EASEMENT FOR A PORTION OF RIVER AVENUE LOCATED SOUTH
OF GARVEY AVENUE
SUMMARY
In accordance with the City of Rosemead Municipal Code Section No. 16.08.220, Los Angeles
County has submitted an executed Quitclaim Deed to forever quitclaim to the City of Rosemead,
all its right, title, and interest in that portion of River Avenue as shown Exhibit "B". The City
Engineer has determined that the Quitclaim Deed of Public Road and Highway Easement Offer
of Dedication are necessary and appropriate to allow access to the landlocked property at 2562
River Avenue at Fern Avenue. City staff is requesting the City Council adopt Resolution No.
2017-55, accepting the quitclaim and authorizing the City Manager to execute the Certificate of
Acceptance.
DISCUSSION
On December 16, 1958, a resolution of intention was adopted by the Board of Supervisors from
the County of Los Angeles in the matter of proposed vacation of portions of River Avenue and
Muscatel Avenue, located easterly of Walnut Grove Avenue. The Board of Supervisors
determined that portions of River Avenue and Muscatel Avenue be vacated and abandoned,
subject to provisions of then-codified Section 959.1 of the Streets and Highways Code of the
State of California. Nevertheless, the described portions were never vacated by Los Angeles
County. City staff and Los Angeles County staff could not find any document officially vacating
the property following the resolution of intention. Therefore, the property located at 2562 River
Avenue is a"Landlocked Property", meaning the property has no direct access to a public street.
On July 8, 2015, the City Manager of the City of Rosemead requested that Los Angeles County
prepare the necessary documents in order to quitclaim to the City of Rosemead, a portion of its
current easement for public access/road purposes adjacent to 2562 River Avenue and Whittier
Narrows Golf Course. The City desires to provide public access for the property owner through

the property.
The Board of Supervisors of the County of Los Angeles has executed a Quitclaim Deed
quitclaiming a portion of its public road and highway easement to allow access to the property at
2562 River Avenue at Fern Avenue.
STAFF RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 2017-55, accepting the Quitclaim
Deed of Public Road and Highway Easement from Los Angeles County for a portion of River
Avenue, South of Garvey Avenue, and authorize the City Manager to execute the attached
Certificate of Acceptance.
FISCAL IMPACT—None
ENVIRONMENTAL REVIEW
The project is categorically exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301 (a) of the CEQA Implementing Guidelines.
STRATEGIC PLAN IMPACT—None
LEGAL REVIEW
Resolution No. 2017-55 has been reviewed and approved by the City Attorney.

RESOLUTION NO. 2017-55
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD, CALIFORNIA, ACCEPTING AN EASEMENT QUITCLAIM
DEED FROM LOS ANGELES COUNTY FOR A PORTION OF RIVER
AVENUE LOCATED SOUTH OF GARVEY AVENUE
WHEREAS, Government Code Section 27281 provides an instrument conveying an interest in
real property to the City may not be recorded without a Certificate of Acceptance from the City
Council; and,
WHEREAS, a description of the Quitclaim Deed of Public Road and Highway Easement has
been submitted to and approved by City staff and is attached as Exhibit"A"and Exhibit"B"; and,
WHEREAS, pursuant to the provisions of the State of California Government Code Section
66477.2, offers of dedication must be accepted or rejected by the local governing body; and,
WHEREAS, The City Council finds and determines that the Quitclaim Deed easement for street
purposes described and depicted in the Quitclaim Deed attached to the staff report dated October
24, 2017 is acceptable.
NOW,THEREFORE,the City Council of the City of Rosemead does hereby resolve as follows:
SECTION 1. The easement for all purposes a public road as depicted in the Quitclaim Deed and
shown in Attachment A in the staff report dated October 24, 2017, is accepted.
SECTION 2. The City Manager is hereby directed to execute the Certificate of Acceptance
attached to the hereto before described Quitclaim Deed.
SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a
certified resolution to be filled in the Office of the City Clerk, and shall cause Quitclaim Deed
with the executed Certificate of Acceptance to be recorded with the County Recorder's Office.
