RE: 3027 - 3029 EARLE AVENUE - REHEARING
The subject property consists of three, tenant-occupied units located in the M-1 zone. The
only remaining substandard condition is the carport attached to the rear garages that was
constructed without permits.
This property was previously before the Board on May 27, 1997. At that time, Ms. Hwang
indicated she still wanted a carport. She agreed to demolish the substandard structure, and
to submit plans and obtain permits and approvals for a complying carport. The Board ordered
the case deferred, and to be returned for Rehearing in July. After the initial Hearing, Ms.
Hwang submitted another letter, dated June 6, 1997, again asking that the substandard
structure be allowed to remain. The letter also contains various accusations towards staff. On
June 10, 1997, Mr. Steve Bailey, Supervising Building Inspector, responded to Ms. Hwang's
letter.
To date, no plans have been submitted and no permits have been issued.
A Notice of Rehearing was mailed and posted on the property on July R, 1997. -All interested
parties have been notified.
CITY BUILDING OFFICIAL'S RECOMMENDATION:
It is recommended that the Board find the property substandard and order all substandard
conditions removed and/or corrected by September 2, 1997. This is a final Board Order, and
not to be returned for Rehearing.

The City Building Official has determined by inspection that the following property is
substandard, as defined in Section 9905 of the City of Rosemead Building Laws, because of
the defects listed on the attached letter.
THEREFORE, NOTICE IS HEREBY GIVEN that on Tuesday, July 22. 1997, at 7:00
p.m., in the City Hall, 8838 E. Valley Boulevard, Rosemead, California, a I IEARING

A.- Posts are less than six (6) feet from existing dwelling without required
setback from property line.
B. Roof sections are deteriorated, separated and do not meet minimum load
design for carport roofs.
C. Roof connection to garage has pulled away from roof
Permits are required for the above repairs and may be obtained at the Building Department
between the hours of 7.00 - 11 :00 a.rn., Monday through Thursday, and between 4:00 - 6:00
pm., Thursday.

Ms Hwang,
We are in receipt of your letter dated June 06, 1°97. In the letter you make a request to continue the
use of an unpermitted carport. As previously indicated to you and at the Rehabilitation .Appeals
Board Hearing of May 27, 1997, the carport was constructed without all necessary permits and
approvals. The carport does not meet the current requirements with regards to construction methods,
design and location to adjacent structures. At the same meeting you indicated you wanted to keep
a carport and therefore agreed to remove the existing carport and construct a new one with proper
permits and approvals. The Rehabilitation Appeals Board has granted you a 60-day continuance
from the May 27, 1997 hearing and will hear your case again on July 22, 1997. You will be properly
notified of the hearing time and date. At that time your letter will be included in the staff report to
the Rehabilitation Appeals Board. The Board will consider your request at that time. Please note,
neither Mr. Tripepi nor Mr. Kress are members of the Rehabilitation Appeals Board and therefore
do not vote. Also, we will again recommend that the carport be rebuilt to code with legal setbacks
and permits, or demolished.
You also indicate in your letter that the City of Rosemead staff is apparently spending too much time
on your property and even working overtime to process your case. Our staff is only making
inspections at regular intervals for those properties involved in the Rehabilitation process. As to your
claim that the staff is working overtime on Fridays to process your case. The City of Rosemead
routinely provides Building and Safety inspections on Fridays even though the City Hall is closed.
Finally,you make a statement that I find quite disturbing. You claim the City of Rosemead Building
Inspectors are unfriendly, biased and discriminate against the Asians. You also indicate you have
trouble finding contractors to work in the City of Rosemead because of the same. The City of
Rosemead and all of its employees are committed to providing services with the utmost respect and
professionalism regardless of sex, origin, race, religion or disability. We can assure you that your
above-mentioned claims are not true and quite simply do not occur.

Dear Mr. Guerra,
On behalf of my mother and aunties who put the down payment wanted me to write
you to have all the officials in the Appeal Board to reconsider to LET THE PATIO STAND for
the following reasons :
1. It was there when we bought it. Somewhere down there,there is the permit because the
patio or carport was huge. We don't think the previous owner did not get the permit.
We think the 20% variance of 1.5 feet was approved also With the 4.5 feet, it did not
block any air to enter the house nor any hazard to anybody.
2. The carport was built very sturdy and strong to withstand for so many strong winds and
typhoon. The two line missing on the top is okay because we can not find the materials.
These were intentionally broken by my troublesome tenant's son.
3. The carport did not post any health hazard to any body and the community.
4. The most important is that there is no live wire hanging on it.
5. We can't afford to put a S600 carport on it, maybe your Board can help us as seniors from
your Rehabilitation fund.
6. My auntie who is sick and have to go the doctor frequently getting in and out of the car
might collapse when there is no carport and the car will be very very hot. If that is the
case, Who will be responsible for her?
We hope you will consider the consequences. We want to live in our own house
comfortable and free from stress. We hope you will leave us alone in our house. We don't rent
to those other people who cause a lot of trouble to our daughter , not only on money but also
for many steepness night and sick time from work.
Your office are spending too much time in our property. There are many houses
that need special attention like the one that the garage was burned down and one's can see it
from the street that the burned wood is going to fall down and hit people. There were many run
down houses which your office should be aware off by just driving on. Your inspections wanted
to have more substandard so that they can keep on coming back and forth. Your office was
closed on Friday, and your inspector will come on Friday to check the building. They are
working overtime_ These were the unneccessary expenses your office spent on taxpayer money.
What a waste ? My daughter always maintained the building clean and neat without pay to help
us. We want to be left alone so that we can live our lifts in our own house without the
interference by anybody.
We have many friends, relatives and business investor from the Asian community
refused to do business or invest in Rosemead city, because of your unfriendly, and biased
inspectors who discriminate the Asians. Some plumbers or electrician refused to do the repair
on Rosemead city because they said it is not worth to earn few hundreds of dollar that the
inspectors have to come back many times. They rather invest in city of El Monte and do business
there.
Please have all the officials of the board to sign for each decisions to LET STAND TEE
