Ordinance No. 027 - Care and Expenditure of Moneys Received from SOC• ORDINANCE NO. 27. AN ORDINANCE OF THE CITY OF ROSEMEAD RELATING TO THE CARE AND EXPENDITURE OF MONEYS RECEIVED FROM THE STATE OF CALIFORNIA UNDER THE PROVISIONS OF ARTICLE 51 CHAPTER 1, DIVISION 1 OF THE STREETS AND HIGHWAY CODE. `W THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN AS FOLLOWS: Section 1. To comply 5 of Chapter I of Division"1 of there is hereby created in the be known as the "Special Gas Ta with the provisions of Article the Streets and Highways Code, City Treasury a special fund to x Street Improvement Fund." Section 2. All moneys received by the city from the State of Ca TT ornia under the provisions of the Streets and Highways Code for the acquisition of.real property or interests therein for or the construction, maintenance or improvement of streets or highways other than State highways shall be paid into said fund. Section 3. All moneys in said fund shall be expended exclusively or tie purposes authorized by, and subject to all of the provisions of-Article 5, Chapter 1, Division 1 of the Streets and Highways Code. Section 4. The City of Rosemead was incorporated on the 4th day o August, 1959 and there is presently no ordinance in existence creating the gas tax and improvement fund required by the provisions of Article 5, Chapter 1, Division 1 of the Streets and Highways Code. To comply with said code and to provide for the deposit of monies to be received imminently by the City of Rosemead in said fund, it is essential that this fund be created immediately. This ordinance is therefore an urgency ordinance and shall take effect immediately. Section 5. The City Clerk shall certify ,to the passage an adoption of this ordinance and shall cause the same to be posted in three public places within the City of Rosemead. This ordinance is an ordinance for the immediate_preserva ion of the public peace, health and safety and pursuant to the provisions of sub-section (b) of Section 36937 of the Government Code shall take effect immedi- ately. The facts constituting such urgency are as follows: The City Council and the City Planning Commission are presently,,conducting studies for the purpose of adopting a master plan or program of planning and a°permanent zoning ordinance, including regulations pertaining to the required area and other conditions which must be complied with before buildings or structures may be erected, constructed, occupied, used, altered or enlarged on-lots or parcels of land in Zones R-1, R-2, R-A, A-1 and A-2-H. The erection, construction or alteration of many buildings and structures contrary to the contemplated scheme or plan of use envisioned by such master plan or program of planning and permanent zoning ordinance is imminent and would seriously interfere with the orderly and planned development of the City of Rosemead pursuant to the provisions of..the Planning Law of the State of California, unless this ordinance is given immediate effect. The unregu= lated erection, construction, or alteration of such buildings or structures will impair seriously the health and welfare of persons, and the safety of persons and property within the City, by causing over.,crowded conditions, fire and traffic hazards, congestion and unsightliness.
