ROSEMEAD BUILDING REHABILITATION
APPEALS BOARD
AUGUST 25, 1998
The regular meeting of the Rosemead Building Rehabilitation Appeals Board was called to order
by Chairman Bruesch at 7:05 p.m. in the Conference Room of City Hall, 8838 E. Valley
Boulevard, Rosemead, California.
The Pledge to the Flag and Invocation were waived as having been completed during the
meeting just adjourned.
ROLL CALL OF OFFICERS:
Present: Boardmembers Clark, Imperial, Taylor, Vice-Chairman Vasquez, and
Chairman Bruesch
Absent: None
APPROVAL OF MINUTES: JULY 28, 1998 - REGULAR MEETING
MOTION BY BOARDMEMBER TAYLOR, SECOND BY BOARDMEMBER
IMPERIAL that the Minutes of the Regular Meeting of July 28, 1998, be approved as submitted.
I. ADMINISTRATION OF OATH
The Board Secretary administered the oath to all persons wishing to address the Board.
H. HEARINGS
A. 3355-551/2 DELTA AVENUE
The subject property consists of an owner-occupied single family dwelling, a second,
tenant-occupied unit and an illegal garage conversion as a third unit. The property is zoned R-2.
A "Please Letter" was mailed to the property owner on April 20, 1998. Inspection on May 21,
1998 revealed no progress. The Building Official declared the property substandard and filed a
Declaration of Substandard Property with the Los Angeles County Recorder's office. On May 26,
1998, the building inspector spoke with an individual who claimed to be the owner's daughter.
This individual requested a thirty day extension to commence repairs and stated that her parents
were out of the country. On June 11, 1998, a "Fifteen Day" certified letter was mailed and posted
on the property, requesting abatement of the substandard conditions. No progress was observed
at the time of posting. A follow-up inspection on June 25, 1998 again showed no progress. On
June 30, 1998 the inspector spoke to the property owner. The inspector explained the
rehabilitation process and the necessity for permits and timely progress. A "bulky item" trash
notice was mailed to the owner on July 16, 1998.
A review of Building Department records revealed that permits were issued in February,
1996 for stucco, window replacement, and conversion of a carport to a garage at 3355 Delta
Avenue. Inspections were never requested and the permits have since expired.
Inspections on July 28, and August 3, 1998 showed no change at the property. A Notice
of Hearing was mailed and posted on the property on August 10, 1998. All interested parties
have been notified.
The City Building Official recommends that the Board find the property substandard and
order all substandard condition be removed and/or corrected by October 1, 1998. However, if
permits and approvals are obtained, and sufficient progress is achieved by October 1, 1998, the
abatement date may be extended to November 2, 1998.

Muoi Nug Vuong, 3355 Delta Avenue, Rosemead, property owner, was present.
Chairman Bruesch asked if the property is for sale.
Ms. Vuong responded that she wants to sell it, but it is not for sale yet.
Henry , Arcadia, a friend of the owner, added that
the property is not for sale.
Chairman Bruesch asked if the garage is occupied at 3355% Delta.
Ms. Vuong responded that a garage is presently empty.

Chairman Bruesch explai ed to the owner that the carport has to be converted back to
allow cars to park under it, and,garage has to be converted back,to a garage. Mr. Bruesch asked
Ms. Vuong if that was time enough for her to get ihat-d nie. ''`- c-t^ ° e t -
Ms. Vuong requested more time as those conversions will require a lot of money and
added that she purchased those properties in that condition in 1991.
Chairman Bruesch suggested that Ms. Vuong meet with staff to go over the list of
conditions in order for her to begin corrections within the next few months.
MOTION BY BOARDMEMBER IMPERIAL, SECOND BY BOARDMEMBER
CLARK that the Board find the property substandard and order all substandard conditions be
removed and/or corrected by October 1, 1998. However, if permits and approvals are obtained,
and sufficient progress is achieved by October I, 1998, the abatement date may be extended to
November 2, 1998. Vote resulted:

Abstain: None
The Chairman declared said motion duly carried and so ordered.
Boardmember Clark asked when the disclosure laws became effective?
Robert Kress, City Attorney, responded that they were effective before 1991.
Boardmember Clark asked if the property owner has any legal recourse?
James Guerra, Building Official, responded that a plot plan submitted by the owner of
record in 1996 does not show the addition at the back of the garage and that the carport is still a
carport.
Mayor Bruesch stated that those changes were made since 1991 and explained to the
owner the corrections that need to be made.

Boardmember Imperial requested an update on 4623 Earle Avenue.
James Guerra, Building Official, responded that the property remains secured.
Robert Kress, City Attorney, stated that the owner still cannot be found, and that a
computer check of records is run every few months.
V. ADJOURNMENT
There being no further action to be taken at this time, the meeting was adjourned at 7:15
p.m. The next regular meeting is scheduled for September 22, 1998, at 7:00 p.m.
