REHAB – Approval of Minutes 11-25-97 NOT 07—'77'r, UNTrt MINUTES OF THE REGULAR MEETING ROSEMEAD BUILDING REHABILITATION APPEALS BOARD NOVEMBER 25, 1997 The regular meeting of the Rosemead Building Rehabilitation Appeals Board was called to order by Chairman Imperial at 7:10 p.m. in the Conference Room of City Hall, 8838 E. Valley Boulevard, Rosemead, California. The Pledge to the Flag and Invocation were waived as having been completed during the meeting just adjourned. ROLL CALL OF OFFICERS: Present: Boardmembers Clark, Taylor, Vasquez, Vice-Chairman Bruesch, and Chairman Imperial Absent: None APPROVAL OF MINUTES: AUGUST 26, 1997 -REGULAR MEETING MOTION BY BOARDMEMBER TAYLOR, SECOND BY VICE-CHAIRMAN BRUESCH that the Minutes of the Regular Meeting of August 26, 1997, be approved as corrected. APPROVAL OF MINUTES: OCTOBER 28, 1997 - REGULAR MEETING MOTION BY VICE-CHAIRMAN BRUESCH, SECOND BY BOARDMEMBER TAYLOR that the Minutes of the Regular Meeting of October 28, 1997, be approved as submitted. ADMINISTRATION OF OATH The Board Secretary administered the oath to all persons wishing to address the Board. II. HEARINGS The following item was taken out of order in deference to those in the audience REHAB 11.25-97 Page el B. 2508 MUSCATEL AVENUE The subject property consists of an owner-occupied single family residence located in the R-I zone. A "Please Letter" was mailed to the property owner on March 11, 1997, and a "bulky item" trash notice was sent on March 25, 1997. Inspection on April 10, 1997 revealed no progress. The Building Official declared the property substandard and filed a Declaration of Substandard Property with the Los Angeles County Recorder's office. A "Thirty Day" certified letter was mailed and posted on the property on April 24, 1997, requesting abatement of the substandard conditions. While posting the property, the building inspector observed that some progress had been made. However, follow-up inspections in May and June 1997 revealed no further progress. On July I, 1997, another trash notice was mailed. Inspections in July and August 1997 again showed no progress. On September 24, 1997, another inspection was made. Very minor progress was noted. The building inspector attempted to telephone the property owner, but was unable to make contact. Contact was made with the owner on October 7, 1997. She claimed the work would be complete by October 13, 1997. On October 8, 1997 a third trash notice was mailed. Inspection on October 22, 1997 revealed that the porch had been painted, but other defects remained. A Notice of Hearing was mailed and posted on the property on November 10, 1997. All interested parties have been notified. The City Building Official recommends that the Board find the property substandard and order all substandard conditions be removed and/or corrected by January 5, 1998. Armida and Rafael Ambriz, 2508 Muscatel, Rosemead, were present. Vice-Chairman Bruesch asked what their plans were for the Mustang parked on the property and is it registered. Mr. Ambriz responded that it needs a battery and that he pays a $10 yearly fee to DMV for that vehicle. Chairman Imperial stated that the vehicle is still considered inoperable and needs to be moved. The owners agreed to move the car into the garage. Mr. Ambriz stated that they are having problems with their neighbor regarding the deteriorated fencing and whose property the fence is on. James Guerra, Building Official, explained that the recommendation is that the property owner look at the assessors maps to try to calculate property boundaries. Mr. Guerra added that their neighbor's property is under rehab also. Boardmember Taylor suggested that the fencing issue to deferred to the next meeting to determine ownership. MOTION BY VICE-CHAIRMAN BRUESCH, SECOND BY BOARDMEMBER TAYLOR that the Board find the property substandard and order substandard condition #3 be removed and/or corrected by January 5, 1998, and that ownership of the fence be determined. REHAB 11-25-97 Page e2 A. 3261-63 ISABEL AVENUE The subject property consists of an owner-occupied single family dwelling and a second, tenant-occupied unit. The property is zoned R-2. A "Please Letter" was mailed to the property owner on August 11, 1997. Inspection on August 26, 1997 revealed no progress. The Building Official declared the property substandard and filed a Declaration of Substandard Property with the Los Angeles County Recorders office. A "Thirty Day" certified letter was mailed and posted on the property on September 4, 1997, requesting abatement of the substandard conditions. Inspections were attempted on October 6, and November 6, 1997, however the gates were locked and no change was evident. The City Building Official recommends that the Board find the property substandard and order all substandard conditions removed and/or corrected by January 5, 1998. James Guerra, Building Official, stated that upon inspection today, not all the conditions were corrected. Vice-Chairman Bruesch asked who owns the fence down the middle of the property. Mr. Guerra responded that the fence is not on their list of defects, however, they will inspect that property again. SUBSTANDARD BUILDINGS AND PROPERTIES B. BUILDING REHABILITATION APPEALS BOARD C. CITY PROSECUTING ATTORNEY REFERRAL UPDATE Boardmember Taylor requested an update on 9406 Valley Boulevard. Steve Bailey, Building Inspector, responded that the new owner was notified, but no response has been received. Vice-Chairman Bruesch asked if any soils testing has been done. Mr. Bailey stated that as far as he knows, no testing has been done. IV. MATTERS FROM OFFICLALS Vice-Chairman Bruesch asked what is the State regulation regarding vehicle registration of inoperable cars parked in the driveway. REHAB 11-25-97 Page 43 Frank Tripepi, City Manager, explained that the owner has to file a Non-Operable Permit with the State, which cost $10.00. However, Mr. Tripepi continued, that does not relieve the owner of local ordinances that are in effect; such as Rosemead's, which does not allow inoperable or unregistered, unmoved vehicles to be parked in the driveway in public view. V.
