Ordinance No. 116 - Establishing a Modification CommitteeORDINANCE NO. 116 AN ORDINANCE OF THE CITY OF ROSEMEAD ESTABLISHING A MODIFICATION COMMITTEE, PROVIDING PROCEDURES RELATING THERETO AND AMENDING THE ROSEMEAD MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF ROSEMEAD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The Rosemead Municipal Code is hereby amended y ad ing a new Chapter 5.5 to Article 11 of said Code to read: CHAPTER 5.5 - MODIFICATION COMMITTEE 2550 Modification Committee Creation of. A Modification Committee is hereby established with membership, powers and duties as provided in this Chapter. 2551 Members. The Modification Committee shall consist of testy Administrator, City Planning Advisor and Chair- man of the Planning Commission, who shall serve on such Modification Committee by virtue of and during the tenures of their respective offices. In the event of the illness, absence or inability to act of the City Administrator, the Administrative Assistant may act, or of the Chairman of the Planning Commission, the Vice Chairman of the Planning Commission may act on such Modification Committee. 2552 Powers and Duties. The Modification Committee shall have such powers and duties as are assigned to such Committee under the provisions of Chapters I and 2 of Article IX of the Rosemead Municipal Code. In addition thereto, the Modification Committee shall act as an administrative committee to consider and determine from time to time on the basis provided in this section, whether proposed maps, building plans, plot plans or other land development plans require hearings and action by the Planning Commission or City Council pursuant to such Chapters. If the Modification Committee should determine that a proposed . map, building plans, plot plan or other land develop- ment plan deviates or fails to comply with the strict letter of Chapter 1 or 2 in so minor and insubstantial a degree that application to the Planning Commission for a variance or other approval and a public hearing, are not required in the public interest, and that the spirit and purposes of the applicable zoning or lot split ordinance, adjacent properties and the public welfare will not be adversely affected by the approval of such minor or insubstantial deviation, said Modifi- cation Committee may act upon such minor or insubstantial deviation, and may approve the same or may approve the same subject to such conditions as such Modification Committee may impose in order to avoid detriment to adjacent properties or the public welfare and to carry out the spirit and purposes of the applicable ordinance. 2553 Application. Any owner, optionee or person holding a contract for the purchase of real property may make written application to the Modification Committee for the modification of the strict requirements of Chapter 1 or Chapter 2 of Article IX of the Rosemead Municipal Code, with respect to such property. Such application shall be in writing on a form and shall provide such information as may be prescribed by the Modification Committee, and shall be signed by such owner, optionee or purchaser. No fee shall be required for the filing or processing of such application. The Modification Committee shall. act on such application within ten days after the filing thereof. 2554 Declsloms and Reports. All decisions or actions of the o i ication Committee shall be concurred in by all members of the Committee. Any decision made or action taken by the Modification Committee in any matter where there is any deviation from the requirements of said Chapter 1 or 2 shall be reduced to writing, signed by all members and filed with the City Clerk. The City Clerk shall cause such action to be reported to the next meeting of the Planning Commission, and a record thereof to be permanently filed in the City Clerk's office.
