RE: 2538 LA PRESA AVENUE - HEARING
The subject property consists of a single family dwelling with an unpermitted garage conversion and
garage addition. The property is zoned R-1. A "Please Letter" was mailed to the property owner
on July 9, 1998. The letter was returned "attempted - not known". The Building Official declared
the property substandard and filed a Declaration of Substandard Property with the Los Angeles
County Recorder's office. A "Thirty Day" certified letter was mailed and posted on the property on
July 28, 1998, requesting abatement of the substandard conditions. On July 29, 1998, staff received
a telephone call from an attorney, Mr. Spiegel. He explained that the property was part of a trust,
and that the occupants, two sisters who are also co-owners, were residing there as part of a
conservatorship. He stated the family was considering selling the property and had been in contact
with local realtors.
Inspection on August 12, 1998 revealed that plumbing repairs and some yard area cleanup had
commenced. The building inspector spoke with Mr. Gutierrez, another co-owner, who was working
at the property. He reiterated what Mr. Spiegel had stated and indicated that he hoped to sell the
property once he was able to relocate his sisters. A progress inspection on September 15, 1998
revealed that the property remained reasonably clean at the front. Mr. Gutierrez spoke to the building
inspector and stated that the attorney was in the process of obtaining a court order authorizing the
sale of the property and the relocation of the occupants. A follow-up inspection was conducted on
October 22, 1998. It appeared the dwelling was still occupied and was not being maintained. Dried
branches and debris were piled in the driveway. The building inspector left telephone messages for
both Mr. Gutierrez and Mr. Spiegel. No response was received at that time. Inspection on
November 23, 1998 again showed no progress. The inspector noted that the rear door was broken.
Telephone messages were again left for Messrs. Gutierrez and Spiegel. On November 24, 1998,
Mr. Spiegel returned the call and spoke with the building inspector. He claimed to have a court date
of November 30, 1998. The inspector advised Mr. Spiegel of the broken door.

Follow-up inspection on December 14, 1998 revealed that the rear door had been secured and that
the trash and debris had been removed. A"For Sale" sign was posted on the property. On January
13, 1999, Mr. Gutierrez advised staff that the property was in escrow. However, an updated title
report indicated no change of ownership.
To date, no permits have been obtained and no documentation has been submitted substantiating any
court action or pending escrow.
A Notice of Hearing was mailed and posted on the property on February 8, 1999. All interested
parties have been notified.
CITY BUILDING OFFICIAL'S RECOMMENDATION:
It is recommended that the Board find the property substandard and order all substandard conditions
be removed and/or corrected by April I, 1999. However, if permits and approvals are obtained,
and sufficient progress is achieved by April 1, 1999, the abatement date may be extended to May
3, 1999.

The City Building Official has determined by inspection that the following property is substandard,
as defined in Section 9905 of the City of Rosemead Building Laws, because of the defects listed on
the attached letter.
THEREFORE, NOTICE IS HEREBY GIVEN that on Tuesday, February 23, 1999 at 7:00 p.m.,
in the City Hall, 5838 E. Valley Boulevard, Rosemead, California, a HEARING WILL BE
CONDUCTED before the City of Rosemead Rehabilitation Appeals Board on this matter.
All persons who desire to be heard shall appear before the above Board at said time and place to

a. Must reconvert back to a two car garage. (Remove all interior portions).
b. Remove all unpermitted plumbing. It must be properly abandoned at its source.

Dear Property Owners:
A recent inspection of the property at the above address has found it to be substandard as defined by the City of
Rosemead Building Code, because of the defects enumerated in the attached list.
Section 9908 of the Code declares all such substandard buildings a public nuisance and requires the abatement thereof
by correction, if practical, or demolition of the substandard conditions.
As the owner of record, you are hereby notified to comply with the requirements of the above code, and to correct
or remove the substandard conditions listed. All such work shall be completed within thirty(30) days after receipt
of this letter. Be advised ifvou are renting this property to others the City may file a Notice of Non-Compliance with
the State Franchise Tax Board. Revenue and Taxation Code, Section 17274 states: "No deduction shall be allowed
for interest. taxes depreciation. or amortization._with respect to substandard (rental) housing."
This notice will be posted on the property. If in your opinion, you disagree or cannot comply with the above findings
or order, you may request a public hearing. The request for hearing must be within thirty (30) days after posting of
this notice on the property, must be in writing, and directed to the City of Rosemead Building Official, 8838 East
Valley Boulevard, Rosemead, California 91770.
