I RE: RENEWAL OF AGREEMENT - STREET TREE MAINTENANCE
The City of Rosemead's agreement with Evan's Tree Service for Street
Tree Maintenance is scheduled for renewal.
The Contractor has indicated that he would like to continue as the
City's Street Tree Contractor for next year without an increase in
fees.
To date, the Contractor has provided quality service in a timely
manner.
RECOMMENDATION:
It is recommended that the Rosemead City Council approve the
Extension of Agreement and authorize its execution by the Mayor.

EXTENSION OF AGREEMENT
THIS EXTENSION OF AGREEMENT is entered into effective the 1st
day of October, 1997, by and between the CITY OF ROSEMEAD, a
municipal corporation (hereinafter "CITY") , and JOHN R. ROWLAND dba
EVAN'S TREE SERVICE, sole proprietorship, (herinafter "CONTRACTOR") .
WHEREAS, the parties have executed that certain Agreement dated
August 22 , 1995, in which CITY agrees to contract with CONTRACTOR for
the performance of certain tree trimming, maintenance and removal;
and
WHEREAS, a true and correct copy of said Agreement is attached
hereto as Exhibit "A" and incorporated herein by this reference; and
WHEREAS, the Agreement of August, 1995, provides for an
extension of said Agreement for an additional one year period; and
WHEREAS, CONTRACTOR has thus far satisfactorily performed the
service set forth in the Agreement dated August 22, 1995; and
WHEREAS, CONTRACTOR has offered to perform the services required
in the Agreement for another calendar year.
NOW THEREFORE, the parties agree:
1. That the Agreement of August 22, 1995, is hereby extended
for an additional one-year period to September 30, 1998 .
2 . This EXTENSION OF AGREEMENT shall be effective as of
October 1, 1997, and continue in full force and effect until
September 30, 1998.
3. During the one-year extension of the Agreement, CONTRACTOR'S
compensation shall be limited to the rates and charges set forth in
Exhibit "A" to the August 22, 1995 Agreement.
IN WITNESS WHEREOF, the parties have executed this extension of

EXHIBIT A
AGREEMENT
This Agreement dated this 22nd day of August, 1995 between the
CITY OF ROSEMEAD ("City") , a municipal corporation and John R. Rowland, an
individual d.b.a. EVANS TREE SERVICE ("Contractor") .
The parties agree as follows:
1. OBLIGATIONS OF CONTRACTOR
Contractor, at Contractors expense, shall furnish all tools,
implements, methods, processes and facilities as set forth in Sections
13 . 0 through 13. 4 of the attached specifications, and transportation,
labor and material necessary to perform, in a good and worker like manner,
all work described herein. Work shall include the normal tree maintenance
of all street trees within the City of Rosemead, emergency service as set
forth hereinafter and accessory services including removal of dead wood,
clean up and traffic control in areas where work is performed.
2 . COMPENSATION
The City shall pay Contractor monthly upon demand as described in
Sections 12. 0 through 12.2 . 4 of the specifications all compensation due
for work performed in the preceding calendar month. The rates for work
commencing on or after October 1, 1995 are stated on Exhibit "A", attached
hereto required, his monthly payment, or any portion thereof as determined
by the Director of Parks and Recreation, may be withheld until corrective
action is taken. The Contractor shall be notified in writing and given a
reasonable time to take corrective action.
3 . TERMINATION BY CITY
The City may terminate this Agreement, on ten days written notice
to Contractor, for any reason, the remaining term of the agreement or any
portion of the services.
4 . PERFORMANCE STANDARDS
All work shall be performed in accordance with Section 1. 0 through
13 . 4 of Part 2 of the attached specifications. All work shall be
performed in a worker like manner and thereafter, all work areas properly
cleaned of debris.
5 . EMERGENCY SERVICES
Emergency services shall be performed in accordance with Sections
2 . 0 through 2 . 4 of the Cork Schedule and Emergency Services (Part 3C)
attached hereto. All emergency service shall be Performed with the
uderstanding that the primary obligation of the Contractor is to restore
the emergency area to a safe and normal condition which protects the
public from risks to person or property.

6. PROTECTION OF WO
RK AND PUBLIC
The Contractor shall take all necessary measures to protect the
work and prevent accidents during any and all phases of work. The
Contractor shall strictly adhere to all applicable federal and state OSH
regulations. The Contractor shall provide and maintain necessary
• barriers, guards, watch persons, and warning lamps during maintenance
procedures.

1 .0 PROPOSALS
.1 . 1 Bids shall be made upon the form obtained at the office of the
City Clerk properly and with all items filled out, numbers
shall be stated both in writing and in figures for the Base
Bids, the signature of all persons signing shall be in long-
hand. The completed form shall be without interlineations ,
alterations or erasures. Any irregularity may ba cause for -
rejection of the bid.

1 . 2 Bids shall not contain any recapitulation of the work to be
done. Alternative propcals will not be considered, unless
called for. No oral , telegraphic or telephone proposals or
modifications shall be considered.

1 .3 Before submitting a bid, bidders shall carefully, read the
specifications and shall visit the site of work and shall
fully inform themselves as to all existing conditions and
limitations and shall :incltded in the bid a sum to cover the
cost of the work included in the contract.
1 . 4 Bids shall be accompanied with a certified or cashier' s check,
or a bidder' s bond for an amount not less than ten percent
( 10%) of the bid made payable to the order of the City of
Rosemead. If a bidder' s bond accompanies the proposal , said
bond shall be secured with a Surety Company satisfactory to
the Owner. Said check or bond shall be given as a guarantee
that the Bidder will enter into a contract if awarded the work;
and in the case of refusal or failure to enter into said con-
tract , the check or bond as the case may be, shall he forfeited
to the City of Rosemead.
2.0 OPENING OF BIDS
2. 1 Bids will be opened and read publicly at the time set in the
City Council Chambers as indicated in the Invitation for Bids.

3 . 0 AWARD AND REJECTION OF BIDS

responsibility of Bidders and of their proposed subcontractors

Bidders are required to inform themselves fully of the conditio
relating to the tree trimming Specifications and the location
of the work to be done. The Contractor must employ, as far as
possible , such methods and means in the carrying out his work -
as will not cause any interruption or interference with any
other Contractor.
7.0 ASSIGNMENT OF CONTRACT
7. 1 No assignment by the Contractor of any contract to be entered
. into hereunder or any part therof, oe if funds to be received
thereunder by the Contractor will be recognized by the Owner,
unless such assignment has had the approval in writing of the
awarding authority. No assignment will receive the approval of
the Owner unless the instrument of assignment contains a clause
to the effect that it is agreed that the funds to be paid the
assignee under the assignment are subject to a prior lien for .
services rendered or materials supplied for the performance of
the work called for in said contract in favor of all persons,

firms, or corporationsrendering such services or supplying
such material . A merger, consolidation , bankruptcy, either
voluntary or involuntary, or a sale of a controlling interest
of the Contractor' s business, shall be considered an assignment
as that term is used herein.

8.0 INTERPRETATION OF DOCUMENTS
8. 1 If, any person contemplating submitting
contract is in doubt as to the true mening �ofd fan spa propoedt

submit to the Owner a written request for an interpretation
therof. The person submitting the request will be responsible
for its prompt delivery. Any interpretation of the proposed
documents, which in the Owner' s judgement is necessary, will
be made only by Addendum duly issued, and a copy of such
Addendum will be mailed or delivered to each person receiving
a set of such documents . The Owner will not be responsible
for any other explanations or ' interpretations of the proposed
documents.

diseased branches, all heavily shaded branches, all criss-
crossing branches, all water sprouts, and enough less desirabYe
branches to reduce crown weight by forty percent (40%) .
1 .3 Radial distribution of branches should allow five (5) to seven
(7) scaffold branches to fill the circular space around the
trunk.
1 .4 Scaffold branches should be spaced vertically 18 to 24 inches

7. 2 Large limbs, (over one inch in diameter) shall be cut with a saw
using the following procedure. Make the first cut on the under
side of the branch, one to two feet from the crotch. The undercut
should be at least 1 /3 of the diameter. Make the second cut on the
branch topside one to three inches further from the crotch than the
first. (The limb should break off between the two cuts . )
7.3 The third cut shall be made at the point bisecting the top angle .
of the crotch and a similar point bisecting the lower angle of
attachment.
8 . 0 REMOVING DEAD WOOD
8. 1 The cut shall be made in healthy wood well below the infection,
twelve to eighteen inches , if possible.
8. 2 All pruning tools (extension pruners , handsaws , power saws , loopers ,
hand pruners , and pruning knives ) shall be sharp and in good work-
ing condition .
9. 0 CLIMBING
9. 7 Spikes shall not be used for climbing live trees , without written
permission of the Park Supervisor.

11 .0 SAFETY
11 . 1 The Contractor shall be solely responsible for initiating,
maintaining, and supervising all safety precautions in
connections with this work.
11 . 2 All damages to property attributable to the fault or negligence
of the company shall be immediately remedied by the Contractor
at his own expense.
12.0 TRAFFIC
12. 1 Pedestrian and vehicular traffic shall be allowed to pass
through the work area only under conditions of safety andwith
as little delay and inconvenience as possible, Adequate
barridades, warning devices and flag men shall be stationed
where necessary for the safety of persons and vehicles.
13 .0 EQUIPMENT
13. 1 Bidders are required to have the following equipment available
for use in the City.

site immediately.
13. 4 Successful bidder, at the time of the execution of the contract ,
shall provide from the manufacturer a certificate of condition
for his skyworker.
