TRIPEPI, CITY MANAGER ' DATE: SEPTEMBER 15, 1998 RE: 4552 SULTANA AVENUE - REHEARING The subject property consists of a single family residence located in the R-I zone. The property was previously before the Board on August 26, 1997. At that time the Board ordered a completion date of September 11, 1997. Compliance was not achieved. A"Notice of Intent" was mailed and posted on the property on September 17, 1997. The yard areas were cleaned under City contract on September 29, 1997. A "Notice of Cost" was sent to the owner on October 6, 1997. No payment was received and no appeal was filed. (In July of 1998, a direct assessment was filed with the Los Angeles County Auditor-Controller Tax Division to recover the costs incurred by the City.) In December, 1997 the property sold. The seller's realtor advised Building Department staff that the buyer was aware of the Declaration of Substandard filed against the property, and that they would act immediately to correct the remaining code violations. A follow-up inspection on February 2, 1998 revealed that the conditions at the property had begun to deteriorate. A"fifteen Day" certified letter was mailed to the new owners and posted on the property on February 9, 1998. Inspection on February 27, 1998 showed that the property had been cleared of trash and debris, however the other substandard conditions remained. Since the sale, the property has continued to be occupied by the former owner, Patricia Alcantara. The present owners have stated to staff that they have offered Ms. Alcantara relocation assistance. She allegedly refuses and will not vacate the premises. Mr. Kupper, one of the owners, sent a copy ofa"Three Day Notice to Quit Premises" dated June 8,1998, however no documentation of proof of service was provided. The Building Inspector has monitored the property and has had to regularly contact the owners to ensure the property is minimally maintained. For several months the yard areas have alternately been overgrown then cleared. Access to the interiors of the dwelling and garage has not been gained. REHAB AGENDA SEP 221898 ITEM No. A Notice of Hearing was mailed and posted on the property on September 8, 1998. All interested parties have been notified. CITY BUILDING OFFICIAL'S RECOMMENDATION: It is recommended that the Board find the property substandard and order the all substandard conditions removed and/or corrected by November 2, 1998.
