A. Public Hearing on Accessory Dwelling Unit Regulations — Municipal Code
Amendment 18-01
The State of California enacted bills that established new regulations pertaining to
the development of accessory dwelling units(ADUs)within the jurisdiction of local
agencies, and rendered the City of Rosemead's existing Second Dwelling Unit
Ordinance (Ordinance No. 931 — Second Dwelling Unit Section) null and void.
However, per Government Code Section 65852.2(a)(1), a local agency may, by
ordinance, provide for the creation of accessory dwelling units in areas zoned to
allow single-family or multifamily use.The proposed Municipal Code Amendment
(MCA 18-01) would amend Title 17 (Zoning) of the Rosemead Municipal Code
relating to ADUs.The proposed amendment would adopt new standards for ADUs,
in accordance with the provisions of Section 65852.1 and Section 65852.2 of the
Government Code, and would provide clarity and consistency for the regulation of
ADUs throughout Title 17 (Zoning) of the Rosemead Municipal Code.
Recommendation: That the City Council:
1. Conduct a public hearing and receive public testimony; and
2. Introduce for first reading, by title only, Ordinance No. 979, approving
Municipal Code Amendment 18-01, entitled:

Recommendation: That the City Council approve the minutes from the special and
regular joint meeting on March 27,2018.
C. Consideration to Cancel May 22,2018 City Council Meeting
The City Council will consider the cancellation of the May 22. 2018, City Council
meeting due to Councilmembers attending the ICSC - RECon from May 20th
through May 23`d in Las Vegas, Nevada.
Recommendation: That the City Council cancel the May 22, 2018, City Council
meeting.
D. Participation in the Preparation of Design Plans for Three Load Reduction Strategy
Projects for the Rio Hondo River and Tributaries
The Clean Water Act of 1972 regulates discharges of pollutants into the waters of
the United States as well as water quality standards. The Environmental Protection
Agency (EPA) utilized the Clean Water Act to establish the National Pollutant
Discharge Elimination System (NPDES) permit. The NPDES permit regulates
water discharge from any source point into navigable waters and requires
implementation of pollution control measures. In California, the Regional Water
Quality Control Board. Los Angeles Region (Regional Board) regulates the
discharge of water and its pollutants,into the waters of the U.S. The City is required
to secure an NPDES Permit from the Regional Board to discharge water to Los
Angeles River and its tributaries.
The City of Rosemead is one of eight agencies that are a permittee under the
Regional Board Order R4-2012-0175. One element of this Order is known as the
Bacteria Total Maximum Daily Load (TMDL) for the Los Angeles River and its
tributaries. The City of Rosemead and other agencies are all contributors to the Rio
Hondo River and were required to turn in a plan for Bacteria Load Reduction in
2015.
The analysis showed a large number of storm drains that would need to be treated
to reduce the Bacteria load to the Regional Board established levels. The County,
in reviewing the Load Reduction Strategies(LRS)available, looked at treating each
storm drain separately (approximately 30 storm drains) versus accomplishing the
treatment at three locations where they all collect. The County met with Regional
Board staff and reached an agreement in principal that will allow the agencies to
use the Alhambra Wash Channel, the Eaton Wash Channel, and the Rubio Wash

Channel to collect the runoff from all storm drain outlets and treat the runoff before
the storm drain runoff enters the Rio Hondo River.
Recommendation: That the City Council take the following actions:
I. Approve the Load Reduction Strategy Agreement.
2. Authorize the City Manager to execute the Load Reduction Strategy Agreement
and submit to the County of Los Angeles.
E. Participation in the Coordinated Integrated Monitoring Program (CIMP) and
Enhanced Watershed Management Plan (EWMP) for the Upper Los Angeles River
Watershed Management Area
On November 8, 2012, the California Regional Water Quality Control Board, Los
Angeles Region(Regional Board)adopted the new County Wide National Pollutant
Discharge Elimination System (NPDFS) Permit for the County, the County Flood
Control District, and 84 of the 88 incorporated cities within Los Angeles County.
This permit became effective on December 28, 2012, and gave the permittees
options for complying with the permit. Of the options offered, on July 27, 2013,
the City of Rosemead selected to join the City of Los Angeles along with 17 other
agencies to form the Upper Los Angeles River (ULAR), an Enhanced Watershed
Management Plan (EWMP) group. The group jointly prepared an EWMP and a
Coordinated Integrated Monitoring Plan (CIMP), which were submitted to the
Regional Board for approval.
On August 5, 2015, the Regional Board approved the ULAR EWMP group CIMP.
During the Regional Board approval process the ULAR EWMP group had
developed a Memorandum of Agreement(MOA)to administer and establish a cost
share for the implementation of the CIMP. This MOA,which was approved by the
City Council at its meeting of October 20,2015, is scheduled to expire on June 30,
2018. The MOA is being presented to continue the administration and establish the
cost share based on services used by each member of the EWMP group for the next
five-year period beginning July 1, 2018 thru June 30, 2023.
This MOA has added services, beyond the monitoring functions that were defined
in the previous MOA. These additional services in the new MOA are related to the
EWMP implementation that each member must perform.
Recommendation: That the City Council take the following actions:
1. Approve the Memorandum of Agreement authorizing the City of Rosemead's
participation in the Coordinated Integrated Monitoring Program and Enhanced
Watershed Management Plan for the Upper Los Angeles River Watershed
Management Area.
2. Authorized the City Manager to execute the Memorandum of Agreement
authorizing the City of Rosemead's participation in the Coordinated Integrated
Monitoring Program and Enhanced Watershed Management Plan for the Upper

Los Angeles River Watershed Management Area and submit to the City of Los
Angeles.
3. Approve the Letter to the City of Los Angeles, authorize the Mayor to execute,
and forward to the City of Los Angeles with the executed Memorandum of
Agreement.
F. Professional Services Agreement for Stormwater Management Services for Fiscal
Year 2018-19
On November 8. 2012, the California Regional Water Quality Control Board, Los
Angeles Region(Regional Board)adopted the new County Wide National Pollutant
Discharge Elimination System (NPDES) Permit for the County, the County Flood
Control District, and 84 of the 88 incorporated cities within Los Angeles County.

options for complying with the permit. Of the options offered, on July 27, 2013,
the City of Rosemead selected to join the City of Los Angeles along with 17 other
agencies to form the Upper Los Angeles River (LIAR), an Enhanced Watershed
Management Plan (EWMP) group.
As related to the NPDES program, compliance with the Municipal Separate Storm
Sewer System (MS4) Permit is required. The MS4 Permit is both complex and
expensive due to unrealistic requirements. Some of the requirements include storm
runoff quality testing, strict compliance with numerical limits set by Total
Maximum Daily Load(TMDL),and collaboration among permittees. The City has
used a number of consultants over the last few years to manage the City's MS4
Permit program in order to keep the City in compliance, as well as in compliance
with state and federal Laws.
Recommendation: That the City Council authorize the City Manager to enter into
a Professional Service Agreement with CWE for Stormwater Management Services
in a not-to-exceed amount of$179,979.
7. MATTERS FROM CITY MANAGER& STAFF
A. Annual Fee Resolution
The City provides various `individualized" services (i.e., inspections, permits,
variances, etc.) that are not of general benefit. Historically. many of these services
have been provided at a city cost greater than the price being charged for them thus,
resulting in the subsidies of the remaining costs of service from the general
taxpayers. As a matter of routine fee maintenance and to keep pace with increasing
costs of individualized services,the fees charged to users' needs to be reviewed on
a regular basis, preferably each year.
In the interest of being responsive to the service needs of Rosemead residents and
businesses, not all fees need to be adjusted and some are controlled by statute.
Consequently, not every fee is being recommended for an adjustment this year.

Attachment A is the summary listing of all the proposed fee changes. Those with
strikethroughs and identified in red arc for adjustment, all others will remain
unchanged.
Recommendation: That the City Council approve Resolution No.2018-24 "Annual
Comprehensive Fee Schedule."
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ROSEMEAD, CALIFORNIA, ADOPTING A
COMPREHENSIVE SCHEDULE OF FEES AND CHARGES
B. Professional Service Agreement for Building and Safety Division
The Building and Safety Division serves and protects the public by ensuring that
building construction complies with California Building Standards Code(Title 24,
California Code of Regulations) as well as State safety laws, disable access, and
City Ordinances. As a contract city. Rosemead has historically contracted its
Building and Safety Division of the Community Development Department with
Los Angeles County ("County'") or a private consultant. From Rosemead's
incorporation as a City in 1959. the County had provided Building and Safety
services until 1981 when the City entered into a service contract with Willdan
Engineering("Willdan"). Since 1981. Willdan has provided ongoing building and
safety services under Professional Service Agreement(s) ("Agreement") with the
City.
The current Agreement with Willdan was entered on April 28, 2015 and is
scheduled to expire on June 30,2018. the Agreement does include an option for
the City to extend the Agreement two (2) additional years. However, Staff felt
prudent and in the best interest of the City, to release a Request for Proposal
("RFP") in order to ensure that the City retains for upcoming years the highest
qualified consulting services at a competitive cost.
The City received a strong response to the RFP with eleven (11) submittals. After
careful consideration of each proposal, including but not limited to; responses to
the REP requirements, firms' history and ability to provide services, proposed staff
qualifications, proposed fee structures, and interviews with the four qualified low
bidding firms, staff believes that entering into a new contract with Interwest
Consulting Group would be the best course of action for the City at this time.
Recommendation: That the City Council authorize the City Manager and the
Community Development Director to finalize negotiations with Interwest
Consulting Group for Building and Safety Division Services pursuant to the
Request for Proposal No. 2018-06 at service fee not to exceed 47% for building
plan check and 47% for building permit of net revenues, and for the City Manager
to execute a Professional Service Agreement for a term of three(3) years with two
(2) one-year options.
