Manager, the Director Of'PUblic Works and the Interim Director ol'Parks and Recreation
and are working to take care all` the problem.
Ms. Holt shared information on as liorricless program that takes place every Thursday at the

provided for the homeless. She explained the organized program, serves about 100 people
and VVOUld like the City to be aware ofthis in order tar spread the wword,
In addition, Ms. Holt cxpressed concerns froni semors about the Garvey Cornri'lunity
Center, Concerns include the staffing at the Garvey Conimunity Center, Ms. I lolt notes
that tile center only has two full time staff members, along with part-time staft' merribers
and often, makes it confusing to know who is in charge when full-titne stall` is not present.
Ms. I lolt stressed that during kinch unlC the VOILInteersare in need ofassistance., the part-
tinic staff at the C01111"nUnity center should help out. Ms. Holt also raised concerns that left
over lbod that was once available 1'(ir purchase is now being thrown out.
Ms, I lolt thanked the City COLHICil for the senior craft class and purchasing a new bingo

Ms,. Holt lastly mentioned that phone messages left at (1I ity Hall are not returned.
Mavor Ly assured Ms. Holt that the Council will look into that.
Council Member Art-nenta clarified the City is going through a transition and assures Ms.
Holt that the 0ty is doing the best it can during this period.
Mayor ProTern Clark expressed, concerns regarding food being wasted an(] it was shocking
to her, due to new laws that require giving left over food to local food banks: asked staf'.1"to
look into regulations it'the center is violating any laws.

Director of Finance Lieu reported as a matter of routine lee maintenance and to
keep pace with increased costs ofindividualized services. the fees charged to users'
requires review on a regular basis. In the interest ol'beitig responsive to the service
needs of Rosemead residents and businesses, not all Cees need to be adjusted and
some are controlled by SILMUIC, MI's,. Licu highlighted the proposcd changes to the

license fee per Assernbly Bill 1379., tree inspection fee, and a new cite fee tor non-

Council Member Low asked if outSOUrcing plan reviews to consultant, does the
resident have as choice option,
Director ofCommunity Development Kim replied plan review can be done by a
Consultant, sometimes it's more efficient l'or stall` tem do it in-house. Outsourcing
plan revievv services will be for Larger projects where we have to be Compliant with
the SI)ecilic Plan.
Council Member Armenta also asked if the fees were consistent with Surrounding
cities.
Director of Finance Lieu explained the new fees are charged based on calculating
staff tinic hourly rate. \Ve are trying to be business friendly to residents, and
bLISinesscs. For the Public Safety citation tie, staff surveyed several cities and
received two responses, one city charges $43 arrid the other charges the full cost of
towing, as as result, Staff VVC111 with a con)parative fee.
ACTION: Motion by Council Member Low and seconded by Council Mernbcr
Armenta to approve Resolution 2018-24adopting a comprehensive schedule off'ces
and charges. Motion was carried by the following vote: AYES: Armenta, Clark,

underwater lights at a cost of $8,400; and (3) approve a budget appropriation of
$80,5 16 ,29, from the unassigned General Fund Balance to cover the costs related to
the emergency purchase of' the two heaters and for the additional Purchases
recommended above.
Interim Parks and Recreation Director Yugar reported the City had to do all
emergency Purchase of two pool heaters. In addition, due to lack of preventive
maintenance ofthe pool, staffalso noticed issues that have to be addressed in order
to meet compliance by Los Angeles County I lealth codes. Staff had to determine
to rebuild the heating units or purchase two brand new heater units, Staff` opted to
and was granted to do an emergency purchase with the approval of the City
Manager for the replacement of two heater units, installation costs, and
maintenance costs in the amount of $66,338.29. An additional $14,178 is, being
requested fc)r the valve refurbishment and repair of underwater lights. The total
fiscal impact is $80,516.29
Mayor Ly stated the pools are heavily used by the public and should be repaired
before the pool season opens.
Council Member Armenta thanked Mrs. Yugar l"or being proactive in addressing
the pool issues and fixing them for the use of Rosemead residents.
triterim Director of Parks and Recreation YUgar commended Recreation Supervisor
Monday Regan in contacting a contractor that has, managed to temporarily fix the
functions of the pool at Rosemead Park.
ACTIONS Motion by Council Member An-nenta and seconded by Mayor Pro Tem
Clark to approve the purchase of backwash and vent, valve refurbishment at a cost
of $5,778; approve purchase and repair of 14 underwater lights at a cost of $8,400;
and approve a budget appropriation of $80,516.29 front the unassigned General
Fund Balance to covet, the costs related to the emergency purchase of the two
heaters,. Motion was carried by the following vote: AYES: Armenta, Clark, Low,

7. MATTERS FROM MAYOR & CITY COUNCIL
A. Council Member Alarcon Absence and Discussion of'Options to Address Potential
Vacancy with an Appointment and/or Special I'dection
Recommendation: That the City COUncil discuss and provide direction to staff'.
City Attorney Richman reported that in order to provide the City Council some
direction to address the currently eXCUsed absence of Council Member Alarcon,
staff has provided two options. At the March 9, 2018, special meeting, the City
Council approved a resolution extending the excused absence of Council Member
Alarcon from. Council meetings until June 19, 2018. California Government Code
Section 36513 provides that the City Council may grant permission to a Council

Member to be absent fi-omCouncil meetings for a period longer than 60 days, which
ifunexcused, would result in the office becoming vacant. She further explained, it'
the seat becomes vacant the City Council could make an appointment or not make
an appointment and call for an election. The City C.ourici I must take one of these
two actions "within 60 days from the commencement of the vacancy". The options
available depend on when the vacancy occurs.
Mrs. Richman explained with option I if the vacancy occurs after July 12th, the

"ity Council could fill a vacancy by appointment or choose not to fill the vacancy
and call an election for March 2020 within 60 days ot'vacancy. The City Council
may decide to fill a vacancy by appointment per Government Code Sections 36502,
36512 or leave the seat vacant until the next permissible election opportunity.
With option 2 if the vacancy occurs before July 12th, the City Council would need
to call a special election to Fill the vacant seat within 60 days of the vacancy per
Elections Code Section 12001. Further, if the Council calls for an election, the
special election shall be held not less than 114 days froin the next regularly
established election date, which is November 6, 2018, The City Council would have
to adopt a resolution calling for a special election no later than July 12".
Speaker Brian Lewin, expressed support for a special election and noted the
Government Code does provide for opportunity to enact a special ordinance that
would allow for an election to be field sooner.
Mayor Pro Tem Clark asked with option I to appoint or not appoint somebody and
call for an election for March 2020, could the City go on without a council member
for so long.
City Attorney Richman replied that the Government Code allows for the City to
call f=or an election at the next General City Election or a Statewide Election. The
next Statewide Election is on November 6, 2018 and the next General Municipal
Election for the City is in March 2020.
Mayor Ly noted a similar situation occurred in the City of Monterey Park, when
Mike Frig won his seat to the Assembly. The City of Monterey Park left his seat
vacant for four months.
City Attorney Richman opined this is a unique situation because the City's election
would have been in March 2019. Due to, Senate Bill 415 that required the city to
change elections dates, to even years due to the statue requirements, the next city
election vvill be in March 2020.
Council Member Low agreed with resident Brian Lewin and has heard from other
residents the need to have a full council whether by appointment or by an election.

Council Member Armenia agreed and noted that the Council is as decisive Council
and residents deserve to have as full City Council. The niost difficult part, will be
coliling to an agrecinent on an appointment or have as special election,
Mayor Ly reiterated ifthe desire ofthe C. I ity OLITICH is to attempt an appointment
with the u tide rstand i n g that if an appointment is not rnade, the seat may stay vacant
until March 2020, otherwise, call fOr a special election and spend $35,000,
Mayor Pro "Fem Clark asked for clarification on the appointmerit application
process, will the City still have to call a special election tor November.
City Attorney Richman explained when as vacancy occurs there is a 60 day period
from a vacancy, where you have to make anappointment and you have to call for a
special election or potentially holding an election on the next municipal election
date, The appointirient is only until the next election and not for a full term. For
example, if the vacancy occurs and an appointment is made beforc July 12"�' the
Council needs to, call t*or ain election at the next regular schedule Statewide l"lection
which isNoveniber 6, 2018 Ifthe vacancy OCCUrS and an aippoinnnent, is made after
.In]\, 12"' (lien the next regular scheduled election is in March 2020.
Mrs. Richman added that if the City Council ChOSC not to give Council Member
Alarcon any more CXCLIscd absences, then the 60 days run. If Mr. Alarcon submits
a resignation letter, the seat is immediately vacant.
Mayor Pro Tein Clark stated at this point Council Member Alai -con is willing to do

Council Member Arnienta stressed it' a special election is going to happen, the
Council needs to agree to allow interested members ofthe public start campaigning.

City Council seat to determine it'a November election will happen,
Council Member Low stated that having as special election will he fair to the
residents to vote for a candidate.
City Attorney Richman reiterated the direction of the City Council to talk, to

preparations for the Jay Imperial park opening and invited the public to rsvp.
Mayor Pro Tem Clark and Council Mernbcr Armenta reported out their attendance
to the Contract Cities 2018 Annual Municipal Serninar May 17"' to May 20'h.
