Ordinance No. 184 -Establishing Zone P-D (Planned Development)ORDINANCE NO. 184 (URGENCY) AN ORDINANCE OF THE CI-TY COUNCIL OF THE CITY OF ROSEMEAD ESTABLISHING A ZONE "P-D" (PLANNED DEVELOPMENT) AND AMENDING ARTICLE IX OF THE ROSEMEAD MUNICIPAL CODE, THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES ORDAIN AS FOLLOWS; Section 1, Part XX, including Sections 9120 to 9120,12, inclusive,' isTeby added to Article IX, Chapter I of the Rosemead Municipal Code, to read; PART XX - P-D ZONE 9120 P-D Planned Development, This zone is designated to accommocla a various types of development such as shopping centers, professional and administrative areas, multiple housing developments, single-family residential developments, commercial service centers and industrial parks and other uses or,a combination of uses which can be made appropriately a part of planned development, 9120,1 Uses Permitted, Single family residences, minimum of size UUUU square feet, are permitted in the P-D zone provided such use or uses are shown on the development plan for the particular P-D zone as approved by the Planning Commission and City Council. 9120,2 Uses Permitted Sub'ect to Obtainin A royal, Other residential, commer is , ser i an an in ustrial or research and development uses are permitted pro- vided such uses are shown on the development plan for the particular P-D zones as approved by the Planning Commission and City Council, 9120,3 Accessory Buildings and Uses Permitted, Accessory buildings an uses are permit a as s own on the development plan for the particular P-D zone as approved by the Planning Commission and City Council, • 912004 Maximum Allowable Height. The front, side and rear yard shall be as sewn on the development plan for the particular P-D zone as approved by the Planning Commission and City Council. 9120.8 Fences and Wells. Fences and walls and access to any parking area, loading area or public street shall be as shown on the development plan for the particular P-D zone as approved by the Planning Commission and City Council. 9120.9 Minimum Off-Street ParkiaR_Req_ui red. Minimum off- street parking s a i e as s on wn -on the development plan for the particular P-D zone as approved by the Planning Commission and City Council, but not less than 'the provisions of'Part XXII unless modified by the Planning Commission because of improved design or staggered.use of facilities. 9120.10 Open Area and Density Per Family Unit. Open area and density per family unit shall be as shown on the development plan for the particular P-D zone as approved by the Planning Commission and City Council, but not more than one (1) dwelling unit for each twenty-five hundred (2500) square feet of land area. 9120.11 Development Plan. An application for a use permitted in a zone small include and be accompanied by a development plan which, if approved by the Planning Commission and City Council, shall become a part of the Zoning Map of the City of Rosemead. A. Changes in the use or area shown in the develop- ment plan shall be considered the same as changes in the zoning map and shall be made in accordance with the procedures set forth 'n amending this Chapter, except such changes may be accomplished by resolution rather than by Ordinance. Minor modification in elevations or area of a use may be approved by the Planning Commission and City Council without a public hearing. B. The development plan shall include: • i. A map showing any proposed street system, proposed lot design and any areas proposed to be dedicated or reserved for parks, parkways, playgrounds, school sites, public buildings, and other such uses within the zone. Compliance with this requirement shall not be construed as relieving the applicant from compliance with the Subdivision Ordinance or other provisions of the Municipal Code of the City of Rosemead. ii. A map showing the topography of the proposed zone at 1' contour intervals on areas of a cross slope of less than 5% at 2' contour intervals on areas of 5-10% gross slope; 5' contour intervals on areas exceeding 100% cross slope. iii. A general land use plan for the proposed zone, indicating the approximate area to be used for various purposes, - 2 - iv, A plot plan for each building site or sites in the proposed zone. A plot plan shall not be required for a building site to be used for a single family residence. The required plot plan shall show the approximate location of all proposed buildings, indicating maximum and minimum distances between buildings and property or building site lines, v. Any or all of the following plans and diagrams may also be required to be included on the plot plan or appended thereto: a. Off-street parking and loading plan: Such plan may be presented in terms of a ratio between off-street parking and loading spaces - and building floor area, if accom- panied by an example plan demonstrating the feasibility of the proposed ratio, b. Circulation diagram indicating the proposed movement of vehicles and pedestrians within the zone and to and from adjacent public thoroughfares. Any special engineering features and traffic regulation devices needed to facilitate or insure the safety of the circulation pattern shall be shown, • c, Landscaping and Tree Planting Plan: Such a plan shall not be required for the areas pro- posed for residential use, but the applicant shall not be relieved of any requirements of the Subdivision Ordinance with respect thereto, vi. Elevations and Perspective Drawings of all pro- posed structures, except single family residences. Such drawings need not be the result of the final architectural decisions and need not be in detail. The purpose of such drawings is to indicate, with- in stated limits, the height of the proposed buildings and the general appearance of the pro- posed structure, to the end that the entire development will have architectural unity and be in harmony with the surrounding developments, • vii, No building permit shall be issued until plans are approved by the City. Permit shall only be issued for plans substantially in accordance with approved plans, 9120,12 Development Schedule, A. An application for a use in a P-D zone shall be accompan- ied by a development schedule indicating the approximate date on which construction of the project can be expected to begin, the anticipated rate of development and com- pletion date. Such development schedule, if approved by the Planning Commission and City Council, shall become a part of the development plan and shall be adhered to by the owner of the property in the P-D zone, and his successors in interest, B. If, in the opinion of the Planning Commission, the owner or owners of property in a P-D zone are failing or have failed to meet the approved schedule, the Commission may initiate amendment proceedings under this Chapter to - 3 - remove the P-D zone from the zoning map, or to amend the development plan. Upon the recommendation of the Planning Commission, and for good cause shown by the property owner, the City Council may extend the limits imposed by the development schedule. Section 2, Section 9103 of the Rosemead Municipal Code is amended ybd g at the end thereof: "P-D Planned Development", Section 3, In order to preserve the orderly development of property within the City of Rosemead, and to encourage developments in conformity with the public interest, the City Council of the City of Rosemead does establish the zone P-D (Planned Development), There are presently within the City of Rosemead potential developments which will involve development of land areas larger,than the separate in- dividual parcels, which developments would be frustrated and precluded if individual parcels were developed within such areas without regard to a plan of development. This ordinance will prevent disruption of and enable planned development and is necessary for the preservation of property values, to protect the citizens of the community and the public health and safety, and is an urgency measure to take effect immediately upon its adoption, PASSED, APPROVED and ADOPTED this 13th day of September, 1966, 0 MAYOR OF THE CITY OF ROSEMEAD ATTEST: 0
