AN ORDINANCE OF THE CITY OF ROSEMEAD RE
GARBAGE AND RUBBISH DISPOSAL AND AMENDING
THE MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. Sections 5408, 5409 and 5410, of
Chapter IV o rticle V of the Rosemead Municipal Code,
are amended to read:
51:03. Duration of Storage. It shall be unlawful for,
any person to store or accumulate any garbage,
combustible or non-combustible rubbish, mis-
cellaneous debris or combined rubbish, in any
container or at any location other than as here-
inabove set forth, or for any length of time
other than as follows:
(a) Garbage. Garbage shall not be accumulated
or stored for a period or' time in excess of:
ep 1. Commercial zone areas - forty-eight (48)
hours. (Sundays and holidays excepted.)
2. All other areas - One week.
(b) Combustible or non-combustible rubbish and
miscellaneous debris shall not be stored or
accumulated for a period of time in excess
of one week.
(c) Combined rubbish shall not be accumulated or
stored for a period of time in excess of:
Commercial zone areas - forty-eight (48)
hours. (Sundays and holidays excepted.)
2. All other areas - One week.
(d) The above periods of time which end in any
week in which a holiday occurs are extended
one (1) additional day.
5`.09. Duty Property Owners NR Collection. Except as
Otherwise prove e i1is c apiTpter, it shall be
unlawful for any person other than the Contractor,
as defined in this chapter, or the City, to gather,
collect or remove, any garbage or rubbish from any,
commercial, business, industrial or residential,
premises within the City.
5410. Franchise Garbage and Rubbish Collection - Charges.
The City ~Ts aTi-Trom time to time enter into contracts
or exclusive franchise agreements regarding the
collection of garbage, combustible and non-com-
bustible rubbish, miscellaneous debris and combined
rubbish from commercial, business, industrial and
residential property. So long as any such contract
or franchise agreement remains in force, collection
of the materials provided for therein may be made
• •
only in accordance with the terms and conditions
thereof. Fees and charges shall be, and are .
hereby, imposed upon owners of residential property,
and upon occupants of business, commercial or
industrial, premises in the City for the collection,
removal and disposal of such garbage, rubbish,
debris and other refuse matter, within the City.
Such fees and charges for such collection, removai
and disposal services shall be those which the
City Council may from time to time hereafter deter-
mine, fix and establish, by resolution or by the
terms of any contract or franchise agreement between
the City and a Contractor. Such fees and charges
shall be billed and collected by the Contractor.
Section 2. Section 5403 of the Rosemead Municipal
Code is hereby amended by amending the heading thereof to
read: "5403 Containers and Locations Householders' Duties'
and by adding to said Section 5403, as the last paragraph
thereof, a new paragraph to read:
All loose materials shall be secs;rely tied in
bundles which shall not weigh in e;;cess of
sixty (60) pounds each, and shall not exceed
the size of one (1) cubic yard or three (3)
feet in length.
Section 3. Subsection (c) of Section 5411 of the
Rosemead Municipa Code is hereby repealed.
