Public Hearing on the Consolidated Annual Performance and Evaluation Report (CAPER) for FY 2016-17 The City of Rosemead's Community Development Department has completed its Consolidated Annual Performance Report (CAPER) for the period July 1, 2016, through June 30, 2017. The CAPER describes the overall use of federal Community Development Block Grant (CDBG) and HOME Investment Partnerships (HOME) funds received from the Department of Housing and Urban Development (HUD) in relationship to the needs of the community as outlined in its Fiscal Year (FY) 2016-17, Annual Action Plan. The City's overall objective in the CDBG and HOME programs is the development of viable communities by providing decent housing, a suitable living environment and expansion of economic opportunities primarily for low -to -moderate income persons. City Council and the Successor Agency to the Rosemead Community Development Commission Special & Joint Meeting Agenda October 24, 2017 Recommendation: It is recommended that the City Council conduct a public hearing and take public testimony on the City's FY 2016-17, Consolidated Annual Performance and Evaluation Report. No further City Council action is necessary. B. Public hearing on Modification 17-07, a City Initiated Request to Eliminate Condition of Approval Number 59 from the Conditions of Approval of Modification 16-02 (Walmart) The City is initiating a request to modify the conditions of approval for Modification 16-02 by eliminating Condition of Approval Number 59. On April 25, 2017, the City Council adopted Resolution 2017-08 and approved Modification 16-02, which modified Condition of Approval Number 59 of Development Agreement 04-01, Tentative Parcel Map 26827, and Conditional Use Permits 02- 882 and 03-939. The modification amended the requirements of the annual Planning Commission review of Walmart's compliance with the conditions of approval to requiring Planning Division staff to conduct a quarterly meeting with Walmart and neighboring residents within a 300 -foot radius. City Council Meeting Minutes Recommendation: That the City Council approve the minutes from the regular meeting on September 12, 2017 and the minutes from the special meeting on September 19, 2017. C. Request to Install Red Curb — 8336 Mission Drive The Traffic Commission received a request from a resident living at 8336 Mission Drive to paint a minimum of 5 -feet of red curb on the east and west side of her driveway. The resident's complaint describes a lack of visibility due to vehicles parking along the curb, in front of her residence, obstructing the view of oncoming traffic, which creates a hazardous condition for her and her family members to reverse out of the driveway. The resident also stated that on trash pick-up days, the vehicles are parked too close to her driveway leaving her no place to put her trash cans. On September 7, 2017, the Traffic Commission reviewed the traffic conditions and recommended the installation of 5 -feet of red curb on the east and west side of the driveway apron. Recommendation: It is recommended that the City Council approve the Traffic Commission's recommendation to install 5 -feet of red curb on the east and west side of the driveway apron. D. Request to Install Red Curb — Singing Wood Lane The Traffic Commission received a request from a resident living at 4600 Singing Wood Lane to install red curbing on the east and west side of the entrance way to Singing Wood Lane, along Mission Drive. The resident's complaint describes a lack of visibility when exiting from Singing Wood Lane due to vehicles parked along the curb, which creates hazardous conditions. The resident also stated that on trash pick-up days, the vehicles are parked too close to the entrance way of Singing Wood Lane leaving no place for the residents to put her trash cans along Mission Drive. Recommendation: It is recommended that the City Council approve the Traffic Commission's recommendation to install 5 -feet of red curb on the east and west side of Singing Wood Lane. 5 City Council and the Successor Agency to the Rosemead Community Development Commission Special & Joint Meeting Agenda October 24, 2017 E. Request for Traffic Improvements — Intersection of Fern Avenue and Jackson Avenue (near Bitely Elementary School) The Traffic Commission received a request from the Garvey School District's Chief Business Officer, Grace Garner, regarding traffic concerns at the intersection of Jackson Avenue and Fern Avenue. This intersection serves two nearby schools: Bitely Elementary School and Garvey Intermediate School. On September 7, 2017, the Traffic Commission reviewed conditions at this intersection and recommended to paint advance "Stop" lines 4 -feet prior to the crosswalks in all four legs of the intersection of Fern Avenue and Jackson Avenue, paint 20 -feet of red curb on all corners at the same intersection, and repaint all existing red curbing within the area. Ordinance No. 975 — Second Reading and Adoption: Repealing Chapter 9.30 Titled Residency Restrictions for Registered Sex Offenders from the Rosemead Municipal Code On September 12, 2017, the City Council introduced Ordinance No. 975, repealing chapter 9.30, titled residency restrictions for registered sex offenders from the Rosemead Municipal Code. Recommendation: It is recommended that the City Council approve the second reading and adoption of Ordinance No. 975, AN ORDINANCE OF THE CITY COUNCIL OF ROSEMEAD REPEALING CHAPTER 9.30 TITLED RESIDENCY RESTRICTIONS FOR REGISTERED SEX OFFENDERS FROM THE ROSEMEAD MUNICIPAL CODE G. Resolution No. 2017-54 —Authorizing the Recordation of the Irrevocable Drainage Easement for those portions of LA County Assessor Parcel No's. 5282-026-048 & 5282-026-049 for Storm Drainage Maintenance In accordance with the City of Rosemead Municipal Code Section No. 16.08.220, the owner(s) of the property located at 9048 Garvey Avenue have submitted an executed irrevocable offer of drainage easement. The irrevocable offer of dedication has been determined by the City Engineer to be necessary and appropriate to permit storm drainage maintenance. Recommendation: It is recommended that the City Council approve Resolution No. 2017-54, authorizing the City Engineer to execute and record the irrevocable offer of drainage easement for Los Angeles County Parcel No. 5282-026-048 & 5282- 026-049. City Council and the Successor Agency to the Rosemead Community Development Commission Special & Joint Meeting Agenda October 24, 2017 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, AUTHORIZE CITY STAFF TO EXECUTE AND RECORD THE IRREVOCABLE OFFER OF DEDICATION OF A GRANT OF EASEMENT FOR DRAINAGE PURPOSES LOCATED AT 9048 GARVEY AVENUE (APN 5282-026-048 & 5282-026-049) H. Amendment to the Crossing Guard Services Agreement with All City Management Services, Inc. and Annual Cost Sharing Agreement with Rosemead School District The City Council will consider an amendment to an agreement with All City Management Services, Inc., (ACMS) for crossing guard services near Emma W. Shuey Elementary School (Shuey Elementary), and annual cost sharing agreements with the Rosemead School District for crossing guard services for the 2017/18 Fiscal Year (FY). The amendments to the agreement will add an additional crossing guard in the Rosemead School District at Shuey Elementary. Recommendation: It is recommended that the City Council authorize the City Manager to: 1. Execute an Amendment to an Agreement with All City Management Services, Inc. for crossing guard services through June 30, 2019; and 2. Execute the cost sharing agreement with the Rosemead School District in funding the crossing guard services for the 2017/18 Fiscal Year, and 3. Appropriate additional funding in the FY 2017/18 budget for crossing guard services in the amount of $4,252.01. I. Resolution No. 2017-57, Approving the Walnut Grove Avenue Resurfacing Project Funded by the Road Repair and Accountability Act On April 28, 2017, the Governor signed a Senate Bill (SB) 1, which is known as the Road Repair and Accountability Act of 2017 (RMRA); to address basic road maintenance, rehabilitation and critical safety needs on both the state highway and local streets road system. In order to receive RMRA funds, the City must meet a "Maintenance of Effort" requirement to ensure that these new road funds do not supplant existing levels of general revenue spending on streets and roads. Recommendation: It is recommended that the City Council: 1. Adopt Resolution No. 2017-57, approving the Walnut Grove Avenue Resurfacing Project from Marshall Avenue to Northerly City Limit funded by the Road Repair and Accountability Act — Senate Bill SB 1. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, TO APPROVE THE LIST OF City Council and the Successor Agency to the Rosemead Community Development Commission Special & Joint Meeting Agenda October 24, 2017 PROJECTS TO BE FUNDED BY SB 1 THE ROAD AND REPAIR AND ACCOUNTABILITY ACT 2. Approve a budget appropriation of $57,000 from the General Fund unassigned fund balance to meet the MOE requirements. J. Resolution No. 2017-55 — Adoption of Resolution Accepting a Quitclaim Deed of Public Road and Highway Easement for a Portion of River Avenue located South of Garvey Avenue In accordance with the City of Rosemead Municipal Code Section No. 16.08.220, Los Angeles County has submitted an executed Quitclaim Deed to forever quitclaim to the City of Rosemead, all its right, title, and interest in that portion of River Avenue as shown Exhibit `B". The City Engineer has determined that the Quitclaim Deed of Public Road and Highway Easement Offer of Dedication are necessary and appropriate to allow access to the landlocked property at 2562 River Avenue at Fern Avenue. City staff is requesting the City Council adopt Resolution No. 2017-55, accepting the quitclaim and authorizing the City Manager to execute the Certificate of Acceptance. Recommendation: It is recommended that the City Council adopt Resolution No. 2017-55, accepting the Quitclaim Deed of Public Road and Highway Easement from Los Angeles County for a portion of River Avenue, South of Garvey Avenue, and authorize the City Manager to execute the attached Certificate of Acceptance. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ACCEPTING AN EASEMENT QUITCLAIM DEED FROM LOS ANGELES COUNTY FOR A PORTION OF RIVER AVENUE LOCATED SOUTH OF GARVEY AVENUE K. Adoption of Annual Resolution Establishing Compensation and Benefits for the City Council The City Council will consider approval of the annual Resolution establishing compensation and benefits for the City Council of the City of Rosemead. The purpose of the annual compensation and benefits resolution is to ensure transparency and reaffirm the compensation and benefits provided to the City Council. Recommendation: It is recommended that the City Council adopt Resolution No. 2017-57, for the City Council with no changes from the prior year. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, CALIFORNIA, ESTABLISHING ANNUAL SALARY RANGES AND BENEFITS FOR THE CITY COUNCIL OF THE CITY OF ROSEMEAD City Council and the Successor Agency to the Rosemead Community Development Commission Special & Joint Meeting Agenda October 24, 2017 L. Resolution 2017-59 - Providing Permission to Councilmember Alarcon to be Absent from Council Meetings Pursuant to Government Code Section 36513 Councilmember Alarcon has missed two regularly convened council meetings and will likely miss the next several meetings in order to attend to a personal health issue. California Government Code Section 36513 provides that the City Council may grant permission to a Councilmember to be absent from Council meetings for a period longer than 60 days, which if unexcused, would result in their office becoming vacant. Recommendation: It is recommended that the City Council adopt Resolution 2017- 59, providing permission for Councilmember Alarcon to be absent from the next several Council meetings to attend to his health issues. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROSEMEAD, . CALIFORNIA GRANTING PERMISSION TO COUNCILMEMBER ALARCON TO BE ABSENT FROM COUNCIL MEETINGS PURSUANT TO GOVERNMENT CODE 36513 6. MATTERS FROM CITY MANAGER & STAFF A. Consideration of Senate Bill 415 and Consolidation with a Statewide Election Date Senate Bill (SB) 415, also known as the California Voter Participation Rights Act, amended the State Elections Code pertaining to municipal election dates. The bill requires cities that currently hold standalone municipal elections to change their election dates to coincide with statewide election dates, unless voter turnout rates for past standalone elections meet a certain threshold. The City's past voter turnout rates are lower than the threshold established by SB 415, so the City must move its election date to coincide with a statewide election date. Recommendation: It is recommended that the City Council discuss the options available and provide direction to staff. B. Direction on Painting by Guy Rose A painting by Guy Rose was recently re -discovered at City Hall. Guy Rose, a son of Rosemead founder L.J. Rose, was regarded as a very accomplished California impressionist artist. The painting was originally donated to the City by Markel Gallagher, the granddaughter of L.J. Rose, in February of 1980. In February of 2002, the City had the painting restored and attempted to sell it at auction by John Moran Auctioneers for minimum sale price of $35,000. The highest offer received at auction was $25,000, which did not meet the minimum sales price. After the unsuccessful sale, the City opted to hold onto the painting. Receive Comments from Councilmember Armenta Regarding the City Clerk Contract Amendment At the August 8, 2017, City Council meeting, the City Clerk received a "meets expectation" review with a 3.6 rating. At the September 12, 2017, City Council meeting, the first amendment to the City Clerk employment agreement was approved by the City Council. Since that time, Councilmember Armenta has requested to put the item on back on the agenda to provide comments. Recommendation: Receive comments from Mayor and City Council. B. Accessibility and Technology Reimbursement Administrative Policy This item is presented to the City Council at the request of Councilmember Armenta. Councilmember Armenta would like to discuss Administrative Policy 30- 02: Accessibility and Technology Reimbursement Policy as it related to provision B. Provision B — Because these technologies are required to maintain contact with one another, the City will provide the City Council, the City Manager, Department Heads, and Division Heads an annual technology reimbursement that includes the following components: Once per calendar year, participants will be qualified for a one-time reimbursement amount of no more than $300 for the purchase of eligible electronic devices. In order to be eligible for the reimbursement, receipts must be turned in. • Beginning in the month in which participants sign-up for this program, eligible employees shall also receive a reimbursement of up to $150 per month for applicable technology costs such as a voice and data plan. In order to be eligible for the reimbursement, receipts must be turned in. Recommendation: Discuss and provide direction to staff. C. City Council Comments 8.
