TRIPEPI, CITY MANAGER DATE: YY11MARCH 18, 1997 RE' SB 689 (JOHNSON) - REGULATORY TAKINGS: HOURS AND MANNER OF OPERATION- OPPOSE Attached is a copy of SB 689 (Johnson). The bill seeks to amend current law by stating that no lawfully established business shall be compelled by any local government agency to change or limit is customary hours of operation without being provided just compensation for that limitation. If enacted, cities would be prohibited from regulating any established business in a manner requiring a change in its hours of operation unless the city to provide compensation for the loss of business resulting from the reduced hours. The bill's potential impact on Rosemead is fairly obvious. Passage of the bill would,in effect,prohibit the City from regulating problems that have been addressed in the past by limiting the hours of operation. Recent examples of such action have included KTV operations,bars and other similar business activities. As a result, the City would lose one of its most powerful regulatory tools if this bill becomes law. SB 689 is scheduled to be considered next by the Senate Housing and Land Use Committee. No date has been set for hearing.
