MUNOZ
The attached claim was received in this office on November 30, 1998. A copy was sent to the
City's claims adjuster, Carl Warren& Company on the same day. The claimant alleges that
malfunctioning traffic signal lights caused his accident. Observation by SMI/Peek Traffic and the
Sheriffs Department of that intersection (Valley Boulevard and Rio Hondo/Mission Drive) found
the signals to be functioning properly. All information was forwarded to the City's adjuster.
Carl Warren & Company sent a notice on December 2, 1998, recommending that this claim be
rejected by the City.
RECOMMENDATION li
It is recommended that the City Council approve the rejection of this claim and authorize a letter
of rejection be sent to the claimant.

EVALUATION: We will tender this claim to Peek Traffic as the contract documentation
allows. This is a questionable liability case.

Dear Mr. Stewart,
On September 16, 1998, we received a call to the above referenced intersection to check out
the possibility of the lights displaying conflicting greens. During questioning regarding the
origination of the call, we were told that an accident had occurred on the 15th, and that it had
been witnessed by a council member who saw the problem with the intersection controls. Also,
officer Robles had called Mr. Wagner and reported the problem with the intersection to him.
Our technician responded and performed a preventative maintenance check of the intersection
and found all to be working well. The technician then reported his findings to me and also to
Ms. Jessica Wilkinson at the City Hall. The next day (September 17th) the technician and his
leadman returned to the intersection to once again check out the workings of the controller and
the signal monitor. They conflicted the monitor and it immediately went to a flash mode as it is
designed to do. When the technicians left the intersection, it was working as intended.
I had the technician retrieve a copy of the timing chart, maintenance log and extraordinary
maintenance log from the cabinet so that we could study the workings of the intersection at our
office. Dave Scott, Ken Harris and myself sat down and went over the phasing and timing of the
signals, and we agreed that the intersection equipment was performing as it was designed to
do. We could see as we studied the workings of this particular intersection, that unless the
drivers were paying close attention to the lights, certain phasing could be misinterpreted.
In order for you to better understand (and explain) the workings of the traffic controls at the
intersection, the following is a brief description of the phasing:
Mission intersects the north side of Valley at an angle just west of the intersection of Rio
Hondo. The entire intersection is controlled by a 170 controller. Phase 1 is for the traffic
that is southbound on Mission, and when it is green, the traffic proceeds south on
Mission and east on Valley. In conjunction with the green for phase 1, the traffic signal at
Rio Hondo (phase 6 for eastbound) turns green to allow the traffic to continue on 'Valley.
At the same time, the traffic at Rio Hondo which is stopped at Valley (north and south)
has a red light (phase 4). Also, the traffic headed westbound on Valley (phase 2) has a
red light, and this allows the eastbound traffic to continue eastbound or turn left onto Rio

Hondo going northbound. Phase 1 will time out and go to yellow and then to red,
allowing phase 2 to go to green. At the same time phase 6 remains green and you now
have east/west traffic on Valley with a permissive' left turn at Rio Hondo. When phases
2 &6 time out and go to red, then phase 4 (north/south traffic on Rio Hondo) gets a
green signal. After phase 4 times out, the entire process is repeated.
The above description is a very simplified version of the workings of the traffic controls at the
intersection and is by no means all that happens during each signal cycle. It is only to allow you
to understand the design of the basic flow of traffic.
My understanding of the accident after reading the police report of the incident, is that it appears
as if one of the motorists involved in the accident was turning left on to northbound Rio Hondo
from eastbound Valley Blvd., and did not realize that the westbound traffic had received a green
light and that she would have to yield to oncoming traffic. One inexpensive method of
preventing this from recurring is to institute different signal phasing and additional signage.
There is also the possibility of installing protective/permissive left turns phasing, but this would
be much more expensive and would require some reengineering on the part of the City.
From the standpoint of SMI, the signal is operating as it was designed to operate. If the City
would like to discuss options with SMI, we would be happy to meet and go over them with you
and your staff.
