Minutes of the Special Meeting
ROSEMEAD CITY COUNCIL
December 18, 2007
The special meeting of the Rosemead City Council was called to order by Mayor Tran at
4:11 pm in the Conference room of City Hall, at 8838 E. Valley Boulevard, Rosemead,
California.The pledge to the flag was led by Mayor Tran and the invocation was
delivered by Councilmember Clark.
ROLL CALL OF OFFICERS:
Present: Councilmembers Clark, Low, Taylor (arrive at 4:21pm), Mayor Pro
Tern Nunez and Mayor Tran
Absent: None
1. PUBLIC COMMENT FROM THE AUDIENCE
Marlene Shinen, residing at 8447 Drayer Lane, South San Gabriel brought two
issues before the Council. Her first concern was it appeared the City Clerk was
appointed by the Council with oversight from the manager, but now it appears the
City Clerk would report to one of the assistant managers. She also, inquired about a
letter of commendation which was submitted to former City Manager Andy
Lazzaretto in regards to former City Clerk Nina Castruita. Mrs. Shinen asked current
City Manager what happened to the letter of commendation.
City Manager Chi responded that the letter of commendation in regards to the City
Clerk was put in her personnel file.
Mrs. Shinen asked Mr. Chi if the City Clerk was evaluated at all.
City Manager Chi addressed that the Clerk had left the City before she received her
evaluation.
Councilmember Clark stated that she had not seen that letter.
City Manager Chi clarified to Mrs. Shinen that he was under the impression that her
expectations were met.
Mrs. Shinen read part of the telephone message of former City Manager Lazzaretto
explaining how he agreed with her letter. She submitted a copy of the letter and a
transcript of the message to staff.
Councilmember Clark asked City Manager Chi, how come she had not seen that
letter. When people write letters of appreciation of staff, usually it gets printed in the
City Manager's Newsletter.

Mayor Tran clarified that if the Council would have had the chance to evaluate the
City Clerk before she had left, they would have seen the letter of commendation.
City Manager Chi asked council if they would like staff to forward commendation
letters that staff receives. C
Jim Flournoy, a Rosemead resident, advised Council to give the City Clerk's i
department the necessary resources and equipment for the department to work
more feasibly.
Mayor Tran reiterated to Councilmember Taylor, that the council had decided to
conduct the City Clerk interviews in closed session.
Mayor Pro tem Nunez commented that it would be ok to have interviews in open
session and deliberate in closed session. However, closed session interviews would
be fine too.
City Attorney Bonifacio Garcia explained that the Council could have the interviews
either way given the way the notice was posted.
Mayor Tran felt the interviews should be held in closed session.
Councilmember Taylor agreed with Mayor Tran to conduct the interviews in closed
session, due to the confidentially memo Council received earlier. Also, asked staff to
give Council a clarification memo as to why the confidentially memo was given. .
City Attorney Garcia clarified that the Brown Act provides that for the appointment of
an individual, it may be considered as an employee. So, the City Clerk would have
dual position in which the Clerk is a public official and a city employee appointment,
therefore, there is no legal impediment.
Mayor Tran moved the interviews to closed session.

The City Council will recess to a closed session pursuant to California Government
Code Section 54957.6.
City Clerk Interviews and Appointment
The Council recessed to closed session at 4:27 pm. The Council reconvened back from
closed session at 6:30 pm.

Mayor Tran reported that the Council took action in which Mayor Pro Tern Nunez made
a motion, second by Councilmember Taylor and carried to a unanimous vote to appoint
Gloria Molleda as the City Clerk and directed City Manager to enter into negotiations
with the City Clerk. Votes resulted:
Yes, Clark, Low, Nunez, Taylor, Tran
No: None
Abstain: None
Absent: None
4. ADJOURNMENT
The Special meeting adjourned at 6:31 pm. The next regular City Council meeting is
scheduled to take place on January 8, 2008 at 7:00 pm.
