TRIPEPI, CITY MANAGER DATE: SEPTEMBER 18, 1997 RE: ANIMAL CONTROL SERVICES At the Regular Meeting of September 9, 1997, the Council voiced concerns regarding the current level of service provided by the Los Angeles County Animal Care and Control Department It was suggested by several members of the Council that the residents would receive more efficient service if the City were to hire ifs own Animal Control Officer_ The City renewed the five year contract with the County at the April 22, 1997 Council Meeting. Although Section 9 of the contract allows the City to "..terminate this agreement as of the first day of July of any year upon thirty (30) days prior written notice to the County', If it is the decision of the City Council to hire a City Animal Control Officer, it is recommended that staff amend the contract with the County and have the County continue to house the animals and provide additional administrative and field services as needed. Preliminary cost estimates are as follows: Animal Control Officer-annual salary and benefits ($2450\mo) $47,577 Departmental Supplies 2,000 Vehicle Maintenance 2,600 Purchase of Patrol Vehicle $35,000 Total $87,177 COUNCIL AGENDA SEP 231997 ITEM No. 7• S Animal Control Services September 18, 1997 Page Two The cost for providing animal control services during 1996-97 was approximately $55,000 after receiving credit for the estimated $85,481 in license fees collected. In the event the City hires an Animal Control Officer, there will be a decrease in cost of field services provided by the County, The City Animal Control 011ier will be patrolling five days a week between the hours of 8:00 a.m. and 5:00 p.m. The County will continue to respond to requests for service during off- hours, weekends and holidays. During 1996-97 approximately 302 (20%) of the 1506 field hours billed to the City were for field services provided after regular working hours. Since the Council is concerned with increasing service levels, staff would recommend budgeting at least 600 hours. At a current hourly rate of$42.20, this additional service will cost $25,320. That figure added to the estimate of$87,177 increases the total cost for the first year to at least $112,497. In summary, hiring a City Animal Control Officer would increase the cost of providing the service, the City will have the advantage of having it's own employee patrolling the City during working hours. RECOMMENDATION If the Council is in favor of hiring an Animal Control Officer, it is recommended that the following action be taken: 1. Authorize staff to begin recruiting for the position of Animal Control Officer; 2. TRIPEPI, CITY MANAGE�d�— DATE: APRIL 15, 1997 RE: RENEWAL OF ANIMAL CONTROL CONTRACT BETWEEN THE CITY AND THE LOS ANGELES COUNTY ANIMAL CARE AND CONTROL Attached for your consideration is a five year contract for the renewal of animal control services provided by the Los Angeles County Animal Care and Control Department. The period of the contract is from July 1, 1997 through June 30, 2002. The agreement has been reviewed as to form by the City Attorney's Office. Included in the attached materials is a five year summary of animal control program costs. It covers fiscal years 1992-93 through 1996-97 and includes the formula used to calculate the total program cost. The formula is a function of the cost of patrolling, collecting and housing the stray animals balanced against the licenses fees received, minus the cost of collecting the fees. Although the five year summary indicates a increase from $36,131 in 1992-93 to $48,314 in 1996-97, a majority of the increase occurred from 1992-93 to 1993-94. This increase resulted from a dramatic increase in calls for service. Since that year the cost has stabilized between $45- 50,000 per year. COUNCIL AGENDA APR 2 21997 -I] ITFM No �. 1 AGREEMENT 2 BNTMPJ CONTROL SERVICES 3 CITY OF ROSEMEAD 4 5 THIS AGREEMENT, dated for purpose of reference only, 6 July 1, 1996, is made by and between the COUNTY OF LOS ANGELES, 7 hereinafter referred to as "County", and the CITY OF ROSEMEAD, 8 hereinafter referred to as "City" . 9 RECITALS: 10 (a) The City is desirous of contracting with the County for 11 the performance of the hereinafter described animal control service 12 within its boundaries by the County of Los Angeles through the 13 Director of Animal Care and Control. 14 (b) The County of Los Angeles is agreeable to rendering such 15 services on the terms and conditions as hereinafter set forth. 16 (c) Such contracts are authorized and provided for by the 17 provisions of Section 56 1/2 of the Charter of the County of Los 18 Angeles and Sections 51300 et seq. of the Government Code. 19 (d) Parties are aware of the recent enactment of Government 20 Code Section 907 regarding offset of delinquent amount due for 21 services and the City has agreed to waive its right of advance 22 written notice in accordance with terms set forth in this 23 agreement. 24 THEREFORE, THE PARTIES AGREE AS FOLLOWS: 25 1. The County agrees, through the Director of Animal Care 26 and Control of the County of Los Angeles, to provide animal control L.A. County Dept. of Animal Care & Control Animal Services Contract 07/01/97 1 services within the corporate limits of City to the extent and in 2 the manner hereinafter set forth. 3 Such services shall only encompass duties and functions of the 4 type coming within the jurisdiction and customarily rendered by the 5 Department of Animal Care and Control of the County of Los Angeles 6 under the Charter of said County and statutes of the State. 7 The level of service shall be that same basic level of service B that is and shall hereafter during the term of this agreement be 9 provided for unincorporated areas of the County of Los Angeles by 10 said Director of Animal Care and Control. 11 The rendition of such services, the standard of performance 12 and other matters incidental to the performance of such services, 13 and the control of personnel so employed shall remain in the 14 County. In event of dispute between the parties as to the extent 15 of the duties and functions to be rendered hereunder or the level 16 and manner of performance of such service, the determination 17 thereof made by the Director of Animal Care and Control of the 18 County shall be final and conclusive as between the parties hereto. - 19 Such services shall include the enforcement of State statutes 20 and such municipal animal control ordinances as the City may adopt, 21 as hereinafter provided for. 22 2 . The County agrees to provide kennel and animal shelter 23 services to the City at Animal Center 4 (Baldwin Park) . The County 24 at that facility shall accept all animals delivered for impoundment 25 by the City on 24-hour-a-day, seven-days-a-week basis. 26 3 . To facilitate the performance of said functions, it is L.A. County Dept. of Animal Care & Control Animal Services Contract 07/01/97 2 1 hereby agreed that the County shall have full cooperation and 2 assistance from the City, its officers, agents and employees. 3 4. For the purpose of performing said functions, County shall 4 furnish and supply all labor, supervision, equipment and supplies 5 necessary to maintain the level of service to be rendered 6 hereunder. 7 Notwithstanding anything hereinbefore contained, it is agreed 8 that in all instances wherein special supplies, stationery, 9 notices, forms and the like must be issued in the name of said 10 City, the same shall be supplied by said City at its own cost and 11 expense. 12 5. All persons employed in the performance of such services 13 and functions for said City shall be County employees and no City 14 employee as such shall be taken over by said County, and no person 15 employed hereunder shall have any City pension, civil service, or 16 any status or right. 17 For the purpose of performing such services and functions, and 18 for the purpose of giving official status to the performance 19 thereof where necessary, every County officer and employee engaged 20 in the performance of any service hereunder shall be deemed to be 21 an officer or employee of said City while performing services for 22 said City, which services are within the scope of this agreement 23 and are purely municipal functions. 24 6. City shall not be called upon to assume any liability for 25 the direct payment of any salaries, wages or other compensation to 26 any County personnel performing services hereunder for said County L.A. County Dept. of Animal Care & Control Animal Services Contract 07/01/97 3 1 or any liability other than that provided for in this agreement. 2 Except as herein otherwise specified, the City shall not be 3 liable for compensation or indemnity to any County employee for 4 injury or sickness arising out of his employment. 5 7 . The parties hereto have executed an Assumption of 6 Liability Agreement approved by the Board of Supervisors on 7 December 27, 1977 and/or a Joint Indemnity Agreement approved by 8 the Board of Supervisors on October 8, 1991. Whichever of these 9 documents the City has signed later in time is currently in effect 10 and hereby made a part of and incorporated into this agreement as 11 set out in full herein. In the event that the Board of Supervisors 12 later approves a revised Joint Indemnity Agreement and the City 13 executes the revised agreement, the subsequent agreement as of its 14 effective date shall supersede the agreement previously in effect 15 between the parties hereto. 16 8. For and in consideration of animal control services by 17 County, City agrees that it shall pay the full cost to the County 18 for providing such services at rates determined by the County of 19 Los Angeles Auditor-Controller. City further agrees that County 20 may keep and retain any and all license fees provided for by said 21 Municipal Animal Control Ordinance and collected by the County 22 pursuant hereto as an offset against City's obligation to pay the 23 full cost of animal control services. 24 The County agrees, through the Department of Animal Care and 25 Control to provide, on or before April 15 of each year, an estimate 26 of the total costs for all animal shelter services to be provided L.A. County Dept. of Animal Care & Control Animal Services Contract 07/01/97 4 1 to the City for the fiscal year then in progress. It is agreed 2 3 that in connection therewith, the County shall have all the powers 4 of the City and shall receive all cooperation possible therefrom to 5 enable efficient enforcement of such ordinance and to effectuate 6 collections called for thereunder. 7 9 . This contract shall become effective on the date 8 hereinabove first mentioned and shall run for period ending June 9 30, 2001, and at the option of the City Council of the City, with 10 the consent of the Director of Animal Care and Control, shall be 11 renewable thereafter for an additional period of not to exceed five 12 (5) years. 13 In event the City desires to renew this agreement for said 14 five-year period, the City Council shall not later than the tenth 15 of May 2001, notify the Director of Animal Care and Control that it 16 wishes to renew the same, whereupon the Director of Animal Care and 17 Control shall notify the City Council in writing of the 18 Department's willingness to accept such renewal. Otherwise, such 19 agreement shall finally terminate at the end of the aforedescribed 20 period. 21 Notwithstanding the provisions of this paragraph hereinabove 22 set forth, the County may terminate this agreement at any time by 23 giving thirty (30) days prior written notice to the City. The City 24 may terminate this agreement as of the first day of July of any 25 year upon thirty (30) days prior written notice to the County. 26 10. City agrees that whenever animals from within the L.A. County Dept. of Animal Care & Control Animal Services Contract 07/01/97 5 1 boundaries of the City are delivered to animal shelters operated by 2 County, the City shall pay for the services and shelter of said 3 animals at the following rates: 4 Services RATES 5 Impounding of a relinquished $ 8. 56 per day, plus all 6 dog or cat. veterinarian costs for 7 treating these animals B Impounding a stray dog or cat. while at the County 9 Shelter. 10 Holding a dog or cat wearing a 11 license. 12 13 (city shall pay for the foregoing 14 shelter and treatment for a 15 period not to exceed seven days. ) 16 17 Holding an abandoned dog or cat. 18 19 20 Holding a dog or cat for $ 10.02 per day, plus all 21 observation. veterinarian costs for 22 treating these animals 23 Holding a sick or injured dog or while at the County 24 cat. County Dept. of Animal Care & Control Animal Services Contract 07/01/97 6 1 City shall pay for the shelter and treatment of all live 2 animals, reptiles, and fowl from within the boundaries of the City 3 and are delivered to animal shelters operated by the County and the 4 cost of such shelter and treatment of such animal shall be as 5 determined by the County Auditor-Controller. 6 11. The foregoing rates shall be adjusted by the County 7 Auditor-Controller annually, effective July 1st of each year 8 commencing July 1, 1996, to reflect the cost of such service in 9 accordance with such rates as determined by the Auditor-Controller 10 and as approved by the Board of Supervisors of County. 11 All services rendered hereunder are subject to the limitation 12 of the provisions of Section 23008 of the Government Code, and, in 13 accordance therewith, before any services are rendered pursuant 14 hereto, an amount equal to the cost, or an amount ten percent in 15 excess of the estimated cost, shall be reserved by the City from 16 its funds to ensure payment to the County for work, services or 17 materials provided hereunder. 18 12 . For shelter services rendered, the County shall submit an 19 itemized invoice to said City within 10 days after the close of 20 each calendar month which includes all such shelter services 21 performed during the preceding month, and said City shall pay 22 County therefore within thirty (30) days after the date of the 23 invoice. If such payments provided above and in Section 8 of this 24 contract are not delivered to the County office which is described 25 on said invoices within thirty (30) days after the date of the 26 invoice, the County is entitled to recover interest thereon. Said L.A. County Dept. of Animal Care & Control Animal Services Contract 07/01/97 7 1 interest shall be at the rate of seven (7) percent per annum or any 2 portion thereof calculated from the last day of the month in which 3 the services were performed. However, the interest herein provided 4 may be waived, whenever the Director of Animal Care and Control 5 finds late payment excusable by reason of extenuating 6 circumstances. 7 13. Notwithstanding the provisions in Government Code Section 8 907, if such payments are not delivered to the County office 9 which is described on said invoice within thirty (30) days after 10 date of the invoice, the County may satisfy such indebtedness, 11 including interest thereon, from any funds of the City on deposit 12 with the County without giving further notice to City of County's 13 intention to do so. 14 14 . The City will review all invoices and report in writing 15 of any discrepancies to the Director of Animal Care and Control 16 within ten (10) business days. The County shall review the 17 disputed charges and send a written explanation detailing the basis, 18 for the charges within ten (10) business days of the receipt of the 19 City' s written report. If the City does not receive from the 20 County a written explanation within the ten (10) business day 21 period, it shall be implied that the County is not disputing the 22 charges. 23 15. The County agrees to keep separate records for each City 24 in such form and manner as the County Auditor-Controller of the 25 County of Los Angeles shall specify. Such records shall be open 26 for examination by said City during all business hours. L.A. County Dept. of Animal Care & Control Animal Services Contract 07/01/97 8 1 16. County agrees that redemption fees which it collects on 2 animals delivered to its animal shelter shall be credited to the 3 City every thirty (30) days. 4 17. The County agrees to provide to the City additional 5 animal control services on an as-needed basis if requested by 6 written notice 24 hours in advance. If such animal control 7 services are requested during any emergency, the written notice may 8 be waived and said services requested verbally by a duly authorized 9 representative of the City provided a written request is given the 10 County within 48 hours after services are rendered. Such animal 11 control services will be provided by the County to the City at 12 rates determined by the Auditor-Controller. 13 18. The County agrees to maintain its kennel and animal 14 shelter in a humane manner and keep said premises in a sanitary 15 condition at all times and that all services furnished by it 16 hereunder shall be in accordance with the laws of the State of 17 California and that it will give the prescribed notices and use 18 humane methods of care and destruction of any animal coming under 19 its jurisdiction. The Department operates six animal care and control centers. These shelters provide 24-hour, seven- day-a-week animal services to 42 cities in Los Angeles and Ventura counties. The Department's service area covers more than 3,200 square miles and serves more than 3 million residents. The Department's basic mission is to regulate, license and provide public safety and humane control of domestic animals throughout Los Angeles County and the cities with which it contracts. The Department has a fleet of 58 animal control field units that travel more than I million miles yearly to perform its public safety and service mission. The animal holding capacity of these vehicles is larger than for many other agencies, which means officers can remain in the field longer, providing more direct service to residents in an area. Each vehicle is equipped with individual fresh air circulation vents, lighted transport cages and a raised floor to keep the animals more comfortable. Each animal control officer is equipped with a hand-held, extended-range radio to allow them to be in constant communication with their district shelters. This contact facilitates the communication of current licensing and vaccination information, the reporting of actual or potential problem situations and requesting specialized equipment, such as large animal trailers, etc. The field and shelter office staff enforces all state, county and municipal laws regarding the care and control of domestic animals. Each of the Department's six shelters are responsible to: • Impound stray dogs, cats and other animals, including livestock. • Enforce the leash law that forbids dogs from running at large. • Provide dead animal pick-up. • Investigate cases of suspected animal abuse and neglect and the impoundment of animals seized in such cases. • Assist local law enforcement agencies in raids to end illegal dog and cock fighting activities. • Impound dangerous or vicious dogs and conduct hearings on their disposition. • Respond to special animal control problems caused by natural disasters, such as fires, floods and earthquakes. The Department has a mobile field command post that can travel to the command center of a disaster area and operate as the on-site communications and control headquarters for animal-related rescue work. • Relocate and return to nature, when possible, wild animals that migrate into urban areas. The Department works with the California Department of Fish and Game and the County Department of Agriculture in dealing with predator animals such as mountain lions and coyotes. • Investigate complaints relating to excessive animal noise, including barking dogs and crowing fowl. • Inspect and license pet shops, animal boarding kennels, pet grooming parlors, wild animal compounds and exhibitions as well as guard dog firms and guard dogs owned by individual businesses. • License dogs in accordance with California Health and Safety Code Sec. 1920 and registration of cats under Los Angeles County Code Sec. 10.24.020. Among the programs and services that are unique to the Department and not offered by any other animal control agency in Los Angeles County are: • Full-time,trained, uniformed officers who canvass the area the Department services to issue pet licenses. The cities we serve receive full credit for all license collection income. Additionally, pet licenses are sold at shelters, city hall and at Department-conducted pet vaccination clinics. • A state-of-the-art computer system that tracks individual problem animals, alerting officers to previous complaints and expediting the direct return of stray animals wearing traceable license tags. • Low-cost spay and neuter surgery, performed by staff veterinarians at each of the Department's shelters. These veterinarians also provide emergency treatment for injured animals. • Rabies vaccination clinics for dogs and cats. • A volunteer program that assists in the grooming and placement of animals and the reunification of lost pets with their owners. The nonprofit Animal Care Foundation, working with shelter staff and volunteers, offers financial assistance to animal owners who are unable to afford the cost of pet spay and neutering surgery for their dogs and cats. MI calls are handled on a 24-hour a day emergency priority basis. Holding Policy California law requires all stray animals to be held three days. This department's policy is to hold animals at least 7 days allowing owners more chance to locate their missing pets. After 7 days, stray animals are made available for adoption. Kennels Ranh center's kennel area is sectioned into specific areas including: animals that are available for adoption, stray male dogs, stray female dogs, observation, hospital area and cat room. Additionally, each center has facilities for housing livestock and the holding of small wild animals. Shelter and Office Services Page 2 Veterinarians and Animal Health Technicians The department has full time veterinarians and animal health technicians on staff. They provide for the health, care and treatment of all center animals. Animal Vaccinations/Health Check-ups For the protection of all pets, each animal brought into a County Animal Care Center receives a health check-up and is immediately inoculated against Distemper, Hepatitis, Leptospirosis, Parainfluenza and Parvovirus. Additionally, all animals receive rabies inoculations before placement and/or before being returned to their owner if a rabies vaccination cannot be verified. The public may also purchase rabies shots at the low cost of$4.00. In addition, dogs receive the 6-in-1 shot and cats get the 3 in 1 for a low fee. Volunteers Volunteers are available to assist at most centers in many different areas, including helping to reunite owners with their pets, assisting potential new pet owners in selecting the right pet for them, grooming and exercising the animals. Adoption Fees Each center has many wonderful animals of all shapes, sizes, colors and ages just waiting to be adopted. Adoption fees are: Dogs (over four months of age) From $49.00 - $64.74' 'depending on the size of the animal. Licensing fees will also be charged for animals residing in our juris- dictional area. Puppies(under four months of age) Approx. $47.00 Cats/kittens From $40.00 - $47.00 Adoption fees include the State mandated spay/neuter fee, initial vaccinations, a seven day exchange period and a free health examination by local participating veterinarians. Groom in Thanks to the support of the Animal Care Foundation, most shelters have specially designed pet grooming rooms to spruce up pets for placement. An animal's chance of being adopted into a new home is greatly increased after a bath, haircut and a little bow. Spay/Neuter Policy All purebred animals are spayed/neutered prior to being adopted into a new home. Programs are now in place at several County Animal Care Centers to spay/neuter all animals prior to adoption. Euthanasia Euthanasia is administered by sodium pentobarbitol injection by certified staff veterinarians and animal health technicians. Complete animal care and control services are provided seven days a week, 24-hours a day by specially trained, uniformed animal control officers. State-of-the-Art Field Units Fleet of 55 state-of-the-art animal control field units travel more than one million miles yearly. The animal holding capacity on these vehicles is higher than most other animal control vehicles which means officers can stay out in the field longer providing more direct service to residents in your area. Each vehicle is equipped with individual fresh air circulation vents, lighted transport cages and a raised floor to keep animals more comfortable. Each officer is equipped with a hand-held extended range radio to allow field officers constant communication with District Offices. This contact is imperative for obtaining up-to-the- minute licensing and vaccination information,the reporting of potential problem situations and requesting special equipment, such as tranquilizing equipment, large animal trailers, etc.. The Department has a mobile field command post equipped with an emergency animal medical clinic for deployment in disaster situations, such as earthquakes, fires, floods and other emergencies. Enforcement of State and County Animal Control Laws • Impounding dangerous dogs and conducting hearing on their disposition; • Impounding and quarantine of stray dogs and cats that have bitten or attacked someone; • Investigating suspected cases of animal abuse or neglect and impoundment of animals seized in such rases. Ensuring compliance with state and local ordinances relative to - the humane care of all animals within our jurisdiction. Field Services Page 2 Every call of potential abuse/neglect is thoroughly investigated by specially trained staff; • Enforcement of the leash law to prevent dogs from running at large; • Impoundment of stray dogs, cats and other animals, including livestock; • Acceptance of stray or unwanted pets from their owners or custodians; • Assisting local law enforcement agencies in raids to end illegal dog and cock fighting activities; • Responding to special animal control problems caused by natural disasters such as fires, floods and earthquakes. The Department is equipped with a mobile field command post that can travel to an"emergency" area of a disaster and operate as the on-site communications and control headquarters for animal-related rescue work; • Dead animal pick up; • Relocation and return to nature,when possible, of most wild animals that migrate into urban areas. We cooperate with agencies such as the California Department of Fish and Game in dealing with dangerous predators such as mountain lions. Coyotes are handled by the County Department of Agriculture or whichever private firm a contract city has chosen, and we work cooperatively with those agencies; • Investigating complaints relating to excessive animal noise, including barking dogs and crowing fowl; • Inspections and licensing of pet shops, boarding kennels, animal grooming parlors, wild animal compounds, exhibitions as well as guard dog companies and guard dogs owned by individual businesses; • Wild animal trap referrals and support to assist citizens in resolving wild animal problems. • COUNTY OF LOS ANGELES DEPARTMENT OF ANIMAL CARE AND CONTROL SUPPORT SERVICES AND SPECIAL PROGRAMS Six Low-cost Spav/Neuter Clinics The County operates six low-cost spay/neuter clinics in Downey (310) 940-8870, Carson (310) 523-9575, Baldwin Park (818) 960-2841, Lancaster (805) 940-4193, Castaic (805) 257-3191 and Agoura Hills(818) 991-0075. Door-to-Door Canvassing Uniformed license field officers systematically canvass door-to-door in all areas. Officers enforce licensing regulations, issue licenses for newly acquired pets and update departmental census statistics. All fees collected are credited to the city to reduce animal care and control costs. Many cities who contract with Los Angeles County implement a licensing surcharge for their city ranging from $2- 15. Cat License Fees Unaltered Cat $10.00 Altered Cat $ 5.00 Although cat licensing is mandatory in all County unincorporated areas and several contract cities, all cats deserve the protection a license tag provides. Computerized Licensing System Computerized licensing system including direct mail courtesy notices reminding pet owners that their pet licenses are becoming due. Licensing/Renewing Convenience Licensing is made as convenient as possible for pet owners renewing licenses by providing many licensing locations across the county. These locations include: County Animal Care Centers, city halls, and many pet vaccination clinics conducted by the Department. Permanent License Tag Pet owners receive a permanent license tag for the life of their pet. This high quality, heavy duty stainless steel tag saves pet owners from having to replace tags yearly and helps protect pets by providing valuable information for a safe return home if they should become lost. Annual License Expiration Date An annual license expiration date, June 30, allows pet owners to ALWAYS know when licenses will expire. Discount License Fees Available Discount license fees available for the following: Honorably discharged military dogs from the Armed Forces of the United States of America; Guide dogs for the blind; Signal dogs for the hearing impaired; Service dogs for the disabled. License fees for the above mentioned dogs are only $5.00 with proof of service. Low Cost Vaccination Clinics Low cost vaccination clinics are provided at strategic locations throughout the County. Approximately 35 vaccination clinics are held yearly in conjunction with the Southern California Veterinary Medical Association, the Antelope Valley Veterinary Medical Association, the Ventura County Veterinary Medical Association and local community groups. Clinic fees are just $4 for rabies vaccinations and $11 for 6-in-1 vaccinations. County pet licenses are also available at each clinic for the pet owner's convenience in renewing licenses and obtaining licenses for newly acquired pets. Support Services and Special Programs Page 3 Rabies Enforcement Prorram The Rabies Enforcement Program requires every veterinarian within Los Angeles County to provide this Department with a copy of all rabies vaccination certificates. This important pet vaccination information is critical for rabies control and becomes a part of the Department's permanent pet information database. Backyard Breeder Permits Backyard breeder permits require any person, except a person possessing a valid kennel license, who breeds animals for pay or other compensation, to obtain an animal breeding permit in the amount of$125.00. Each permit shall authorize the whelping of no more than one litter per female dog in any twelve month period and no more than one litter per domestic household in any twelve month period. Animal Control Officer Training Ongoing specialized training is a critical part of animal care and control. Training is provided on a continual basis for all County Animal Care and Control employees. Public Education Programs The Department's public education program includes the following: • Animal Care Center Tours • Educational Pamphlets • Career Fairs • Service Club Presentations • Pet Visitation Programs • Mobile Public Service Messages Administrative Services • Computerized monthly invoices • Monthly activity reports • Additional statistical service reports as requested • Animal Care and Control staff support is just a phone call away Media Support Services Departmental public relations staff are available to assist with support material for city newsletters, public relations programs and/or special animal related campaigns. Pet Identification Tattooing Pet identification tattooing is offered at all six Los Angeles County Animal Care Centers. A pet's permanent license tag number is tattooed onto the animal's inner left thigh area along with the letters LACO which indicate that this is a Los Angeles County Pet ID Tattoo. A green dot is also tattooed into the pet's ear which is one of the areas always checked by animal control agencies, veterinary offices, etc.. When an animal is examined, the green dot alerts attention to the tattoo. This program provides a permanent method of protecting pets. Pet ID tattooing costs only $20. Support Services and Special Programs Page 4 YARTAG for Cats EARTAG is the new, safe and effective way to protect cats. Eartag is easily placed through a cat's ear much like an earring and shows your pet's individual license number and the telephone number of the County's 24-Hour Lost Pet Hotline. The numbers are visible and readible without special scanning equipment or any other device. EARTAG looks great and provides critical information that can help get pets back home if they stray. EARTAG is available at all six Los Angeles County Animal Care Centers for only $15 and can be used in place of the metal tag when licensing cats. Pet Makeovers County Pet Makeovers allow pets at all six County Animal Care Centers a second chance to be adopted. Volunteers spruce-up shelter pets with a bath, haircut and a little bow which greatly improves that animal's chance of being adopted. Almost 100% of these animals are adopted after the "makeover'. Seniors for Seniors The Seniors for Seniors Program places adult shelter animals in homes with senior citizens who are looking for the companionship a pet can provide. This heartwarming program greatly increases the chances of adult animals being adopted. So many times adult animals are overlooked for the spry, young puppy or kitten. Shelter staff work with senior citizens to find just the right pet. All adoption fees for the seniors through this program are paid for through donations. State-of-the-Art Computer System A state-of-the-art computer system tracks all animals housed at each of the six Los Angeles County centers. This system is linked to our licensing database and can identify problem animals, such as vicious dogs and expedites the return of stray animals wearing traceable license tags. Pet Population Control Policy Every purebred animal placed into a new home is spayed or neutered before leaving the shelter. Additionally, programs are in place to spay/neuter all animals prior to adoption. This ensures that any pet adopted from a Los Angeles County Animal Care and Control Center will not add to the over pet population problem. 510 Spav/Neuter Rebate Coupon Through a special program funded by the Animal Care Foundation, a private non-profit organization that works with the Department, $10 spay/neuter rebates are offered to pet owners to encourage sterilization. To date,more than 19,000 such rebate coupons have been issued. This helps offset the sterilization costs for pet owners and is another measure to assist in controlling the over pet population problem. I � r 66591 AGREEMENT ANIMAL CONTROL SERVICES CITY OF ROSEMEAD THIS AGREEMENT, dated for purpose of reference only, July 1, 1992 , is made by and between the COUNTY OF LOS ANGELES, hereinafter referred to as "County", and the CITY OF ROSEMEAD, hereinafter referred to as "City" . RECITALS: (a) The City is desirous of contracting with the County for the performance of the hereinafter described animal control service within its boundaries by the County of Los Angeles through the Director of Animal Care and Control. (b) The County of Los Angeles is agreeable to rendering such services on the terms and conditions as hereinafter set forth. (c) Such contracts are authorized and provided for by the provisions of Section 56 1/2 of the Charter of the County of Los Angeles and Sections 51300 et seq. of the Government Code. (d) Parties are aware of the recent enactment of Government Code Section 907 regarding offset of delinquent amount due for services and the City has agreed to waive its right of advance written notice in accordance with terms set forth in this agreement. THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1. The County agrees, through the Director of Animal Care and Control of the County of Los Angeles, to provide animal control services within the corporate limits of City to the extent and in -2- the manner hereinafter set forth. Such services shall only encompass duties and functions of the type coming within the jurisdiction of the customarily rendered by the Department of Animal Care and Control of the County of Los Angeles under the Charter of said County and statutes of the State. The level of service shall be that same basic level of service that is and shall hereafter during the term of this agreement be provided for unincorporated areas of the County of Los Angeles by said Director of Animal Care and Control . The rendition of such services, the standard of performance and other matters incidental to the performance of such services, and the control of personnel so employed shall remain in the County. In event of dispute between the parties as to the extent of the duties and functions to be rendered hereunder or the level and manner of performance of such service, the determination thereof made by the Director of Animal Care and Control of the County shall be final and conclusive as between the parties hereto. 2 . The County agrees to provide kennel and animal shelter services to the City at Animal Center 3 , Baldwin Park Shelter. The County at that facility shall accept all animals delivered for impoundment by the City on 24-hour-a-day, seven-days-a-week basis. 3 . To facilitate the performance of said functions, it is hereby agreed that the County shall have full cooperation and assistance from the City, its officers, agents and employees. 4 . For the purpose of performing said functions, County shall furnish and supply all labor, supervision, equipment and supplies -3- necessary to maintain the level of service to be rendered hereunder. Notwithstanding anything hereinbefore contained, it is agreed that in all instances wherein special supplies, stationery, notices, forms and the like must be issued in the name of said City, the same shall be supplied by said City at its own cost and expense. 5 . All persons employed in the performance of such services and functions for said City shall be County employees and no City employee as such shall be taken over by said County, and no person employed hereunder shall have any City pension, civil service, or any status or right. For the purpose of performing such services and functions, and for the purpose of giving official status to the performance thereof where necessary, every County officer and employee engaged in the performance of any service hereunder shall be deemed to be an officer or employee of said City while performing services for said City, which services are within the scope of this agreement and are purely municipal functions. 6. City shall not be called upon to assume any liability for the direct payment of any salaries, wages or other compensation to any County personnel performing services hereunder for said County or any liability other than that provided for in this agreement. Except as herein otherwise specified, the City shall not be liable for compensation or indemnity to any County employee for injury or sickness arising out of his employment. -4- 7 . The Assumption of Liability Agreement executed by the Parties to this agreement is hereby made a part of and incorporated into this agreement as is set out in full herein unless said Assumption of Liability Agreement is expressly superseded by a concurrently or subsequently executed agreement entered into between the parties is hereby made a part of and incorporated into this ageeenent as if set out in full herein. 8 . For and in consideration of animal control services by County, City agrees that it shall pay the full cost to the County for providing such services at rates determined by the County of Los Angeles Auditor-Controller. City further agrees that County may keep and retain any and all license fees provided for by said Municipal Animal Control Ordinance and collected by the County pursuant hereto as an offset against City's obligation to pay the full cost of animal control services. The County agrees, through the Department of Animal Care and Control to provide, on or before April 15 of each year, an estimate of the total costs for all animal shelter services to be provided to the City for the fiscal year then in progress. It is agreed that in connection therewith, the County shall have all the powers of the City and shall receive all cooperation possible therefrom to enable efficient enforcement of such ordinance and to effectuate collections called for thereunder. 9 . This contract shall become effective on the date hereinabove first mentioned and shall run for period ending June 30, 1997, and at the option of the City Council of the City, with -5- the consent of the Board of Supervisors of County, shall be renewable thereafter for an additional period of not to exceed five (5) years. In event the City desires to renew this agreement for said five-year period, the City Council shall not later than the tenth of May 1997 , notify the Board of Supervisors of County that it wishes to renew the same, whereupon the Board of Supervisors, not later than the last day of May 1997, shall notify the City Council in writing of its willingness to accept such renewal. Otherwise, such agreement shall finally terminate at the end of the aforedescribed period. Notwithstanding the provisions of this paragraph hereinabove set forth, the County may terminate this agreement at any time by • giving thirty (30) days prior written notice to the City. The City may terminate this agreement as of the first day of July of any year upon thirty (30) days prior written notice to the County. 10. City agrees that whenever animals from within the . boundaries of the City are delivered to animal shelters operated by County, the City shall pay for the services and shelter of said animals at the following rates: Services Rates Impounding of a relinquished dog $ 7. 32 per day, plus or cat. all veterinarian cost for treating these animals while Impounding a stray dog or cat. at the County Shelter Holding a dog or cat wearing a license. -6- (City shall pay for the fore- going shelter and treatment for a period not to exceed seven days. ) Holding an abandoned dog or cat. Holding a dog or cat for $ 10. 40 per day, plus observation. all veterinarian costs for treating these animals while Holding a sick or injured animals while at dog or cat. the County Shelter Holding dogs, cats, poultry, livestock that are ordered impounded for court, i.e. , fighting dogs, guard dogs, etc. For each dead animal brought into $ 4 . 11 per animal the centers for disposal For each dead livestock, i. e. $150. 00 per animal horse, cow, etc. , brought into the centers for disposal City shall pay for the shelter and treatment of all live animals, reptiles, and fowl from within the boundaries of the City and are delivered to animal shelters operated by the County and the cost of such shelter and treatment of such animal shall be as determined by the County Auditor-Controller. 11. The foregoing rates shall be adjusted by the County Auditor-Controller annually, effective July 1st of each year commencing July 1, 1992 , to reflect the cost of such service in accordance with such rates as determined by the Auditor-Controller and as approved by the Board of Supervisors of County. All services rendered hereunder are subject to the limitation of the provisions of Section 23008 of the Government Code, and, in accordance therewith, before any services are rendered pursuant hereto, an amount equal to the cost, or an amount ten percent in excess of the estimated cost, shall be reserved by the City from its funds to ensure payment to the County for work, services or materials provided hereunder. 12 . For shelter services rendered, the County shall submit an itemized invoice to said City within 10 days after the close of each calendar month which includes all such shelter services performed during the preceding month. Said City shall pay County therefore within thirty (30) days after the date of the invoice, the County is entitled to recover interest thereon. Said interest shall be at the rate of seven (7) percent per annum or any portion thereof calculated from the last day of the month in which the services were performed. However, the interest herein provided may be waived, whenever the Director of Animal Care and Control finds late payment excusable by reason of extenuating circumstances. 13 . Notwithstanding the provisions in Government Code Section 907, if such payments are not delivered to the County office which is described on said invoice within thirty (30) days after date of the invoice, the County may satisfy such indebtedness, including interest thereon, from any funds of the City on deposit with the County without giving further notice to City of County's intention to do so. 14 . The City will review all invoices and report in writing of any discrepancies to the Director of Animal Care and Control within ten (10) business days. The County shall review the disputed charges and send a written explanation detailing the basis for the charges within ten (10) business days of the receipt of the City's written report. If the City does not receive from the -8- County a written explanation within the ten ( 10) business day period, it shall be implied that the County is not disputing the charges. 15. The County agrees to keep separate records for each City in such form and manner as the County Auditor-Controller of the County of Los Angeles shall specify. Such records shall be open for examination by said City during all business hours. 16. County agrees that redemption fees which it collects on animals delivered to its animal shelter shall be credited to the City every thirty (30) days. 17 . The County agrees to provide to the City additional animal control services on an as-needed basis if requested by written notice 24 hours in advance. If such animal control services are requested during any emergency, the written notice may be waived and said services requested verbally by a duly authorized representative of the City provided a written request is given the County within 48 hours after services are rendered. Such animal control services will be provided by the County to the City at rates determined by the Auditor-Controller. 18 . The County agrees to maintain its kennel and animal shelter in a humane manner and keep said premises in a sanitary condition at all times and that all services furnished by it hereunder shall be in accordance with the laws of the State of California and that it will give the prescribed notices and use humane methods of care and destruction of any animal coming under its jurisdiction. -9- IN WITNESS WHEREOF, the City of Rosemead, by order of its City Council , causes this agreement to be signed by its mayor and attested by its clerk and the County of Los Angeles, by order of its Board of Supervisors, has caused this agreement to be subscribed by the Chairman of the said Board and the seal of said Board to be affixed thereto and attested by the Clerk of said Board. And, I could call in here and say, "Mr. Tripepi, I want preferential treatment, those dogs are still out here." I haven't done that. But, I did ask last summer, a year ago, for a report of the Temple City...you were going to meet with the City Manager about what their cost for their...they have their own animal control officer. TRIPEPI: Correct. He provided us with a budget on that and we wrote, I believe, a staff report. It wasn't on the agenda, but I believe the information was given. TAYLOR: I don't recall ever seeing it, I've been waiting for it. So, if you have one, give it to me and it's besides the point, but I said I was going to vote No on this contract for those reasons. The does are still out there and I have to admit, when you did call them, they went out there for four or five nights, they did patrol that area, but I'll be honest with you, I cannot say in that time frame that I have seen animal control more than one time since then.
