TRIPEPI, CITY MANAGER DATE: May 19, 1998 • RE: 3202 ROSEMEAD PLACE - HEARING The subject property consists of an owner-occupied single family dwelling located in the R-I zone. The residence has allegedly been altered to accommodate six separate tenants. Prior to the property rehabilitation case being initiated, the City Code Enforcement Officer was able to verify that there were two kitchens, four telephone lines, and at least three refrigerators at the location. In April, 1993, a building permit was issued for an addition of 1349 square feet-three bedrooms and two bathrooms. As a condition of permit issuance, Planning Department required that the property be maintained as a single family occupancy. A "Please Letter" was mailed to the property owner on October 28, 1997. Inspection on November 18, 1997 revealed no progress. The Building Official declared the property substandard and filed a Declaration of Substandard Property with the Los Angeles County Recorder's office. A"Thirty Day" certified letter was mailed and posted on the property on December 9, 1997, requesting abatement of the substandard conditions. On December 10, 1997,the owner's granddaughter phoned to inform staff that plans for the unpermitted alterations were being prepared. On December 23, 1997, plans were submitted for plan check by the architect. The plans were approved and ready for issuance on December 30, 1997. The owner and the architect were notified. Inspection on January 8, 1998 revealed no progress. On January 26, 1998, a building permit was issued to Wai King Au, the property owner, to legalize the unpermitted bath and laundry room. The permit was issued on the condition that the second kitchen be removed and that access to the interior of the entire residence be provided. REHAB AGENDA MAY 2 ti 1998 . ITEM No.TLE B . Since that time, Building Department staff has had difficulty making contact with the owner. Communication is usually through the granddaughter, or by leaving messages on the answering machine. The building inspector attempted to make personal contact at the site. No one would answer the door, although it appeared evident that someone was inside. On March 11, 1998, the inspector was able to meet the granddaughter at the property. The list of defects was explained and discussed. Partial interior access was gained. On April 14, 1998,telephone contact was again made with the granddaughter in an attempt to gain access to the remainder of the house. A"bulky item" trash notice was also mailed that day. No response was received from the owner regarding the requested access. Staff contacted the architect and requested that he convey to the owner the significance of the situation. On April 21, 1998, a list of corrections from the previous partial inspection was mailed to the owner. To date, no access has been gained, nor has the owner made any further contact with staff. A Notice of Hearing was mailed and posted on the property on May 5, 1998. All interested parties have been notified. CITY BUILDING OFFICIAL'S RECOMMENDATION: It is recommended that the Board find the property substandard and order all substandard conditions be removed and/or corrected by July 1, 1998. Valley Blvd. Rosemead, Ca 91770 Re: COMPLAINT FOR LANLORD Dear Sir/Madam, I am a tenant of Landlord Mrs. Wai King Au, whose house is located at 3202 Rosemead Place, Rosemead, Ca 91770. Now I submit this letter of complaint for this lady. She rented this house to many tenants without any legal formalities for example of rental receipts. I spoke to her:you should give me rent receipt if rented your room. Then she was so unpleasant about my suggestion. She said:"no any tenant asked the rent receipt from me. Why do you want me to write the receipt? ". Since then, she has been angry about my suggestion. She threatened me every day and said: "lam landlord, I have a right to let you get off I could call some people to open your door and throw all your stuffs out on the outside street. I answered her: "I am very busy and have no time to augur with you. You should talk these with my lawyer. It was hot day on September 13, 1997 10:30 AM then. I found my meat and vegetables, stored in the refrigerator, and my two roommate's meat off the refrigerator and defroze on the ground. I was mad about her illegal action and violation. I took my camera to photograph the site and knocked at her door. She was impolite to keep staying inside and not to open her door any way. Page 1 I hoped to talk about her illegal action with her in peaceful manner. She kept her door locked. I called police to come over here. Police put everything on the table. The police was asked to take picture and report the facts and site. The police let me report to Rosemead city hall directly. So, I am writing you to report everything happened in my residence. Here has been not safe enough to live any longer. I have to report city hall administration that: (1). She was illegal to make construction in her house such as remodeling of bedroom, back yard house and kitchen room without any city hall permit. (2). She rented the house to ten about tenants and rented one bed to one student without any other space. She charged the student$ 10/each day and charged other student rent $ 15/each day including food. So many tenants gathered in the same house. Fighting and auguring happened every day in the house. We could not sleep well due to noise. (3). She still disturbed and threatened me and tenants. For example, she took off air conditioner when it was hot weather in summer; turned the gas down in purpose of stooping the tenants to cook meals; always took my stuffs such meals and vegetables off the refrigerator. I declare that all the above fact is true and correct under the law of California. The landlord's illegal action and behavior really increased my psychological pressure and burden and damage the peaceful atmosphere, and affected my normal work It is requested that the report would draw your attention to this matter and the further investigation would be made by the officers of city ball administration. No building shall be erected, and no existing building shall be moved,altered,added to or enlareed,nor shall any land, building or premises be used, designed or intended to be used for any purpose or in any manner other than a use listed as permitted in the respective zone in which such land, building or premises is located. It is alleged that you have converted your residence into a four(4) unit apartment complex. Upon initial inspection on October 13, 1997 it was discovered there are two kitchens and three refrigerators in what appears to be an altered interior. It is requested that you take action necessary to correct the conditions that are in violation by 10/27/97. A follow up inspection will be conducted on that day, if the conditions in violation are not alleviated by 10/27/97, this matter will be referred to the CITY ATTORNEY.
