Ordinance No. 194 - Juvenile Loitering Law~i ORDINANCE NO. i/( 4Li AN ORDINANCE OF THE CITY OF ROSEMEAD ur.._ ESTABLISHING A JUVENILE LOITERING LAW APPLICABLE TO PERSONS UNDER THE AGE OF c EIGHTEEN YEARS, AND AMENDING THE ROSEMEAD MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Sections 4167, 4167.1, 4167.2, 4167.3 and 4167.4 are hereby added to Chapter I of Article IV of the Rosemead Municipal Code, to read as follows: 4167. Juvenile Loitering Law. Every person under the age of eighteen (18) years who loiters about the public streets, avenues, alleys, parks, or other public • places between the hour of 10:00.o'clock P.M. and the time of sunrise of the following day when not accompanied by his parent or legal guardian having legal custody and control of such person, or by the spouse over twenty-one (21) years of age of such person, is guilty of a misdemeanor. 0 4167.1 Every parent, guardian, or other person having the legal care, custody, or control of any person under the age of eighteen (18) years who knowingly aids, abets, or encourages such person described in Section 4167 to violate any provision of said section is guilty of a misdemeanor. 4167.2 The word "loiter" as used in Section 4167 is defined to mean to idle, to loaf, to stand idly by, or to walk, drive or ride about aimlessly without lawful purpose. 4167.3 Nothing in Sections 4167, 4167.1 or 4167.2 shall be construed as in any way limiting the power or right W of law enforcement officers to make such investiga- tions, detentions, or arrests as such law enforcement officers would be permitted to make had such sections not been enacted. 4167.4 If any provision or clause of Sections 4167, 4167.1, 4167.2 or 4167.3 or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of said sections which can be given effect without the invalid provision or application, and to this end the provisions of said sections and of each of them are declared to be severable. • PASSED, APPROVED and ADOPTED this 28th day of February 1967. /s/ STUART H.
