APPEALS BOARD
OCTOBER 28, 1997
The regular meeting of the Rosemead Building Rehabilitation Appeals Board was called to order
by Chairman Imperial at 7:02 p.m. in the Conference Room of City Hall, 8838 E. Valley
Boulevard, Rosemead, California.

Boardmember Taylor requested the Minutes of the Regular Meeting of August 26, 1997
be deferred to the next meeting.
APPROVAL OF MINUTES: SEPTEMBER 23, 1997 -REGULAR MEETING
MOTION BY BOARDMEMBER TAYLOR, SECOND BY VICE-CHAIRMAN
BRUESCH that the Minutes of the Regular Meeting of September 23, 1997, be approved as
submitted. Vote resulted:

I. ADMINISTRATION OF OATH
The Board Secretary administered the oath to all persons wishing to address the Board.
II. HEARINGS
The following item was taken out of order in deference to those in the audience.
B. 3009-11-13 EVELYN AVENUE
The subject property consists of three units located in the C-3 zone. One unit is vacant;
another is tenant-occupied, although eviction proceedings are in progress; and the third unit,
which has no substandard conditions, is occupied by one of the owners. A "Please Letter" was
mailed to the property owners on December 5, 1996. Inspection on December 13, 1996 revealed
no progress. The Building Official declared the property substandard and filed a Declaration of
Substandard Property with the Los Angeles County Recorder's office. A"Thirty Day" certified
letter was mailed and posted on the property on January 14, 1997, requesting abatement of the
substandard conditions. On February 4, 1997, Mr. Gastelum, the owner's son-in-law, came to
City Hall to discuss the list of defects. He also advised staff that one owner shown on title, Juan

Camarena, is deceased. Mrs. Camarena is in a convalescent home, and the third owner, a son
who resides at the property, is disabled. Mr. Gastelum stated he had power-of-attorney and
would return with the proper documentation to obtain the required permits. "Repair per Rehab"
permits for 3011 and 3013 Evelyn were issued to Mr. Gastelum on February 26, 1997.
On March 3, 1997, the building inspector met with Mr. Gastelum and further explained
the list of defects and the record search procedure. Minor yard area cleanup was noted. On
March 24, 1997, a "bulky item" trash notice was sent to Mr. Gastelum and the tenants. The same
day, Mr. Gastelum phoned to advise staff that he was in the process of evicting the tenant at 3013
Evelyn Avenue. He called again on April 8, 1997 to say that, on the advice of his attorney, he
would not be commencing any work until the tenant had vacated. On June 4, 1997, telephone
contact was made with Mr. Gastelum. He indicated that he expected the tenant to be out within
two weeks, and stated that he would then contact the building inspector to make and appointment
to meet at the property. A follow-up inspection on June 25, 1997, revealed no progress. Another
"bulky item" trash notice was mailed on July 10, 1997. On July 28, 1997, the building inspector
met with Mr. Gastelum at the site. Mr. Gastelum informed the inspector that he was in the
process of evicting the second tenant at 3011 Evelyn Avenue. Inspection on August 28, 1997
revealed that all defects, with the exception of the roof, had been completed at 3013 Evelyn
Avenue. However, all the defects at 3011 Evelyn Avenue remained.
A Notice of Hearing was mailed and posted on the property on October 13, 1997. All
interested parties have been notified.
The City Building Official recommends that the Board find the property substandard and
order all substandard conditions removed and/or corrected by December 1, 1997. However, if
eviction proceedings are delayed, by circumstances beyond the control of the owner, the
abatement date may be extended to January 5, 1998.
Richard and Evelyn Gastelum, 1051 N. Avenue 63, Los Angeles, were present.
James Guerra, Building Official, stated that list of defects is complete at 3013, and repairs
are in progress at 3011; however, inspection today revealed additional defects on the interior, of
which the owner was advised.
MOTION BY VICE-CHAIRMAN BRUESCH, SECOND BY BOARDMEMBER
VASQUEZ that the Board find the property substandard and order all substandard conditions
removed and/or corrected by December 1, 1997. However, if eviction proceeding are delayed, by
circumstances beyond the control of the owner, the abatement date may be extended to January 5,
1998. Vote resulted:

Vice-Chairman Bruesch requested for the record that Mr. Gastelum has made a valiant
effort to bring this property up to code.
C. 7525 GRAVES AVENUE
Mr. Guerra reported that all repairs have been made and this case has been closed out.
Vice-Chairman Bruesch asked about the two garage conversions.

Steve Bailey, Building Inspector, responded that the interior partition walls and plumbing
were removed and is now converted back to a garage.
A. 2716-16 1/2 EVELYN AVENUE
The subject property consists of two, tenant-occupied single family residences located in
the R-2 zone. A"Please Letter" was mailed to the property owner on July 30, 1996. Inspection
on August 29, 1996 revealed no progress. The Building Official declared the property
substandard and filed a Declaration of Substandard Property with the Los Angeles County
Recorder's office. A "Thirty Day" certified letter was mailed and posted on the property on
September 19, 1996, requesting abatement of the substandard conditions. Inspection on October
22, 1996 revealed minor progress, however, no interior access was gained. On November 5,
1996, Mr. Sinnett, the property owner, called for inspection. Interior access was gained at 2716
Evelyn Avenue. Additional defects were noted, and a revised list of defects was mailed to Mr.
Sinnett. Progress inspection on December 2, 1996 and January 3, 1997 revealed no progress. On
January 7, 1997, a "bulky item" trash notice was sent to both the property owner and tenants. On
February 12, 1997, the building inspector met with Mr. Sinnett at the property. Minor progress
was noted, and Mr. Sinnett was reminded of the necessity to obtain the required permits. Interior
inspection was not conducted because the tenants had not been notified. On February 20, 1997,
interior access was gained at 2716 1/2 Evelyn Avenue. Additional defects were noted, and a
revised list of defects was mailed to the property owner.
On February 27, 1997, Mr. Sinnett came to City Hall to obtain the necessary permits.
Planning Department denied his application to legalize the unpermitted construction due to
problems involving density and parking. On March 10, 1997, Mr. Sinnett returned to the City and
obtained a "Repair per Rehab" permit to correct the other deficiencies. Mr. Sinnett phoned on
March 24, 1997 to inform staff that he was in the process of evicting the tenant at 2716 Evelyn
Avenue. He stated that he would commence work as soon as the unit was vacant. Progress
inspections on April 11, and May 13, 1997 showed no progress. Inspection on June 12, 1997
revealed that the tenant at 2716 Evelyn Avenue had vacated. The owner was in the process of
cleaning the house so that the tenant at 2716 1/2 Evelyn Avenue could move into that unit. Mr.
Sinnett indicated he would start repairs at 2716 1/2 Evelyn Avenue once it was vacant. Monthly
inspections since July 1997 reveal that Mr. Sinnett is working, but making very slow progress.
Several defects, as well as the illegal addition, remain.
A Notice of Hearing was mailed and posted on the property on October 13, 1997. All
interested parties have been notified.
It is recommended that the Board find the property substandard and order all substandard
conditions removed and/or corrected by December 1, 1997.
Mr. Guerra stated that the owners have agreed to the recommendation and repairs are in
progress.
Boardmember Taylor asked why the owner's application at 2716 1/2 to legalize the
unpermitted construction was denied.
Mr. Guerra responded that they were unable to obtain a permit to legalize the bedroom
due to density and parking problems and the permit they obtained was to demolish that room.
