REGULAR JOINT MEETING
JANUARY 22,2019
The regular meeting of the Rosemead City Council was called to order by Mayor Steven Ly at
7:06 p.m., in the Rosemead City Council Chamber located at 8838 -East Valley Boulevard,
Rosemead, California.
PLEDGE OF ALLEGIANCE was led by Council Member Low
INVOCATION was led by Council Member Dang
STAFF PRESENT: City Manager Molleda, Assistant City.Manager Tsujiuchi;,Deputy City
Attorney Thuyen, Chief of Police Kusayanagi, Chief of Fire Ramirez, Director'of Community
Development Kim,Director of Public Works Alfonso,Director of Finance Lieu, Director of Parks
and Recreation Boecking, and Deputy City Clerk Haworth.
1. PUBLIC COMMENT
Mayor Ly opened the Public Comment period.
Speaker Raymond Hu, on behalf of Danny Hu,his father, indicated his parents are
in the process of building a newly structured home in their backyard;however,they
need to submit a Minor Exception Application which requires written consent of
all adjoining neighbors.as there is a legal non-conforming structure on the lot. He
expressed frustration-that it has been a struggle trying to obtain consent from the
-owners that do not live at the-property, but rather rent to tenants. Mr. Hu stated it
• was his understanding that in April 2018, the City Council agreed to streamline the
process by providing The adjoining neighbors an opportunity to respond, whether it
was to give consent, express their concern or make an appeal.
'Director of Community Development Kim clarified neighbors' consent is not
required to submit a Minor Exception Application; however,if it is obtained,it will
help'speed up the application process. Mr. Kim affirmed one way or another, your
application/Will be processed.
Mr. Hu stated staff from the Planning Division indicated the process is more
stringent since his parents are building a new structure,rather than expanding upon
the existing house.
Director of Community Development Kim advised Mr.Hu that he would work with
him and his parents through the application process.

Mayor Pro Tern Clark and Council Member Armenta indicated they would like to
address Mr. Hu's comments.
Mayor Ly advised Mayor Pro Tern Clark and Council Member Armenta that only
one of them could speak,otherwise Council would be violating the Brown Act since
it is not an agendized item.
Council Member Armenta noted she still had to abide by the same rules when she
was adding to her house by knocking down her den that was a non-conforming
structure; emphasized the rules are created to protect all reidents.
Speaker Heidi Tong,Los Angeles County Sanitation Districts, stated the Sanitation
Districts' work is vital to both public and.environmental health, which is why it is
unheard of that labor management is threatening'to cut compensation and withhold
the cost of living adjustments for the`past two years for no good reason; urged the
Council to sign a letter that will:appeal to thei3oard of the Sanitation District to
facilitate an immediate agreement that will serve everyone's best interest:'
There being no further comments, Mayor Ly closed the Public Comment period.
2. PRESENTATIONS

C: Los Angeles County Sheriff's Temple Station Department Quarterly Report
Captain Flores provided an overview covering crime and arrest statistics from
January to December 2018.
Chief of:-Police Kusayanagi discussed crime patterns such as residential/
commercial burglaries, grand theft autos, and robberies, affecting Rosemead and
neighboring cities. He noted the Sheriff's Station crime strategies include
identifying and reducing crime patterns, increased patrol in the affected areas,
undercover surveillance operations, networking with neighboring law enforcement
agencies to gather intelligence and new ideas, Area Watch/ Neighborhood Watch
Programs and developing new camera program with City staff.

The City Council commended Chief of Police Kusayanagi for gathering and
analyzing the data.
In response to Council inquiry, Chief of Police Kusayanagi stated there is a specific
team assigned to Rosemead to ensure the data is correlated; indicated they are
looking at the number of calls to determine the specific areas of traffic issues,
particularly fatal collisions; affirmed the Sheriff's Station is diligently working to
strengthen the ties between law enforcement and the community through efforts
such as Coffee with the Chief to encourage community policing.
Chief of Police Kusayanagi concurred with Mayor Pro Tern Clark that Assembly
Bill 109 serves as a hindrance to law enforcement as burglars push the threshold of
under $950 and simply get a slap on the wrist;,further'stated that owners will not
apprehend a burglar because it is safer to risk'the'loss than theliability.
Mayor Ly requested the data regarding the response times to the activity type of
call(i.e.routine,priority,emergent)be compared to the neighboring Contract Cities
such as South El Monte and Temple City.

"Corporation Annual Financial Reports
The report provides the Fiscal Year 2017/2018 annual financial reports for the City
of Rosemeadd and the Rosemead Housing Development Corporation to the City
Council. The. City of Rosemead Comprehensive Annual Financial Report and
Rosemead Housing Development Corporation Financial and Compliance Report
provide a complete presentation of the finances of each of the above-mentioned
organizations:',
Recommendation: That the City Council receive and file the City of Rosemead
Comprehensive Annual Financial Report and the Rosemead Housing Development
Corporation Annual Financial.and Compliance Report for the Fiscal Year ending
June 30, 2018.
C. Ordinance No. 986—Second Reading and Adoption Adding Chapter 10.28 to the
Rosemead Municipal Code to Prohibit Shared On-Demand Personal Mobility
Devices and Businesses

On December 11, 2018, the City Council introduced for first reading, by title only,
Ordinance No. 986 adding Rosemead Municipal Code Section 10.28 related to
shared on-demand personal mobility devices such as bicycles and scooters, which
prohibits such devices and their related businesses from operating within the City.
Recommendation: That the City Council approve the second reading and adoption
of Ordinance No. 986 by title only, entitled:
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ROSEMEAD, COUNTY OF.LOS- ANGELES,
STATE OF CALIFORNIA, ADDING SECTION 10.28 TO

5. MATTERS FROM CITY MANAGER &STAFF
A. Proposed Agreement with San Gabriel Valley Humane Society for Animal Control,
Shelter and Care Services
Recommendation: That the City Councildiscuss and direct staff further.
-- Assistant-City Manager Tsujiuchi 'stated in June 2015 the City entered into an
agreement with Sari.Gabriel Valley Humane Society (SGVHS)for animal care and
control related services:^During the third year of service, SGVHS communicated
that the rates that were contained in the agreement were no longer viable for
SGVHS due to an increase in animal take ins. Over several months, staff met and
discussed a new pricing arrangement and cost for services. In October 2018, the
city,`Council approved Amendment No. 1, allowing time for the City to issue a
Reqest for. Proposal (RFP). An RFP was issued on December 17, 2018 with
SGVHSproviding the sole response. Mr. Tsujiuchi stated SGVHS is proposing
$210,000, however that would be a reduction in the services provided to the City.
Mayor Ly inquired if staff was providing options other than SGVHS.
Assistant City Manager Tsujiuchi indicated staff is seeking Council's direction;
noted there are untraditional options such as staff could seek services from different
shelters outside of the Los Angeles County to compartmentalize the services.

City Manager Molleda noted the City is in the process of hiring Other CSOs to pick
up dead animals. i -
Mayor Ly opined although it's disconcerting to see a contract that is higher in cost
but lower in services,we have an obligation to provide a seamless quality of service
to our residents; emphasized staff needs to determine a plan as soon as possible
since the current amendment ends January 31St
Council Member Armenta expressed frustration thataCit ' staff is doing the bulk of
the work, yet SGVHS is still charging us S210,000;aconcurred with Mayor Ly that
staff needs to.determine if they will be prepared,,and well-equipped to run the
animal services program in-house. /4,1'

City Manager Molleda referenced a confidential letter that was'provided to the City
Council,in which different agencies were identified that could assist with sheltering
the animals; emphasized this option would allow staff to provide'alasterresponse
to the residents.

Mayor Ly inquired why,;the information was presented via a confidential memo and
not included as part of the'Staff Report.
Assistant City Manager Tsujiuchinoted the memo was provided as an alternative,
in case Council did not want to.move forward with the.current agreement.
City Manager`Molleda further explained it was important that staff brought this
information to Council for consideration since`the'current agreement's expiration
is fast approaching j
Tn response to Council Member Armenta, Assistant City Manager Tsujiuchi

chip in''it, and as a courtesy will return the animal to its owner at no charge rather
thankeep it sheltered 4

By consensus;,th'e City Council decided to not take any action, which would result
in a lapse of the contract with the San Gabriel Valley Humane Society.

D. Los Angeles County Fire Department Quarterly Report
Chief of Fire.Ramirez asserted that in 2018, the Los Angeles County Department-
Fire Station 4 responded to a total of 2,738 responses, 61 of which were structure
fires, and the fire safety personnel inspect all the commercial buildings in the City;
indicated Fire Station 42 responded to a total of 2,450.incidents,62 of which were

structure fires. Fire Chief Ramirez discussed the CERT training offered to the
community; displayed photos of the firefighters suppressing the Woolsey Fire and
the equipment used.
Council Member Armenta noted that Senator Susan Rubio went to the Woolsey
Fire to aid those suffering from the fire.
6. MATTERS FROM MAYOR & CITY COUNCIL
A. City Council Comments
Council Member Armenta commended the Parks and Recreation Department for
organizing the grand opening and ribbon, cutting of the beautiful Community
Garden; thanked Mayor Ly for his vision of the Community Garden.
Council Member Low echoed:.appreciation to the Parks and' Recreation staff;
thanked Chief of Police Kusayanagi and Chief of Fire Ramirez for :presenting
updates to the Council.
Council Member Dang expressed appreciation,to'City staff for all the planning and
preparation to ensure the Community Garden event was a success.
7. ADJOURNMENT •
Mayor Ly adjourned the regular meeting at 8:24 p.m. The next regular City Council
meeting isscheduled to be held on February 12, 2019;"at 7:00 p.m. in the Rosemead City
Hall Council Chamber.
