1. Executive Summary
Waikiki Property, LLC retained DCI Environmental Services to perform a Phase I
Environmental Site Assessment on the Subject Property located at 8449 Garvey Avenue, in the
City of Rosemead, California.
The purpose of this “all appropriate inquiries” investigation was to assess the Subject Property
for environmental conditions and assessing potential liability for any contamination, in an
effort to minimize the exposure of the owner to liability pursuant to the Comprehensive
Environmental Response, Compensation, and Liability Act (CERCLA), known generally as the
“Landowner Liability Protections”. A rigorous records review and environmental database
survey of the Subject Property and surrounding properties were performed. In addition, a site
reconnaissance survey was conducted on May 27th, 2017.
The Subject Property consists of two light industrial parcels of land developed with two
commercial buildings and two single-family dwellings with separate asphalt paved lots. The
Subject Property includes the contiguous property to the north at 3014 Earle Avenue. Florence
Bonino constructed the single-family dwelling at 3014 Earle Ave., in 1949 with approximately
1,320 square feet in area. Arrow Auto Sales constructed a small sales office building at 8449 E.
Garvey Ave., in 1952 with approximately 294 square feet in area. Everett Harwood completed
a wash rack and parts room addition in 1955. F. Magallanes constructed a storage garage at
3014 Earle Ave., in 1957 with approximately 960 square feet in area. Machinery Rental
Company installed a 5,000-gallon underground gasoline storage tank at 8449 E. Garvey Ave.,
in 1957. Frank Magallanes constructed a furniture storage building and carport at 3014 Earle
Ave., in 1961 with approximately 1,104 square feet in area. Frank & Sons Upholstery Shop
constructed a warehouse for furniture storage at 3014 Earle Ave., in 1965 with approximately
2,100 square feet in area. Lou’s A-1 Rental constructed the present commercial building at
8449 E. Garvey Ave., in 1972 with approximately 2,750 square feet in area. Lou’s A-1 Rental
installed a grease interceptor at 8449 E. Garvey St., in 1972. Lou’s A-1 Rental installed
underground storage tanks at 8449 E. Garvey Ave., in 1975. The permit information does not
list the size or quantity of UST’s installed. Eric Chang obtained a certificate of occupancy to
use the structure for office purposes at 8449 E. Garvey Ave., in 1992. Dollar Rent A Car and
Award Auto Dealer, Inc. currently occupy the site. A service shop and a car wash unit are
located in the commercial building on Garvey Avenue. One aboveground hydraulic lift is
installed. Petroleum-based oils, low emission solvents, and coolant are stored in 55-gallon
drums or smaller containers inside secondary containment barriers. A single floor drain in the
car was unit connects to a multi-stage clarifier in the open lot. One abandoned hydraulic lift is
located in the warehouse on Earle Avenue. The abandoned hydraulic lift is suspect to have
been used for service shop activities. No other regulated hazardous materials are being handled
or stored on the Subject Property. No spills, heavy staining, corrosion, or other signs of
significant chemical releases was observed onsite.
The Subject Property was found listed in the HWIS database. A-1 Lou’s Rental Inc., Award
Auto Dealer Inc., Carco Enterprises Inc., and Rentaland maintain(ed) permits to handle
hazardous substances and generate hazardous wastes at 8449 E. Garvey Avenue. The Los
Angeles County Department of Public Works (LACDPW) has records of five underground

storage tanks formerly located at 8449 E. Garvey Avenue. GKN Rentals contracted Exceltech,
Inc. to remove all five UST’s and complete a Tank Closure Report. In April 1990, Exceltech
removed one 10,000-gallon gasoline tank, one 5,000-gallon diesel tank, one 1,000-gallon
kerosene tank, one 500-gallon fresh motor oil tank, and one 500-gallon waste oil tank. No
leaks or damage to the tanks was observed. Based on laboratory analysis results, additional soil
had to be removed from the fresh oil tank and waste oil tank excavation. All of the
contaminated soil was transported offsite for legal disposal. Exceltech conducted additional
soil sampling in the fresh oil tank excavation due to reported elevated TRPH levels. TRPH
contamination detected at 82ppm was allowed to remain in-place. Closure certification was
approved by LACDPW for the completed UST removal on July 22nd 1993. The closure letter
indicates that changes in the present or proposed use of the site may require further site
characterization and mitigation activity. It is the property owner’s responsibility to notify
LACDPW of any changes in the report content, future contamination findings, or site usage.
LACDPW issued permits to GKN Rentals to discharge wastewater through an existing three-
stage clarifier located at the Subject Property in April 1990. The wastewater generated was
from washing rental equipment. GKN Rentals vacated the site in 1991. Carco Enterprises Inc.
(dba Dollar Rent A Car) was issued permits to discharge industrial wastewater through the
three-stage clarifier in July 1996. Award Auto Dealer Inc. has maintained the three-stage
clarifier since 2009. No significant violations were observed during the latest compliance
inspection of the clarifier on September 8th 2016. Best management practices were being
followed according to state law.
The Regulatory Records Research identified several properties with contamination issues
located within the default area of concern (1/3rd mile radius) at the Subject Property, as defined
by ASTM E2600-15 Tier I Vapor Encroachment Screening. The nearest listing is a “case
closed” LUST site approximately 500 feet to the west at Laidlaw Harley Davidson (8399 E.
Garvey Ave.). Soil only contamination was mitigated at this facility form a waste oil tank leak
in 2008. No conditions were observed that indicate potential impact to the Subject Property
from this source of hazardous wastes. Any properties under remediation for contamination
within the vicinity are unlikely to impact the environmental integrity of the Subject Property.
Areas of concern identified at the Subject Property are the service shops, car-wash unit, multi-
stage clarifier, abandoned hydraulic lift, and former UST locations. Petroleum-based oils,
volatile organic compounds, ethylene glycol, and heavy metals may have been released onsite.
The Subject Property appears to be safe for the present commercial use however, further
investigation and possible mitigation activities will be required to legally close the multi-stage
clarifier and if there are any changes in the present or proposed use of the site. It is the property
owner’s responsibility to notify LACDPW if there are any changes in the present use or future
contamination is discovered.
Prior to redevelopment, DCI recommends removing the multi-stage clarifier and abandoned
hydraulic lift. Subsurface investigations will be necessary to determine if either of these
features has released chemicals into the soil. The Los Angeles County Department of Public
Works will have to be involved with legal closure of the multi-stage clarifier and future
redevelopment. Also, a soil vapor survey is recommended in the service shops and former
UST locations. The combined sampling activities should be able to determine if the Subject
Property is safe for redevelopment.

2. Introduction
Waikiki Property LLC retained DCI Environmental Services to perform a Phase I
Environmental Site Assessment (ESA) on the Subject Property located at 8449 Garvey Avenue,
in the City of Rosemead, California.
2.1. Purpose
The purpose of this environmental site assessment was intended to identify, to the extent
feasible pursuant to the processes prescribed by ASTM E 1527-13, “all appropriate inquiries”
in connection with the Subject Property. As such, this practice is intended to permit a user to
satisfy one of the requirements to qualify for the innocent landowner, contiguous property
owner, or bona fide prospective purchaser limitations on CERCLA liability and defense known
as the landowner liability protections or LLP’s. This investigation was performed in an effort
to minimize exposure of the user to liability pursuant to the Comprehensive Environmental
Response, Compensation, and Liability Act (CERCLA), and should constitute “all appropriate
inquiries” for purposes of protection from CERCLA liability as an as defined in at 42 U.S.C. §
9601 (35) (B) et seq.
2.2. Detailed Scope of Services
DCI Environmental Services will attempt to obtain all reasonably ascertainable information
related to the Subject Property that may help identify recognized environmental conditions,
historical recognized environmental conditions, and controlled recognized environmental
conditions in connection with the Property. ASTM E 1527-13 defines the term “recognized
environmental conditions” as the presence or likely presence of any hazardous substances or
petroleum products in, on, or at a property: (1) due to any release to the environment; (2) under
conditions indicative of a release to the environment; (3) or under conditions that pose a
material threat of a future release to the environment. The term is not intended to include de-
minimis conditions that generally do not pose a threat to human health or the environment and
that generally would not be the subject of an enforcement action if brought to the attention of
appropriate governmental agencies. An historical recognized environmental condition HREC
as “a past release of any hazardous substances or petroleum products that has occurred in
connection with the property and has been addresses to the satisfaction of the applicable
regulatory authority, without subjecting the property to any required controls (deed restrictions,
use limitations, industrial controls, environmental controls). A controlled recognized
environmental condition CREC is “ a REC resulting from a past release of hazardous
substances or petroleum products that has been addresses to the satisfaction of the applicable
regulatory authority (evidence by issuance of a NFA letter or equivalent, or meeting risk-based
criteria established by regulatory authority), with hazardous substances or petroleum products
allowed to remain in place subject to the implementation of required controls (property use
restrictions, use limitations, industrial controls, engineering controls).
A Phase I ESA includes four components. The first component of the Phase I is a records
review, which typically includes the standard Federal and State environmental record sources,
additional Regional and Local environmental record sources, physical setting sources, and

historical use information. The second component is the site reconnaissance, which may
include, but is not limited to observations of current and past uses of the Subject Property and
adjoining properties, visible hydrogeologic and topographic conditions, structures, roads, and
water systems. The site reconnaissance attempts to make observations regarding the possible
presence of hazardous substances and petroleum products, storage tanks, polychlorinated
byphenols (PCB’s), and other potentially hazardous substances or materially threatening
practices. The third component of the Phase I ESA comprises interviews with the Subject
Property’s owner, key management personnel, commercial occupants, and relevant government
officials. The fourth component is a report summarizing the findings of the records review, site
reconnaissance, and interviews, and presenting a professional opinion regarding the existence
of any recognized environmental conditions in connection with the Subject Property.
2.3. Significant Assumptions
The only significant assumptions made during this investigation were that the information DCI
obtained from outside sources (environmental and historical records) was accurate and up-to-
date at the time this report was prepared, and that no information was withheld from DCI by
any persons with actual knowledge of recognized environmental conditions associated with the
Subject Property.
2.4. Limitations and Exceptions
This environmental site assessment report was prepared in accordance with ASTM E 1527-13,
and generally accepted practices and principles. The ASTM E 1527-13 standard states, that no
environmental site assessment can wholly eliminate uncertainty regarding the potential for
recognized environmental conditions in connection with a property. Performance of a Phase I
ESA is intended to reduce, but not eliminate, uncertainty regarding the potential for recognized
environmental conditions in connection with a property, while recognizing the limits of time
and cost. No sampling or analysis of soil, water, building materials, or air is conducted as part
of this assessment. This study is not intended to be a definitive investigation of recognized
environmental conditions at the Subject Property and is not inclusive of all possibilities.
Opinions expressed herein reflect conditions existing at the time of our investigation, and may
change at any time.
2.5. Special Terms and Conditions
In accordance with ASTM E 1527-13, this report is considered to be valid up to 180 calendar
days from the date it was finished. Any use of this report after such time is not recommended
by DCI and is not in accordance with the appropriate standards and practices. All information
in this report is considered to be privileged and confidential. DCI shall release the report only
to the client. DCI shall not release the report, or make disclosures or notifications to any
others, including government agencies, unless so authorized by the client in writing. DCI does
not authorize the use of the report or portions thereof by any third party.

2.6. User Reliance
The opinions expressed in this report are based on all reasonable ascertainable information
obtained through a rigorous records review, site reconnaissance, and personal interviews.
Although DCI believes that the information contained herein is reliable, no guarantee can be
made as to the accuracy of information provided to DCI by others.
3. Site Description
3.1. Site Location and Legal Description
The Subject Property, located at 8449 Garvey Avenue, in Rosemead, California, is on the
northeast corner of Garvey Avenue and Earle Avenue. It is legally described as Assessor
Parcel Numbers APN’s #5288-004-041 & #5288-004-057. The Subject Property can be
located on Thomas Brothers Maps page 636, grid G-2 (Los Angeles County). A Site Location
Map is included in Appendix A.
3.1. Site Vicinity and Characteristics
The overall character of the surrounding neighborhood is mixed light industrial, commercial,
and residential development. Commercial businesses and dwellings surround the Subject
Property (see Site Location Map - Appendix A).
3.2. Current Use of Property
The Subject Property consists of two light industrial parcels of land developed with two
commercial buildings and two single-family dwellings with separate asphalt paved lots. Dollar
Rent A Car and Award Auto Dealer, Inc. currently occupy the site.
3.3. Descriptions of Structures, Roads, Other Improvements on the Site
The onsite buildings are a combination of wood frame and block structures on both raised or
concrete foundations covered by wood framed composition roofs. Interior walls are painted
plaster over wood frame with plaster and exposed beam ceilings. The commercial buildings
are divided into offices, service shops, car wash unit, and warehouse space. A service shop and
a car wash unit are located in the commercial building on Garvey Avenue. One aboveground
hydraulic lift is installed. Petroleum-based oils, low emission solvents, and coolant are stored
in 55-gallon drums or smaller containers inside secondary containment barriers. A single floor
drain in the car was unit connects to a multi-stage clarifier in the open lot. One abandoned
hydraulic lift is located in the warehouse on Earle Avenue. No other regulated hazardous
materials are being handled or stored within the buildings. No staining, corrosion, or other
signs of chemical releases was observed in the buildings.

Access to the site is via Garvey Avenue and Earle Avenue, only. The exterior lots are covered
with the buildings, decorative landscaping, exposed soils, asphalt-pavement, and cement
improvements. The onsite pavement has some minor cracks and staining from normal vehicle
traffic. A multi-stage clarifier is installed in the exterior lot outside of the car wash unit.
Hazardous substances are not being handled or stored on the exterior lot. No significant
staining, corrosion, or other signs of illegal dumping activities was present. All municipal
services — including sewer, water, telephone, gas, and electric are connected to the site. Site
photographs are included in Appendix C.
3.4. Current Uses of Adjoining Properties
The sites directly adjacent to the Subject Property are described below:
North: A single-family residence located at 3020 Earle Avenue.
South: Across the street is a Mattress Station store located at 8440 E. Garvey Avenue.
East: Palm Motel located at 8463 E. Garvey Avenue.
West: Across the street is a Coin-Op Car Wash located at 8419 E. Garvey Avenue.
4. User Provided Information
The user provided the following information to DCI regarding the Subject Property.
4.1. Title Records
Title record documents were not provided for review by DCI from the user. These records
would likely indicate that the Subject Property was previously developed residential land prior
to the present commercial use.
4.2. Environmental Liens or Activity and Use Limitations
No information regarding environmental liens on the Subject Property was provided to DCI. A
California Grant Deed filed in October 2009 indicates that the document transfer taxes were
computed on the full value of the interest in the property conveyed without any liens or
encumbrances remaining at the time of transfer. Further, there are no known activity or use
limitations in connection with the property.
4.3. Specialized Knowledge
According to ASTM E 1527-13, if the user is aware of any specialized knowledge or
experience that is material to recognized environmental conditions in connection with the
Subject Property, it is the user’s responsibility to communicate any information based on such

specialized knowledge or experience to DCI prior to the site reconnaissance. The user has not
communicated any specialized knowledge to DCI.
4.4. Valuation Reduction for Environmental Issues
In a transaction involving the purchase of a parcel of commercial real estate, if a user has actual
knowledge that the purchase price of the property is significantly less than the purchase price of
comparable properties, the user should attempt to identify an explanation for the lower price
and to make a written record of such explanation. If the information in this report concludes
that there are recognized environmental conditions connected to the Subject Property, such
information may be used to explain a valuation reduction of the property.
4.5. Owner, Property Manager, and Occupant Information
The owner’s representative of the Subject Property was available for interview with DCI
personnel during the site reconnaissance. Ms. Cindy Lau provided the following information
regarding the occupants of the Subject Property:
1) The contact person given to DCI for this site was Ms. Cindy Lau. She stated that to
the best of her knowledge, “ car rental and sales businesses have occupied the site
for over 25 years. Hazardous materials and wastes are permitted at the site. A
private service is contracted to remove the hazardous wastes generated and clean the
clarifier. There are no underground storage tanks or posted violations for the
Subject Property.”
4.6. Reason for Performing Phase I ESA
It is assumed that the reason this Phase I Environmental Site Assessment was requested in
order to qualify for the “innocent landowner defense” to CERCLA liability associated with a
commercial real estate transaction. Another reason for performing a Phase I ESA might
include the need to understand potential environmental conditions that could materially impact
the operation of a business associated with the Subject Property.
5. Records Review
5.1. Standard Environmental Record Sources
BBL of Solana Beach provided DCI Environmental Services with a report containing (at a
minimum) all federal, state, and tribal environmental databases required by ASTM E 1527-13
to determine any potential recognized environmental conditions connected to the Subject
Property from onsite or in the vicinity of the Subject Property. The environmental databases
are included in the Environmental Records Search (ERS) in Appendix E.

Several of the databases included in the ERS report contain information not relevant to this
investigation, have duplicate information, or contain no sites within a one-mile radius of the
Subject Property. Lists of concern are discussed in the following within their respective
minimum search distances defined in ASTM E 1527-13 § 7.2.1.1.
5.1.1. Federal Environmental Record Sources
Federal NPL (within 1.0 miles)
The United States Environmental Protection Agency (US EPA) has compiled this list from the
designated CERCLIS list. The National Priority List (NPL) sites are prioritized as to their
significant risk to human health and the environment. The list targets those sites to receive
remedial funding under the Comprehensive Environmental Response Conservation and Liability
Act (CERCLA). The NPL lists the nation’s highest priority sites for remedial action. Only NPL
sites can receive CERCLA funds. The Subject Property and adjacent properties were not on the
NPL list. The only NPL site listing located within a one-mile radius is widespread contamination
in the San Gabriel Valley Groundwater Basin. All potential responsible parties have been
investigated and remedial action is underway. No conditions were observed that indicate
potential impact to the Subject Property from this source of hazardous wastes.
Federal Deleted NPL (within 1.0 miles)
The United States Environmental Protection Agency (US EPA) has compiled this list from the
designated CERCLIS list. The National Priority List (NPL) sites are prioritized as to their
significant risk to human health and the environment. The list targets those sites to receive
remedial funding under the Comprehensive Environmental Response Conservation and Liability
Act (CERCLA). The NPL lists the nation’s highest priority sites for remedial action. Only NPL
sites can receive CERCLA funding. The Subject Property and adjacent properties were not on the
Deleted NPL list. There are no Deleted NPL site listings located within a one-mile radius of the
Subject Property.
Federal CERCLIS (within 1.0 miles)
The EPA has compiled this list of contaminated properties for designation under the Federal
Superfund Program pursuant to the Comprehensive Environmental Response Conservation and
Liability Act (CERCLA). These sites represent environmental concern for the discharge of
hazardous materials by hazardous waste generators, treatment and storage facilities, and
hazardous waste disposal sites. The Subject Property and adjacent properties were not on the
CERCLIS list. There are no CERCLIS site listings located within a one-mile radius of the
Subject Property.
Federal CERCLIS NFRAP (within 1.0 miles)
As of February 1995, CERCLIS sites designated 'No Further Remedial Action Planned'
NFRAP have been removed from CERCLIS. NFRAP sites may be sites where, following an
initial investigation, no contamination was found, contamination was removed quickly without
the site being placed on the NPL, or the contamination was not serious enough to require

Federal Superfund action or NPL consideration. EPA has removed these NFRAP sites from
CERCLIS to lift unintended barriers to the redevelopment of these properties. The Subject
Property and adjacent properties were not on the NFRAP list. There are no NFRAP site
listings located within a one-mile radius of the Subject Property.
Federal RCRA CORRACTS (within 1.0 miles)
The Resource Conservation and Recovery Act of 1976 provides for "cradle to grave" regulation
of hazardous wastes. RCRA requires regulation of hazardous waste generators, transporters,
and storage/treatment/disposal sites. Evaluation of potential violations ranging from manifest
requirements to hazardous waste discharges are typically conducted by the US EPA. This
database is also known as Corrective Action Report (CORRACTS). If enforcement action is
required it is typically delegated to a State Agency. The Subject Property and adjacent
properties were not on the CORRACTS list. There are no CORRACTS site listings located
within a one-mile radius of the Subject Property.
Federal RCRA-D non-CORRACTS TSD (within 1.0 miles)
The Environmental Protection Agency regulates the treatment, storage and disposal of
hazardous material through the Resource Conservation and Recovery Act (RCRA). All
hazardous waste TSD facilities are required to notify EPA of their existence by submitting the
Federal Notification of Regulated Waste Activity Form (EPA Form 8700-12) or a state
equivalent form as well as part A (EPA form 8700-23) and Part B of their Hazardous Waste
Permit Application. The Subject Property and adjacent properties were not on the RCRA-D
list. There are no RCRA-D site listings located within a one-mile radius of the Subject
Property.
Federal RCRA-G Generators (within 0.25 miles)
The Environmental Protection Agency regulates generators of hazardous material through the
Resource Conservation and Recovery Act (RCRA). All hazardous waste generators are
required to notify EPA of their existence by submitting the Federal Notification of Regulated
Waste Activity Form (EPA Form 8700-12) or a state equivalent form. The notification form
provides basic identification information and specific waste activities. The Subject Property
was not on the RCRA-G list. The nearest of the five RCRA-G site listings located within a
one-quarter mile radius is across the street to the west at Winston Tire Company (8419 E.
Garvey Ave.). No conditions were observed that indicate potential impact to the Subject
Property from this source of hazardous wastes. Based on the current status and observation of

“case closed” LUST site approximately 500 feet to the west at Laidlaw Harley Davidson (8399
E. Garvey Ave.). Soil only contamination was mitigated at this facility form a waste oil tank
leak in 2008. No conditions were observed that indicate potential impact to the Subject
Property from this source of hazardous wastes. Based on the current status and distance from
the site, it is unlikely that this LUST site listing or other such listings have adversely impacted
the environmental integrity of the Subject Property.
Underground Storage Tanks UST (within 0.25 miles)
The California Water Resources Control Board also provides a list of all permitted
underground tanks containing hazardous substances (UST). This database provides
information on all registered underground storage tanks. According to information provided,
the Subject Property and adjacent properties were not on the UST list. The nearest of the nine
UST site listings located within a one-quarter mile radius is approximately 300 feet to the east
at Ta-Ting Kan (8515 E. Garvey Ave.). No conditions were observed that indicate potential
impact to the Subject Property from this nearby source of hazardous wastes. Based on the
current status and distance from the site, it is unlikely that this UST listing or other such
listings have adversely impacted the environmental integrity of the Subject Property.

In order to provide for the orderly and efficient delivery of safe drinking water the California

5.2.3. Regional
The Regional Sources list consists of sites tracked by the State of California Water Resources
Control Board and the Regional Water Quality Control Board for program tracking and
inventory of waste management units.
Toxic Releases
The California Regional Water Quality Control Boards or local Department of Health Services
keeps track of toxic releases to the environment. These lists are known as Unauthorized
Releases, Spill, Leaks, Investigations and Cleanups (SLIC), Non-Tank Releases, Toxics List or
similar, depending on the local agency. The Subject Property and adjacent properties were not
on the SLIC list. The nearest of the six SLIC site listings located within a one-half mile radius
is approximately 600 feet southwest of the Subject Property at Corsair LLC (8350 E. Garvey
Ave.). Based on the current status and distance from the site, it is unlikely that this SLIC site
listing or other such listings have adversely impacted the environmental integrity of the Subject
Property.
Toxic Pits
The Toxic Pits Clean-Up Act (Katz Bill) places strict limitations on the discharge of liquid
hazardous wastes into surface impoundment, toxic ponds, pits and lagoons. Regional Water
Quality Control Boards are required to inspect all surface impoundment annually; in addition,
every facility was required to file a Hydrogeological Assessment Report. Recent legislation
allows the Department of Health Services to exempt facilities that closed on or before
December 31, 1985, if a showing is made that no significant environmental risk remains
(AB1046). Special exemption provisions have been created for surface impoundments that
receive mining wastes. The Subject Property and adjacent properties were not on the TP list.

Solid Waste Assessment Test (SWAT)
This program, provided for under the Calderon legislation (Section 13273 of the Water Code),
requires that disposal sites with more than 50,000 cubic yards of waste provide sufficient
information to the regional water quality control board to determine whether or not the site has
discharged hazardous substances which will impact the environment.
Site operators are required to file Solid Waste Assessment Test reports on a staggered basis.
Operators of the 150 highest ranking (Rank 1) sites were required to submit Solid Waste
Assessment Tests by July 1, 1987, Rank 2 in 1988 and so on.
Operators submit water quality tests to the Regional Water Quality Control Board, describing
surface and groundwater quality and supply; and the geology within one-mile of the site. Air
quality tests are submitted to the local Air Quality Management District or Air Pollution
Control District. The Subject Property and adjacent properties were not on the SWAT list.
The nearest of the two SWAT site listings located within a one-mile radius is over one-half
mile east of the Subject Property, and too distant to be of concern.
5.2.4. Federal and State Operating Permits
Various agencies issue operating permits or regulate the handling, movements, storage and
disposal of hazardous materials and require mandatory reporting. The inclusion in this section

permits, compliance and enforcement statues of NPDES facilities. The Subject Property and
adjacent properties were not on the PCS list. The only PCS site listing located within a one-

AIRS Facility System
AFS contains emissions and compliance data on air pollution point sources tracked by the U.S.
EPA and state and local environmental regulatory agencies. There are seven "criteria
pollutants" for which data must be reported to EPA and stored in AIRS: PM10 (particulate
matters less than 10 microns in size), carbon monoxide, sulfur dioxide, nitrogen dioxide, lead,
reactive volatile organic compounds (VOC), and ozone. AFS replaces the former Compliance

Hazardous Waste Information System (HWIS)
The Department of Toxic Substance Control, California Environmental Protection Agency,
maintains a database keeping track of the movement and disposal of hazardous waste. The data
is used to support the Tanner legislation, AB 2948. The Subject Property was among the forty-
eight HWIS site listings located within a one-quarter mile radius. A-1 Lou’s Rental Inc.,
Award Auto Dealer Inc., Carco Enterprises Inc., and Rentaland maintain(ed) permits to handle
hazardous substances and generate hazardous wastes at 8449 E. Garvey Avenue. The nearest
offsite HWIS listing is across the street to the west at Winston Tire Company (8419 E. Garvey
Ave.). Based on the current status and observations of the Subject Property, it is unlikely that
this offsite HWIS listing or other offsite listings have adversely impacted the environmental
integrity of the Subject Property.
5.2.5. Other Regional and Local Sources
City of Rosemead – Building Permit Department
DCI researched building permits for the Subject Property for information concerning the past
use of the property and for the possible installation of UST's, clarifiers and other substantial
sources of hazardous wastes that could have impacted soil and groundwater. According to
Rosemead Building Department Technicians, the earliest building permit information available
was issued to Florence Bonino to construct a single-family dwelling at 3014 Earle St., in 1949
with approximately 1,320 square feet in area. Arrow Auto Sales constructed a sales office at

8449 E. Garvey Ave., in 1952 with approximately 294 square feet in area. Everett Harwood
completed a wash rack and parts room addition in 1955. Florence Bonino constructed the
single-family dwelling in 1949 with approximately 1,320 square feet in area. F. Magallanes
constructed a storage garage at 3014 Earle St., in 1957 with approximately 960 square feet in
area. Machinery Rental Company installed a 5,000-gallon underground gasoline storage tank
at 8449 E. Garvey Ave., in 1957. Frank Magallanes constructed a furniture storage building
and carport at 3014 Earle St., in 1961 with approximately 1,104 square feet in area. Frank &
Sons Upholstery Shop constructed a warehouse for furniture storage at 3014 Earle St., in 1965
with approximately 2,100 square feet in area. Lou’s A-1 Rental constructed the present
commercial building at 8449 E. Garvey Ave., in 1972 with approximately 2,750 square feet in
area. Lou’s A-1 Rental installed a grease interceptor at 8449 E. Garvey St., in 1972. Lou’s A-1
Rental installed new underground storage tanks at 8449 E. Garvey Ave., in 1975. The permit
information does not list the size or quantity of UST’s. Eric Chang obtained a certificate of
occupancy to use the present structure for office purposes at 8449 E. Garvey Ave., in 1992.
See Permits in Appendix B.
Los Angeles County – Fire Department
DCI requested records at the Los Angeles County Fire Dept., Public Health Investigation
Division, for information regarding underground storage tanks, hazardous materials use records
and/or posted violations at the Subject Property. At this time, no response has been received
from this agency. According to other relevant sources, Award Auto Dealer, Inc. AR0050413
maintains compliance records for hazardous materials and hazardous wastes on the Subject
Property located at 8449 Garvey Avenue, in Rosemead, California.
City of Rosemead – Planning Department
Records indicate that the Subject Property is approved for light industrial use (M-1).
County of Los Angeles, Department of Public Works
DCI reviewed source control lists from the Los Angeles County Department of Public Works,
Environmental Programs Division concerning information on underground storage tanks and
industrial wastewater discharges at the Subject Property. The Los Angeles County Department
of Public Works (LACDPW) has records of five underground storage tanks formerly located at
8449 E. Garvey Avenue. GKN Rentals contracted Exceltech, Inc. to remove all five UST’s and
complete a Tank Closure Report. In April 1990, Exceltech removed one 10,000-gallon
gasoline tank, one 5,000-gallon diesel tank, one 1,000-gallon kerosene tank, one 500-gallon
fresh motor oil tank, and one 500-gallon waste oil tank. No leaks or damage to the tanks was
observed. Based on laboratory analysis results, additional soil had to be removed from the
fresh oil tank and waste oil tank excavation. All of the contaminated soil was transported
offsite for legal disposal. Exceltech conducted additional soil sampling in the fresh oil tank
excavation due to reported elevated TRPH levels. TRPH contamination detected at 82ppm was
allowed to remain in-place. Closure certification was approved by LACDPW for the
completed UST removal on July 22nd 1993. The closure letter indicates that changes in the
present or proposed use of the site may require further site characterization and mitigation
activity. It is the property owner’s responsibility to notify LACDPW of any changes in the
report content, future contamination findings, or site usage. LACDPW issued permits to GKN

Rentals to discharge wastewater through an existing three-stage clarifier located at the Subject
Property in April 1990. The wastewater generated was from washing rental equipment. GKN
Rentals vacated the site in 1991. Carco Enterprises Inc. (dba Dollar Rent A Car) was issued
permits to discharge industrial wastewater through the three-stage clarifier in July 1996.
Award Auto Dealer Inc. has maintained the three-stage clarifier since 2009. No significant
violations were observed during the latest compliance inspection of the clarifier on September
8th 2016. Best management practices were being followed according to state law.
County of Los Angeles, Sanitation District
DCI requested a record search at the Los Angeles County Sanitation District concerning
information on industrial wastewater discharges at the Subject Property. At this time, no
response has been received from this agency. Based on records from other sources, Award
Auto Dealer, Inc. maintains permits to discharge suspended solids, dirt, and grease from car
washing activities on the Subject Property located at 8449 Garvey Avenue, in Rosemead,
California. See LACDPW permits if Appendix B.
Regional Water Quality Control Board
DCI requested a records search at the Los Angeles Regional Water Quality Control Board for
information on leaking underground storage tanks, toxic releases, posted violations, and active
investigations for the Subject Property. At this time, no response has been received from this
agency. Based on “Geotracker” web site, there are no records for the Subject Property.
State of California – Division of Oil, Gas, and Geothermal Resources
The Subject Property is not located within any oil or gas field boundary - see Appendix D.
Also, there is no known producing and/or abandoned oil well located within 1,500 feet of the
Subject Property.
South Coast Air Quality Management District
DCI performed a records search at this agency’s web site regarding permits to operate and
notices of violations for regulated air-emissions at the Subject Property. According to
SCAQMD records, A-1 Lou’s Rental maintained permits to operate underground storage tanks
with dispensers at the Subject Property from the 1970’s thru 1985. GKN Rentals maintained
permits to operate underground storage tanks with dispensers at the Subject Property from the
1990’s until legal closure in 1993. There are no active permits to operate, posted violations,
notices to comply or outstanding violations for the Subject Property located at 8449 Garvey
Avenue, in Rosemead, California.
Cal-State University, Northridge
DCI reviewed available Historical Topographic Maps, Sanborn Fire Insurance Rate Maps, and
Aerial Photographs to establish and historical use of the Subject Property. Historic
Topographic Maps produced in 1925 identify the Subject Property and surrounding properties
as developed residential or agricultural land. Sanborn Fire Insurance Rate Map coverage was
not available for the Subject Property. ASCS-USDA aerial photographs taken in 1952 show

the Subject Property developed with single-family dwellings and a small commercial building.
Single-family dwellings and commercial buildings are adjacent in all directions.
5.3. Physical Setting Sources
The physical setting of the Subject Property and vicinity is described in terms of topographic,
geologic, and hydrogeologic features in the following text.
5.3.1. Topographic Features
A topographic map of the immediate vicinity of the Subject Property is included in Appendix
D. DCI reviewed current USGS 7.5 Minute Topographic maps to determine the general
topographic features of the Subject Property and surrounding areas. The Subject Property is
located on relatively level terrain with a shallow downward slope towards the southwest.
5.3.2. Geologic Features
The Subject Property is situated in the San Gabriel Valley Groundwater Basin, at an elevation
of approximately 260’ feet above mean sea level. According to boring logs from boreholes at
nearby locations, the soil consists of sand, gravel, clay and silts to a depth of several hundred
feet and thence more coarse-grained sediments below. Poorly consolidated Holocene and
Pleistocene Age alluvial deposits occur within the San Gabriel Valley Groundwater Basin.
Tertiary age sediments underlying the Subject Property are semi-consolidated (non-water
bearing) sedimentary rocks.
5.3.3. Groundwater Hydrogeology
Groundwater flow direction and depth could not be determined specifically for the Subject
Property, since there is no groundwater monitoring well on the property. It is typical that the
groundwater flow direction follows the ground surface topography, which generally appears to
be in a southwesterly direction. Based on information provided by the Los Angeles County
Public Works Department, depth to shallow groundwater in the vicinity of Subject Property
was measured at approximately 40’ feet below ground surface. This well is less than one-
quarter mile east of the Subject Property. Depth to groundwater beneath the Subject Property
is assumed to be more than 50’ feet below ground surface.
5.4. Historical Use Information of the Property and Adjoining Properties
5.4.1. Aerial Photographs
DCI reviewed aerial photographs in an effort to establish historical usage of the Subject
Property. Fairchild aerial photographs taken in 1948 show the Subject Property developed with
a single-family dwelling and small commercial building. Single-family dwellings, vacant land,
and commercial buildings are adjacent. There were no significant changes to the Subject
Property in ASCS-USDA aerial photographs taken in 1952. A new warehouse building is
located on the northern parcel and small commercial buildings on the southern portion of the
Subject Property in Teledyne aerial photographs taken in 1968. The adjacent properties remain
the same. The present commercial buildings are located on the Subject Property in AMI aerial

photographs taken in 1980. The adjacent commercial building to the east first appears in
USGS aerial photographs taken in 1994.
5.4.2. Fire Insurance Maps
Sanborn Fire Insurance Rate Map coverage was not available for the Subject Property.
5.4.3. Property Tax Files
DCI did not research Property Tax Files for the Subject Property based on the history of use.
5.4.4. Recorded Land Title Records
DCI did not research Land Title Records for the Subject Property based on the history of use.
5.4.5. USGS 7.5 Minute Topographic Maps
DCI reviewed current USGS 7.5 Minute Topographic maps to establish the historical use of the
Subject Property. On a Historic Topographic Map produced in 1925, the Subject Property and
adjacent properties as improved agricultural land or vacant. On a map dated 1995 (Rosemead
map photo-revised in 1995 using aerial photographs) the Subject Property and adjacent
properties are developed commercial/residential land.
5.4.6. Local Street Directories
DCI did not research Local Street Directories for the Subject Property located at 8449 Garvey
Avenue, in Rosemead, California. Arrow Auto Sales, Machinery Rental Company, Frank &
Sons Upholstery Shop, A-1 Lou’s Rental Inc., Award Auto Dealer Inc., Carco Enterprises Inc.,
GKN Rentals and Rentaland previously occupied the site for more than 50 years. Dollar Rent
A Car and Award Auto Dealer, Inc. currently occupy the site.
5.4.7. Building Department Records
DCI reviewed building permits for the Subject Property for information concerning the past use
of the property and for the possible installation of UST's, clarifiers and other substantial
sources of hazardous wastes that could have impacted soil and groundwater. There are permits
on-file for the installation of underground storage tanks and clarifiers at the Subject Property.
5.4.8. Zoning/Land Use Records
Records indicate that the Subject Property is zoned for light industrial use (M-1).

6. Site Reconnaissance
A site reconnaissance of the Subject Property was conducted to look for signs of any
recognized environmental conditions at the Subject Property and its adjoining properties.
6.1. Methodology and Limiting Conditions
A site reconnaissance generally consists of a brief meeting onsite with the property owner (or
owner’s representative), a walk through visual inspection of the property itself, and a visual
inspection of the interior and exterior of any existing onsite structures. Conclusions drawn
from the site reconnaissance regarding recognized environmental conditions are only based on
surface evidence. This conclusion does not apply if surface evidence was concealed from view
or altered beyond recognition. A subsurface investigation to detect the presence of UST’s,
hazardous substances, or petroleum products was not part of this investigation.
6.2. General Site Setting
The south and west sides of the Subject Property are open to vehicle traffic. The Subject
Property is level terrain, currently developed light industrial land. No spills, heavy staining, or
illegal dumping activities were observed on the Subject Property or adjacent parcels. See
Appendices.
6.3. Exterior Observations
DCI found no adverse environmental impact due to hazardous materials use or storage on the
Subject Property. No heavy staining or corrosion was observed at the Subject Property.
Migration of hazardous substances from off-site sources does not appear to be a concern.
6.3.1. Hazardous Substances and Petroleum Products (Containers)
Petroleum-based oils, low emission solvents, and coolant are stored in 55-gallon drums or
smaller containers inside secondary containment barriers. A single floor drain in the car was
unit connects to a multi-stage clarifier in the open lot. There was no evidence of illegal
dumping of chemicals or suspicious containers identified on the Subject Property.
6.3.2. Underground Storage Tanks
During the site reconnaissance, exposed and accessible areas of the Subject Property were
visually inspected for signs of underground storage tanks. After an interview with the
representative of the Subject Property, records search with local authorities, and visual
inspection completed, there appeared to be active registered underground storage tanks located
at the Subject Property. GKN Rentals removed dispensers, underground storage tanks, and
piping from the Subject Property. The Los Angeles County Department of Public Works
issued final closure for the completed UST removal project on June 22nd, 1993.

6.3.3. Polychlorinated Byphenols (PCBs)
Dry-type transformers are located on the Subject Property. Transformers are a concern because
of the presence of PCB’s in the coolant of some earlier models. Current (new) transformers
utilize mineral oil as the insulating or cooling fluid exclusively. In a recent statistically-valid
test of over 20,000 distribution transformers, it was determined that the concentration of PCB’s
in mineral oil was less than fifty parts per million in over ninety-six percent of the transformer
units tested. A single abandoned hydraulic lift is located in the warehouse on Earle Avenue.
Older hydraulic fluid contained polychlorinated byphenols and may have been used in the
abandoned lift.
6.3.4. Pits, Ponds, or Lagoons
DCI did not locate any pits, ponds, or lagoons on the Subject Property and directly adjacent
properties currently present or in past historical data.
6.3.5. Stained Soil or Pavement
DCI did not observe any stained soils on the Subject Property and adjacent properties currently
present or in past historical data.
6.3.6. Stressed Vegetation
DCI did not observe any distressed vegetation on the Subject Property and adjacent properties
currently present or in past historical data.
6.3.7. Solid Waste
A solid waste dump container was observed on the Subject Property. The container is not open to
the public and appears to be in good condition overall. No spills, staining, odors, or suspicious
containers suggestive of the improper disposal of hazardous materials were present. DCI
observed no vegetative stress or staining suggestive of illegal hazardous materials dumping.
6.3.8. Wastewater Treatment / Discharge
DCI observed a multi-stage clarifier system located at the Subject Property. No heavy staining
or unusual odors were present in the connecting drain, building, or exterior lot.
6.3.9. Septic Systems
DCI did not observe any septic tank systems located on the Subject Property. Public sewer
connections are on-file with the City of Rosemead.
6.3.10. Wells
DCI did not observe any Wells (monitoring, water, oil and/or gas) located on the Subject
Property and adjacent properties.

6.4. Interior Observations
DCI observed the buildings interior to be maintained in good condition overall.
6.4.1. Heating/Cooling (gas, electric, steam boiler with furnace, etc.)
DCI observed both natural gas and electrical appliances located on the Subject Property.
6.4.2. Stains or Corrosion
DCI did not observe any large stains or corrosion located on the Subject Property.
6.4.3. Drains and Sumps
DCI observed surface drains in the building and exterior lot. Also, the site is graded to allow
surface water run-off onto the street.
6.4.4. Asbestos Containing Materials (ACM's)
Sampling for Asbestos Containing Materials (ACM’s) was not a part of the scope of services
for this report. It should be noted that both friable and non-friable forms of ACM might be
present in building materials used prior to 1978. Based on the age of the building
improvements, it is likely that ACM’s are located in the construction on the Subject Property.
Precautions should be taken when removing or replacing any damaged construction. If
asbestos material is disturbed, it may release airborne fibers that can be inhaled and pose a
serious health threat. If the material is in good condition and left undisturbed, it should not
pose a significant health threat and is not mandatory to be removed.
6.4.5. Lead Based Paints
Sampling for Lead Based Paints was not a part of the scope of services for this report. It
should be noted that Lead Based Paints might be present in older construction. Based on the
age of construction, it is likely that Lead Based Paints are located in the building improvements
on the Subject Property. Lead paint poses little or no health risk as long as it is maintained in
good condition. Even loose or damaged paint poses little to no risk for most adults as long as it
is not ingested or inhaled. Special care should be taken to prevent airborne releases if the
building is going to be demolished, remodeled or suspect material is damaged. California
Health & Safety Code Sections 17920.10 and 105256 require lead safe work practices for all
repairs in pre-1979 buildings that disturb paint.
6.4.5. Radon
Sampling for radon gas was not a part of the scope of services for this report. Radon is a
colorless, odorless, radioactive gas produced by the decay of uranium, which is present in
virtually all rocks and soil, typically at 1 to 4 parts per million. Radon gas concentration in air
is commonly measured in picocuries per liter (pC/l). The EPA has established 4pC/l as a
general guideline for maximum acceptable, long term, indoor-radon gas concentration levels.

Los Angeles County Health Department conducted a survey and determined <2pC/l as the
average radon gas concentration for the area.
7. Interviews
7.1. Interview with Owner’s representative
The owner’s representative of the Subject Property was identified to DCI Services as Ms.
Cindy Lau. According to Cindy, “regulated hazardous materials are being handled and stored
onsite. There are no posted violations or non-compliance issues for the Subject Property.”
7.2. Interview with Site Manager

According to nearby neighbors, a service station previously occupied the Subject Property
7.4. Interviews with Local Government Officials
Rosemead Building Department Technicians assisted DCI staff with a thorough records search
for the Subject Property located at 8449 Garvey Avenue and 3014 Earle Avenue, in Rosemead,
California.
8. Findings and Opinions
The Subject Property consists of two light industrial parcels of land developed with two
commercial buildings and two single-family dwellings with separate asphalt paved lots. The
Subject Property includes the contiguous property to the north at 3014 Earle Avenue. Florence
Bonino constructed the single-family dwelling at 3014 Earle Ave., in 1949 with approximately
1,320 square feet in area. Arrow Auto Sales constructed a small sales office building at 8449 E.
Garvey Ave., in 1952 with approximately 294 square feet in area. Everett Harwood completed
a wash rack and parts room addition in 1955. F. Magallanes constructed a storage garage at
3014 Earle Ave., in 1957 with approximately 960 square feet in area. Machinery Rental
Company installed a 5,000-gallon underground gasoline storage tank at 8449 E. Garvey Ave.,
in 1957. Frank Magallanes constructed a furniture storage building and carport at 3014 Earle
Ave., in 1961 with approximately 1,104 square feet in area. Frank & Sons Upholstery Shop
constructed a warehouse for furniture storage at 3014 Earle Ave., in 1965 with approximately
2,100 square feet in area. Lou’s A-1 Rental constructed the present commercial building at
8449 E. Garvey Ave., in 1972 with approximately 2,750 square feet in area. Lou’s A-1 Rental
installed a grease interceptor at 8449 E. Garvey St., in 1972. Lou’s A-1 Rental installed
underground storage tanks at 8449 E. Garvey Ave., in 1975. The permit information does not
list the size or quantity of UST’s installed. Eric Chang obtained a certificate of occupancy to

use the structure for office purposes at 8449 E. Garvey Ave., in 1992. Dollar Rent A Car and
Award Auto Dealer, Inc. currently occupy the site. A service shop and a car wash unit are
located in the commercial building on Garvey Avenue. One aboveground hydraulic lift is
installed. Petroleum-based oils, low emission solvents, and coolant are stored in 55-gallon
drums or smaller containers inside secondary containment barriers. A single floor drain in the
car was unit connects to a multi-stage clarifier in the open lot. One abandoned hydraulic lift is
located in the warehouse on Earle Avenue. The abandoned hydraulic lift is suspect to have
been used for service shop activities. No other regulated hazardous materials are being handled
or stored on the Subject Property. No spills, heavy staining, corrosion, or other signs of
significant chemical releases was observed onsite.
The Regulatory Records Research identified several properties with contamination issues
located within the default area of concern (1/3rd mile radius) at the Subject Property, as defined
by ASTM E2600-15 Tier I Vapor Encroachment Screening. The nearest listing is a “case
closed” LUST site approximately 500 feet to the west at Laidlaw Harley Davidson (8399 E.
Garvey Ave.). Soil only contamination was mitigated at this facility form a waste oil tank leak
in 2008. No conditions were observed that indicate potential impact to the Subject Property
from this source of hazardous wastes. Any properties under remediation for contamination
within the vicinity are unlikely to impact the environmental integrity of the Subject Property.
9. Conclusions
DCI Environmental Services has performed a Phase I Environmental Site Assessment, in
conformance with the scope and limitations of ASTM Practice E 1527-13, at 8449 Garvey
Avenue, in Rosemead, California. Any exceptions to, or deletions from, this practice are
described in Section 13 of this report. This assessment has revealed no evidence of any
recognized environmental conditions in connection with the Subject Property, except for the
following:
The Subject Property was found listed in the HWIS database. A-1 Lou’s Rental Inc., Award
Auto Dealer Inc., Carco Enterprises Inc., and Rentaland maintain(ed) permits to handle
hazardous substances and generate hazardous wastes at 8449 E. Garvey Avenue. The Los
Angeles County Department of Public Works (LACDPW) has records of five underground
storage tanks formerly located at 8449 E. Garvey Avenue. GKN Rentals contracted Exceltech,
Inc. to remove all five UST’s and complete a Tank Closure Report. In April 1990, Exceltech
removed one 10,000-gallon gasoline tank, one 5,000-gallon diesel tank, one 1,000-gallon
kerosene tank, one 500-gallon fresh motor oil tank, and one 500-gallon waste oil tank. No
leaks or damage to the tanks was observed. Based on laboratory analysis results, additional soil
had to be removed from the fresh oil tank and waste oil tank excavation. All of the
contaminated soil was transported offsite for legal disposal. Exceltech conducted additional
soil sampling in the fresh oil tank excavation due to reported elevated TRPH levels. TRPH
contamination detected at 82ppm was allowed to remain in-place. Closure certification was
approved by LACDPW for the completed UST removal on July 22nd 1993. The closure letter
indicates that changes in the present or proposed use of the site may require further site
characterization and mitigation activity. It is the property owner’s responsibility to notify
LACDPW of any changes in the report content, future contamination findings, or site usage.

stage clarifier located at the Subject Property in April 1990. The wastewater generated was
from washing rental equipment. GKN Rentals vacated the site in 1991. Carco Enterprises Inc.
(dba Dollar Rent A Car) was issued permits to discharge industrial wastewater through the
three-stage clarifier in July 1996. Award Auto Dealer Inc. has maintained the three-stage
clarifier since 2009. No significant violations were observed during the latest compliance
inspection of the clarifier on September 8th 2016. Best management practices were being
followed according to state law.
Areas of concern identified at the Subject Property are the service shops, car-wash unit, multi-
stage clarifier, abandoned hydraulic lift, and former UST locations. Petroleum-based oils,
volatile organic compounds, ethylene glycol, and heavy metals may have been released onsite.
The Subject Property appears to be safe for the present commercial use however, further
investigation and possible mitigation activities will be required to legally close the multi-stage
clarifier and if there are any changes in the present or proposed use of the site. It is the property
owner’s responsibility to notify LACDPW if there are any changes in the present use or future
contamination is discovered.
Prior to redevelopment, DCI recommends removing the multi-stage clarifier and abandoned
hydraulic lift. Subsurface investigations will be necessary to determine if either of these
features has released chemicals into the soil. The Los Angeles County Department of Public
Works will have to be involved with legal closure of the multi-stage clarifier and future
redevelopment. Also, a soil vapor survey is recommended in the service shops and former
UST locations. The combined sampling activities should be able to determine if the Subject
Property is safe for redevelopment.
10. Data Gaps
There is no significant Data Gap in connection with the Subject Property.
11. Additional Services
No additional services outside the Detailed Scope of Services described in Section 2.2 were
employed.

.Discovery of this Hazardous Waste site was brought to EPA's attention on 04/01/80. A numeric estimate of the relative severity
of a hazardous substance release and its potential, computed using the Hazard Ranking System, was established on 09/01/83.
The Preliminary Assessment, consisting of collecting and documenting existing information about the source and nature of the
site hazard was completed on 09/01/83. On 09/01/83, a screening Site Inspection was completed, collecting site data and
samples to characterize the severity of the hazard to support the ranking and enforcement of the clean-up required. On 09/01/83, a

As published in the Federal Register on 09/08/83, this site was proposed to be placed on the National Priority List (NPL), based
on the site's Hazard Ranking Score. On 05/08/84, the proposed NPL status was converted to Final Status. Data was collected on
06/13/84 for analyses of the site problem, identification of preliminary remedial alternatives, and recommendations of a cost-
effective remedy (RI/FS). A Removal Investigation was started on 09/19/90, collecting field data on the actual hazardous
substance at the site for the purpose of characterizing the magnitude and severity of the hazard. The action was completed on
09/19/90. An Administrative Order was issued on 10/29/91 by the EPA unilaterally (under section 106 of SARA). A Removal
Investigation was started on 12/27/91, collecting field data on the actual hazardous substance at the site for the purpose of
characterizing the magnitude and severity of the hazard. The action was completed on 12/27/91. A search of PRPS was initiated
on 09/30/84. The action was completed on 07/01/94. A search of PRPS was initiated on 01/30/89. The action was completed on
07/01/94. A voluntary and enforceable agreement, Administrative Order of Consent, pursuant to CERCLA was signed by EPA
and PRPS on 05/26/95, whereby the PRPS agree to perform and/or pay for the response costs involved in site cleanup. The order
describes the PRP response to be taken at the site, stipulated penalties, indemnification, effective date, and may be subject to
public comment. An Administrative Order was issued on 05/31/95 by the EPA unilaterally (under section 106 of SARA). A
voluntary and enforceable agreement, Administrative Order of Consent, pursuant to CERCLA was signed by EPA and PRPS on
07/25/95, whereby the PRPS agree to perform and/or pay for the response costs involved in site cleanup. The order describes the
PRP response to be taken at the site, stipulated penalties, indemnification, effective date, and may be subject to public comment.
Discussions were held on 06/28/95 between EPA and the PRPS on liability for and conduct of a RI/FS. The action was completed
on 07/25/95. EPA regional attorneys took legal action on 06/30/99 to establish EPA as a creditor of the PRP, who has filed for
bankruptcy. An enforcement instrument (e.g. Consent Decree) is lodged by DOJ with the court. A judicial Consent Decree was
entered on 08/20/96 between the Federal government and the PRPS settling a claim under CERCLA. The federal government
provided assistance on 01/12/88 of state administrative costs of participation in the remedial activities at the site. Support was
provided for conducting the review of remedy treatment facilities five years after construction completion.
SEMS Comprehensive Environmental Response, Compensation, and Liability Act
Superfund Enterprise Management System (SEMS) replaced CERCLIS in 2014. This database is used by the EPA to track
activities conducted under the Comprehensive Environmental Response and Liability Act CERCLA (1980) and the
amendment the Superfund Amendments and Reauthorization Act SARA (1986). Sites to be included are identified
primarily by the reporting requirements of hazardous substances Treatment, Storage and Disposal (TSD) facilities and
releases larger than specific Reportable Quantities (RQ), established by EPA. Using the National Oil and hazardous
Substance Pollution Contingency Plan (National Contingency Plan) the EPA set priorities for cleanup. The EPA rates
National Contingency Plan sites according to a quantitative Hazard Ranking System (HRS) based on the potential health
risk via any one or more pathways: groundwater, surface water, air, direct contact, and fire/explosion. The EPA and state
agencies seek to identify potentially responsible parties (PRP) and ultimately Responsible Parties (RP) who can be required
to finance cleanup activities, either directly or through reimbursement of federal Superfund expenditures.

NFRAP No Further Remedial Action Planned sites (CERCLIS)
As of February 1995, CERCLIS sites designated 'No Further Remedial Action Planned' NFRAP have been removed from
CERCLIS. NFRAP sites may be sites where, following an initial investigation, no contamination was found, contamination
was removed quickly without the site being placed on the NPL, or the contamination was not serious enough to require
Federal Superfund action or NPL consideration.

HMIRS Hazardous Material Incident Report System
The Hazardous Material Report Incident Report Subsystem HMIRS of the Research and Special Programs Administration
(RSPA) Hazardous Material Information System was established in 1971 to fulfill the requirements of the Federal
hazardous material transportation law. Part 171 of Title 49, Code of Federal Regulations (49 CFR) contains the incident

TPC Toxic Pits
The Toxic Pits Clean-Up Act (Katz Bill) places strict limitations on the discharge of liquid hazardous wastes into surface
impoundment, toxic ponds, pits and lagoons. Regional Water Quality Control Boards are required to inspect all surface
impoundment annually, in addition, every facility was required to file a Hydrogeological Assessment Report. Recent
legislation allows the Department of Health Services to exempt facilities that closed on or before December 31, 1985, if a
showing is made that no significant environmental risk remains (AB1046).
Special exemption provisions have been created for surface impoundment that receive mining wastes.

SWAT Solid Waste Assessment Test - Regional
This program, provided for under the Calderon legislation (Section 13273 of the Water Code), requires that disposal sites
with more than 50,000 cubic yards of waste provide sufficient information to the regional water quality control board to
determine whether or not the site has discharged hazardous substances which will impact the environment.
Site operators are required to file Solid Waste Assessment Test reports on a staggered basis. Operators of the 150 highest
ranking (Rank 1) sites were required to submit Solid Waste Assessment Tests by July 1, 1987, Rank 2 in 1988 and so on.
Operators submit water quality tests to the Regional Water Quality Control Board, describing surface and groundwater
quality and supply; and the geology within 1 mile of the site. Air quality tests are submitted to the local Air Quality
Management District or Air Pollution Control District.

The Corteses Bill (AB2013), enacted in 1983, required registration of all underground storage tanks (UST) with the State
Water Quality Control Board by July 1, 1984. About 176,000 tanks and surface impounds were registered between 1984
and 1987. An amendment (AB 1413) was passed in 1987, effectively removing the State Board from the registration
