The subject property consists of a single family residence located in the R-I zone. The property was
previously before the Board on August 26, 1997. At that time the Board ordered a completion date
of September 11, 1997. Compliance was not achieved. A"Notice of Intent" was mailed and posted
on the property on September 17, 1997. The yard areas were cleaned under City contract on
September 29, 1997. A "Notice of Cost" was sent to the owner on October 6, 1997. No payment
was received and no appeal was filed. (In July of 1998, a direct assessment was filed with the Los
Angeles County Auditor-Controller Tax Division to recover the costs incurred by the City.)
In December, 1997 the property sold. The seller's realtor advised Building Department staff that the
buyer was aware of the Declaration of Substandard filed against the property, and that they would
act immediately to correct the remaining code violations. A follow-up inspection on February 2, 1998
revealed that the conditions at the property had begun to deteriorate. A"fifteen Day" certified letter
was mailed to the new owners and posted on the property on February 9, 1998. Inspection on
February 27, 1998 showed that the property had been cleared of trash and debris, however the other
substandard conditions remained.
Since the sale, the property has continued to be occupied by the former owner, Patricia Alcantara.
The present owners have stated to staff that they have offered Ms. Alcantara relocation assistance.
She allegedly refuses and will not vacate the premises. Mr. Kupper, one of the owners, sent a copy
ofa"Three Day Notice to Quit Premises" dated June 8,1998, however no documentation of proof
of service was provided.
The Building Inspector has monitored the property and has had to regularly contact the owners to
ensure the property is minimally maintained. For several months the yard areas have alternately been
overgrown then cleared. Access to the interiors of the dwelling and garage has not been gained.

CITY BUILDING OFFICIAL'S RECOMMENDATION:
It is recommended that the Board find the property substandard and order the all substandard
conditions removed and/or corrected by November 2, 1998. However, if permits and approvals are
obtained, and sufficient progress is achieved by November 2, 1998, the abatement date may be
extended to December t, 1998.

City records indicate that the above referenced property has incurred costs that have not as yet been
reimbursed to the City of Rosemead. These costs were a result of the City having to contract for the
fencing/securing and/or removal of substandard conditions which existed on the property.
Official notice was served upon the owner stating the costs, in the amount of$1,012.15, will become
a special assessment against the property if not paid in full. On June 29, 1998, any outstanding costs
due the City of Rosemead plus additional fees for recording and filing of the special assessment in the
amount of$345 will be placed upon the property tax rolls.
To avoid the additional fees please submit$1,012.15, payable to the City of Rosemead prior to June

A recent inspection of the property at the above address has found it to be substandard as defined by the City of
Rosemead Building Code, because of the defects enumerated in the attached list.
Section 9908 of the Code declares all such substandard buildings a public nuisance and requires the abatement thereof
by correction, if practical, or demolition of the substandard conditions.
As the owner of record, you are hereby notified to comply with the requirements of the above code, and to correct
or remove the substandard conditions listed. All such work shall be completed within fifteen (15) days after receipt
of this letter. Be advised if vou are renting this property to others the City may file a Notice of Non-Compliance with
the State Franchise Tax Board. Revenue and Taxation Code, Section 17274 states: "No deduction shall be allowed
for interest, taxes, depreciation, or amortization...with respect to substandard (rental) housing."
This notice will be posted on the property. If in your opinion, you disagree or cannot comply with the above findings
or order, you may request a public hearing. The request for hearing must be within fifteen (I 5) days after posting

NOTICE OF INTENT
An inspection of the above mentioned property on September 11, 1997 revealed that the attached
substandard conditions have not been corrected or abated as required by our Rehabilitation
Appeals Board Order of August 26, 1997. Specifically, the property was found to be littered with
trash, debris, overgrown vegetation, and the structure remains in a state of disrepair and
deterioration. The conditions existing on the property are in violation of Section 9908 of the Uniform
Building Code, as adopted by the Rosemead Municiapl Code, which declares all such conditions a
public nuisance and requires the abatement thereof
It is the City's intention to enter on the property and remove the exterior storage (furniture,
mattresses, etc ) and clear the property of all weeds, trash and debris COMMENCING
SEPTEMBER 22, 1997.
All parties are advised to remove their personal or household items they may wish to retain before
Monday, September 22, 1997, at 5.00 a.m_, as the City assumes no responsibility for their
conservation.
The actual cost of the work plus approximately S492 processing fees, as specified in the Building
Code, will be charged to the owner of the property.

NOTICE OF ORDER
Evidence and testimony concerning the condition of the improvement at the address listed below has
been presented to the City of Rosemead Building Rehabilitation Appeals Board.
The Board confirms the Building Official's findings of substandard property and ordered: That all
substandard conditions be removed and/or corrected by September 11, 1997.
The completion date, shown below, was established by Board Order as a deadline for compliance. If the
work is not completed, but reasonable progress has been made, you may send a written request to the
Building Rehabilitation Appeals Board for a rehearing. Such request must be made at least ten (10) days
prior to the completion date.
Failure to comply with the Board Order or failure to request a rehearing will result in the necessary work

2. All unpermitted plumbing must be removed and capped. It must also be properly abandoned
at its source.

between the hours of 7:00 - 11 :00 a.m. Monday through Thursday, and between 4:00 - 6:00 p.m.
