public announcement of vacancies and exam- inations and the acceptance of applications for employment. (3) The preparation and conduct of written and/or oral examinations and the establishment and use of employment lists containing the names of persons eligible for appointment. (4) The evaluation of employees during probationary period and periodically thereafter. (5) The standardization of hours of work, attendance, leave regulations, working conditions, and the development of programs for improvement in employees' morale, welfare, training and safety. (6) The separation from service of employees through layoff, suspension, and dismissal. (7) The maintenance and use of necessary forms and records to indicate days worked, sick leave, vacations, leaves of absence, etc. (8) The establishment and maintenance of suitable methods for effective communication between the Council, City Administrator, supervisors and other employees relating to conditions of employment in the City service. D. All original and promotional appointments shall be for a probationary period of not less than six (6) months, and may be extended to one year at the discretion of the City Administrator. During the probationary period the em- ployee may be rejected at any time. An employee rejected during the probationary period from a position to which he was promoted shall be reinstated to the former position unless he is discharged for a reason which would have been sufficient to cause his discharge from his former position. ® E. In order to assist in the determination of qualifications of employees or proposed employees of the City under Section 1941 of the Labor Code, each employee or proposed employee shall submit a copy of his birth certificate or citizenship certificate to tle City Administrator.. Such birth certificate or citizenship certificate shall be kept on file in the city office at all times during such person's employment. F. Every officer or employee of the City shall, before entering on the duties of his office or employment, take and subscribe the oath or affirmation set forth in Section 3 or Article XX of the Constitution of the State of California. G. Any person holding a position of employment in- cluded in the classified service who, on the effective date of this ordinance, shall have served continuously in such position, or in some other position included in the classified service, for a period equal to the probationary period prescribed in this chapter, shall assume regular status in the classified service in the position held on such effective date without additional qualification thereto, and shall thereafter be subject in all respects to the provisions of this chapter. - 2 - • 0 Section 2904. Political Activity. A. Employees in the service of the City shall not: (1) Seek or accept election, nomination, or appoint- ment as an officer of a political club or political organization. (2) Take an active part in a Rosemead municipal political campaign. (3) Act as workers at the polls. (4) Act as political workers or distribute badges, pamphlets, dodgers, or handbills of any kind favoring,or opposing any candidate for election or nomination to a city office. (5) Take part in political activity of any type during hours of regular employment and at city offices. B. This section does not prevent any employee from: (1) Becoming or continuing to be a member of a political club or organization. (2) Attendance at a political meeting. (3) Enjoying entire freedom from all interference in casting his vote. (4) Seeking or accepting election or appointment to public office other than an elective office in the City of Rosemead. (5) Seeking signature to any initiative or referendum petition directly affecting his rates of pay, hours of work, retirement, civil service, or other working conditions. (6) Distributing badges, pamphlets, dodgers, or handbills or other participation in any campaign . in connection with such petition if the activity is not carried on during hours of work, or when he is dressed in the uniform required in any department of the City government, except as prohibited in Subsection B (3) of this section. Section 2905. Solicitation of Contributions. No officer or employee of the City, or any other person directly or indirectly shall solicit or receive, or in any manner be concerned in soliciting or receiving, from anyone on an eligible lish or employed in the service of the City any assessment, subscription, contribution or political service, for aiding or assisting in the campaign for election or appointment to any political or official or other position in the City, either partisan or non-partisan. - 3 - Section 2906. Discrimination. No person in the classified service or seeking admission thereto shall be favored or discriminated against in his employment because of political affiliations, race, or religious beliefs. 1961.
