Workshop
The special meeting of the Rosemead City Council was called to order by Mayor Low at 6:11 p.m.
in the Rosemead City Council Chamber located at 8838 East Valley Boulevard, Rosemead,
California
PRESENT: Mayor Low, Mayor Pro Tern Ly, Council Members Armenta (arrived at 6:14 p.m.)

1. WORKSHOP
A. Highway Safety Improvement Program—Rosemead Boulevard
City Engineer Fajardo gave a brief presentation on the Highway Safety
Improvement program beginning from the Union Pacific Rail Road overpass to
Valley Boulevard on Rosemead Boulevard. He explained there are ADA compliant
deficiencies and lack of landscape. He clarified that Rosemead Boulevard on the
City's side is owned and maintained by Caltrans, while the Temple City side of the
Rosemead Boulevard is owned by them.
Mayor Low asked if the City of Temple City was aware of the drain issue as shown
in the power point presentation.
Mayor Pro Tem Ly replied Temple City was aware of the issue,however there was
a debate that the City of Rosemead was going to paint the portion of the grade
separation and put Rosemead's emblem on it. Temple City did allow the City to
paint because the separation grade is in their city.
City Engineer Fajardo continued with the presentation and explained an application
was submitted to Caltrans for Rosemead Boulevard Highway Safety Improvement
Program for the construction of sidewalk, landscape parkway on the easterly side
and westerly side from Grand Avenue to the northern city limits. The project
included pedestrian lighting, installation of bike lanes type 2,minor traffic signal
upgrades on the intersection of Valley Boulevard and Mission Drive.

In 2011, Rosemead was selected for funding for preliminary engineering and
construction funds with a total funding of$512,883. Since Rosemead Boulevard is
owned by Caltrans an encroachment permit was required;plans, revisions, and fact
sheets were submitted. At that time, the Interim Public Works Director had placed
a hold on the project. Since then,Caltrans closed the application and the City would
have to start the application process again to move forward with the project.
Council Member Armenta asked if there were any application fees.
City Engineer Fajardo replied the City had spent money on the application process
and due to the new regulations from Caltrans, they were only approving the
sidewalk project portion,which allowed for ADA compliance for pedestrian safety.
Mayor Low suggested Caltrans should make the ADA compliant changes, since
they own Rosemead Boulevard.
Mayor Pro Tem Ly expressed Caltrans may never make the changes to the sidewalk
and it would be a disservice to the residents. However, if the City pays for the
improvements then the project would get done.
Mayor Low asked for clarification on why the permit was cancelled.
City Manager Manis stated the window of opportunity expired, therefore the City
would have to reapply for the permits.
Mayor Pro Tem Ly stated the Public Works Department has been without a Director
for the last three years.
Council Member Armenta asked who the Interim Public Works Director was that
placed a hold on the project.
Director of Public Works Ramirez replied Anthony La.
City Engineer Fajardo stated that Mr. La had said he knew somebody from Caltrans
in a high ranking position, who could move the project along.
Director of Public Works Ramirez also added because of the grant funding the City
received, there was a deadline to have the project completed by August of 2018.
Mayor Pro Tem Ly suggested staff use the similar tactics used on the Jay Imperial
Park project for the Rosemead Boulevard improvements. He reiterated the
improvements to the sidewalk is a benefit to the residents.
Council Member Clark expressed concerns and asked why the City had to pay for
the project, when the money could be used for other projects in the City.
Mayor Pro Tern Ly replied by improving and beautifying the area it would create a
transition on Rosemead Boulevard entering Temple City. Currently, you lose bike
lanes, beautification, and sidewalk on the City's side.

Council Member Clark reiterated she could not support the project because there
was no landscape and people would question the City's decision. She requested to
hold off on the project and noted someone from the ADA community could
possibly force Caltrans to do the project through litigation.
Mayor Pro Tern Ly disagreed and stated the City had to do more on the north end
of the City near the rail road to protect the residents.
Mayor Low inquired on the cost to move forward with the project and construction.
City Engineer Fajardo replied there would be an initial soft cost of$35,000 which
includes the encroachment permit process. The construction project would cost
approximately $550,000.
Mayor Low requested staff to provide a finalized cost of the construction and an
explanation of the funding sources for the project.
Director of Public Works Ramirez stated since the next City Council meeting was
scheduled for October 24`h, it narrowed the timing of the August deadline. Also, if
Caltrans has additional changes, that could delay the permit process. Therefore,
staff could not have a full cost analysis of the project for the next meeting. There is
enough grant funding to move forward with the project if Council authorizes to
proceed.
Council Member Armenta asked is some of the work could be done in-house to
expedite the process.
City Engineer Fajardo replied that Caltrans requires a stamp of a professional
engineer outside of the City on the fact sheet, which is a legal document showing
the City is in compliance with Caltrans standards.
City Manager Manis stated there are components that could be done in-house and
other components could be consulted.
Director of Public Works Ramirez explained the City limits its liability when an
outside professional engineer is used for a project.
Council Member Clark asked if the grant could be used elsewhere.
City Engineer Fajardo replied the grant received was exclusively for the highway
improvement project.
Mayor Pro Tem Ly explained the City receives a share funding of Measure R every
year.
Public Works Director Ramirez reiterated if the project is not going to move
forward,the City would only lose the grant money and not the Measure R funding.
The gas tax and Measure R funds could be used for other projects.

Council Member Armenta added the Capital Improvement Project could not be
done with just $70,000; the full $438,000 is needed to complete the project. ' —
Council Member Clark expressed concerns if the City Council endorsed the project,
there are no protected bike lanes in the design. She reiterated that she could not
support the project due to the lack of landscaping, no protected bike lane
improvements and because it's Caltrans responsibility.
Mayor Low asked what would be other options, if the City misses the deadline to
complete the project.
Director of Public Works Ramirez stated the City would have to fund the project
with other city monies.
City Manager Manis stated there are ways to look at the project from a killing stand
point, there could be monies expended without the project technically being
completed and then invoicing the cost of the project before the August deadline.
City Engineer Fajardo agreed and stated submitting an invoice in the amount of
$430,000 by August 29th, 2018 would be fine.
Council Member Armenta stated there are currently no protected bike lanes on
Rosemead Boulevard and if the project moves forward, there would still be no
protected bike lanes in the design.
Mayor Pro Tem Ly reiterated that the priority is making the sidewalk ADA
compliant for the safety of the residents.
Director of Public Works Ramirez requested to the City Council to direct staff to
resubmit the application and start the process. Staff could provide a breakdown of
the construction cost at the October 24th meeting.
Director of Finance Lieu explained Measure R funds have been exhausted. The Gas
Tax has approximately$70,000,and the grant is for$430,000. If needed,additional
funds are available and Measure R appropriations could be made during the mid-
year budget adjustments.
Council Member Clark stated there was no guarantee the gap and sidewalk which
belongs to Temple City is going to be extended. She requested to not move forward
with project.
City Attorney Richman stated there is no recommended action but staff was
requesting direction from the City Council.
ACTION: Moved by Mayor Pro Tem Ly and seconded by Council Member
Armenta to authorize staff to resubmit for an encroachment permit application with "^
Caltrans and to return at the October 24`h meeting with further cost analysis of the

The regular joint meeting of the Rosemead City Council, Housing Development Corporation, and
Successor Agency to the Rosemead Community Development Commission was called to order by
Mayor Low at 7:05 p.m. in the Rosemead City Council Chamber located at 8838 East Valley
Boulevard, Rosemead, California.

Mayor Low announced agenda item 6A and 6B would be discussed after the public comment
portion of the agenda.
2. PUBLIC COMMENT
Brian Bristol, Principal at Rosemead High School, thanked Councilmember Clark for
attending their 9/11 5k run event. In addition, he stated Rosemead High School was doing
great on their programs and has seen an increase on student enrollment. He thanked the
City Council for their ongoing support to the school and community.
Josephine Elizondo representing the senior clubs at Garvey Community Center, submitted
a petition for the record, in support to consider Janette Vicario as the Recreation Supervisor
for the Garvey Community Center.
6. MATTERS FROM CITY MANAGER& STAFF
A. Organic Waste Recycling Program
Recommendation: It is recommended that the City Council approve the Organic
Waste Recycling Program proposed by Republic Services by adopting Resolution
Number 2017-45.

Director of Public Works Ramirez reported that in October 2014, Governor
Brown signed a bill which required local jurisdictions to implement an organic
waste recycling program to divert organic waste generated by businesses,
including multifamily residential dwellings that consist of five or more units. In
addition, the City's franchise waste hauler Republic Services, proposed a fully •
compliant AB 1826 program for Rosemead that would divert organic materials
from landfills to reduce greenhouse gas emissions.
Brian Lewin, resident, stated he was in favor of the program and suggested
implementing an oversight component to the program. He expressed concerns
with multifamily properties that are still trying to implement recycling programs.
Lastly, he expressed support on using the current waste hauler to implement the
organic waste recycling program.
Mayor Pro Tern Ly asked how staff was going to address the language barrier,
with Chinese, Vietnamese, and Spanish speaking restaurants and dining facilities
to understand the importance of the organic waste recycling program.
Director of Public Works Ramirez explained the City's waste hauler, Republic
Services,has the languages available to communicate with different businesses in
the City.
Mayor Pro Tern Ly requested staff to conduct public outreach before October 1"
and asked for a future update of the types of outreach that would be conducted. —"
Director of Public Works Ramirez assured the waste hauler, Republic Services
provides outreach material in different languages and could provide samples the
City Council.
Mayor Pro Tern Ly stated the State may eventually regulate recycling for residents
and requested staff to develop a voluntary residential recycling program. IIe
explained that a voluntary program may give residents the option to start recycling
mixed waste. In addition, requested staff to look into mix stream "muffing" of
waste, because there are materials going into the black waste bin that could be
recycled.
Mayor Low shared that during her trip to Canada, they implemented a similar
program. However, she noticed, there was an increase of flies in the dining
facility. She asked how dining facilities in the City could prevent an increase of
flies, as a result of the organic waste recycling program.
Jeff Snow, representative for Republic Services, stated the company would
provide commercial food waste establishments containers with secured lids that
are vector controlled proof. In addition, it is recommended to place the containers
in freezers to mitigate odors from decomposing. For businesses who do not have
freezers, its recommend to request frequent service pick-ups.

Mayor Pro Tern Ly suggested staff speak with potential applicants in doing
restaurant like businesses to install a larger refrigeration storage space.

B. Ordinance No. 975 Repealing Chapter 9.30 Titled Residency Restrictions for
Registered Sex Offenders from the Rosemead Municipal Code
Recommendation: It is recommended that the City Council introduce for first
reading, by title only, Ordinance No. 975, entitled:
AN ORDINANCE OF THE CITY COUNCIL OF ROSEMEAD
REPEALING CHAPTER 9.30 TITLED RESIDENCY
RESTRICTIONS FOR REGISTERED SEX OFFENDERS FROM
TILE ROSEMEAD MUNICIPAL CODE
City Attorney Richman reported the City received a letter from an attorney
indicating that a recent case law has held that additional residency restrictions that
are placed on sex offenders are not being upheld in court.The Sheriffs Department,
as a practice, is not enforcing those additional restrictions because of the risk of
doing so. Therefore, staff was recommending the removal of the added restrictions
to avoid any future litigation.
ACTION: Moved by Mayor Pro Tem Ly and seconded by Council Member
Armenta to introduce for first reading Ordinance No. 975 by title only. Motion was

3. PRESENTATIONS
A. Taking Back Our Community Presentation—Oliver Chi, Monrovia City Manager
Oliver CM, City Manager of City of Monrovia spoke of a new- coalition of cities
getting together to work on developing reforms related to California's criminal
justice System. He described the impacts of AB 109, shifting responsibility for
housing and supervising of non-serious, non-violent, non-sexual offenders from
State prison to local county jail facilities; Proposition 47, drug possession crime
reduced from felonies to misdemeanors; reduced theft under $950 to a
misdemeanor; and allowed persons already convicted of said offenses to petition
for reduction and resentencing. Proposition 57 eliminated direct filing on juveniles
and raised fitness criteria; made"non-violent"offenders in State prison eligible for
early parole; and allow the early release of all persons incarcerated in State prison.
As a result, the Taking Back Our Community Coalition has developed a network
of over 20 cities and invited the City of Rosemead to take part on the coalition.

Council Member Armenta thanked and congratulated Mr. Chi for heading the
campaign to keep the San Gabriel Valley and children safe.
Mayor Low inquired as to what the plans were for the Coalition, other than the
education component.
Mr. Chi explained the initial part was to educate and engage constituents and next
was to possibly propose a ballot proposition which would go directly to the voters
for legislative changes at the State level. The Coalition has been evolving quickly
and trying to determine what the next steps would be.
B. Rosemead 3rd Annual Back-to-School Resource Fair Recognitions
Mayor Low thanked donors for participating in the Back-to-School Resource Fair
to assist children to receive school supplies.
Council Member Armenta commended Public Safety Supervisor Mandy Wong for
her work and dedication in coordinating the donations of school supplies. She also
recognized Ray Jan, Executive Director of the Rosemead Chamber of Commerce
for her help to secure donations.
The City Council presented certificates of recognition to the Annual Back-to-
School Resource Fair volunteers.
Public Safety Supervisor Wong thanked the City Council and stated they were ..,.
honored to be part of the event.
C. Former Traffic Commissioner Recognition—Joanne Russell Chavez
Ms. Joanne Russell-Chavez was not in attendance to receive her recognition.
D. Former Beautification Committee Recognitions — Martha Ruvalcaba & Veronica
Pena
The City Council presented certificates of recognition to Martha Ruvalcaba for her
service to the Beautification Committee since the committee's inception in 2013.
Council Member Armenta commended Mrs. Ruvalcaba for her civic service to the
community and her commitment to the Beautification Committee.
Veronica Pena was not in attendance to receive her recognition.
Council Member Armenta left the City Council meeting at 8:03 p.m. to go to the
airport for the League of California Cities Conference.
E. Garvey School District Computer Science Program Recognitions
Mayor Low commended the Garvey School District for being proactive in teaching -
computer programing to the students as part of their curriculum.

City Council presented certificates of recognition to the Garvey School District
teachers, staff, and students for their Computer Science Program.
Anita Chu,Garvey School District Superintendent thanked the City Council for the
recognition and the support of their ongoing partnership.
Robert Bruesch, Garvey School Board Member spoke about the Computer Science
Program and the success students have had.
Council Member Clark praised the Computer Science Program.
Mayor Pro Tern Ly commended the school district for the Computer Science
Program and thanked Garvey School District Board Members Bruesh and Chin for
their service to the school district.
F. Rosemead School District Teacher of the Year—Respect Ly, Janson Elementary
The City Council presented a certificate of recognition to Rosemead School District
Teacher of the Year, Respect Ly for her commitment in working with children.
Ms. Ly thanked the City Council for the recognition and expressed how much she
enjoys working with children to reach their goals.
G. National Preparedness Month Proclamation
Public Safety Supervisor Wong spoke on the importance of emergency
preparedness and planning.
The City Council presented Public Safety Supervisor Wong and the CERT Team
with a proclamation for National Preparedness Month.

Resurfacing Project; and (2) authorize the City Manager to enter into a contract
with All American Asphalt for the Garvey Avenue Resurfacing Project in the
amount of$629,645.00 and authorize a contingency in the amount of$70,355.00 ,
(approximate 10%)to cover the cost of any unforeseen constructions expenses.
E. Approval of First Amendment to City Clerk Employment Agreement
Recommendation: It is recommended that the City Council consider approving the
First Amendment to the City Clerk Employment Agreement granting a 2% salary
increase to the City Clerk.
F. Request to Install Red Curb - 1060 Walnut Grove Ave
Recommendation: It is recommended that the City Council approve the Traffic
Commission's recommendation to add 10 additional feet of red curb to the south of
the driveway apron at 1060 Walnut Grove Avenue and repaint all existing red
curbing within the area.
G. Review of Traffic Conditions at Lawrence Avenue between Muscatel Avenue and
Ivar Avenue
Recommendation: It is recommended that the City Council approve the Traffic
Commission's recommendation to install"School Speed Limit Assembly C"(SR4-
1) signs on Laurence Avenue east of Muscatel Avenue for eastbound traffic and
west of Ivar Avenue for westbound traffic. ' -

I. Proposed Support of Public Safety Related Legislative Advocacy Efforts
Recommendation: It is recommended that the City Council direct the League of
California Cities representative to vote in support of the Whittier Resolution
(Attachment A), approve the Resolution supporting the Taking Back Our
Communities Coalition (Attachment 13), and authorizes the City Manager or his
designee to execute all necessary documents (Attachment C).

Recommendation: It is recommended that the City Council authorize the
attendance, at City expense, of any Council Member that wishes to attend the NLC
—City Summit in Charlotte,NC,from November 15-18, 2017.
ACTION: Moved by Mayor Pro Tern Ly and seconded by Council Member Clark
to approved Consent Calendar items A, B, C, D, F, F, G, H, I, and J. Motion was
carried by the following vote: AYES: Clark, Low Ly and ABSENT: Alarcon
and Armenta.
Council Member Clark expressed her support on public safety and the support for
the League of Cities resolution that Mayor Low would be voting for at their next
meeting. Secondly, requested that the notice of cancellations for the next two City
Council meetings be placed on prominent areas of the city's website.
City Manager Manis reassured Council Member Clark staff would make sure the
cancellation notices are placed on the home page of the city's website.

Mayor Pro Tem Ly requested for his comments on the minutes of August 8, 2017
to reflect that he did not disagree on the Planning Commission's initial vote and
there was no reason to overturn their decision.
7. MATTERS FROM MAYOR& CITY COUNCIL
A. Clean Trucks at the Ports of Los Angeles and Long Beach
Recommendation: Discuss and provide direction to staff.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ROSEMEAD, CALIFORNIA, IN SUPPORT OF CLEAN
TRUCKS AT THE PORTS OF LOS ANGELES AND LONG
BEACH
Mayor Pro Tem Ly explained one of the biggest issues of air quality in the region
is due to emissions of trucks from the Port of Los Angeles and the Port of Long
Beach, as fifty percent of the nation's goods are moved through both ports. He
shared that in an article in the San Gabriel Tribune, there are plans to expand the
710 south freeway, which meant the continued deterioration of air quality. He
requested to remove a phrase from the resolution to make sure the focus is on what
was important to the City of Rosemead,for air quality due to emissions and making
sure trucks are emitting cleaner emissions.
Mayor Low asked by approving the resolution, how that would affect the current
situation.
Mayor Pro Tem Ly replied, plans like these do influence the ports, as well as the
Air Quality Management District. When cities form a coalition, it helps encourage
and promote cleaner emission sources and promote cleaner options when it comes
to utilizing trucks.
ACTION: Moved by Mayor Pro Tem Ly and seconded by Council Member Clark
to approve the recommended action: Motion was carried by the following vote:
AYES: Clark,Low, Ly and ABSENT: Alarcon and Armenta.
B. City Council Comments
Mayor Pro Tem Ly stated it was pleasant to see both Garvey School District and
Rosemead School District recognizing their colleagues and coming together to
better their residents.
Mayor Low thanked staff for coordinating the 9/11 ceremony and shared positive
comments received by the community.
