TRIPEPI, CITY MANAGER DATE: V MARCH 17, 1999 RE: REQUEST FROM CALIFORNIA CONTRACT CITIES ASSOCIATION TO PAY $2,834.75 ASSESSMENT TO COVER LEGAL COSTS INCURRED FOR ESTABLISHING SELF-INSURANCE AUTHORITY FOR EFFECTIVE RISK MANAGEMENT Attached for your consideration is an invoice from the California Contract Cities Authority regarding an assessment to cover the legal costs incurred in creating SAFER(Self-insurance Authority for Effective Risk Management). Although the County of Los Angeles will continue to administer the Liability Trust Fund, SAFER is contracting with the California Joint Powers Authority to assist in the oversight of the Liability Trust Fund. The City has received a separate invoice from the Joint Powers Authority for that service. RECOMMENDATION It is recommended that the Rosemead City Council authorize the payment, from appropriated reserves, in the amount of$2,834.75 to the California Contract Cities Association. TREASURER JOHN C. MCTAGGART Rancho Palos Verdes BUDGET&AUDFT COMMITTEE The Budget and Audit Committee addressed this matter at their meeting on RAY JOHNSON, Chair February 3, 1999. They recommended to the Executive Board that the forty Rc° cities be assessed their proportional share of the legal costs based upon their BY-LAWS COMMITTEE 1998/99 annual Sheriff's contract costs. Therefore, Rosemead we believe it is appropriate to assess each of the forty cities who have cnY MGRS./CITY.ADM.COMMITTEE benefited from this work product. SELECTION LVA ,COMMITTEE Over the last three years the California Contract Cities Association has LARRY Cudahy , Chair Cndanr expended $95,637.39 on legal fees in establishing a Joint Powers Authority SPECIAL EVENTS COMMITTEE called Self-Insurance Authority for Effective Risk Management (SAFER). La Puente PAST PRESIDENT Under the direction of the COCA Board of Directors we were to explore RANDY BOMGAARS alternatives and options to the then current Contract Cities / County Liability Penno"er Trust Fund (LTF). Resolutions from each of the cities were adopted. At four Board of Directors meetings as well as almost every city manager meeting held in 1996, 1997 and 1998, presentations were made to address the issues SAN DIEGO CHAPTER which caused cities concerns regarding accounting and cost of the Liability GLORIA MCCLELLAN Trust Fund. Vista EXECUTIVE DIRECTOR The Board of Directors' formal action to proceed was followed by the Executive Boards' action to appoint a transition committee to select a law firm to revise the Assumption of Liability agreement and establish a Joint Powers Authority. The firm of Burke, Williams and Sorensen was selected. The Association did not budget any funds for legal fees. However, only by Board of Directors action to adjust the budget to set aside the funds for legal work were costs incurred. The costs incurred by the Contract Cities Association were to be absorbed by SAFER once the JPA was formed and operational. We have now embarked upon a process with more accountability, better reporting and decision making under the control of cities. As a result of adoption of the Self-Insurance Authority for Effective Risk Management (SAFER), the Contract Cities' goal of a better system to manage the claims were met. Attached is the shared cost for legal services incurred for each of the forty cities contracting for law enforcement services.
